About this file
This is an Award Notice and Limited Sources Justification documenting a sole source procurement under the General Services Administration (GSA) Federal Supply Schedule Program. The Department of Veterans Affairs, Network Contracting Office 23, awarded contract GS-07F-0559X (Award Number: 36C26326N0580) to Waters Technologies Corporation on July 1, 2026, for $368,211.94. The Minneapolis VA Health Care System, Laboratory Department, is the requiring activity for the acquisition of a replacement mass spectrometer analyzer and related equipment to support the VA's forensic drug testing program nationwide.
The procurement encompasses fourteen line items including a Xevo TQ-S micro mass spectrometer analyzer, MassLynx workstation, monitors, installation certification services, training (3 days), and analytical equipment, with a $15,000 trade-in credit applied toward the old equipment. Waters Technologies Corporation, located at 34 Maple Street, Milford, MA 01757, was determined to be the sole source capable of providing these direct replacement parts compatible with existing systems operating under the National Laboratory Certification Program (NLCP) for Federal Workplace Urine Drugs of Abuse Testing. The justification emphasizes that any deviation from the current fleet of analyzers would cause significant detriment to the nationwide drugs of abuse program and compromise current certifications. The contracting officer confirmed fair and reasonable pricing based on GSA contract establishment and prior replacement costs from FY 2023.

(4) Identify the Authority and Supporting Rationale (see below and if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.
FAR 8.405-6(a)(1)(A): An urgent and compelling need exists and following the ordering procedures would result in unacceptable delays:
FAR 8.405-6(a)(1)(B): Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized;
FAR 8.405-6(a)(1)(C): In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order must not have been previously issued under sole source or limited source procedures.
FAR 8.405-6(b): Items peculiar to one manufacturer:
A patent, copyright or proprietary data limits competition. The proprietary data is:
These are “direct replacements” parts/components for existing equipment.
The material/service must be compatible in all aspects (form, fit and function) with existing systems presently installed/performing.
(5) Describe Why You Believe the Order Represents the Best Value consistent with FAR 8.404(d) to aid the contracting officer in making this best value determination:
This equipment is available on GSA contract # GS-07F-0559X. The price is fair and reasonable considering a previous replacement had similar pricing back in FY 2023. Pricing is also fair and reasonable based on the fact that this is established as that at time of GSA contract award.
Waters is the sole manufacturer and distributor – sole source. Waters is also offering a $15,000 trade-in discount for our old equipment, which means we are receiving some sort of monetary value for the old equipment towards the purchase of the new one.
(6) Describe the Market Research Conducted among schedule holders and the results or a statement of the reason market research was not conducted. The contracting officer reviewed Sole Source documentation and the justification from the customer. This confirms that Waters Technologies Corp. is the sole source to obtain this equipment. SBA search was also done for NAICS 334516 – 276 SDVOSB results returned. GSA schedule confirmed they have an active contract with this equipment.
(7) Any Other Facts Supporting the Justification: This is a replacement analyzer in the current fleet. Any deviation from this fleet of analyzers would cause significant detriment to the current drugs of abuse program for the VA nationwide and the current certification in which the program is operated under National Laboratory Certification Program (NLCP) to conduct the Federal Workplace Urine Drugs of Abuse Testing Program for all the VA hospitals and their affiliated CBOCs.
(8) A Statement of the Actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made: Market research will be conducted for future requirements to determine if any other authorized distributors become available that allow for competition to the maximum extent practicable.
(9) Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge. I understand that processing of this limited sources justification restricts consideration of Federal Supply Schedule contractors to fewer than the number required by FAR Subpart 8.4.
