Combined Synopsis/Solicitation for Sterile Processing Workstation and Borescopes I. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) subpart 12.6, “Streamlined Procedures for Evaluation and Solicitation for Commercial Items,” as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested, and a written solicitation document will not be issued.

II. This is a Request for Quote (RFQ) Solicitation number 36C25925Q0483. The government anticipates awarding a firm-fixed price contract resulting from this solicitation.

III. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2022-08.

IV. This acquisition is 100% SDVOSB set-aside. The North American Industry Classification System (NAICS) code is 339112 Medical Equipment and Supplies Manufacturing with a small business size of 1000 Employees.

V. The PSC is 6515 Medical and Surgical Instruments, Equipment and Supplies.

VI. Department of Veterans Affairs, Network Contracting Office 19 Located at 6162 S. Willow Drive, Suite 300, Greenwood Village, Colorado 80111, in support of Cheyenne VA Medical Center 2360 East Pershing Blvd. Cheyenne, WY 82001-5356 is seeking to procure services in accordance with the Statement of Work and price schedule.

VII. All interested parties shall provide quotations for products in accordance with the Attachment 1 - Statement of Work (SOW). Attachments A and B are also attached for reference.

VIII. The Contractor shall price for Products as detailed in Attachment 2 - Price Schedule.

IX. All interested vendors shall provide Brand Name or Equal quotations for the following schedule:

ADDENDUM to FAR 52.212-1 INSTRUCTIONS TO OFFERORS—COMMERCIAL ITEMS Provisions that are incorporated by reference (by Citation Number, Title, and Date), have the same force and effect as if they were given in full text. Upon request, the Contracting Officer will make their full text available. The version of FAR 52.212-1 in the addendum is tailored for Simplified Acquisition Procedures and supersedes the current version of FAR 52.212-1 contained in the FAR.

(a)Gray market items are Original Equipment Manufacturers (OEM) goods sold through unauthorized channels in direct competition with authorized distributors. This procurement is for new OEM medical supplies, medical equipment and/or services contracts for maintenance of medical equipment (i.e. replacement parts) for VA Medical Centers. No remanufactures or gray market items will be acceptable.
(b)Offeror shall be an OEM, authorized dealer, authorized distributor or authorized reseller for the proposed medical supplies, medical equipment and/or services contracts for maintenance of medical equipment (i.e. replacement parts), verified by an authorization letter or other documents from the OEM, such that the OEM’s warranty and service are provided and maintained by the OEM. All software licensing, warranty and service associated with the medical supplies, medical equipment and/or services contracts for maintenance of medical equipment shall be in accordance with the OEM terms and conditions.
(c)The delivery of gray market items to the VA in the fulfillment of an order/award constitutes a breach of contract. Accordingly, the VA reserves the right enforce any of its contractual remedies. This includes termination of the contract or, solely at the VA’s election, allowing the Vendor to replace, at no cost to the Government, any remanufactured or gray market item(s) delivered to a VA medical facility upon discovery of such items.
(d)Offerors providing an “or equal” product(s) must adhere to the terms in FAR 52.211-6. If an item in this solicitation is identified as “brand name or equal,” the purchase description reflects the characteristics and level of quality that will satisfy the Government’s needs. The salient physical, functional, or performance characteristics that “equal” products must meet are specified in the solicitation. To be considered for award, offers of “equal” products, including “equal” products of the brand name manufacturer, must—
i.Meet the salient physical, functional, or performance characteristic specified in this solicitation.
ii.Clearly identify the item by:
1.Brand name, if any and
2.Make or model number
iii.Include descriptive literature such as illustrations, drawings, or a clear reference to previously furnished descriptive data or information available to the Contracting Officer; and
iv.Clearly describe any modification the offeror plans to make in a product to make it conform to the solicitation requirements. Mark any descriptive material to clearly show the modification.

The contracting officer will evaluate “equal” products on the basis of information furnished by the offeror or identified in the offer and reasonably available to the contracting officer. The Contracting Officer is not responsible for locating or obtaining any information not identified in the offer. Unless the offeror clearly indicates in its offer that the product being offered is an “equal” product, the offeror shall provide the brand name product referenced in the solicitation

(e)Any award made as a result of this solicitation will be made on an All or Nothing Basis.
(f)State if quoted items are available and priced through offerors existing Government-wide Acquisition Contract (GWAC), GSA Multiple Award Schedule (MAS) contract, or VA-wide Acquisition Contract.
(g)If the acquisition is set-aside for SDVOSBs/VOSBs, their socioeconomic status must be VetCert verified and visible in the VA Vendor Information Pages (VIP): https://www.vip.vetbiz.gov/ at the time of quote submission AND award, or will be considered non-responsive, and will NOT be considered for award.
(h)Offerors are warned against contacting any VA personnel other than the Contracting Officer and Contract Specialist prior to placement of any award made resulting from this RFQ. If such contact occurs and found to be prejudicial to competing contactors, the offeror making such contact may be excluded from award considerations.
(i)All proprietary information shall be clearly and properly marked. If the Offeror submits annexes, documentation, attachments or the like, not specifically required by this solicitation, such will count against the Offeror’s page limitations unless otherwise indicated in the specific volume instructions below.
(j)All information shall be confined to the appropriate file. The offeror shall confine submissions to essential matters, sufficient to define the quote and provide an adequate basis for evaluation. Offerors are responsible for including sufficient details, in a concise manner, to permit a complete and accurate evaluation of each quote.
(k)Submission of quote shall include the following volumes: (I) Price, (II) Narrative and documentation to Support the General Standards of Responsibility

Volume I – Price - The offeror shall complete Attachment B – Price Schedule Volume II – General Standards of Responsibility – Offeror shall submit documentation as detailed in XI (d) i-iv and adhere to the terms in FAR 52.211-6. when quoting other than Brand Name (End of Addendum to 52.212-1)

OFFER SUBMITTAL INSTRUCTIONS:

Offeror shall:

1. Submit offers by Due Date/Time specified in section XVII. Late quotes shall not be considered.

1. Acknowledge all amendment acknowledgements as part of their offer/quote

1. Complete and submit Attachment 2 – Price Schedule with this offer.

1. Submit General Standards of Responsibility Documents as detailed in XI (d) i-iv and adhere to the terms in FAR 52.211-6 when quoting other than Brand Name.

1. Vendors must clearly identify what country of origin the product is manufactured.

1. Completed Attachment 3 – LOS 852.219-76 VA Notice of Limitations on Subcontracting – Certificate of Compliance for Services and Construction (Nov 2022) (DEVIATION).

Offers received that do not comply with the terms and conditions of the solicitation and/or have missing documentation may be considered non-compliant and eliminated from evaluation.

XII. The provision at 52.212-2 Evaluation – Commercial Items applies to this acquisition.

Addendum to 52.212-2 EVALUATION—SIMPLIFIED ACQUISITION PROCEDURES

(a) Basis of Award: The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The Government will evaluate offers based on price and other factors. Evaluation of quotes will be conducted utilizing Simplified Acquisition Procedures in accordance with FAR 13.106-2(b)(3), Evaluation of Quotations or Offers, using ca two (2) factor evaluation. Two (2) factor evaluation is the side by side pairwise comparison of quotes based on factors resulting in a Contracting Officer decision for the quote most beneficial to the Government. The Government reserves the right to consider a quotation other than the lowest price. Quotations may exceed minimum requirements of the solicitation. The Government reserves the right to select a quotation that provides a benefit to the Government that exceeds the minimum requirements of the solicitation but is not required to do so. Each offer must meet the requirements of the solicitation to be considered for evaluation.

Please read each section below carefully for the submittals and information required as part of the evaluation. Offers missing the requested information below, as well as the items listed in the Addendum to FAR 52.212-1, Instructions to Offerors, shall be considered non-compliant and may be removed from the evaluation process.

a. Non price Factor: General Standards of Responsibility – Offeror shall submit documents as detailed in XI (d) i-iv and adhere to the terms in FAR 52.211-6 when quoting other than Brand Name.

b. Price: The Government will evaluate the price schedule submitted by each offeror. Contractors shall submit Attachment B – Price Schedule. Firm fixed unit pricing shall include all labor, overhead, profit, materials, and associated costs of the like to provide product/services.

1. Pricing shall not be handwritten on Attachment B – Price Schedule to ensure pricing is legible.

2. The offeror agrees to hold the prices in its offer firm for 90 calendar days from the date specified for receipt of offers.

(b) Options - The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) Evaluation Process: The government anticipates selecting the best suited contractor from initial responses, without engaging in exchanges with contractors. Contractors are strongly encouraged to submit their best price in response to this RFQ. Once the government determines the contractor that is the best‐suited (i.e., the apparent successful contractor), the government reserves the right to communicate with only that contractor to address any remaining issues, if necessary, and finalize a task order with that contractor. These issues may include technical capability and price but will not include relaxing the Government’s requirement or the basis on which offerors proposed. If the parties cannot successfully address any remaining issues, as determined pertinent at the sole discretion of the government, the government reserves the right to communicate with the next best‐suited contractor based on the original analysis and address any remaining issues.

(d) Acceptance of Offer. A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), without negotiations after its receipt, unless a written notice of withdrawal is received before award.

In addition to information provided by FAR Provision 52.212-2 Evaluation- Commercial Items, the following evaluation approach will be used:

For each proposal received, the Government will evaluate the following:

· Non-price factor: General Standards of Responsibility

· Price Factor: Price Quotes will be evaluated in the following manner:

1. The lowest-priced quote will be identified and evaluated to determine if the quoted price exceeds the amount of funding available for the procurement.

2. If the quoted price does not exceed the amount of funding available for the procurement, the quoted price will be evaluated to determine if it is reasonable.

3. The contracting officer will then determine if the successful offeror is responsible in compliance with Federal Acquisition Regulations FAR 9.105-2.

4. If the quoted price is found to be reasonable and the offer is determined to be responsible, the non-price factor General Standards of Responsibility will be evaluated.

5. If the General Standards of Responsibility will meet the need of the government the responsible offeror who submitted the lowest-priced quote will be identified as the “successful offeror.”

6. If contract award cannot be made to the successful offeror, the contracting officer will evaluate the next lowest-priced quote following the procedures described above.

7. This process will continue until a contract award can be made, or the contracting officer determines that no contract award can be made.

The contracting officer may find all quotes not acceptable and cancel the solicitation if the lowest-priced quote exceeds the amount of funding available for the procurement. The contracting officer may likewise find a quote under evaluation, as well as all remaining quotes, not acceptable and cancel the solicitation if the quote currently under evaluation exceeds the amount of funding available for the procurement. The Government intends to evaluate quotes and award a contract without discussions with offerors. However, the Government reserves the right to conduct discussions at any time if determined by the contracting officer to be in the Government’s interest.

Offerors must complete annual representations and certifications electronically via the System for Award Management (SAM) website located at https://www.sam.gov/portal in accordance with FAR 52.212-3, “Offerors Representations and Certifications–Commercial Items.” If paragraph (j) of the provision is applicable, a written submission is required.

XIII. FAR 52.212-4 – CONTRACT TERMS AND CONDITIONS – COMMERIAL ITEMS (November 2021), applies to this requirement.
