About this file
This document is a Justification and Approval (J&A) for Other Than Full and Open Competition for Technical and Engineering Services (TES) for the C-5M aircraft fleet, issued by the Air Force Life Cycle Management Center (AFLCMC). The sole-source procurement is for specialized engineering services supporting the Aircraft Structural Integrity Program (ASIP), Functional Systems Integrity Program (FSIP), and Corrosion Prevention & Control Program (CPCP), with a focus on maintaining operational readiness of the C-5M fleet through technical data package (TDP) reconstruction, engineering investigations, and specialized technical support.
The contract will be a five-year Indefinite Delivery/Indefinite Quantity (IDIQ) task order contract with an anticipated start date of 24 July 2024, valued at approximately $XX million. The primary contractor is a large business determined to be the only vendor capable of providing these highly specialized services due to unique technical data rights, historical knowledge, and extensive on-job experience with the C-5M fleet. Market research included a Sources Sought/Request for Information posted on SAM.gov, which resulted in two vendor responses, with only the incumbent deemed capable of meeting the government's requirements. The contract will utilize various pricing arrangements, including Cost Plus Fixed Fee (CPFF), Firm Fixed Price (FFP), and Cost Reimbursable No Fee (CRNF).

Justification and Approval (J&A) for Other Than Full and Open Competition
CUI
March 2023 CUI Page 5 of 13 identified in response to Engineering Technical Assistance Requests where gaps are identified in the Technical Data Package (TDP) baseline that should have been delivered under the original production contract but were either missed, incomplete, illegible, or lost by the Government prior to establishing a digital baseline/ repository for the C-5M. Relative to lost data, at program onset, the TDP consisted of multiple forms of technical data and drawings, including hand-drafted drawings, Mylars, microfiche, and other media that was subject to degradation and loss.
The estimated annual cost of these services is as follows:
may be exercised for task orders as required.
Total Estimated contract value was based on historical actuals of the Sustaining Engineering and Technical Support Services (SETSS) contract, and independent government estimate derived by Cost Analysts (AFSC/FZC-R) in coordination with the C-5M Galaxy Division (AFLCMC/WLS). A separate CLS contract is being established, reducing activities from the TES effort, which accounts for the annual decrease in estimated value.
The notional Contract Line Item Number (CLIN) structure is as follows:

• Most of C-5's CPCP Support is contracted to an 8(a) company as a direct award on a recurring basis. In FY23, 60% of all CPCP programmed funds were awarded to the 8(a) direct awardee.
TES CLIN for CPCP Support is only for consultation with OEM CPCP expert personnel.
• The Department of Defense's Defense Technical Information Center (DTIC) administers the IAC MAC contract vehicle which is currently being utilized to provide engineering and technical support for specified mechanical system components and Line Replaceable Units (LRU), including environmental systems, landing gear system, flight controls, avionics, and sustainment solutions for structures. DTIC has also been utilized by WLS in its previous incarnations of contract vehicles known as Information Analysis Centers (IACs) and Defense Systems Technical Area Tasks (DS TAT). Another example is support for the Electrical Wiring Interconnect System (EWIS), which is a project that supports identification and solutions for existing and emerging wiring health issues, creates technical data for aircraft wiring hardware and wires issues, accomplishes reverse engineering on wiring artifacts, and creates wiring test procedure.
The plan to break barriers to competition in the prior J&A was as follows:
• The Government will send an inquiry to g Government Purpose Rights to the technical data prior to each ordering period. The plan was completed on a project basis;
however, the to assert proprietary rights to critical technical data to successfully maintain Integrity Programs. The Government met some success with gaining Government Purpose Rights or Unlimited Rights for some individual drawings.
• Any second source will be required to generate non-proprietary data which will be Government owned. The Government executed this plan by requiring flow down of data rights validation requirements to sub-contractors for delivery of technical data with “other than unlimited rights.” These requirements were included in the prior SETSS contract. The SETSS contract required delivery of updated drawings and technical orders per contract data requirements.
• At the enterprise level, the C-5 SPO planned to collect “any changes to drawings and technical orders that produces, whether it was directed by the Government or internal
These changes are delivered per contract data requirements, reviewed, and approved by the technical authority at Robins AFB. The collection of this data may allow for limited organic support in the future. TDS data deliverables have supported various efforts for organic local manufacturing in support of PDM and allowed for DLA to procure parts that would otherwise be non-procurable as they would be non-releasable to other vendors.
XI. Certification by the Contracting Officer.
As evidenced by my signature above, I certify that this justification is accurate and complete to the best of my knowledge and belief.
XII. Certification by the technical/requirements personnel.
As evidenced by my (our) signature(s) above, I (we) certify that any supporting data contained herein, which is my (our) responsibility, is both accurate and complete.
