1 PROJECT DESCRIPTION
The existing Courtroom ceiling panels need to be replaced due to de-laminating of 1 x 4 panel backer boards, which has caused one ceiling panel to fall and others to be loose and capable of falling. Detected loose panels have been clamped to provide further de-lamination. There are a total of 64 ceiling panels in the Courtroom. Some are acoustic panels and some are reflective panels. All are fabric covered. The panels were attached to wood blocking at the ceiling by means of metal angles screwed into the wood blocking and 1 x 4 panel backer boards. All panels are 5’ x 5’ in size.
The contractor shall replace all 64 ceiling panels, and all are to be acoustic and be the same size as the existing. The contractor may used a similar attachment to the wood blocking at the ceiling if the new panels can be better constructed for that anchoring type detail. The project will include repairs to the damage in the Courtroom done by the one ceiling panel that fell. See Appendix A for the Owner’s Project Requirements. The reflected ceiling plan, ceiling panel section detail, and ceiling panel specification from the previous project are attached for reference only to aid the contractor in formulating a proposal and in preparation of new construction submittals. Not all items contained in those documents apply to this project.
1.1 Project Type
Repair & Alterations
1.2 Project Goals and Objectives
GOALS:
• To replace existing Courtroom ceiling panels with new panels that are both functional and secure from falling.
OBJECTIVES:
• To maintain the original design intent of the Courtroom ceiling panel layout and system, but in a manner that provides safety for Courtroom occupants and furnishings.
1.3 Project Delivery Approach
Project will be a construction project based on the drawings, specifications, and requirements provided by the Courts and GSA.
2 GENERAL REQUIREMENTS
The requirements set forth in this section apply to all Stages and Phases of the project as described in the Scope of Services section below.
2.1 Contract Parties and Contract Work
The parties to this contract are the Contractor and the United States Government. For purposes of this contract, the office representing the Government is the General Services Administration (GSA), Southeast Sunbelt (SE) Region, Public Buildings Service, hereinafter referred to as the GSA.
This contract includes Construction Stage work, all to be performed by the Contractor.
The specific activities, tasks, and deliverables required of the Contractor are further delineated in this Statement of Work.
2.2 Professional Ethics and Standards of Practice
In the conduct of all activities required for or otherwise related to the performance of the contract work, the Contractor shall conform to and uphold all established ethical principles and professional standards of practice governing the contractor segment of the construction industry.
2.3 Project Delivery Team Roles and Responsibilities
In the performance of the requirements of this contract, the Contractor shall work in concert with other parties on the Project Delivery Team. The Project Delivery Team will include the Contractor and his subcontractors, the GSA personnel, the Courts representatives, and other possible stakeholders.
2.4 Owner’s Project Requirements (OPR)
The Owner’s project requirements stated in Appendix A as well as other supplied documents in the solicitation.
2.5 Budget
See the Request for Proposal for budget information.
2.6 Schedule
Provide an overall project delivery schedule addressing the schedule for all stages construction adhering to following milestones:
• Submittals: Provide submittals for review and approval prior to ordering of materials
• Security Clearances: Obtain required security clearances
• Construction Notice to Proceed: After obtaining security clearances
• Project Construction: 90 Calendar Days after Notice to Proceed
• Project Closeout: Upon completion of Final Construction Inspection
2.7 Contractor Team
The Contractor shall provide experts in disciplines listed in PBS-P100, Facilities Standards for the Public Buildings Service, and as otherwise required in this section, with credentials as indicated, as they apply to this project. The Contractor shall provide sufficient staff of project manager, field superintendent, electricians, clerical and accounting personnel, etc. to perform the required work.
At a minimum, the Contractor key team members shall consist of the following:
• Project manager
• Construction superintendent
• Quality control superintendent
In addition to the key team members identified above, the Contractor shall provide administrative, clerical, and technical personnel as necessary to perform the services required under this contract.
See FAR 52.236-5, Material and Workmanship, regarding removal of any employee deemed incompetent, careless, or otherwise objectionable.

2.8 Performance Objectives
2.8.1 Standards and Criteria Documents
2.8.1.1 Applicability
All services must be conducted in accordance with the documents listed below. The applicable version of each document shall be the version current at the time of award of this contract. In the event of a conflict between the requirements stated in these documents and requirements provided elsewhere in this Statement of Work, the requirements in the Statement of Work will prevail.
2.8.1.2 Document List
PBS-P100, Facilities Standards for the Public Buildings Service, including all applicable Standards, Criteria and Guides listed therein.
2.8.2 Sustainable Design/LEED
Comply with any Sustainability/LEED requirements contained in the construction documents.
2.8.3 Fire Protection/Life Safety: Not Used.
2.8.4 Historic Preservation: Not Used.
2.8.5 Site Investigation
It is the Contractor’s responsibility to investigate and verify the existing conditions and government furnished information and documents.
The Contractor shall perform all investigations necessary to accomplish the general scope. The Contractor shall also furnish all materials and equipment to accomplish this work.
2.9 Cost Management: Not Used.
2.10 Project Management Responsibilities
2.10.1 Communications Plan
The Contractor shall assist the GSA in developing and complying with a project communications plan. This plan will be used and maintained throughout the project and modified as necessary depending on circumstances.
The Contractor contractual responsibility is to the GSA only, not to other contractors, tenant agencies, or the local community interests where the project is located. The Contractor shall direct all questions and requests from tenant agencies and local community interests to the GSA.
The Contractor shall take direction involving price, quantity, delivery schedules or other such terms and conditions of the contract only from the Contracting Officer. The Contractor shall confirm all meetings and/or communications with the GSA.
The Contractor shall not release any oral, written or graphic information regarding this project to outside sources without obtaining prior consent from the GSA. All requests for information concerning the project must be referred to the GSA for response.
2.11 Electronic/Print Media
2.11.1 CAD Documents
After completion of the work and prior to final payment and close out of the project, the Contractor shall furnish as-builts documents in CAD format.
2.11.2 Other Electronic Documents
In addition to any hardcopy submission requirements, all submittals should be submitted in an electronic format. All electronic media must be in a form readable by standard office automation applications such as .pdfs and Word documents.
2.11.3 Submission Security
All submissions must follow the PBS Order 3490.1 “Document security for sensitive but unclassified paper and electronic building information” for the proper use, procedures, and disposal of sensitive building information that is contained in the submittals.
2.12 Contractor Personnel Security Requirements
In the performance of work required under this contract, all Contractor personnel must present proper identification to gain access to occupied building areas housing federal operations. Contractor personnel means employees and subcontractor employees at all tiers. This requirement does not apply to unoccupied building areas under construction, provided that access to any adjacent or surrounding occupied building areas housing federal operations is separately controlled.
Contractor personnel requiring daily/weekly access to occupied building areas housing federal operations, over a period of 180 days or more, shall undergo background investigations conducted by the United States Government, and will be issued Government-wide standard secure and reliable forms of identification issued by the Federal Government (i.e., federal personal identity verification (PIV) credentials) as required under Homeland Security Presidential Directive-12 (HSPD-12).
Credentialed Contractor personnel must wear their PIV credential cards visibly above the waist at all times while in occupied building areas housing federal operations.
All other Contractor personnel requiring access to occupied building areas housing federal operations will be issued visitor badges upon entry, must wear their visitor badges visibly above the waist, and must surrender their visitor badges upon exit.
All non-PIV credentialed Contractor personnel must be escorted at all times (including after hours) while in occupied building areas housing federal operations. The escort must be a PIV credentialed individual who has been found suitable after completion of the required background investigation.
2.12.1 Law Enforcement Checks and Background Investigations
The GSA will designate a Department of Homeland Security (DHS) Federal Protective Service (FPS) representative to coordinate the required law enforcement checks and background investigations. The Contractor shall justify the need for and obtain the GSA approval of all requests for Contractor personnel law enforcement checks or background investigations, before initiating further action.
For each Contractor employee (including subcontractor employees) required to undergo a law enforcement check, the Contractor shall provide a legible ten-print fingerprint submission.
For each Contractor employee (including subcontractor employees) required to undergo a background investigation, the Contractor shall provide the following documents:
• A completed Questionnaire for Non-Sensitive Positions (Standard Form 85)
• A legible ten-print fingerprint submission
• A Declaration for Federal Employment (Optional Form 306) with items 1, 2, 8 through
13, 16, and 17a completed (or a document containing the same information)
The required forms may be downloaded from the GSA website at: www.gsa.gov/forms .
The GSA will provide fingerprinting at no cost for Contractor personnel requiring law enforcement checks or background investigations. Alternatively, fingerprinting may be obtained from local or state law enforcement agencies. Any fees charged by these agencies shall be non-reimbursable.
The Contractor shall provide the documents required above to the GSA or directly to the designated DHS FPS representative, at least 60 days before the subject individuals will require daily/weekly access to building areas housing federal operations. The documents required for each applicant shall be provided in a separate sealed and secure envelope.
Contractor personnel for whom background investigations have been requested must appear at least once in person before the designated DHS FPS representative and present two acceptable original identity source documents. One of these documents must be a valid (unexpired) picture ID issued by a state government or the federal government. [Note: the list of acceptable documents to establish identity is contained in Appendix G to the GSA HSPD-12 Personal Identity Verification and Credentialing SOP.]
Contractor personnel requiring daily/weekly access to building areas housing federal operations may be in possession of previously issued valid federal PIV credentials. For each such Contractor employee (including subcontractor employees), the Contractor shall provide evidence verifying that the employee: (1) possesses a valid (unexpired) federal PIV credential; and (2) has undergone the required suitability or national security level investigation comparable to or higher than that required on this contract. If both of these conditions cannot be met, a new background investigation shall be required.
2.12.2 Credentialing and Return of Credentials
A federal PIV credential may be issued after an initial background check has been completed. If the ensuing further background investigation results in a preliminary finding that the subject individual is unsuitable to occupy a position at the designated sensitivity level, the PIV credential may be revoked and the subject individual denied access to building areas housing federal operations pending completion of any adjudication and/or appeal process or final determination.
Unsuitable individuals may be escorted out of building areas housing federal operations by DHS FPS, Immigration and Customs Enforcement (ICE), or other law enforcement entities, if necessary to protect government employees, property, and interests.
To receive an approved PIV credential, the applicant must appear in person before the designated DHS FPS representative and again present an original valid (unexpired) picture ID issued by a state government or the federal government. Additionally, the applicant must sign an affidavit attesting to acceptance of the PIV credential and related responsibilities.
The Contractor immediately shall deliver to the GSA each federal PIV credential obtained for performance of this contract, under whichever of the following conditions occurs earliest:
• Receipt of notification from GSA that the PIV credential has been revoked
• Determination that the subject individual no longer requires daily/weekly access to building areas housing federal operations
• Release of the subject individual from Contractor or subcontractor employment
• Completion of subcontract work (for PIV credentials issued to subcontractor employees)
• Expiration of this contract
In the event that a Contractor PIV credential is damaged, lost, misplaced or stolen, the Contractor immediately shall notify the GSA and, if needed, request a replacement. Damaged PIV credentials shall be returned to the GSA.
2.12.3 Subcontracts
The Contractor shall incorporate provisions in all applicable subcontracts as necessary to ensure compliance with all requirements provided in this Contractor Personnel Security Requirements section.
3 SCOPE OF SERVICES
The Contractor shall perform all services described in this Scope of Services in accordance with applicable requirements and provisions set forth in the General Requirements above.
3.1 Construction Stage
Upon receipt of notice to proceed with the Construction Stage work, the Contractor shall perform all services described in this section as a part of the Construction Stage work.
3.1.1 Construction Delivery Phase
3.1.1.1 Construction Start Coordination
3.1.1.1.1 Pre-Construction Conference
Participate in the pre-construction conference to be held at the site in conjunction with the Notice to Proceed.
3.1.1.2 Construction Administration
3.1.1.2.1 Construction Safety Program
Submit a construction safety program, tailored for this contract, to the Contracting Officer for approval.
3.1.1.2.2 Submittal Processing
Prepare and submit a submittal schedule to the Contracting Officer within 7 calendar days of Notice to Proceed. Ensure that all subcontractors understand, agree to, and conform with their respective roles, responsibilities, and timeliness requirements for submittal processing.
Promptly correct and resubmit any submittals returned unapproved, allowing sufficient time for re-review in order to maintain the project schedule.
Upon receipt of submittal approvals, coordinate as necessary with all involved subcontractors.
Refer to FAR 52.236-21, Specifications and Drawings for Construction, for further submittal and shop drawing review requirements.
Expedite the processing of submittals to minimize approval times.
Submittals will be due to the Contracting Officer based on the approved submittal schedule. No equipment shall be ordered until the respective submittal has been approved by the Contracting Officer or their designated representative.
Submittals shall include construction safety program, proposed ceiling panels, method of ceiling panel attachment, scaffolding plan and details, project schedule, and schedule of values.
3.1.1.2.3 Clarifications/Requests for Information/Change Orders
Each RFI must include a specific description of the issue requiring clarification, citing the specific related contract documents requiring clarification. RFI’s should only be submitted after performing due diligence to confirm that the contract requirements in question are in fact unclear or otherwise inadequate.
Upon receipt of the response to each RFI submitted, coordinate the response with all involved subcontractors to ensure understanding and appropriate action.
3.1.1.3 Turnover Documents
3.1.1.3.1 Substantial Completion
When the Contractor determines that their work is substantially complete, contact the GSA for a final inspection..
3.1.1.3.2 Punch-Lists
During the final inspection, where the GSA certifies that the work, or each designated portion thereof, is actually substantially complete, assist the GSA in preparing a punch-list documenting remaining work to be done.
Participate with the GSA in conducting follow-up inspection(s) to document resolution of punch-list items.
3.1.1.3.3 Operation and Maintenance (O&M) Manuals – As-Built
Drawings Prepare and submit 3 complete and properly organized O&M manuals(if applicable). The manuals shall include: equipment cutsheets, installation data; operation and maintenance data; warranties, guarantees, and certificates. Prepare and submit electronic and 2 CD’s of the as-built drawings. CD’s shall be in CAD format.
3.1.1.3.4 Warranties, Guarantees and Certificates
Prepare and submit warranties, guarantees, and certificates, ensuring that the GSA rights and responsibilities are clearly defined. In addition to any manufacturer’s warranty, all materials and equipment provided shall be warranted against defect in material and workmanship for a period of one (1) year from the date of final acceptance by the government
3.2 Contract Closeout
Resolve all remaining punch-list items.
Submit release of claims with final invoice.
4 ADMINISTRATION
4.1 Payment for Construction Delivery Phase Work
Refer to FAR 52.232-5 Payments under Fixed-Price Construction Contracts and FAR 52.232-27 Prompt Payment for Construction Contracts.
4.2 Travel
Unless otherwise indicated in the Scope of Services sections, the Contractor is responsible for travel costs to support the requirements contained in this Statement of Work, including all progress meetings, reviews, and site visits. The Contractor shall assume all travel will be within the vicinity of the project site except as specifically indicated otherwise in the Scope of Services section.
4.3 Reproduction and Delivery
Printing, reproduction and delivery costs necessary for execution of this contract shall be included in the contract price.
4.4 Contract Administration
The Contractor’s point of contact with GSA regarding contract administration is the Contracting Officer.
5 APPENDIX A - Owner’s Project Requirements
Provide construction services for the replacement of 64 existing 5’ x 5’ Courtroom ceiling panels at the U.S. Courthouse in Natchez, MS. New ceiling panels shall be the same size as the existing panels, surface mounted, and shall all be acoustic panels according to the Claro model as manufactured by Decoustics.
The contractor shall provide submittals for approval before ordering the new panels.
Work shall include scaffolding in the Courtroom and the removal and re-installation of existing Courtroom furniture to accommodate the scaffolding; protection of existing furnishings, fixtures, and finishes; removal and disposal of the existing panels; installation of the new panels; removal and re-installation of existing fire sprinkler heads, HVAC diffusers and grilles, and sound system speakers that may be located in existing panels; and repair and refinishing (or replacement) of Courtroom items that were damaged by the one ceiling panel that fell.
The Contractor shall provide continuous cleaning throughout the projectwhich includes areas outside the Courtroom in the path of Contractor travel. Existing Courtroom pendant light fixtures may need to be removed and re-installed in order to perform the work, but they could possibly be protected and left in place. The Contractor and the Manufacturer of the new ceiling panels shall provide a 2 year warranty of the panels against defect and workmanship from the date of Substantial Completion.
The ceiling panel shop drawing submittals shall show fabrication and installation details including plans, elevations, sections, details, and attachments to the ceiling wood blocking. The panel shop drawings shall also show orientation of fabric application, pattern matching, and seams (if any); areas of field trimming (if any); and details to accommodate installation of abutting and thru-penetrating work, such as sprinkler heads, lights, speakers, HVAC diffusers, fire alarm devices, etc. Provide samples for selection of manufacturer’s color charts showing the full range of colors, textures, and patterns available for the facing materials of the panels. New ceiling panels shall have the following fire test response characteristics:
Flame spread – 25 or less; Smoke developed – 450 or less.
