About this file
This document provides answers to questions regarding a solicitation for surgical saws and drills. The solicitation seeks battery-powered surgical saws and drills through a contract set aside for service-disabled veteran-owned small businesses. The contracting agency is the Department of Veterans Affairs Veterans Health Administration Veterans Integrated Service Network 22. Offerors must certify their intent to comply with the applicable limitation on subcontracting, which for this services contract allows no more than 50% of the costs to be incurred for employees not employed by the prime contractor. If no eligible SDVOSB concerns can fulfill the requirements, the agency will cancel the solicitation and reevaluate the acquisition.

36C26222Q1694 0001 Continued
The following are the Government’s answers for the three questions posed regarding this solicitation:
1. Is contracting allowing SDVOSB to provide product and technical support of a large business?
This is a contract for services that has been set aside for SDVOSB concerns. Because this procurement has been set aside for SDVOSB concerns, the contract awardee must comply with the limitation on subcontracting that applies to services contracts, which can be found at 13 CFR 125.6(a)(1). Offerors must certify their intent to comply with this limitation by returning the signed certification at VAAR 852.219-77 with their quotes. Offerors who fail to return this certification with their quotes will not be considered for a contract award. In general, an SDVOSB may subcontract with a large business provided it complies with the limitation on subcontracting described at 13 CFR 125.6(a)(1). There may be other federal laws with which an offeror must also comply that can limit with whom the offeror may subcontract. Whether a particular subcontracting arrangement your company is considering will comply with the limitation on subcontracting found at 13 CFR 125.6(a)(1), or other federal laws applicable to this procurement, is a legal question for which you should consult your own legal counsel. The VA contracting office is unable to provide legal advice to offerors regarding their individual planned subcontracting arrangements.
2. With lease over $250,000 does contracting officer need to request an SBA waiver if providing end product/technical support of large business or are rules different under a service contract?
VA is conducting this procurement under the Veterans First Contracting Program authorized by 38 USC 8127. The requirements for this program are implemented in the VA Acquisition Regulations Subpart 819.70. Under VA Acquisition Regulations, this procurement is required to comply with the SBA Rules regarding the limitation on subcontracting found at 13 CFR 125.6. Because this procurement is a services procurement that has been set aside for SDVOSB concerns, the contract awardee must comply with the limitation on subcontracting applicable to services contracts found at 13 CFR 125.6(a)(1). This requirement is not waived for this procurement.
3. How will Limitations on Subcontracting be met (852.219-74 and 852.219-77) if there is no SDVOSBs able to provide the requested product, technical support, and lease?
SDVOSB offerors are required to certify their intent to meet the limitation on subcontracting applicable to this procurement when submitting their quotes. If a quote fails to include the certification required by VAAR 852.219-77, or if the quote, on its face, demonstrates that the offeror does not intend to meet the limitation on subcontracting applicable to the procurement, the quote will not be eligible for a contract award. If the VA receives no quote from an SDVOSB concern to whom a contract award can be made, VA will cancel the solicitation, re-evaluate its requirements, and may take other action, which could include issuing a new solicitation for this requirement that is set aside for Small Business concerns or another socio-economic group, or as an unrestricted competitive procurement.
No changes have been made to this solicitation.
