J&A-21-00197
This acquisition is conducted under the authority of the Multiple-Award Schedule Program, 41 U.S.C. 152(3), Competitive Procedures, and 40 U.S.C. 501, Services for Executive Agencies.

Page 3 of 5 Version 2.0 operational requirements; severely harming HSI’s ability to support investigative analytical requirements, creating an unacceptable risk to ICE’s ability to perform its law enforcement mission. Due to the specialized nature of the RAVEN platform and the expertise that lies solely with the incumbent contractor, there is no other company available that can provide the support needed to bring the platform online.
After the new RAVEN Platform is live, additional support is required from the incumbent contractor to support knowledge sharing and to ensure transitioned services to the incoming contractor are fully functional. BAH has developed and provided all maintenance of the RAVEN platform which includes security patching, database maintenance, developing deployment pipelines and supporting the overall computing needs of project teams since inception. It will be difficult to transfer knowledge of the design, inner workings of the extensive and intricate RAVEN platform with its hundreds of software libraries, advanced artificial intelligence and machine learning software modules to a new contractor even in the six months allotted. The risk of an incomplete working knowledge transfer for such a complex platform in that timeframe is exceedingly high. BAH is the only contractor with the expertise to facilitate knowledge transfer of the incumbent to the successor contractor.
Continuity of support from the incumbent will increase the likelihood of a successful transition in the short period of time required and will help minimize the risk to ICE’s law enforcement mission.
Only BAH is capable of performing this immediate need for an extension of services and adequately supporting the effort to bring the RAVEN platform online and the subsequent transfer and processing of data during transition to the successor. Accordingly, it is in the best interest of the Government to issue this extension on a sole source basis while ICE concurrently issues a competitive TO award.
5. Determination by the ordering activity contracting officer that the anticipated order represents the best value consistent with FAR 8.404(d).
The contracting officer has determined that issuing a modification to extend the current TO with BAH for the continuation of DevSecOps support services represents the best value and will result in the lowest overall cost, considering price and administrative costs, to meet the Government’s needs.
This extension will be placed in accordance with FAR 8.404, “Use of Federal Supply Schedules.” The General Services Administration (GSA) has already negotiated fair and reasonable pricing rates. Discounts to these GSA schedule rates will be encouraged.
Additionally, prior to issuance of the modification, the Program Office (PO) will consider the labor categories, skill levels and level of effort proposed to perform the specific task being ordered are commensurate to the work being performed in order to support a determination that the total price is fair and reasonable. The contractor’s labor categories, skill levels and level of effort will also be compared to the Independent Government Cost Estimate (IGCE) and the historical support provided under the TO for these continued operations.

6. A description of the market research conducted among schedule holders and the results, or a statement of the reason market research was not conducted.
Extensive market research was conducted in preparation for the recompete of this requirement. Market research results indicate that experience and skills required to provide DevSecOps support for RAVEN are commercially available from GSA schedule contract holders. However, due to the complexity of the hand-off from the incumbent to the incoming contractor, the transition support cannot reasonably be completed by any contractor other than BAH. Only BAH has the staffing and institutional knowledge required to complete the deliverables due on and assist the incoming contractor with the learning curve associating with this complex requirement. Therefore, ICE is currently competingthis effort while also extending the current TO in order to ensure the Government’s objectives can be satisfied.
7. Any other facts supporting the limited-sources justification. Additional facts may be stated in this section. If there are no additional facts, you must state that here.
There are no additional facts to support this Limited Source Justification (LSJ).
8. A statement of actions, if any, the agency may take to remove or overcome any barriers that led to restricted consideration (i.e., limited-sources) before any subsequent acquisition for the supplies or services is made.
ICE does not currently contemplate future non-competitive actions and is anticipating awarding the recompete using fully competitive procedures. ICE will use the time afforded by this extension to finish the current competition, make an award and complete transition to the new contract. In addition, ICE will continue to define requirements so that they can be solicited competitively to the maximum extent practicable. After the initial go-live and the first transition is complete, ICE will have a better understanding of the transition requirements and will be able to better define adequate transition periods into future contracts to support programmatic and stakeholder changes.
