STATEMENT OF WORK

KERRVILLE VA MEDICAL CENTER CONSTRUCTION PROJECT 671A4-15-131 REPLACE ELEVATORS P1-P4 PURPOSE: This project will replace and/or refurbish elevators P1, P2, P3, and P4 and their associated equipment at the Kerrville VA Medical Center. These units are around 30 to 35 years old and have surpassed their normal life expectancy. One elevator has been out of service for over a year.

SCOPE OF WORK - BASE BID:

Visit site prior to bid to be fully acquainted with existing site conditions and scope of work. Field verify prior to bid the existing elevators and all associated devices and equipment. The contractor shall furnish all labor, materials, equipment, supervision and any/all other necessary provisions to replace and/or refurbish elevator interior finishes, hoistway lobby assemblies, elevator doors, elevator machine room equipment, elevator controls, signals, and associated assemblies for hydraulic elevators P1, P2, P3 and P4 at the Kerrville VA Medical Center, 3600 Memorial Blvd., Kerrville, TX 78028 and in accordance with other contract documents.

The contractor is required to provide complete and working elevator systems that have been fully adjusted, tested, commissioned and shown to meet the highest industry, code, and VA standards. This includes following all VA guidelines for infection control, safety, recycling, security, interim life safety, quality, and other requirements set forth in the contract documents. Work will be scheduled so that at least one elevator from each pair will be fully operable and available for normal patient, staff, and visitor usage always.

It will be the intent of the project to replace all major operating components of each elevator, including but not limited to:

1. Machine Room components: power unit(s), valve, muffler, oil line, shut off valve, controller, motor starter

2. Signal Fixtures: Elevator cab and vestibule

3. Door Operator: replace with a closed loop type

4. Hoistway switches and accessories

5. Hoistway wiring and travelling cable

6. Elevator hoistway door panels [retain door frames in place]

7. Interlock assembly

8. Elevator cab finishes-per drawings and project specification manual This work will include, but not be limited to, the following:

A. Demolition of all components

1. Elevator controls

2. Conduit and wire back to the source panel

3. Doors, rails, platforms, counterweight and other items

4. Call panel, light and mechanical room items related to elevator

B. New work installation, adjustment, and commissioning

1. New platform and cabin

2. New controls

3. New electrical & mechanical connections and equipment

4. New low voltage control system tie into existing

5. New call buttons arrows at each level

6. New Rails and brakes

7. Patch existing holes in shaft walls

8. New climate control for mechanical equipment rooms.

The contractor will hire highly qualified, experienced, and licensed professionals to accomplish all tasks required. Licensed HVAC, plumbing, electrical, and fire suppression professionals will be hired where appropriate. Licensed elevator technicians for all elevator related work and licensed commissioning agents to verify and document that the highest industry and VA standards have been met are also required.

ADDITIVE ALTERNATE #1:

Add Alt. #1: In lieu of refurbishment of the elevator hoistway
entrance frames (lobby-side) at each elevator opening, replace frames
with new stainless-steel frames (see Specification 14 24 00 “Electric
Hydraulic Elevator Renovation” paragraph 2.35). Provide new electric
distribution system to the elevator machine room per drawing ES1.1.

SUBCONTRACTORS

The Contractor shall be responsible for obtaining and coordinating the services of all third-party Contractors performing other services on site and other entities as part of the contract to ensure the expected quality, timely delivery, and documented final product. O&M Manuals, As-Built drawings in CAD and PDF, applicable permits, installation, testing, and commissioning are also required.

SECURITY

All contractors shall obtain and wear a security badge in plain sight above the waist always. Contractors found without a badge will be immediately removed from VA property by VA Police.

TUBERCULOSIS(TB)

Construction contractor is responsible for TB testing of all workers scheduled to be on-site at the VA prior to the start of work. On-site workers will provide the VA Infection Control Nurse a copy of the TB test at the time of the infection control training provide by the VA. TB test must be within 90 days prior to assignment. Coordinate with the VA COR.

INFECTION CONTROL TRAINING

Construction contractor is responsible for all workers scheduled to be on-site at the VA to take the mandatory VA provided Infection Control Training prior to the start of work. The training is held in room 0023 located in the basement floor of Audie Murphy Hospital every Tuesday at 10:00 AM and at 10:00 AM every Thursday in Kerrville. All workers will provide the TB test results at the time of this training to the Infection Control Nurse. Training sticker will be given upon completion and placed on the backside of the security badge. Training sticker expires on September 30th of every year and must be retaken.

HOURS OF OPERATION

Normal hours of operation for VA sites are 8:00AM to 4:30 PM Monday through Friday except for Federal Holidays. If the Contractor desires to work on Saturday, Sunday, holidays, or outside the project site’s normal working hours the contractor must submit a written request for approval to the VA-COR at least five (5) working days prior to the proposed start of such work.

OTHER DELIVERABLES

Base Bid Period of Performance: 330 Calendar days after Notice to Proceed.

Base Bid Plus Add Alt. #1 Period of Performance: 360 Calendar days after Notice to Proceed.

Performance and Payment Bonds: Due 10 Calendar days after Notice of Award Proof of Insurance: Due 10 Calendar days after Notice of Award Commissioning Plan: The contractor shall appoint a Commissioning Agent to develop a Commissioning Plan as detailed in the Project Specification Manual. This plan will outline, in detail, a quality control process developed to meet the VA’s project requirements (as set forth in the contract documents) for this specific project. The Commissioning Agent shall develop a Commissioning Plan and shall furnish to VA for review no later than 45 calendar days after the receipt of Notice to Proceed. The plan shall identify personnel, procedures, control, instructions, tests, records, and forms to be used. VA will consider an interim plan for the first 45 calendar days of operation. Installation will be allowed to begin only after acceptance of the Commissioning Plan or acceptance of an interim plan applicable to the feature of the work to be started. Work outside of the features of the work included in an accepted interim plan will not be permitted to begin until acceptance of a Commissioning Plan or another interim plan containing the additional features of the work to be started. After acceptance of the Commissioning Plan, the Commissioning Agent shall notify the Contracting Officer Representative (COR) in writing of any proposed change. Proposed changes are subject to acceptance by the Contracting Officer.

Safety Plan (APP): Contractor shall develop and implement a Comprehensive safety plan (Accident Prevention Plan) to eliminate injuries occurring relative to providing the design and installation services for this project. Contractor shall furnish to VA for review no later than 15 calendar days after the receipt of notice to proceed. The plan shall also describe how final system installation will meet all applicable requirements of NFPA30 and NFPA30A. Construction/Renovation work will be allowed to begin only after VA’s acceptance of the Safety Plan. Contractor is responsible for providing enough project lead time to allow for VA review of Safety Plan before acceptance. The Department of Labor OSHA requires that all Contractors involved in installation on VA owned or leased property comply with the Incorporation of General Industry Safety and Health Standards applicable to Installation Work and Technical Amendments, Final Rule 29 CFR Parts 1910 and 1926 as published in the Federal Register Volume 58, No. 124, June 30, 1993. In addition, any Contractor that performs construction type work on any VA project as defined by the Scope of the referenced regulation is required to; (1) Provide and maintain his own protective equipment and devices, etc.; and (2) Require all sub-contractors used on site to follow these same provisions in the regulation. Contractor shall provide OSHA 10 hr. and OSHA 30 hr. training certificates.

Progress Reports: Shall be submitted electronically every week to the Contracting Officers Representative (COR) and address, at a minimum, the status of deliverables, project schedule, price and technical performance as they relate to the planned and actual work performed during the past two weeks, work planned for the following two weeks and address any open critical issues.

Permits: Contractor shall submit all permits associated with this project to the COR. This shall include permits necessary with City of Kerrville and local Fire departments. The contractor shall be responsible for coordination with these offices.

Operations and Maintenance Manuals (O&M): The Contractor shall provide three (3) complete sets of O&M manuals including a recommended spare parts list identifying components adequate for competitive supply procurement for operation and maintenance of the system. The O&M Manuals shall include maintenance and inspection for all equipment. A three-ring binder containing all the O&M and electronic files on CD-ROM shall be provided within the binder.

Operations and Maintenance Training: The Contractor shall provide on-site O&M training for the location which will consist of one (1) formal on-site training session to include but not limited to system operation, corrective and preventive maintenance and inspections. See Project Specifications Manual for details.

The contractor will coordinate with the COR the scheduling of any training classes in advance. The COR may require the class to be provided at the convenience of the VA Staff.

ACCEPTANCE

For the purposes of Warranty and payment for the work performed at a location, government “Acceptance” will be provided by the VA upon the completion of all the following:

a. The Contractor has demonstrated/verified that the elevators function as intended at commissioning. All punch list items identified during the commissioning have been resolved. All contract specifications have been fulfilled and/or completed.

b. The Contractor has provided O&M manuals and VA staff training.

c. The Contractor has provided Record drawings to include a CD with all as builds CAD files, one full set, and one Mylar full set.

CONFIDENTIALITY AND NON-DISCLOSURE

The preliminary and final deliverables and all associated working papers, application source code, and other material deemed relevant by the VA which has been generated by the contractor in the performance of this Order are the exclusive property of the U.S. Government and shall be submitted to the VA-COR after the contract.

The Contracting Officer (CO) will be the sole authorized official to release verbally or in writing, any data, the draft deliverables, the final deliverables, or any other written or printed materials pertaining to this contract. NO information shall be released by the contractor. Any request for information relating to this contract presented to the Contractor shall be submitted to the CO for response. Press releases, marketing material or any other printed or electronic documentation related to this project, shall not be publicized without the written approval of the CO.

To the extent that the work under this contract requires that the contractor be given access to proprietary business, technical or financial information belonging to the Government or other companies, the contractor shall treat such information as proprietary business sensitive and agrees not to appropriate such information to its own use or to disclose such information to third parties unless specifically authorized by the CO in writing. A mutually agreed to agreement for exchange of sensitive information or nondisclosure agreement may be required.

SPECIAL INSTRUCTIONS TO BIDDERS:

NOTICE: Information Technology (IT) Systems, Privacy & Records Management

1. Information System Officer, Information Protection: The contractor will not have access to VA Desktop computers they will not have access to online resources belonging to the government.

1. Privacy Officer: The Contractor will not have access to protected Patient Health Information (PHI) nor will they have capability of accessing patient information during the services provided to the VA and if removal of equipment from the VA is required, any memory storage device will remain in VA control and will not be removed from VA custody. All research data available for Contractor analysis is de-identified.

1. Records Manager:

a. Citations to pertinent laws, codes and regulations such as 44 U.S.C chapters 21, 29, 31 and 33; Freedom of Information Act (5 U.S.C. 552); Privacy Act (5 U.S.C. 552a); 36 CFR Part 1222 and Part 1228.

b. Contractor shall treat all deliverables under the contract as the property of the U.S. Government for which the Government Agency shall have unlimited rights to use, dispose of, or disclose such data contained therein as it determines to be in the public interest.

c. Contractor shall not create or maintain any records that are not specifically tied to or authorized by the contract using Government IT equipment and/or Government records.

d. Contractor shall not retain, use, sell, or disseminate copies of any deliverable that contains information covered by the Privacy Act of 1974 or that which is generally protected by the Freedom of Information Act.

e. Contractor shall not create or maintain any records containing any Government Agency records that are not specifically tied to or authorized by the contract.

f. The Government Agency owns the rights to all data/records produced as part of this contract.

g. The Government Agency owns the rights to all electronic information (electronic data, electronic information systems, electronic databases, etc.) and all supporting documentation created as part of this contract. Contractor must deliver sufficient technical documentation with all data deliverables to permit the agency to use the data.

h. Contractor agrees to comply with Federal and Agency records management policies, including those policies associated with the safeguarding of records covered by the Privacy Act of 1974. These policies include the preservation of all records created or received regardless of format [paper, electronic, etc.] or mode of transmission [e-mail, fax, etc.] or state of completion [draft, final, etc.].

i. No disposition of documents will be allowed without the prior written consent of the Contracting Officer. The Agency and its contractors are responsible for preventing the alienation or unauthorized destruction of records, including all forms of mutilation. Willful and unlawful destruction, damage or alienation of Federal records is subject to the fines and penalties imposed by 18 U.S.C. 2701. Records may not be removed from the legal custody of the Agency or destroyed without regard to the provisions of the agency records schedules.

j. Contractor is required to obtain the Contracting Officer's approval prior to engaging in any contractual relationship (sub-contractor) in support of this contract requiring the disclosure of information, documentary material and/or records generated under, or relating to, this contract. The Contractor (and any sub-contractor) is required to abide by Government and Agency guidance for protecting sensitive and proprietary information.

INSTRUCTIONS, CONDITIONS AND OTHER STATEMENTS TO BIDDERS/OFFERORS

To assure responsiveness of submitted bids, bidders shall follow the instructions contained herein. The instructions prescribe the format of the bid and describe the approach for development and submission of a complete bid package. Bidders are required to meet all solicitation requirements, including terms and conditions, representations and certifications. The contracting officer has determined there is a high probability of adequate price competition in this acquisition. Interested bidders shall be sole responsible for all costs associated with this solicitation including but not limited to the preparations of bids.

· Bids shall be: (1) submitted on the specified forms furnished by the Government or on copies of those forms to include all required signatures and (2) the person signing a bid shall initial each erasure or change appearing on any bid form(s).

· Bidders shall submit pricing for ALL bid items as required on the provided Section B Schedule of Prices/Description Bid Schedule. Failure to submit pricings for ALL bid items will result in the Bid Package being determined as ‘nonresponsive’ without further consideration.

The following documents shall be submitted to the Contracting Officer on the Bid Due Date at the time indicated on the SF 1442. Electronic bids transmitted through an electronic commerce method including but not limited to telegraph, fax, or email ARE NOT AUTHORIZED under this solicitation and WILL NOT be accepted. Only one (1) original hard (paper) document of the bid shall be submitted at the time of the bid opening. All sealed bids will be date and time stamped upon receipt and will only be opened at the bid opening at the prescribed date and time. Please ensure that the sealed envelope has the Project Name, Solicitation Number, Contracting Office Address, Bid Opening Date and Time evident on the envelope. The original hard documents of the bid shall be in a sealed envelope and arranged in the following order:

a) Completed SF 1442, pages 1 and 2, with required signatures and wither signed copies of all applicable amendments and/or completion of Acknowledgment of Amendments on page 2 in Block 19.

b) A Bid Bond/Guarantee is required and shall be submitted on Form SF24 for Bid Bond/Guarantee. Bid Bonds/Guarantee found non-compliant or omitted from the bid package shall result in a determination of ‘non-responsiveness’. See Clause 52.228-1 Bid Guarantee for additional information on the compliance with bid guarantee requirements.

c) Section B – Schedule of Prices/Description: ALL pricing shall be submitted on the provided Section B – Schedule of Prices/Description. The completed Section B Schedule must contain all requested pricing and shall be submitted with the complete bid package. All pricing must be completed in order to be determined responsive.

d) Offerors are required to be registered in both www.sam.gov/portal/public/SAM and with www.vetbiz.gov - Prior to Submission of a Bid/Offer.

Public Bid Opening Scheduled – Wednesday, July 25, 2018 @ 1:00 p.m. CDT – Bids/Offers shall be submitted in a ‘sealed envelope’ and delivered to the specified address, by means of FedEx, UPS, USPS, OR Hand Carried on the specified bid due date and time as set forth in the SF 1442 Solicitation Form on page 1, block 10 and block 13a. The bid opening shall be held on the specified date, time and location stated in the solicitation on page-1 of Form SF 1442, unless otherwise changed via an amended.

2.1 52.216-1 TYPE OF CONTRACT (APR 1984)

The Government contemplates award of a Firm-Fixed-Price contract resulting from this solicitation.

2.2 52.222-5 CONSTRUCTION WAGE RATE REQUIREMENTS—SECONDARY SITE OF THE WORK (MAY 2014) (a)(1) The offeror shall notify the Government if the offeror intends to perform work at any secondary site of the work, as defined in paragraph (a)(1)(ii) of the FAR clause at 52.222-6, Construction Wage Rate Requirements, of this solicitation.

(2) If the offeror is unsure if a planned work site satisfies the criteria for a secondary site of the work, the offeror shall request a determination from the Contracting Officer.

(b)(1) If the wage determination provided by the Government for work at the primary site of the work is not applicable to the secondary site of the work, the offeror shall request a wage determination from the Contracting Officer.

(2) The due date for receipt of offers will not be extended as a result of an offeror's request for a wage determination for a secondary site of the work.

2.3 52.222-23 NOTICE OF REQUIREMENT FOR AFFIRMATIVE ACTION TO ENSURE EQUAL EMPLOYMENT OPPORTUNITY FOR CONSTRUCTION (FEB 1999)

(a) The offeror's attention is called to the Equal Opportunity clause and the Affirmative Action Compliance Requirements for Construction clause of this solicitation.

(b) The goals for minority and female participation, expressed in percentage terms for the Contractor's aggregate workforce in each trade on all construction work in the covered area, are as follows:

These goals are applicable to all the Contractor's construction work performed in the covered area. If the Contractor performs construction work in a geographical area located outside of the covered area, the Contractor shall apply the goals established for the geographical area where the work is actually performed. Goals are published periodically in the Federal Register in notice form, and these notices may be obtained from any Office of Federal Contract Compliance Programs office.

(c) The Contractor's compliance with Executive Order 11246, as amended, and the regulations in 41 CFR 60-4 shall be based on (1) its implementation of the Equal Opportunity clause, (2) specific affirmative action obligations required by the clause entitled "Affirmative Action Compliance Requirements for Construction," and (3) its efforts to meet the goals. The hours of minority and female employment and training must be substantially uniform throughout the length of the contract, and in each trade. The Contractor shall make a good faith effort to employ minorities and women evenly on each of its projects. The transfer of minority or female employees or trainees from Contractor to Contractor, or from project to project, for the sole purpose of meeting the Contractor's goals shall be a violation of the contract, Executive Order 11246, as amended, and the regulations in 41 CFR 60-4. Compliance with the goals will be measured against the total work hours performed.

(d) The Contractor shall provide written notification to the Deputy Assistant Secretary for Federal Contract Compliance, U.S. Department of Labor, within 10 working days following award of any construction subcontract in excess of $10,000 at any tier for construction work under the contract resulting from this solicitation. The notification shall list the—

(1) Name, address, and telephone number of the subcontractor;

(2) Employer's identification number of the subcontractor;

(3) Estimated dollar amount of the subcontract;

(4) Estimated starting and completion dates of the subcontract; and

(5) Geographical area in which the subcontract is to be performed.

(e) As used in this Notice, and in any contract resulting from this solicitation, the "covered area" is Kerrville, TX 78028 (End of Provision)

2.4 52.225-10 NOTICE OF BUY AMERICAN REQUIREMENT—CONSTRUCTION MATERIALS (MAY 2014)

(a) Definitions. "Commercially available off-the-shelf (COTS) item," "construction material," "domestic construction material," and "foreign construction material," as used in this provision, are defined in the clause of this solicitation entitled "Buy American—Construction Materials" (Federal Acquisition Regulation (FAR) clause 52.225-9).

(b) Requests for determinations of inapplicability. An offeror requesting a determination regarding the inapplicability of the Buy American statute should submit the request to the Contracting Officer in time to allow a determination before submission of offers. The offeror shall include the information and applicable supporting data required by paragraphs (c) and (d) of the clause at FAR 52.225-9 in the request. If an offeror has not requested a determination regarding the inapplicability of the Buy American statute before submitting its offer, or has not received a response to a previous request, the offeror shall include the information and supporting data in the offer.

(c) Evaluation of offers.

(1) The Government will evaluate an offer requesting exception to the requirements of the Buy American statute, based on claimed unreasonable cost of domestic construction material, by adding to the offered price the appropriate percentage of the cost of such foreign construction material, as specified in paragraph (b)(3)(i) of the clause at FAR 52.225-9.

(2) If evaluation results in a tie between an offeror that requested the substitution of foreign construction material based on unreasonable cost and an offeror that did not request an exception, the Contracting Officer will award to the offeror that did not request an exception based on unreasonable cost.

(d) Alternate offers.

(1) When an offer includes foreign solicitation in paragraph (b)(2) of the clause at FAR 52.225-9, the offeror also may submit an alternate offer based on use of equivalent domestic construction material.

(2) If an alternate offer is submitted, the offeror shall submit a separate Standard Form 1442 for the alternate offer, and a separate price comparison table prepared in accordance with paragraphs (c) and (d) of the clause at FAR 52.225-9 for the offer that is based on the use of any foreign construction material for which the Government has not yet determined an exception applies.

(3) If the Government determines that a particular exception requested in accordance with paragraph (c) of the clause at FAR 52.225-9 does not apply, the Government will evaluate only those offers based on use of the equivalent domestic construction material, and the offeror shall be required to furnish such domestic construction material. An offer based on use of the foreign construction material for which an exception was requested—

(i) Will be rejected as nonresponsive if this acquisition is conducted by sealed bidding; or

(ii) May be accepted if revised during negotiations.

2.5 52.228-1 BID GUARANTEE (SEP 1996)

(a) Failure to furnish a bid guarantee in the proper form and amount, by the time set for opening of bids, may be cause for rejection of the bid.

(b) The bidder shall furnish a bid guarantee in the form of a firm commitment, e.g., bid bond supported by good and sufficient surety or sureties acceptable to the Government, postal money order, certified check, cashier's check, irrevocable letter of credit, or, under Treasury Department regulations, certain bonds or notes of the United States. The Contracting Officer will return bid guarantees, other than bid bonds—

(1) To unsuccessful bidders as soon as practicable after the opening of bids; and

(2) To the successful bidder upon execution of contractual documents and bonds (including any necessary coinsurance or reinsurance agreements), as required by the bid as accepted.

(c) The amount of the bid guarantee shall be 20 percent of the bid price or $3,000,000.00, whichever is less.

(d) If the successful bidder, upon acceptance of its bid by the Government within the period specified for acceptance, fails to execute all contractual documents or furnish executed bond(s) within 10 days after receipt of the forms by the bidder, the Contracting Officer may terminate the contract for default.

(e) In the event the contract is terminated for default, the bidder is liable for any cost of acquiring the work that exceeds the amount of its bid, and the bid guarantee is available to offset the difference.

2.6 52.233-2 SERVICE OF PROTEST (SEP 2006)

2.10 VAAR 852.233-70 PROTEST CONTENT/ALTERNATIVE DISPUTE RESOLUTION (JAN 2008)

(a) Any protest filed by an interested party shall:

(1) Include the name, address, fax number, and telephone number of the protester;

(2) Identify the solicitation and/or contract number;

(3) Include an original signed by the protester or the protester's representative and at least one copy;

(4) Set forth a detailed statement of the legal and factual grounds of the protest, including a description of resulting prejudice to the protester, and provide copies of relevant documents;

(5) Specifically request a ruling of the individual upon whom the protest is served;

(6) State the form of relief requested; and

(7) Provide all information establishing the timeliness of the protest.

(b) Failure to comply with the above may result in dismissal of the protest without further consideration.

(c) Bidders/offerors and contracting officers are encouraged to use alternative dispute resolution (ADR) procedures to resolve protests at any stage in the protest process. If ADR is used, the Department of Veterans Affairs will not furnish any documentation in an ADR proceeding beyond what is allowed by the Federal Acquisition Regulation.

REPRESENTATIONS AND CERTIFICATIONS

3.1 52.204-8 ANNUAL REPRESENTATIONS AND CERTIFICATIONS (JAN 2018)

(a)(1) The North American Industry Classification System (NAICS) code for this acquisition is 238290.

(2) The small business size standard is $15 Million.

(3) The small business size standard for a concern which submits an offer in its own name, other than on a construction or service contract, but which proposes to furnish a product which it did not itself manufacture, is 500 employees.

(b)(1) If the provision at 52.204-7, System for Award Management, is included in this solicitation, paragraph (d) of this provision applies.

(2) If the provision at 52.204-7 is not included in this solicitation, and the offeror is currently registered in the System for Award Management (SAM), and has completed the Representations and Certifications section of SAM electronically, the offeror may choose to use paragraph (d) of this provision instead of completing the corresponding individual representations and certifications in the solicitation.
