(viii) 52.212-2, Evaluation--Commercial Items applies to this acquisition

ADDENDUM to FAR 52.212-2 EVALUATION—COMMERCIAL ITEMS:

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government considering price and other factors.

(b) The following factors shall be used to evaluate quotations:

Factor 1. Technical Capability Factor 2. Price

(c) Evaluation Approach. The Government will evaluate quotations using the comparative evaluation process outlined in FAR 13.106-2(b)(3), where quotations will be compared to one another to determine which provides the best benefit to the Government. The Government reserves the right to consider a quotation other than the lowest price that provides additional benefit(s). Quotations may exceed minimum requirements of the solicitation. The Government reserves the right to select a quotation that provides benefit to the Government that exceeds the minimum requirements of the solicitation, but is not required to do so. Each response must meet the minimum requirements of the solicitation. The Government is not requesting or accepting alternate quotations. The evaluation will consider the following:

Factor 1. Technical Capability: The quotation will be evaluated to the extent to which it can meet and/or exceed the Government’s requirements as outlined in the solicitation and based on the information requested in the instructions to quoters section of the solicitation. The candidate education, experience, endorsement and resume will be review as part of responsibility determination for meeting technical requirement

Factor 2. Price: The Government will evaluate the price by adding the total of all line-item prices, including all options. The Government may use various price analysis techniques and procedures to make a price reasonableness determination. Offers that do not meet or exceed the technical capability of the Government requirement shall not be selected regardless of price.

(d) Options. The Government will evaluate quotations for award purposes by adding the total price for all options to the total price for the basic requirement. This includes options under FAR 52.217-8, Option to Extend Services, which applies to this solicitation. Evaluation of options under FAR 52.217-8 will be accomplished by adding six months of the quoter's price for the last potential period of performance under this contract to the quoter's total price. For example, if the contract includes option periods that are exercisable under FAR 52.217-9, the quoter's total price for the purpose of evaluation will include the base period, all option periods, and an additional six months of the last option period. Quoters must price only the base and option periods specified in the contract line item numbers (CLINs), and shall not submit a price for the potential six-month extension of services under FAR 52.217-8. The Government reserves the right to exercise the option under FAR 52.217-8 before the end of any of the contractor's performance periods and will be exercised at the price and/or rates in effect at the time the clause is exercised. Evaluation of options shall not obligate the Government to exercise the option(s).

Offerors must complete annual representations and certifications electronically via the System for Award Management (SAM) website located at https://www.sam.gov/portal in accordance with FAR 52.212-3, “Offerors Representations and Certifications–Commercial Items.” If paragraph (j) of the provision is applicable, a written submission is required. This endorsement must come from the official national endorsing authority of their faith group or denomination. The faith group must be listed on the official Ecclesiastical Endorsing Organizations list maintained by The National VA Chaplain Service.

2. Education—Candidates must possess a Master of Divinity degree, normally based upon completion of three years of graduate study or equivalent educational qualifications.

3. The contractor position is decentralized; the Medical Center Director must approve the proposed Contractor. In an emergency, the VA can accept the employment application/resume and a declaration that the Contractor is in good and regular standing with his/her denomination.

SPECIAL CONTRACT REQUIREMENTS:

1. SERVICE: In a time of need or emergency, as determined by the VA, the local clergy contractor agrees to provide services to meet and fulfill the needs of the Veteran and to be available for call-back as necessitated by the needs of the VA. Mutually acceptable modifications shall be attached to this contract. The practices of the VA Chaplain Integrated Clinical Community will guide the Contractor.

2. TERM OF CONTRACT: This contract, when accepted by the local clergy contractor and the VA Contracting Officer, shall be effective from the date of its execution for a period of one (1) base year with the option to extend for (4) option years.

3. WORK HOURS: The services covered by this contract shall be furnished by the local clergy contractor as defined herein. The local clergy contractor will not be required to provide such services on a national holiday or during non-working hours except in case of an emergency or special request mutually agreed upon. However, this policy does not absolve the local clergy contractor from providing services on religious holidays, even if such holidays coincide with national holidays.

a. The following terms have the following meanings:

i. Work hours - Monday through Friday between 7:30 a.m. and 4:00 p.m.

ii. National Holiday - the eleven holidays observed by the Federal Government, i.e., New Year's Day, Washington's Birthday, Martin Luther King's Birthday, Memorial Day, Juneteenth Day, Independence Day, Labor Day, Columbus Day, Veterans' Day, Thanksgiving and Christmas and any other day specifically declared by the President of the United States to be a national holiday.

Such personnel shall not be considered VA employees for any purpose.

5. PERFORMANCE OF DUTIES: The local clergy contractor will perform all duties in accordance with DM&S VA Manual 1111and VHA Handbook 1111.02 http://vaww.va.gov/vhapublications/ViewPublication.asp?pub_ID=1720

VA and its Pastoral Care Program will provide directions for the local clergy contractor.

a. Record-Keeping System—The local clergy contractor: The local clergy contractor must establish a record-keeping system for Contractor hours worked. The contractor is responsible for paying for any leave, including sick leave, holiday, or vacation time.

b. VA Health Care System/Recordkeeping: The Contracting Officer Representative (COR) will designate appropriate VA personnel to monitor Contractor employee work hours/services through one or a combination of the following mechanisms:

i. Departments being served will monitor the local clergy contractor's work hours through time and attendance logs similar to VA staff positions to ensure that the VA Health Care System has received the services called for in the contract. The COR will be responsible for verifying contract compliance. Any incidents of Contractor noncompliance, as evidenced by monitoring procedures, will be forwarded immediately to the Contracting Officer.

ii. Associate Director for Patient Care Services/Pastoral Care office reviews monitoring data. An internal time-keeping form is maintained and reviewed for the total number of hours worked per month against monthly average hours. Part-time personnel’s care is reviewed against their VA tour of duty to verify that the services were received.

iii. Documentation of services performed will be reviewed before certifying payment. The COR will perform periodic spot checks and document with the using service to ensure records monitoring. VA will pay only for services actually performed at the VA and in strict accordance with the price schedule/costs shown in the item schedule. Contract monitoring and recordkeeping procedures will be sufficient to ensure proper payment and allow audit verification that services were provided.

iv. Monthly invoices are generated for VA Fiscal Services, which forwards them to the COR for review. The COR verifies with Pastoral Care Service that services were actually performed against the schedule and logs. Only after verification are invoices certified for payment.

v. The using service, through the COR, will annually provide a written statement to the Contracting Officer that includes a summary of the Contractor's action and a statement that all requirements of the contract have been fulfilled as agreed. This summary evaluation will be submitted 60 days before the contract's expiration (and before the election of option year renewals, if applicable).

vi. A Contractor’s employee may not certify bills for payment.

6. Designation of Contract Representative: A VA Health Care System representative of the Contracting Officer. Will be designated to represent the Contracting Officer in furnishing technical guidance and advice regarding work being performed under this contract. The preceding is not to be construed as authorization to interpret or furnish advice and information to the Contractor relative to the financial or legal aspects of the contract. Enforcement of these segments is vested in and is the responsibility of the Contracting Officer.
