4. IDENTIFY THE AUTHORITY AND SUPPORTING RATIONALE (see 8.405 6(a)(1)(i)(A), (B), and
(C) or 8.405 6(b)), AND IF APPLICABLE, A DEMONSTRATION OF THE PROPOSED CONTRACTOR’S UNIQUE
QUALIFICATIONS TO PROVIDE THE REQUIRED SUPPLY ORSERVICE.
Items peculiar to one manufacturer:
Direct Replacement, Compatibility, and Single Source details:
The GI endoscopy equipment is mandated by VHA Endoscopes Integrated Procurement Team Standardization of Upper/Lower Gastrointestinal Endoscopes dated November 16, 2010 (See DUSHOM memo in eCMS briefcase).
The endoscopes required are currently direct replacements for existing equipment. At the start of the lease, factory new models replace existing models of equipment. This ensures that the Seattle VA can maintain the highest state of the art operation, functionality and quality of patient care for our veteran patients and ensure that Seattle VA patient care stays commensurate with or higher than the surrounding community and current standards of care.
The equipment must communicate and be directly and seamlessly compatible in form, fit and function with the existing Olympus equipment already owned by the Seattle VA. It must connect, interface, and
VHAPM Part 808.405 6 Limiting Sources Original Date: 08/30/2017 Revision 01 Eff Date: 04/23/2018 communicate seamlessly with the existing Olympus components without the use of adapters or other interfacing connectors. In order for this to occur, each piece of equipment must be specifically designed for direct connection and operation with Olympus equipment, and this is only possible by using Olympus equipment.
Selection of Olympus as the sole source of the equipment is required to ensure the highest level of patient safety and to minimize potential use errors and the resulting litigation caused by alternate (non Olympus) equipment as well as potentialoperational interface errors and patient incident risks caused by the use of after market interfaces.
5. DESCRIBE WHY YOU BELIEVE THE ORDER REPRESENTS THE BEST VALUE CONSISTENTWITH FAR 8.404(d) TO
AID THE CONTRACTING OFFICER IN MAKING THIS BEST VALUE DETERMINATION:
FSS pricing has already been determined to be fair and reasonable. Discounted pricing off the FSS price will be requested in the RFQ and a comparison of proposed prices to historical prices paid will be performed.
6. DESCRIBE THE MARKET RESEARCH CONDUCTED AMONG SCHEDULE HOLDERS AND THE RESULTS OR A
STATEMENT OF THE REASONMARKET RESEARCHWAS NOTCONDUCTED:
The station has investigated other vendors in the past. The key competitor that could provide all the required range of endoscopes was Pentax. A trial of Pentax endoscopes was performed, and the clinicians determined that they did not provide the level of operability, resolution, and function needed to perform their clinical duties, ensure quality of care commensurate with the current standard of care, reduce risk of patient incidents, and maintain the same level of patient outcomes as with the Olympus brand endoscopes. Also, all ancillary items utilized with the Olympus scopes would need to be replaced to Pentax at additional cost, which is not in the government best interest.
7. ANY OTHER FACTS SUPPORTING THEJUSTIFICATION:
If we were purchasing the items, we could obtain them from Olympus’ SDVOSBpartner, however only Olympus has the capability to offer leased items.
8. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS THAT LED TO THE RESTRICTED CONSIDERATION BEFORE ANY SUBSEQUENT ACQUISITION FOR
THE SUPPLIES OR SERVICES IS MADE:
Standardized medical equipment is a bona fide clinical need for patient safety. Future changes in available technologies or standards will require review and approval from the facility Clinical Products Review Committee (CPRC). However, market research will continue to be completed for all subsequent acquisitions to ensure to promote competition from authorizedsources.
9. REQUIREMENTS CERTIFICATION: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge. I understand that processing of this limited sources justification restricts consideration of Federal Supply Schedule contractors to fewer than the number required by FAR Subpart 8.4.
