VHAPM Part 813.106 Simplified Acquisition Procedures: Soliciting from a Single Source Attachment 1: Single Source Justification for SAP under the SAT

VHAPM Part 813.106 Page 1 of 1 Original Date: 08/30/17 Revision 01 Eff Date: 04/23/2018

DEPARTMENT OF VETERANS AFFAIRS

Justification for Single Source Awards IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID: 36C261-19-AP-5310

1. Contracting Activity: Department of Veterans Affairs, VISN 21, VA Southern Nevada Healthcare

System

PR# 593-19-3-136-0272

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:

Software upgrade from VEST 7.x to VEST 8.2 for I-Portal NOTC, PC Upgrade, USB3-kit Upgrade for I- Portal NOTC, Including I-Portal Falcon VOG System 100Hz, and Eye Tracking System Hardware Binocular 100Hz with a software and service agreement for a base plus 4 option year period estimated at $130,600.00

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:

Items in #2 must be integrated into existing equipment. The current system is running on Windows 7 and is no longer supported on Windows 10. Without an upgrade, the facility will be forced to purchase new unit, at a much greater cost than upgrading parts. If an upgrade is not acquired, patients would be required to go to nearest VA, as no other clinic in southern Nevada has similar equipment. This would result in a huge cost to VA.

4. Description of market research conducted and results or statement why it was not conducted:

VIP, FPDS, GSA, the VA NAC, and FBO were used for market research. It appears that NKI has historically been awarded as a sole source. According to a NKI, a letter was sent stating that “NKI is the sole designer, manufacturer, and marketer of its patented and patent pending I-Portal® NOTC systems and VEST™ and I-Portal® software platform. VEST™ and I-Portal® software only work on NKI’s I-Portal® products. NKI products, software, and support can only be purchased directly from NKI or through its distributors”.

5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
