6. REQUIRED REGISTRATION WITH SYSTEM FOR AWARD MANAGEMENT (SAM):

Federal Acquisition Regulations require all contractors conducting business with the Government to be registered in two separate and individual online databases: 1) the System for Award

Management (SAM) Government-wide online database for the provision of basic information relative to contract awards; and 2) the Past Performance Information Retrieval System (PPIRS) for online evaluation of your performance. Award cannot be made to a contractor not registered in both database systems.

Pursuant to the General Services Administration (GSA) implementing the, System for Award

Management (SAM), on July 29, 2012 after initial registration, the Contractor is required to update registration data as changes occur and must re-register annually to ensure all data remains current.

SCOPE OF WORK:

The Department of Veteran Affairs Long Beach Healthcare System (VALBHS) requires a contractor to provide Security Guard Services at five (5) Community Based Outpatient Clinics (CBOC), and one (1)

Community Resource and Referral Center (CRRC). This firm fixed priced (FFP) contract shall be effective for a period of one base year with the Government’s option to extend the contract up to four one year option periods.

B.3 DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK AND REQUIREMENTS

1. DESCRIPTION OF SERVICES:

The Contractor shall be responsible for providing six (6) unarmed Security Guards with a level I certification or higher, furnish all labor, supervision, uniforms, training, transportation, equipment, supplies, and management to provide on-site security guard services for VA Facilities located throughout VA Long Beach Healthcare System (VALBHS).

The Government shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the

Contractor who, in turn is responsible to the Government. The contractor shall perform to the standards in this contract.

3. QUALIFICATIONS:

a. The Contractor shall have relevant experience performing the services required of this

Statement of Work

b. Have a minimum of six (6) Security Guards that have completed a VA Background check at time of award.

c. Security Guards must be a minimum of twenty-one (21) years of age.

4. MEAL PERIODS:

All Security Guards are to remain at the work site during their assigned meal period.

5. SPECIFIC TASKS:

SECURITY GUARD I: All on-site Security Guards fall under this category, except supervisors and special assignment guards. Services shall include but may not be limited to the following:

a. Contractor’s employees are restricted from using Force while providing Security Guard services at VALBHS. The Security Guards primary function will be to observe, document and report.

b. Security Guards are restricted from intervening in domestic disputes. In the case of a domestic dispute Security Guards are to call the local Police Department prior to calling

VA Police Dispatch 1.

c. Notify VA Police (Dispatch 1) upon arrival and prior to departure via a telephone within the assigned VA facility.

d. Ensure all entrances are clear of hazards.

e. Be watchful for vandalism to buildings, equipment and/or government vehicles.

f. Document and notify VA Police, and/or designated VA staff member, upon discovery of a criminal act or violation of VA Policy.

g. Document and report suspicious activity to VA Police and/or designated VA staff official.

h. Render assistance to employees, patients and visitors. Security Guards may relay guidance and or instructions provided by the VA Police to VA employees, patients and visitors during fires, storms, earthquakes, or other incidents when directed by VA Police.

i. Maintain a physical presence by conducting and documenting hourly random patrols of assigned parking lots, buildings and around the assigned VA Facility.

j. Admit only authorized personnel to park in assigned parking lots at the VA facility.

k. Report to VA Police, incidents of persons attempting to gain unauthorized access to

VALBHS and detain only if requested by VA Police.

l. Document and report to the designated VA staff official potentially hazardous conditions, items in need of repair, including inoperative lights, leaky faucets, toilet stoppages, broken or slippery floor surfaces.

m. Security Guards may be assigned to parking lot entrances by VA Police to monitor vehicle and pedestrian traffic flow, to deter illegal parking and to write courtesy violations when authorized by VA Police.

n. Assist VA Police and support Police actions only when directed by the VA Police Officer at the scene or by VA Police Dispatch 1.

o. Notify VA Police immediately of any alarm and report to the site within 15 minutes of alarm (if requested) by VA Police Dispatch 1.

p. The local Police shall be notified first if a crime is in progress or there is evidence that a crime has taken place.

SECURITY SUPERVISOR: The Contractor shall provide the name(s), telephone number(s) and addresses of the Supervisor, in writing, to the Contracting Officer prior to performance under this contract. The term “Supervisor” as used in this contract means a person designated in writing by the Contractor who has authority to act for the Contractor on a day-to-day basis at the work site, or via telephone. The Supervisor’s services shall include but may not be limited to the following:

a. Notify the VA Police no later than fifteen (15) minutes after the start of a shift if a Security

Guard is not at or will not be at his or her assigned VA facility as scheduled. Inform the

VA Police of the disposition or steps being taken to replace the absent Security Guard.

b. Document the amount of time services were not rendered as scheduled and ensure that time is subtracted from the appropriate invoice.

c. Ensure Security Guards are on post and in the proper uniform.

d. Ensure Security Guards know and understand the orders and policies of the post they are assigned.

e. Contractor shall ensure that security officers’ certifications are completed as required and the paperwork is forwarded to the COR.

f. Ensure Security Guards are vigilant for vandalism to buildings and/or government vehicles.

g. Notify VA Police, of any suspected or actual break-in.

h. Ensure that officers are properly informed, trained for the assigned site according to the requirements of the VA Police and VA Policies.

i. Review and reconcile all invoices ensuring the Security Guards name, location, hours worked are correct and the COR has approved the invoice prior to it being submitted.

j. Attend meetings on-site as requested by the COR or VA Police.

k. Notify the COR of any action documented or not (other than normal duties) taken by

Security Guards during a shift.

l. Inform the COR of any mechanical malfunctions of the alarm system.

6. CHANGES:

Services shall only be changed by a written modification to the contract. The modification will be prepared by the VA Contracting Officer prior to becoming effective. Only those services specified herein are authorized. Before performing any service of a non-contract nature, the Contractor shall advise the Contracting Officer of the reasons for the additional work. Changes to the resulting contract are not authorized, unless in writing by the Contracting Officer.

7. QUALITY ASSURANCE:

a. The COR shall evaluate the services provided by the Contractor on an ongoing basis.

b. The Contractor shall perform all work required under the terms of the SOW in a satisfactory manner.

c. The Contractor shall provide to the Contracting Officer a copy of the Contractors Quality

Assurance Plan. This document shall identify the management concept for ensuring compliance with all contract requirements and shall include the following.

I. A description of the Contractor’s plan of providing Security Guard services in the absence of a Security Guard.

II. A description of the Contractor’s plan to replace Security Guards if they unable to remain at work.

d. The Contracting Officer reserves the right at no additional cost to the Government to schedule a quarterly visit with the Contractor to discuss performance. The Contractor shall have at least one person attending the meeting that is able to make decisions on their behalf.

8. ADDITIONAL REQUIREMENTS:

A post-award conference shall be held prior to commencing services with the attendance of the

Contractor, COR, Contracting Officer and other Officials designated by the Contracting Officer.

This meeting will be at no extra cost to the Government. The conference agenda shall include, as a minimum:

9. PROHIBITED ITEMS:

Security Guards shall not have the following items.

a. Handcuffs

b. Batons/Clubs

c. Firearms (even if licensed)

d. Knifes

e. Headphones

f. Pepper spray

g. Brass Knuckles

h. Stun Guns

10. PROHIBITED ACTIVITY:

a. Security Guards are prohibited from sitting in personal vehicles (or any other privately owned vehicle) while providing security services.

b. Security Guards are prohibited from pursuing suspects.

c. Security Guards shall not physically search anyone, even if consent is given.

d. Security Guards shall not conduct investigations at any VA Facility.

11. CONTRACTOR PERSONNEL SECURITY REQUIREMENTS:

The Office of Security and Law Enforcement provides Department-wide policy on the assignment of appropriate position sensitivity designations associated with Department of Veterans Affairs positions involving national security and public trust responsibilities, and on the level of background investigations required for applicants for, and incumbents of, those positions. In addition to VA employees, the policy and investigative requirements are applicable to contractor personnel are listed below:

a. Contractor and subcontractor personnel will not have access to VA computer systems.

b. The cost of any and all background investigations shall be borne by the Contractor. The level of sensitivity shall be determined by the Government on the basis of the type of access required.

The level of sensitivity shall determine the depth of the investigation and the cost thereof.

c. Failure of a Contractor whose personnel or Subcontractor personnel fail to complete a background check may result in termination of the contract for default. At this time, the current estimated costs for such investigations is as follows:

The Contractor shall be required to furnish all applicable employee information required to conduct the investigation, such as, but not limited to, the name, address, social security number, birthday and place of birth of Contractor personnel. 13. CONTRACTOR EMPLOYEES:

The Contractor shall not employ persons for work on this contract if such employee is identified to the Contractor as a potential threat to the health, safety, security, general well-being or operational mission of the installation and its population.

Contract Personnel shall be subject to the same quality assurance standards or exceed current recognized national standards as established by the Joint Commission (JC).

Badge: Contractor shall obtain a “Contractor I.D Badge” from the VA Police. All Contractor personnel are required to wear I.D Badge during the entire time on VA facility. The I.D Badge

MUST have an identification picture and shall state the name of the individual and the company represented.

Parking: It is the responsibility of the contract personnel to park in the appropriate designated parking areas. Parking information is available from VA Police & Security Service Office. The

Contractor assumes full responsibility for any parking violations. The VALBHS does not validate or make reimbursement for parking violations of the contractor’s personnel.

Smoking: Contractor personnel may smoke only in designated areas. It is the responsibility of the

VISN 22 Healthcare Facilities to provide a safe and healthful environment for employees and patients and to serve as a leader in community health awareness and education. It is in fulfillment of this obligation that the facilities are committed to the establishment of a smoke-free environment.

This policy applies to every location in the Healthcare Facilities. There shall be no smoking within

25 feet of all entrances to buildings. Smoking is allowed in all outside areas that are 25 feet away from entrances to buildings unless indicated otherwise. Enclosed patios connected to facility buildings are considered part of the building and as such are non-smoking areas.

The locations for this requirement are listed within this synopsis. There will not be a scheduled site visit, it is the Offerors’ responsibility to view each location prior to submitting an offer in order to be fully aware of the scope of services required. Failure to do so will not relieve the Contractor from performing in accordance with the terms and conditions of this solicitation and at the offered price.

C.2 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within thirty (30) days.

C.3 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)

(a) The Government may extend the term of this contract by written notice to the Contractor within thirty

(30) days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least thirty (30) days before the contract expires. The preliminary notice does not commit the

Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed five (5) years.

C.4 52.219-27 NOTICE OF SERVICE-DISABLED VETERAN-OWNED SMALL BUSINESS

SET-ASIDE (NOV 2011)

(a) Definition. "Service-disabled veteran-owned small business concern"—

(1) Means a small business concern—

(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and

(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.

(2) "Service-disabled veteran" means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).

(b) Applicability. This clause applies only to—

(1) Contracts that have been set aside or reserved for service-disabled veteran-owned small business concerns;

(2) Part or parts of a multiple-award contract that have been set aside for service-disabled veteran-owned small business concerns; and

(3) Orders set aside for service-disabled veteran-owned small business concerns under multiple-award contracts as described in 8.405-5 and 16.505(b)(2)(i)(F).

(c) General.

(1) Offers are solicited only from service-disabled veteran-owned small business concerns. Offers received from concerns that are not service-disabled veteran-owned small business concerns shall not be considered.

(2) Any award resulting from this solicitation will be made to a service-disabled veteran-owned small business concern.

(d) Agreement. A service-disabled veteran-owned small business concern agrees that in the performance of the contract, in the case of a contract for—

(1) Services (except construction), at least 50 percent of the cost of personnel for contract performance will be spent for employees of the concern or employees of other service-disabled veteran-owned small business concerns;

(1) At least one member of the joint venture is a service-disabled veteran-owned small business concern, and makes the following representations: That it is a service-disabled veteran-owned small business concern, and that it is a small business concern under the North American Industry Classification Systems

(NAICS) code assigned to the procurement;

(2) Each other concern is small under the size standard corresponding to the NAICS code assigned to the procurement; and

(3) The joint venture meets the requirements of paragraph 7 of the explanation of Affiliates in 19.101 of the Federal Acquisition Regulation.

(4) The joint venture meets the requirements of 13 CFR 125.15(b)

(f) Any service-disabled veteran-owned small business concern (nonmanufacturer) must meet the requirements in 19.102(f) of the Federal Acquisition Regulation to receive a benefit under this program.

C.5 52.232-19 AVAILABILITY OF FUNDS FOR THE NEXT FISCAL YEAR (APR 1984)

Funds are not presently available for performance under this contract beyond September 30. The

Government's obligation for performance of this contract beyond that date is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise for performance under this contract beyond

September 30, until funds are made available to the Contracting Officer for performance and until the

Contractor receives notice of availability, to be confirmed in writing by the Contracting Officer.

(c) The Contractor need not comply with paragraph (a) above if the Contractor has established a mechanism, such as a hotline, by which employees may report suspected instances of improper conduct, and instructions that encourage employees to make such reports.

C.8 VAAR 852.211-70 SERVICE DATA MANUALS, MECHANICAL EQUIPMENT (JAN 2008)

The contractor agrees to furnish two hard copies of a manual, handbook or brochure containing operating, installation, and maintenance instructions (including pictures or illustrations, schematics, and complete repair/test guides as necessary). Where applicable, it will include electrical data and connection diagrams for all utilities. The instructions shall also contain a complete list of all replaceable parts showing part number, name, and quantity required.

C.10 VAAR 852.232-72 ELECTRONIC SUBMISSION OF PAYMENT REQUESTS (NOV 2012)

(a) Definitions. As used in this clause—

(1) Contract financing payment has the meaning given in FAR 32.001.

(2) Designated agency office has the meaning given in 5 CFR 1315.2(m).

(3) Electronic form means an automated system transmitting information electronically according to the

Accepted electronic data transmission methods and formats identified in paragraph (c) of this clause.

Facsimile, email, and scanned documents are not acceptable electronic forms for submission of payment requests.

(4) Invoice payment has the meaning given in FAR 32.001.

(5) Payment request means any request for contract financing payment or invoice payment submitted by the contractor under this contract.

(b) Electronic payment requests. Except as provided in paragraph (e) of this clause, the contractor shall submit payment requests in electronic form. Purchases paid with a Government-wide commercial purchase card are considered to be an electronic transaction for purposes of this rule, and therefore no additional electronic invoice submission is required.

(c) Data transmission. A contractor must ensure that the data transmission method and format are through one of the following:

(1) VA’s Electronic Invoice Presentment and Payment System. (See Web site at http://www.fsc.va.gov/einvoice.asp.)

(2) Any system that conforms to the X12 electronic data interchange (EDI) formats established by the

Accredited Standards Center (ASC) and chartered by the American National Standards Institute (ANSI).

(d) Invoice requirements. Invoices shall comply with FAR 32.905.

(e) Exceptions. If, based on one of the circumstances below, the contracting officer directs that payment requests be made by mail, the contractor shall submit payment requests by mail through the United States

Postal Service to the designated agency office. Submission of payment requests by mail may be required for:

(1) Awards made to foreign vendors for work performed outside the United States;

(2) Classified contracts or purchases when electronic submission and processing of payment requests could compromise the safeguarding of classified or privacy information;

(3) Contracts awarded by contracting officers in the conduct of emergency operations, such as responses to national emergencies;

(4) Solicitations or contracts in which the designated agency office is a VA entity other than the VA

Financial Services Center in Austin, Texas; or

(5) Solicitations or contracts in which the VA designated agency office does not have electronic invoicing capability as described above.

C.11 VAAR 852.237-70 CONTRACTOR RESPONSIBILITIES (APR 1984)

The contractor shall obtain all necessary licenses and/or permits required to perform this work. He/she shall take all reasonable precautions necessary to protect persons and property from injury or damage during the performance of this contract. He/she shall be responsible for any injury to himself/herself, his/her employees, as well as for any damage to personal or public property that occurs during the performance of this contract that is caused by his/her employees fault or negligence, and shall maintain personal liability and property damage insurance having coverage for a limit as required by the laws of the State of California.

Further, it is agreed that any negligence of the Government, its officers, agents, servants and employees, shall not be the responsibility of the contractor hereunder with the regard to any claims, loss, damage, injury, and liability resulting there from.
