About this file
This document is a Consent Judgment between the State of Oregon, through the Department of Environmental Quality (DEQ), and the City of Milwaukie regarding environmental remediation of the Sparrow Property, a 1.46-acre parcel located at the intersection of Southeast Sparrow Street and Southeast 25th Street. The property, previously used as a construction staging yard and storage area by TriMet and the Oregon Department of Transportation, contains hazardous substances requiring cleanup. The City of Milwaukie intends to develop the property for affordable housing and has agreed to perform a remedial action to make the site protective for residential use, with the work to be completed under a detailed Scope of Work (Exhibit C) that includes developing a Remedial Action Work Plan, conducting site investigations, and implementing cleanup measures.
The Consent Judgment provides a framework for the City to acquire and remediate the property while obtaining protection from potential environmental liability. DEQ has approved multiple schedule extensions for the Remedial Action Work Plan, with the most recent amendment extending the due date to August 5, 2025. The City will be required to conduct environmental sampling, prepare various technical plans including a Health and Safety Plan and Sampling and Analysis Plan, and ultimately submit a Remedial Action Completion Report. The estimated cleanup will address polycyclic aromatic hydrocarbons (PAHs), oil-range hydrocarbons, and other contaminants identified in previous environmental site assessments, with the goal of making the property suitable for future residential development.

10 protection from potential liabilities in accordance with applicable law.
11 2.
Stipulations and Findings
A. Defendant stipulates:
(l) To entry of this Consent Judgment;
(2) To perform and comply with all provisions of this Consent Judgment; and

16 Judgment or to assess penalties for noncompliance with this Consent Judgment, any issue other
17 than Defendant' s compliance with this Consent Judgment.
B. DEQ and Defendant stipulate:
(1) For the purposes of this Consent Judgment, the "Facility," as defined in
20 ORS 465.200( 13), means: (a) the property located at the intersection of Southeast Sparrow Street
21 and Southeast 25 th Street in Milwaukie, Clackamas County, Oregon, tax lot
22 I I E36CC0030023000 (the "Propetiy"); and (b) the full extent of existing known or unknown
23 contamination by hazardous substances of any media on, above, or below the Property, or that
24 has migrated, might have migrated, or hereafter migrates to anywhere from the Property.
25 (2) For the purposes of this Consent Judgment, "Matters Addressed" means all
26 investigation, removal, and remedial actions taken or to be taken and all remedial action costs

2 Facility.
3 (3) For the purposes of this Consent Judgment, "Existing Hazardous Substance
4 Releases" means : (a) any release of hazardous substances, as defined in ORS 465.200, at the
5 Facility existing as of the date of Defendant' s acquisition of ownership or operation of the
6 Property; (b) any spill or release of oil or hazardous material , as defined in ORS 466.605 , at the
7 Facility existing as of the date of Defendant's acquisition of ownership or operation of the
8 Property; and (c) the entry of oil into the waters of the state, as defined in ORS 468B .300, from
9 the Facility before the date of Defendant 's acquisition of ownership or operation of the Prope1ty.
C. DEQ finds , and Defendant neither admits nor denies:
(1) Defendant is a political subdivision (municipality) in the State of Oregon.
(2) The Property proposed for acquisition by Defendant, currently owned by
13 Tri County Metropolitan Transportation District of Oregon (TriMet), is 1.46-acre parcel located l 4 north of the intersection of Southeast Sparrow Street and Southeast 25 th Street in Milwaukie, J 5 Clackamas County, Oregon. The Property is listed in Clackamas County records as tax lot
16 l 1E36CC0030023000. The legal description of the Property is set forth in Exhibit A to this
17 Consent Judgment. The location of the Property is illustrated generally in the Site Vicinity Map, 18 Exhibit B to this Consent Judgment. All attachments are incorporated into this Consent Judgment
19 by this reference.
20 (3) The Prope1ty is covered with gravel, with asphalt patches beneath the gravel
21 in places. The western boundary is vegetated with trees, and slopes steeply upward
22 approximately 20 to 25 feet. The northern Property boundary slopes steeply downward
23 approximately 30 feet to an unnamed, ephemeral creek. TriMet used the Property as a
24 construction staging yard . Prior to TriMet use, the Property was owned and used by the Oregon
25 Department of Transportation (ODOT) as a yard for storage of stockpiled material including
26 asphalt grindings, mixed sand and gravel, and leaf debris . There are currently no structures on

(97 1) 673-1880 / Fax (971) 673-1 886 the Prope1ty. No improvements were identified on the Propetty in historical maps and aerial
2 photographs except for clearing and placement of gravel and asphalt on the ground surface
3 during the operations at the Property by ODOT or TriMet. During an April 2018 site visit, areas
4 that appeared to indicate unauthorized camping activities (fire rings, refuse, etc.) were observed
5 in the northern and northwestern portions at the Property.
6 (4) The Defendant intends to develop the Property for use such as affordable
7 housing.
8 (5) A Phase I Environmental Site Assessment was completed by Landau
9 Associates in February 2011. No recognized environmental concerns (RECs) were identified.
l O However, based on anecdotal information on potential storage of petroleum contaminated soil at
11 the Property, soil sampling was recommended. A Phase II ESA was conducted by Landau
12 Associates in March 2012. Seven direct-push soil borings were advanced across the Property .
13 Groundwater was not encountered to a depth of 25-feet below ground surface (bgs) (the
14 maximum explored depth). Ten soil samples were analyzed for 13 priority pollutant metals, 15 diesel- and heavy oil-range hydrocarbons (TPH-Dx), benzene, toluene, ethylbenzene, and
16 xylenes (BTEX), and polycyclic aromatic hydrocarbons (PAHs). PAHs concentrations detected
17 in two samples were above DEQ risk-based concentration (RBC) for human health for
18 residential use. None of the other contaminants were detected above DEQ RB Cs. Oil-range
19 hydrocarbons were detected in eight of the l O samples at up to l 0, 100 mi I ligrams per kilogram
20 (mg/kg). DEQ has not published RBCs for oil-range hydrocarbons.
21 (6) Stantec completed a Phase I ESA of the Property for Metro and the City of
22 Milwaukie in March 2018. The 2018 Phase I ESA identified metals and petroleum hydrocarbon
23 constituents detected in soil samples collected by Landau during the 2012 focused Phase II ESA
24 as a REC for the Property . Stantec completed a Phase II ESA in April 2018. The Phase II was
25 limited to soil sampling using incremental sampling methodology (ISM). The generally flat
26 portion of the Property was designated as a single decision unit (DU). This DU was further

2 within each SU, for a total of 60 soil borings in the DU. For each boring location, three depth-
3 specific sample increments were collected: surface 0-1-foot bgs ; 1.5 to 4 feet bgs; and 6 to 8 feet
4 bgs. A total of nine SU samples (all depth intervals), three DU samples (all depth intervals, 5 including two replicates) and two DU samples (shallow interval only) were analyzed for J 3
6 priority pollutant metals, TPH-Dx, PAHs, and polychlorinated bi-phenyls (PCBs). In addition, 7 two composite soil samples were collected from the unauthorized camping areas, and analyzed
8 for 13 priority pollutant metals, TPH-Dx, and PAHs. PAH concentrations, converted to
9 equivalent benzo(a)pyrene toxicity, or TEQ, exceeded the DEQ RBC in the shallow fill
IO co1 lected from DU- I, and in the depth interval from 1.5-4 feet in the northern area (SU l) of the
11 Property. Arsenic, diesel-range hydrocarbons, and the benzo(a)pyrene TEQ exceed the
12 residential and urban residential RBCs in the unauthorized camping-area sample SS-2.
13 (7) The contaminants described in C(5) and C(6) are "hazardous substances"
14 within the meaning of ORS 465 .200(16). The presence of hazardous substances at the Property
15 constitutes a "release" of hazardous substances within the meaning of ORS 465.200(22), and
16 makes the Property a "fac ility" within the meaning of ORS 465.200(13).
17 (8) Pursuant to ORS 465.255( 1 )(b ), Defendant could become liable to DEQ and
18 other persons for re leases of hazardous substances at or from the Property by becoming the
19 owner or operator of the Property with actual or constructive knowledge of the releases. On
20 August 23 , 2018, Defendant applied to DEQ for a "prospective purchaser" agreement under
21 ORS 465.327. This Consent Judgment is intended to protect Defendant from potential liability
22 for pre-acquisition releases of hazardous substances at or from the Property, in return for
23 Defendant undertaking certain obligations, as described in this Consent Judgment. In
24 determining to propose this Consent Judgment, DEQ considered reasonably anticipated future
25 land uses at the Property and surrounding properties and consulted with the City of Milwaukie.
26 This Consent Judgment is entered into pursuant to ORS 465.325 and ORS 465.327.

(9) On March 1, 2019, DEQ published notice of this proposed Consent Judgment
2 and provided oppo1iunity for public comment in accordance with ORS 465 .320( I) and
3 465.325(4)(d). Three pa1iies submitted comments. The comments voiced similar concerns, 4 including, I) there was inadequate investigation to define the extent of contamination; 2) the
5 proposed work required under the PPA would not results in substantial public benefit, and
6 3) land use concerns regarding schools, economic conditions, changes to the neighborhood, 7 transpo1iation , effects on habitat/greenspace, and funding sources. DEQ issued a response to
8 comment letter to each commenting party on April 15, 2019. The response letters are available
9 on DEQ's on-line database.
JO (10) ConsistentwithORS465.327(1):
(a) Defendant is a "person" within the meaning of ORS 465.200(21);
(b) Defendant is not currently liable under ORS 465.255, 466.640, or
13 4688.3 IO for the Existing Hazardous Substance Releases;
14 (c) Removal or remedial action is necessary at the Property to protect
15 human health or the environment;
16 (d) Defendant's ownership and operation of the Property will not cause, J 7 contribute to , or exacerbate existing contamination, increase health risks , or interfere with
18 remedial measures at the Property; and
19 (e) A substantial public benefit will result from this Consent Judgment.
20 (I I) Based on the administrative record, the Director of DEQ determines that:
21 (a) the release from liability set forth in Subsection 5.B satisfies the criteria set forth in ORS
