About this file
This Justification and Approval (J&A) document supports a sole-source contract for the Department of the Navy's Naval Supply Systems Command to procure two transformers from Howard Industries through their authorized distributor, Bradley Electro Sales Corp. The Forces Surveillance Support Center (FSSC) requires one 750 KVA and one 1000 KVA transformer for the Relocatable Over the Horizon Radar (ROTHR) Site located in Vieques, Puerto Rico, with a total estimated cost of $398,699.53.
The contract is being awarded on a sole-source basis because Howard Industries is the original equipment manufacturer, only distributes through authorized dealers, and does not sell directly to the government. The existing infrastructure was specifically designed for Howard Industries transformers, and using alternative manufacturers would require extensive and costly modifications estimated at $362,358.32, potentially causing 15-30 days of mission downtime. The ROTHR Site is considered a critical National Security Asset responsible for detecting and monitoring aerial and maritime transit to counter illicit drug trafficking, making mission continuity paramount.

5. Rationale Justifying Use of Cited Statutory Authority.
The Original Equipment Manufacturer (OEM) for the transformers is Howard Industries.
Howard Industries only distributes their products through an authorized network of dealers.
Howard Industries does not sell directly to the government. Market research confirmed that there are two authorized distributors that can deliver OEM products in the state of Virginia, where these transformers must be delivered: Bradley Electro Sales Corp. and HA Rawls.
Through market research, it was confirmed by both the OEM and HA Rawls that HA Rawls cannot fulfill this requirement. Therefore, Bradley Electro Sales Corp. is the only source that can fulfill this requirement.
It is recommended that the required 750 and 1000 KVA transformers be manufactured by
Howard Industries for the following reasons. The units they are replacing are Howard
Industries products and other manufacturers’ substitutes will not be compatible with the current electrical infrastructure. This requires a 1 for 1 change out with the legacy transformers. Pad mounted transformers are designed to be placed on equipment pads. The existing Howard Industries transformers are sitting on a raised engineered concrete equipment pad that was designed and built especially for the Howard Industries equipment.
Procuring alternative transformers increases the risk of system failure. Using the existing manufacturer is the only way to ensure equipment will operate as engineered and will connect without additional modifications to the existing infrastructure.
The customer has verified with Howard Industries that the new transformers requested would match the legacy units. Bradley Electo Sales Corp. provided a quote in the amount of
$293,570.00 ($150,612 for the 1000 KVA transformer and $142,958 for the 750 KVA transformer). Although this quote does not include the supply markup or delivery charge it was compared to historical data for in-kind purchases for the same equipment that was purchased for a new site built in New Kent, Virginia in the amount of $331,402.00.
The Customer provided an independent Government cost estimate based on a quote from a non-Howard Industries transformer manufacturer. The quote from Larson Electronics was in the amount of $398,699.53 ($154,157.39 for the 750 KVA transformer and $244,542.14 for the 1000 KVA transformer).
Using a different transformer manufacturer would result in modifications to the existing electrical connections and pad infrastructure resulting in approximately $362,358.32 in additional expenses as well as up to 30 days of mission downtime. This cost estimate is based on demoing the existing concrete pads, secondary and primary cabling, duct bank systems and other infrastructure and then rebuilding all the infrastructure to meet new requirements and or equipment specifications. This would include the cost of the following rental equipment:
▪ Backhoe rental cost $2,500 monthly $ 2,500.00
▪ Air Compressor rental cost $1000 monthly $ 1,000.00
▪ Breaker/Chipping hammer rental cost $1000 monthly $ 1,000.00
▪ Tamper plate rental cost $800 monthly $ 800.00
▪ Cable Pulling equipment rental cost $1500 weekly $ 1,500.00
Material Costs:
▪ Secondary feeder cable 500 MCM copper wire per foot cost $17.37 total number of feet 10,800 ft total cost $187,065 $187,596.00
▪ Secondary feeder cable ground conductor 1/0 copper wire price per foot $3.59 number of feet 675 total cost $2,500 $ 2,423.25
▪ 2/0 power Distribution cable copper wire price per foot $12.98 number of feet 300 total cost $ 4,000 $ 3,894.00
▪ Secondary 500 MCM 2-hole lugs cost each $29.30 number needed 144, total cost $4,250 $ 4,219.20
▪ Secondary 1/0 AWG ground conductor 2-hole lugs cost each $14.17 number needed 18 total cost $255 $ 255.06
▪ Terminations 15 KV 200-amp load break elbow connectors with ground kits cost each 177.99 number needed 9 total cost $2,000 $ 1,601.91
▪ Inline splices kits 15 KV, 2/0 copper cost each $928.15 number needed 6 total cost $6,000 $ 5,568.90
Labor/overhead/project cost:
▪ One (1) month project, one (1) supervisor, four (4) electricians in Puerto $150,000.00
Rico on Vieques island. $150K. This would include daily flights to and from mainland. Other than above tools and equipment (hand tools, hotels, rental cars on mainland and the island, etc.) TOTAL: $362,358.32
The timeline for the downtime would be seven (7) to fourteen (14) days for demolition;
seven (7) to fourteen (14) days for new work, one (1) to two (2) days for testing for a total downtime range of 15 to 30 days.
Forces Surveillance Support Center (FSSC) operates the Relocatable Over the Horizon
Radar (ROTHR) Site that is a National Security Asset as described in Title 10 USC Section
124. This ROTHR Site is responsible for the detection and monitoring of aerial and maritime transit to counter illicit drug trafficking posing a threat to National Security.
Mission requirements dictate operating schedules and mandate mission readiness and capabilities. Failure to meet these mandated mission parameters risks a failure of mission and jeopardizes the security of the United States.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
The proposed contract will have a notice of intent to sole source via the Contracting
Opportunities website (SAM). The requiring activity and contracting activity have conducted market research and concluded that Bradley Electo Sales Corp. is the sole provider. The requiring activity certifies the requirement can be met by a commercial service on a Sole-Source basis.
7. Determination of Fair and Reasonable Cost.
The Contracting Officer has determined the anticipated cost to the Government of the services covered by this J&A will be fair and reasonable.
8. Actions to Remove Barriers to Future Competition.
For the reasons set forth in Paragraph 5, NAVSUP FLCJ has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NAVSUP FLCJ will assess whether competition for future requirements is feasible.
