Justification for Other Than Full and Open Competition
3. IDENTIFICATION OF STATUTORY AUTHORITY.
41 U.S.C. 3304(a)(1): Only one responsible source and no other supplies or services will satisfy agency requirements.
This one source is uniquely qualified as the space is immediately available and is already constructed to meet SSA’s requirements for the short-term with no disruption or associated moving costs. The economic benefits to remaining in place include a savings of relocation costs, the prevention of disruption, and a savings of any initial build out costs, which are not expected to be recovered through a full and open competition, especially for a short-term.
4. DEMONSTRATION THAT THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY
CITED.
GSAM 570.402-5 allows for negotiation with the incumbent Lessor when a cost-benefit analysis shows that the Government cannot expect to recover relocation and duplication costs through competition.

6. DESCRIPTION OF MARKET RESEARCH CONDUCTED.
7. OTHER FACTS SUPPORTING USE OF OTHER THAN FULL AND OPEN COMPETITION.
SSA has occupied the existing space under the terms of GSA Lease No. GS-04B-44121 since September 22, 2006. A short-term renewal is required to allow time for SSA’s long-term requirements to be met.
The incumbent Lessor, Xenia Management Corporation, 2340 Drew Street, STE 300, Clearwater, FL 33765-3310, is responsive and is meeting the requirements of the lease.
9. STATEMENT OF ACTIONS TO OVERCOME BARRIERS TO COMPETITION.
GSA is working with the SSA to develop a follow on procurement strategy that will meet their long-term needs. If appropriate, a competitive procurement will take place at that time.
