VISITOR SCREENING FACILITY PROJECT

AGREEMENT - SUPPLEMENTARY CONDITIONS

“NOTICE TO PROCEED (NTP)”

1. The Contracting Officer may issue a Notice To Proceed upon verification that the Contractor has re-ceived approved security clearances for a suitable number of employees to begin on-site work and receipt of acceptable insurance and bond coverage. The Contract Performance Period, as stated in block 11 of the SF 1442, begins upon the issuance of the Notice To Proceed.

2. No additional time will be added to the performance period due to the following contractor actions or inactions:

a. Late submittal of security clearance forms

b. Incomplete or inaccurate submittal of security clearance forms

c. Submittal of employees whose adjudication is found to be unsuitable

d. Failure of the contractor to comply with any of the security requirements in the contract

e. Unacceptable insurance and/or bond coverage

APPROVED KEY PERSONNEL AND SUBCONTRACTORS

The Contractor shall exclusively utilize the key personnel and/or subcontractors named in the Contractors proposal to perform identified services. The Government reserves the right to approve or disapprove any changes in key personnel and/or subcontractors proposed by the Contractor after award. In the event that any key personnel are unable to perform their duties, the Contractor shall promptly (within 3 days) submit to the CO, in writing, the name and qualifications of a proposed replacement with equal or superior qualifications. No substitution shall be made without prior approval of the CO. Any approved substitutions shall be made at no increase in contract price, delay in contract performance and/or decrease in capabilities.

GSAR 552.236-81 USE OF EQUIPMENT BY THE GOVERNMENT (APR 1984)

(a) The Government may take over and operate, with Government employees, such equipment as is neces-sary for heating or cooling such areas of the building as require the service, as soon as the installation is sufficiently complete.

(b) The Contracting Officer will advise the Contractor by letter, prior to the use of equipment, which items of equipment will be operated, and the date and time such operation will begin.

(c) Government operation of equipment will not relieve the Contractor of the one-year guarantee on materials and workmanship elsewhere provided for in this contract.

(d) The guarantee period, elsewhere provided for in this contract, for each piece of equipment shall be in ac-cordance with the “Guarantees” clause of this contract.
