1. Per the Solicitation Section IV.J Small Business Subcontracting Plan, and plan is required under FAR 52.219-9 to be submitted with offers. However, Section II Proposals does not indicate a place for the subcontracting plan. Also, typically for a CMc project we submit the plan after award and when the design phase services are complete.

Please confirm whether a Small Business Subcontracting Plan is required for this proposal. If it is required, please let us know where in the proposal to include the plan (in the price proposal or technical proposal).

a. It is required and can be submitted separately with the other documents that are not part of the price or technical proposal i.e. SF24, GSA Form 527, etc.

2. The RFP does not indicate where to put the information requested under Solicitation Section II.E Other Information to Submit with Proposal. Would the GSA like offerors to put those documents with the price proposal, technical proposal, or in its own appendix?

a. These documents can be combined into a separate part of the proposal.

3. Page 37 of 39 in the RFP references the importance of factors 1 through 5—stating “factors 1 and 4 are equal in importance and more important than factors 2 and 3 which are also equal in importance. Factor 5 is the least important.” No specific weighting/value/percentage is mentioned. What is the specific weight/value/percentage of each of the individual factors?

a. There is no more specific information to provide. The relevant importance is provided.

4. In addition to Form 1442 you are also asking for a pricing table to be submitted—For Option 1 Construction Stage item b it asks for a Total Estimated Cost of Work. To clarify, are we being asked to provide an estimate for the job based upon the specifications/drawings supplied in the Appendix (G/H). How much weight will price be given versus the Technical Portion of the RFP?

a. "Estimated Cost of Work" is language prescribed under the GSAR. See GSAR 552.236-79, also included within the RFP, for further information. Per the RFP on page 38, "Price Factors, when combined, are significantly more important than Total Evaluated Price."

5. There is a series of pages that are not legible towards the end of the RFP (155-184). Can you resend those pages?

a. We show no issue with the pages. You can also access the Wage Determination specific to this project on the Department of Labor's website by searching for "IN20200002 05/01/2020."

6. The schedule in the SOW and the schedule provided as Appendix C are different for both the design phase and construction phase. Which one should be followed? As a follow up, Appendix C shows the project being done in two separate phases is this the expectation for the project?

a. See attached updated schedule dated 6.17.20 replacing the previous version under Appendix C and updated SOW. This schedule shows a singular path for design/construction for CBP & USMC.

7. It was stated in the preproposal meeting that the Project Labor Agreement (PLA) is a requirement because the value of the project is greater than $25 Million. Please provide the source for this requirement. If it is determined that a PLA is not required for GSA projects greater than $25M by statute, will the language for this factor be deleted?

a. FAR 22.5 governs the use of PLAs. Page 8 of the RFP clarifies submission is discretionary, "Offerors may submit a price proposal subject to the Project Labor Agreement (PLA) requirements set forth in this solicitation (a PLA proposal), a price proposal not subject to the PLA requirements set forth in this solicitation, or both. Any price proposal submitted shall clearly identify whether it is subject to such PLA requirements."

8. Page 7 of the RFP is amended to allow two (2) representatives from each contractor at the site visit.

Overview

The purpose of this Pre-Proposal Conference is to discuss the Request for Proposals

(RFP), issued on June 4th, 2020, for Construction Manager as Constructor (CMc)

Services for the Major General Emmett J. Bean Federal Center Backfill Project. This is a full and open solicitation.

The goal of this Conference is to answer any questions regarding the RFP, provide an understanding of the contract structure, as well as a brief overview of the proposal submission requirements and evaluation criteria, provide guidance from the Department of Labor, Office of Federal Contracts Compliance Programs (OFCCP), present the scope of work for the Bean Federal Center Backfill Project, and discuss the upcoming site visit.

A copy of the meeting minutes will be posted to beta.SAM.gov. The notes are not intended to reiterate everything discussed in the meeting, but identify those points that may affect an offerors’ understanding of the solicitation.

Please be aware that no oral statement made by the Government Representatives during the conference will have the effect of amending the solicitation. In the event that discussions during the conference indicate a need to change the solicitation, an amendment to the RFP will be issued in writing. All amendments must be acknowledged by the time/date proposals are due. Currently, there are no amendments to the solicitation.

Site visits will only be conducted by appointment.

If you have not already RSVP’d for the site visit you need to reach out to the

Contracting Officer and Contract Specialist.

Only those who have RSVP’d ahead of time will be allowed to participate.

The Site Visit shall be limited to not more than one (1) representative from each contractor, general or subcontractor.

Participants must have a valid, Government issued picture identification, driver’s license preferred, to gain access for the pre-proposal Site Visit.

All individuals attending the site visit shall wear a face covering and practice social distancing as recommended by the Center for Disease Control for the duration of the site visit. All individuals must provide their own face covering.

Face coverings must cover an individual’s mouth and nose. Individuals will be expected to maintain a 6 foot distance from others at all times and proceed in a single file line during the site visit.

Please keep in mind some of the space is currently occupied. A 6 foot distance from those occupying the space must also be maintained and noise levels kept to a minimum to avoid disruption.

Attendees should arrive at the site visit (South entrance) 30 minutes prior to your start time. Be prepared to leave at your designated time.

Tours are anticipated to last 2 hours.

I. INTRODUCTION

o Before we go through the agenda want to note that site visits will be performed at Eastern (local Indy time).

II. PROJECT BACKGROUND & OVERVIEW

o Design

i. GSA is currently executing restack and consolidation project in the Bean Center with a goal to provide

160,000 SF of tenant agencies space back to GSA.

ii. There are two agencies housed in non-federal space with expiring leases that will move into the Bean

Center.

iii. The primary objective is to better use the space by moving agencies from leased space to the Bean

Center.

iv. Overall project is ~200,000 SF. 160,000 SF is provided by release of space and the balance is by other means.

v. The project just completed concept design and design development will begin later in June and complete in February of 2021.

vi. We recently extended duration of design development. The design for one tenant is more developed than another and extending will allow second tenant to catch up in the design process.

vii. The objective is to execute the CMc contract as soon as possible so that CMc can be involved before the end of design development (will complete in August 2021).

o Construction

i. The release of 160,000 SF is needed in order to start construction (both tenants at the same time).

ii. This will occur as late as Sept 2022.

iii. The intent is to closely monitor space release and integrate the CMc in the planning process.

iv. At this point it is unknown if an early start is possible and space release is key to project planning.

v. Construction is planned to start early Oct. 2022 and is planned to be substantially complete Winter

2024.

vi. Tenant agencies may begin to move in earlier than construction completion.

vii. Phased oversight by the CMc is a requirement.

III. CLOSING

I. PROJECT DESCRIPTION

This Statement of Work (SOW) is for Construction Manager as Constructor (CMc) for the renovation project of approximately 200,000 square feet (sf) at the The Major General Emmett J. Bean Federal Center (Bean Center).

GSA has contracted with a separate architect-engineer (A/E) firm that is responsible for developing complete design and construction documents for this Project. In addition, GSA has contracted with a separate Construction Management Advisor (CMa) firm with Commissioning Agent (CxA) services to provide certain services during the design and construction stages of this Project. A copy of the AE and CMa/CxA statements of work (SOW) are included in Section IV Appendix. GSA has also issued an additional, separate contract to an artist under the Art-in-Architecture program.

The MGEJ Bean Center was named after Major General Emmett J. Bean, a commander of the Army Finance Center in St. Louis, and who coordinated the Center's move to Indianapolis.

The building was once part of Ft. Benjamin Harrison, a former military installation. Ft.

Benjamin Harrison closed in 1995 and ownership of the building was transferred from the Department of Defense (DoD) to GSA in October 1996. This 3-story building of approximately

1.66 million gross square feet is currently being used as a multi-tenant office building. It was modernized and renovated in 2003 to an office space type interior from its previous use as a DoD records storage facility and is eligible for listing on the National Register of Historic Places.

The current MGEJ Bean Center’s primary tenant is consolidating their utilization of space. This will result in approximately 200,000 sf of vacant space which the GSA intends to backfill with new federal agency occupancies currently housed in leased office space in the Indianapolis area. Design services, which will be accomplished through a separate contract, will be necessary for the renovations and alterations of vacant space to meet; the functional requirements of prospective tenants, fulfill policy and regulatory criteria, and provide state of the art workplaces that help define interior design standards for the building. Designed solutions shall be consistent with the latest objectives of GSA, prospective tenants, and best practices in architectural planning and design.

The primary customers for this project are U.S. Customs and Border Protection (CBP) and the U.S. Marine Corps (USMC). The space required by these prospective tenants is primarily general office space including; both open office area and private offices, ancillary and support space such as conference rooms, secure sensitive areas and storage.

A. Base Contract (Design Stage) Services The Design Stage of this project shall include all services taking place prior to or preceding the Construction Stage. This Statement of Work (SOW) primarily focuses and outlines the Design Stage services not otherwise provided for in the Contract Design Documents that the CMc Contractor shall be required to perform. The CMc Contractor is required to complete the Design Stage Services for the firm-fixed-price set forth in the Contract Price Schedule.

As a general matter, the CMc Contractor shall review and become familiar with the scope of services under the A/E’s SOW contract, especially the various standards, guidelines, policies, and documents (also see Section II.B. Reference Materials below) required to develop the design and construction documents. This review and familiarization is vitally important as part of the Pre-Construction Services as the primary tasks of the CMc Contractor during the Design Stage are to provide constructability and cost estimation reviews of the A/E’s submissions (see Section III.A). At its core, the CMc Contractor will help to ensure that the design and construction documents will enable the Government to exercise the Guaranteed Maximum Price (GMP) Option at a price that is at or below the GMP.

B. Option (Construction) Services This Option relates to the Construction Stage Services that will be required by the CMc Contractor. These services, as outlined within this SOW, provide a general and brief description of services the CMc Contractor shall be required to perform during the Construction Stage (see Section III.B). In the event of a discrepancy between Construction Stage services outlined within this SOW and the A/E’s Construction Documents (CDs), the CD shall take precedence.

Prior to the exercise of this Option, the Government and the CMc Contractor shall agree on the Estimated Cost of the Work (“ECW”), which when combined with the Fee and the Construction Contingency Allowance shall not exceed the Guaranteed Maximum Price (GMP). Upon exercise of this Option for Construction Stage services, the CMc Contractor shall be held responsible for completing the construction stage work in its entirety.

II. GENERAL REQUIREMENTS

Requirements in this section shall apply to both the Base and Option services and all project stages. The CMc Contractor shall understand and fully comply with the Principles of Federal Contracting, including contract administration, in accordance with Federal Acquisition Regulation (FAR), the General Services Administration Acquisition Manual (GSAM), and Public Buildings Services acquisition policy.

As a general matter, the Facilities Standards for the Public Buildings Service (P-100) represents the overarching document that governs the CMc Contractor’s performance of work.

In addition, other policies and procedures (such as those listed in Section II.Bl. Reference Materials below) provide detailed procedures and requirements that the CMc Contractor shall follow. The primary purpose of this Statement of Work (SoW) is to set forth services that the CMc Contractor shall provide in addition to the services that will be outlined in final, approved Construction Documents (drawings and specifications), which shall be completed by the separate Architect/Engineering (A/E) firm hired as part of this project.

A. Project Duration and Schedule Milestone The project’s general milestone schedules are identified below, and are not indicative or representative of the entire list of anticipated deliverables, tasks, reviews, meetings, and/or due dates as defined within this SOW. Preliminary full project milestone schedule is included in Section IV, Appendix for CMc Contractor’s reference. The finalized project duration(s) and key milestone dates will be located in the Construction Documents.

The CMc Contractor is directed to review the milestone data and base their proposal per the dates indicated below:

Project Team and Communications The parties to this contract are the Construction Manager as Constructor (CMc or CMc Contractor), and the United States of America, acting by and through the General Services Administration (GSA). GSA may be referred to as “Owner” throughout the contract documents and project. The primary Customers for this project is the U.S.

The individual authorized to act on the behalf of the GSA in the administration of this contract is the Contracting Officer (CO). The GSA CO may delegate certain of his or her authorities to others who will be known as the Contracting Officer’s Representative (COR) and if so, will notify the CMc, in writing, of the specific authorities delegated to, and limitations placed upon, named authorized representatives. The CMc must not take any direction, or act upon any information, from individuals other than those having the requisite authority as confirmed by the GSA CO’s written notification.

1. Identification of the CMc Team The CMc shall provide sufficient staff and propose a team that can meet the requirements of this SOW and must utilize the personnel named in its accepted offer to perform the services required under this contract. In the event that any of the personnel named in the accepted CMc proposal become unavailable, the CMc Contractor must promptly; submit a complete written resume for a proposed substitution, any other information necessary for the GSA to approve or disapprove, and a detailed explanation of the circumstances necessitating the proposed substitution. The CMc shall obtain the Contracting Officer’s written consent before making any substitution for subcontractors and outside associates or consultants specifically identified and agreed to during negotiations. GSA shall reserve the right to interview the proposed personnel before approval.

The CMc shall provide a Team Identification and Staffing plan as part of their proposal. The Plan shall include the following sections at a minimum:

● Names of each major trade subcontractor, vendor, or supplier that the CMc used or relied on in preparing their proposal;

● A brief description of the services provided by such company; and

● The work the company might perform on the project, if ultimately selected by the CMc.

At a minimum, the CMc key team members shall consist of the following:

3. Architect/Engineering Firm (A/E) The A/E team has been contracted through the GSA and will provide design development and construction oversight, among other services. During the Design Stage, the A/E will be required to design the project in accordance with the GSA and Customer requirements, budget, schedule, performance objectives, their SOW, and other requirements referenced therein. During the balance of the project, the A/E will perform their contracted services to ensure the design intent is fully realized during the Construction Stage, and conveyed successfully into occupancy, facility management, operation and maintenance at project completion.

4. Construction Manager as Agent (CMa) The CMa team has been contracted through the GSA and will provide design, construction and closeout stage oversight, among other services. The overall responsibilities of the CMa are to perform management services relating to constructability, construction strategy, logistics, and budget control under the Design Stage, and to perform the construction management and oversight, in conjunction with the A/E, and in accordance with the Construction Documents and other

5. Commissioning Agent (CxA) The GSA is committed to Total Building Commissioning for this project to ensure all systems are; well designed, complete, and functioning properly upon occupancy, economical to operate and maintain, and the GSA Property Management staff has adequate system documentation and training. The CMa will be responsible for acquiring a CxA as part of their project team to lead and oversee incorporation of commissioning activities throughout the Design and Construction Stages and as otherwise listed within their SOW; and ensure project compliance with the latest edition of the PBS Commissioning Guide.

6. Communications Plan The GSA will develop, periodically update, and maintain throughout the course of the project, a listing of the Project Delivery Team members and respective roles and responsibilities as part of a communication plan. The CMc shall comply with GSA’s project communication plan and refer to GSA’s CO for all requests and responses concerning the project. The CMc shall also respond to GSA correspondence within seven (7) calendar days.

The contractual responsibility of the CMc Contractor is to the GSA only and not to other contractors, customer or tenant agencies, or local community interests where the project is located. The CMc Contractor must direct all requests for information and questions concerning the project and from customer or tenant agencies, local community interests, inquiries from potential offerors, etc., to the GSA Project Manager (PM). Prior to meeting or communicating with any parties other than the GSA personnel regarding the project, the CMc must confirm all such meetings and/or communications with the GSA. The CMc Contractor must not release any oral, written, or graphic information regarding this project to outside sources without obtaining prior consent from the GSA.

D. Personnel Security Requirements The CMc Contractor and its consultants and/or subcontractors associated with this project are required to obtain an HSPD-12 level security clearance. The CMc Contractor shall incorporate provisions in all applicable subcontracts to comply with the contractor personnel security requirements. Further information on HSPD-12 may be found at the following website: www.gsa.gov/hspd12 and in the Section IV Appendix. The time to process and obtain clearances may vary in length.

The CMc is required to provide one (1) Point of Contact (POC) that will be responsible for the security clearance process management of their employees throughout the duration of the contract. This CMc Contractor POC will coordinate and communicate with the GSA appointed security clearance representative (or POC) throughout the course of the project to ensure all applicable clearances are submitted and processed.

E. Project Management GSA will require the CMc Contractor to utilize an Enterprise electronic Project Management (ePM) system, which is a fully configured version of Meridian Systems’ Proliance Construction Management Software, on this project. GSA’s goal is to implement this state-of-the-art technology to reduce administrative and overhead costs, eliminate redundancies, and institute a collaboration tool to ensure better accountability among all project team members. This technology will provide up-to-date information, encourage disciplined methods for monitoring progress, ensure better communication regarding changes, provide improved documentation, and enable PBS executives to have real-time access to status of projects.

1. Electronic Project Management (ePM) The GSAs’ Electronic Project Management (ePM) system will be used throughout all the entirety of this project. Specification Section 013000 will include the information related to the responsibilities of the CMc and ePM during the Construction Stage.

The CMc shall effectively manage the ePM database including maintaining adequate staffing levels and ensuring that personnel attend the mandatory GSA provided training sessions.

a) Definition ePM is defined as an internet-based information and project communication system that allows the entire project team to collaborate in a centralized and secured repository. All project-specific correspondence, workflow processes, and documentation will be stored and routed within the ePM system.

b) Project Collaboration and Documentation

During the Design Stage, the A/E shall use ePM to upload, store, capture, preserve, record, maintain, update, route and respond to all project-related documentation to comply with GSA's Document Security Requirements.

Classified material is not permitted to be stored in this system. For the avoidance of doubt, the following represents a non-exclusive list of project information that shall be posted in ePM: correspondence, schedules, estimates, design submissions, specifications, daily reports, inspection reports, request for information (RFIs), change orders and project milestone submissions.

The A/E shall use the workflow processes contained within ePM to submit and receive approval for all project deliverables and continuously monitor and review ePM to ensure data is current through the completion of the project.

c) Equipment

The ePM system is based on the Proliance software that was developed by Meridian Systems. Users will be provided a username and password after they

d) Training

GSA will provide no cost training to familiarize team members with the ePM system. However, GSA will not reimburse the CMc for any travel related to ePM training.

GSA will hold several training sessions, as needed, to familiarize team members with the system, and all appropriate CMc staff are expected to attend these sessions or otherwise receive proper training on the system’s use. Furthermore, all CMc team members who are actively participating on the project must have access to the proper computer equipment and software to access and utilize the ePM system and be trained in the proper usage of said equipment and software.
