1.0 General Intent

1.1 The contractor must provide all personnel, equipment, tools, materials, supervision, and other items and services necessary to remove and replace Building 4 transformer, remove and replace Building 105 Transformer, and install oil sampling ports on all transformers throughout the Veterans Affairs Palo Alto Health Care System (VAPAHCS).

1.2 The contractor must perform to the standards in this contract. This project shall take no longer than 265 calendar days from the notice to proceed to complete due to 20 week lead time for materials.

1.3 This project shall be supervised by the appointed COR to insure minimal impact to resident’s day to day activities and minimal noise. Scheduling of work shall be at the convenience of the VAPAHCS.

2.0 General Information and Requirements

2.1 The objective of this project is to remove the existing building 4 transformer and install a direct replacement unit, remove the existing building 105 transformer and install a direct replacement unit, and install external oil sampling ports with nitrogen pressure gauges and nitrogen filled regulators on all Transformers located at the Palo Alto, Menlo Park, and Livermore facilities.

2.2 The contractor shall provide operation and maintenance instructions, and manufacturer documentation at the completion of the project. Manufacturer documentation and maintenance schedule to be provided in close out documents.

2.3 The contractor shall provide all tools, equipment, and personal protective equipment necessary to complete this project as deemed by industry standards, this SOW, all related specifications, applicable code requirements, and site policy.

2.4 The contractor shall provide daily cleanup and securing of work site, including securing tools and equipment. Disposal of all waste and debris is at the contractor’s own expense.

2.5 The contractor shall provide quality control of all work conducted and the individual appointed shall be competent and educated/experienced in the field of work this scope encompasses.

2.6 All work shall be coordinated with the COR assigned to this project and only commence once approved.

2.7 Badges: Contractor will obtain required ID badges for all employees used on project at start of each workday; Report to the COR for escort to the station police service for sign in and badge issuance.

2.8 Security: The contractor and their personnel shall be subject to the same Federal laws, regulations, standards, and VA policies as VA personnel regarding information and information system security.

2.10 Schedule: Normal work hours will be 8:00am – 4:30 pm Monday-Friday excluding Government holidays unless otherwise approved by the COR. It is the intent of the Palo Alto VA Medical Center that the work is to be completed within 265 calendar days from the issuance of the Notice to Proceed (NTP). Any request to utility shutdowns must be requested in writing at a minimum of 30 days prior to the requested day of shutdown.

2.11 Codes and Standards: The Contractor shall follow all applicable codes and standards to this type of work including but not limited to Health Care System Memorandums (HCSM), OSHA Guidelines, NFPA 101, NFPA 70, Lock-out-Tag-out, and Rules of Station. If any code/standard is found to be contradictory; the authority having jurisdiction (COR) shall make the final determination and work shall proceed at no additional cost to the Government.

3.0 Specific Tasks

3.1 The contractor shall provide all supervision, administrative and technical support, labor, subcontractors, tools, transportation, materials, supplies and equipment. The contractor shall plan, schedule, and ensure effective completion of the removal of two existing transformers, installation of two new transformers, and the installation of external oil sampling ports for 56 existing transformers.

3.2 The contractor shall furnish and install 56 external oil sample ports on all transformers throughout the Health Care System. (See Exhibit A). Installation will include a nitrogen pressure gauge and a nitrogen filled regulator on each transformer.

3.3 The contractor shall furnish and install the following for Building 4:

Three Phase 300 KVA Pad Mount Transformer, High Voltage: 12470 Delta Low Voltage: 208Y/120, Taps: W/Taps 2 X 2 ½% +/-.

Transformer accessories shall include:

Primary bushings, Dead Front, Radial feed 8.3/14.4 KV wells with inserts Bayonets in series with ELSP fusing On/Off Switch Secondary Bushings, Standard Spade Connectors Oil level gauge Pressure/Vacuum gauge Pressure relief device Pentahead Entry Assembly Mineral Oil (standard) Non-PCB label Drain valve with sampler Bell Green Paint Undercoating

3.4 The contractor shall furnish and install the following for Building 105: Three Phase 1000 KVA Pad Mount Transformer:

High Voltage: 13200 Delta Low Voltage: 480Y/277, Taps: 14.4 13.8 12.87 12.47 12.0 11.7

Transformer accessories shall include:

Primary Bushings, Dead Front, Loop Feed 8.3/14.4 KV Wells with Inserts LBOR 4 Position Switch Bayonet Fusing Secondary Bushings, Standard Spade Connectors Oil Level Gauge Pressure/ Vacuum Gauge Temperature Gauge Pressure Relief Device Pentahead Entry Assembly Mineral Oil (standard) Non-PCB label Drain valve with sampler Bell Green Paint

3.5 The contractor shall perform a Visual and Mechanical inspection of each Transformer which include the following tasks:

Compare equipment nameplate data with drawings and specs Inspect physical and mechanical condition Inspect Impact recorder prior to unloading Inspect Anchorage, alignment, and grounding Verify the presence of PCB content labeling Verify removal of any shipping bracing after placement Verify the bushings are clean Verify that alarm, control, and trip settings on temperature and level indicators are as specified Verify operation of alarm, control, and trip circuits from the temperature and level indicators, pressure relief device, gas accumulator, and fault pressure relay.

Verify that cooling fans and pumps operate correctly and have appropriate overcurrent protection.

Inspect bolted electrical connections for high resistance using one or more of the following methods:

-Use of a low-resistance ohmmeter -Verify tightness of accessible bolted electrical connections by calibrated torque- wrench method -Perform thermographic survey

Verify correct liquid level in tanks and bushings Verify valves are in the correct operating position Verify that positive pressure is maintained on gas-blanketed transformers Perform inspections and mechanical tests as recommended by the manufacturer Test load tap-changer Verify presence of transformer surge arresters Verify de-energized tap-changer position is left as specified

3.6 The contractor shall perform electrical testing for the new transformers using the following methods:

Perform resistance measurements through bolted connections with a low-resistance ohmmeter if applicable

Perform insulation resistance tests, winding to winding and each winding to ground. Apply voltage in accordance with manufacturer’s published data. In the absence of the published data, use Table 100.5 of NETA ATS. Calculate polarization index.

Perform turns-ratio tests at all tap positions.

Perform insulation power-factor or dissipation-factor tests on each bushing equipped with a power-factor/capacitance tap. In the absence of a power-factor/capacitance tap, perform hot-collar tests. These tests shall be in accordance with the test equipment manufacturer’s published data.

Perform excitation-current tests in accordance with test equipment manufacturer’s published data.

Perform sweep frequency response analysis tests.

Measure the resistance of each high voltage winding in each de-energized tap-charger position

Measure the resistance of each low-voltage winding in each de-energized tap-charger position

Remove a sample of insulating liquid in accordance with ASTM D 923. Sample shall be tested for the following:

· Dielectric breakdown voltage

· Acid Neutralization number: ANSI/ASTM D 974

· Specific Gravity: ANSI/ASTM D 1298

· Interfacial Tension: ANSI/ASTM D 971

· Color: ANSI/ASTM D 1500

· Visual Condition: ASTM D 1524

· Water in insulating liquids: ASTM D 1533

· Power factor or dissipation factor in accordance with ASTM D 924

Remove a sample of insulating liquid in accordance with ASTM D 923 and perform dissolved-gas analysis (DGA) in accordance with ANSI/IEEE C57.104 or ASTM D3612.

3.7 The contractor shall provide a (1)-year warranty, parts and labor, from date of project completion.

SUBMISSION OF BID INSTRUCTIONS:

The Bidder shall submit all of the following documents in response to this Invitation for Bid (IFB). Incomplete bid packages may be determined nonresponsive.

(a) One (1) original fully completed and signed Standard Form (SF) 1442; acknowledgment of all amendments, either by entering data in block 19 of the SF 1442, or by completing blocks 15 a, b, and c of Amendment(s) (SF 30’s), delivered to address in Box 8, SF 1442.

(b) One (1) original completed/signed SF24 Bid Bond with Raised Seals and Power of Attorney as required (delivered with original bid).

(c) One (1) fully completed Divisional Cost-Breakout Sheet.

(d) Documentation of Safety & Environmental Record.

(e) Documentation of Experience Modification Rate (EMR).

(f) Current General Contractor’s License.

Notes:

· Bidders are responsible for insuring and verifying their bid and all required bid documents are received at the address stated in Box 8 of SF-1442, by date and time specified in block 13A of SF-1442 Solicitation (subject to amendment).

· Bidders are cautioned to carefully review System for Award Management regarding Representations and Certifications. See FAR 52.204-7 and 52.204-8 for specific instruction as needed. Also see 52.209-7 and 52.209-9 if applicable / included in solicitation for additional instructions.

INFORMATION FOR BIDDERS:

· Any exception to the terms and conditions of the IFB will result in a nonresponsive bid.

· Failure to provide complete definitive prices on calculation sheet/divisional cost break-down will result in a nonresponsive bid.

Purchases shall be made from, and contracts shall be awarded to, responsible prospective contactors only. The presumed winning Bidder must be determined as “responsible” by the Contracting Officer in accordance with FAR Part 9, Contractor Qualifications. To aid in making this determination, by no later than solicitation due date, Bidders shall provide all documents as required under “Submission of Bid Instructions” above (including the original bid bond, if stated as a requirement in response to the solicitation).

These documents will be reviewed shortly upon receipt. This information, along with other information obtained from Government systems, such as the OSHA and EPA online inspection history databases will be used to make the Determination of Responsibility. Failure to affirm being within the guidelines below or to submit this information may result in a determination of Non-Responsibility and make the bid ineligible for award. PER VHA DIRECTIVE 7715 (06 April 2017) - SAFETY & ENVIRONMENTAL RECORD AND EXPERIENCE MODIFICATION RATE (EMR):

To be eligible for consideration and award, the contractor shall have no more than three serious, or one repeat, or one willful OSHA or EPA violation(s) in the past 3 years and have an EMR of equal to or less than 1.0. See earlier section under “Calculation Sheet” for details.

PRE-BID SITE VISIT:

Bidders are urged and expected to inspect the site where services are to be performed and to satisfy themselves regarding all general and local conditions that may affect the cost of performing construction services. Failure to inspect the site shall not constitute grounds for a claim after contract award.

See Provision 52.236-27 for specific information regarding the project pre-bid site visit, which will be the only opportunity for potential Bidders to visit the site. All potential Bidders, subcontractors, and suppliers are strongly encouraged to attend the pre-bid site visit.

REQUEST FOR INFORMATION (RFI):

· To obtain clarifications and/or additional information concerning the contract requirements or specifications, submit a written RFI utilizing the RFI Form included in this IFB, and send it via email to jose.hernandez1@va.gov. See RFI Form for specifics.

· RFIs will be responded to as necessary in amendment format, which will be posted on FBO. Deadline for submission of RFIs for this IFB is Wednesday, November 6th, 2019, at 2:00 PM Pacific Time. No questions will be answered after this date and time unless determined by the Contracting Officer to be in the best interest of the Government. Telephone request for information will not be accepted or returned.

PLANS/SPECIFICATIONS/DRAWINGS:

Any drawings and specifications are attached in electronic format to this solicitation. Bidders are responsible for downloading and printing their own solicitation documents, including specifications and drawings. The VA will not provide hard copies of drawings and specifications to any Bidders. Contractors are responsible for ensuring that any construction document package used for submitting a bid for construction is complete and current.

TRAINING:

All employees of the general contractor and subcontractors shall have the 10-hour OSHA certified construction safety course and/or other relevant competency training, as determined by the COR with input from the ICRA (Infection Control Risk Assessment) team. The General Contractor’s Competent Person/Superintendent shall have completed the 30-hour OSHA certified construction safety course. Documentation of training shall be submitted to the Contracting Officer for review and approval prior to any work being performed. No ID badge will be issued to an employee who does not provide this documentation. There shall be no exceptions to this requirement.

PREPARATION OF BID:

The Federal Government will NOT pay for any costs incurred in preparation and submission of bid.

PRIVACY AND CONFIDENTIALITY:

Contractors to the Department of Veteran Affairs may be unintentionally exposed to sensitive information. Information may be overheard, seen on documents or electronic devices, or observed that could potentially violate the privacy and confidentiality of our veterans, employees, volunteers, and their families. Regulations such as, but not limited to, the Health Insurance Portability and Accountability Act of 1996 (HIPAA), Freedom of Information Act (FOIA) and Privacy Act of 1974 have been enacted to protect sensitive information from being improperly disclosed. Information should not be divulged or released to anyone unless specifically authorized by this contract or its’ attached documents in accordance with the contracted services. Failure to comply with applicable statutes and regulation can result in the termination of this contract and civil and criminal penalties, including fines and imprisonment. All suspected or actual breeches of privacy and confidentiality should be reported immediately to the Contracting Officer, Contracting Officer’s Representative (COR) or the Facility Privacy Officer.

Certification & Accreditation (C&A) requirements do not apply and a Security Accreditation Package is not required. If the contractor opts to use a computer or computer system for processing contract documents, the requirements of FIPS 140-2 for encryption of contract documents must be met.

SYSTEM FOR AWARD MANAGEMENT (SAM):

Federal Acquisition Regulations require that federal contractors register in the System for Award Management (SAM) database at http://www.sam.gov and enter all mandatory information into the system. Award cannot be made until the contractor has registered. Bidders are encouraged to ensure that they are registered in SAM prior to submitting their bid.

ADDITIONAL VETBIZ INFORMATION:

(a) Eligibility of SDVOSBs continues to be governed by the Small Business Administration regulations, 13 CFR subparts 125.8 through 125.13, as well as the FAR, except where expressly directed otherwise by the VAAR, and 38 CFR verification regulations for SDVOSBs.

(b) At the time of submission of bid, the Bidder must represent to the contracting officer that it is a—

(1) SDVOSB concern

(2) Small business concern under the North American Industry Classification System (NAICS) code assigned to the acquisition; and

(3) Verified for eligibility in the VIP database.

(c) A joint venture may be considered an SDVOSB or VOSB concern if

(1) At least one member of the joint venture is an SDVOSB or VOSB concern, and makes the representations in paragraph (b) of this section;

(2) Each other concern is small under the size standard corresponding to the NAICS code assigned to the procurement;

(3) The joint venture meets the requirements of paragraph 7 of the size standard explanation of affiliates in FAR 19.101; and

(4) The joint venture meets the requirements of 13 CFR 125.15(b), modified to include Veteran-owned small businesses where this CFR section refers to SDVOSB concerns.

(d) Any SDVOSB or VOSB concern (nonmanufacturer) must meet the requirements in FAR 19.102(f) to receive a benefit under this program.

JOINT VENTURES - See 13 C.F.R. § 121.103:

(h) Affiliation based on joint ventures: A joint venture is an association of individuals and/or concerns with interests in any degree or proportion consorting to engage in and carry out no more than three specific or limited-purpose business ventures for joint profit over a two-year period, for which purpose they combine their efforts, property, money, skill, or knowledge, but not on a continuing or permanent basis for conducting business generally.

This means that a specific joint venture entity generally may not be awarded more than three contracts over a two-year period, starting from the date of the award of the first contract, without the partners to the joint venture being deemed affiliated for all purposes. Once a joint venture receives one contract, SBA will determine compliance with the three awards in two years rule for future awards as of the date of initial bid including price.

As such, an individual joint venture may be awarded more than three contracts without SBA finding general affiliation between the joint venture partners where the joint venture had received two or fewer contracts as of the date it submitted one or more additional bids, which thereafter result in one or more additional contract awards. The same two (or more) entities may create additional joint ventures, and each new joint venture entity may be awarded up to three contracts in accordance with this section. At some point, however, such a longstanding inter-relationship or contractual dependence between the same joint venture partners will lead to a finding of general affiliation between and among them.

For purposes of this provision and in order to facilitate tracking of the number of contract awards made to a joint venture, a joint venture must be in writing and must do business under its own name, and it may (but need not) be in the form of a separate legal entity, and if it is a separate legal entity it may (but need not) be populated (i.e., have its own separate employees). SBA may also determine that the relationship between a prime contractor and its subcontractor is a joint venture, and that affiliation between the two exists, pursuant to paragraph (h)(4) of this section.

NOTICE TO PROCEED (NTP):

A Notice to Proceed (NTP) shall be issued after award of a fully executed contract. The NTP date and time are “to be determined” after award to a successful Bidder. Primary factor in determination to issue NTP shall be the Prime Contractor submission of, and the Government review and approval of both Payment and Performance Bonds, if requested, both of which are enforceable legal documents.

SOLICITATION AUTHORITY:

This Invitation for Bid (IFB) is conducted under FAR Part 14 – Sealed Bid procedures, where firms are Bidders and shall submit a bid. References to RFP and Bidder’s, in technical specification sections and technical drawings are strictly coincidental and strictly for purposes of administrative convenience and efficiency. The Contracting Officer exercises final authority over all aspects of this IFB and any resultant contract.

SOLICITATION CLAUSES AND PROVISIONS:

SOLICITATION DEFINITIONS:

Throughout this solicitation, and any resultant contract, the terms Contracting Officer's Technical Representative (COTR), Contracting Officer's Representative (COR), Project Engineer (PE), Resident Engineer (RE), and Project Manager (PM), all denote the same engineering official and may be used equally and interchangeably as described by the Contracting Officer (CO).

SMOKE AND CARBON MONOXIDE MONITORING REQUIREMENTS:

Contractor and its employees, as well as subcontractors and their employees, shall adhere to VA, VHA, and VAPAHCS Policies for smoke and carbon monoxide monitoring requirements. They are available upon request from COR.

WORK DAYS AND HOURS:

The Contractor is required to conduct construction services during normal business hours of 8:00 am to 4:30 pm, Monday through Friday, excluding federal government holidays, unless approved by the COR. If a shutdown is required to perform this work, a 30-day advance notification is required. It is the intent of the Palo Alto VA Medical Center that the work is to be completed within 265 days from the issuance of the Notice to Proceed (NTP). The Contractor shall not conduct construction services when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings. Access to the work site may be restricted to these hours and days.

SECURITY OF DOCUMENTS:

Security requirements addressing the destructions of records, drawings, and specifications by the Contractor shall be accomplished in accordance with VA Directive 6371 dated 02 May 2008.

SECURITY REQUIREMENTS (GENERAL):

1. All personnel employed by the contractor in the performance of work, issued under this contract, or any representative of the contractor shall abide by all security instructions and directives of the Department of Veterans Affairs. Employees are responsible for safeguarding all government property provided for contractor use.

1. At the close for each work period, government facilities, equipment and materials shall be secured, lights, and all doors and window secured.

1. The contractor and, as applicable, subcontractor shall not employ persons for work on this contract if such employee is identified as a potential threat to the health, safety, security, general well-being or operational mission of the station/campus and its population, nor shall the contractor or subcontractor employ persons under this contract who have an outstanding criminal warrant as identified during background checks.

1. Contractors shall ensure their employees and those of their subcontracts have the proper credentials allowing them to work in the United States. Employees and subcontractors later found to be undocumented or illegal aliens will be remanded to the proper authorities.

I.2 52.227-1 AUTHORIZATION AND CONSENT (DEC 2007)

(a) The Government authorizes and consents to all use and manufacture, in performing this contract or any subcontract at any tier, of any invention described in and covered by a United States patent—

(1) Embodied in the structure or composition of any article the delivery of which is accepted by the Government under this contract; or

(2) Used in machinery, tools, or methods whose use necessarily results from compliance by the Contractor or a subcontractor with (i) specifications or written provisions forming a part of this contract or (ii) specific written instructions given by the Contracting Officer directing the manner of performance. The entire liability to the Government for infringement of a United States patent shall be determined solely by the provisions of the indemnity clause, if any, included in this contract or any subcontract hereunder (including any lower-tier subcontract), and the Government assumes liability for all other infringement to the extent of the authorization and consent hereinabove granted.

(End of Clause) I.5 52.204-23 PROHIBITION ON CONTRACTING FOR HARDWARE, SOFTWARE, AND SERVICES DEVELOPED OR PROVIDED BY KASPERSKY LAB AND OTHER COVERED ENTITIES (JUL 2018)

(a) Definitions. As used in this clause—Covered article means any hardware, software, or service that—

(1) Is developed or provided by a covered entity;

(2) Includes any hardware, software, or service developed or provided in whole or in part by a covered entity; or

(3) Contains components using any hardware or software developed in whole or in part by a covered entity.

Covered entity means—

(1) Kaspersky Lab;

(2) Any successor entity to Kaspersky Lab;

(3) Any entity that controls, is controlled by, or is under common control with Kaspersky Lab; or

(4) Any entity of which Kaspersky Lab has a majority ownership.

(b) Prohibition. Section 1634 of Division A of the National Defense Authorization Act for Fiscal Year 2018 (Pub. L. 115–91) prohibits Government use of any covered article. The Contractor is prohibited from—

(1) Providing any covered article that the Government will use on or after October 1, 2018; and

(2) Using any covered article on or after October 1, 2018, in the development of data or deliverables first produced in the performance of the contract.

(c) Reporting requirement. (1) In the event the Contractor identifies a covered article provided to the Government during contract performance, or the Contractor is notified of such by a subcontractor at any tier or any other source, the Contractor shall report, in writing, to the Contracting Officer or, in the case of the Department of…
