This project is being solicited as a Service Disabled Veteran Owned Small Business (SDVOSB) set aside.
Proposals received in response to this solicitation will be evaluated in accordance with procedures outlined in the Federal Acquisition Regulation FAR 15.101-1, Best Value - Tradeoff source selection process.
NOTE: The term offer and bid are interchangeable for this solicitation.
Those offerors not providing the documentation outlined in the "Instructions to Offerors" will be rated unacceptable to the terms of the solicitation. The NAICS code and size standard for this project is 238220 - Plumbing, Heating, and Air-conditioning Contractors, the size standard is $15.0 million.
Estimate of construction magnitude for this project is between $2 to $5 million.
There will be one site visit for this project by August 19, 2019 at 10:00 am CDT in Bldg 15 at Marion VA Medical Center, 2401 West Main St., Marion, IL 62959.

A.3 STATEMENT OF BID ITEM(S)
A. BID ITEM 1 (BASE BID):
Construction Performance Period is not to exceed 365 calendar days. Temporary trailers (SPS, Storage and Office) rental is not to exceed 9 months.
GENERAL CONSTRUCTION: Work includes general construction, alterations, walks, grading, necessary removal of existing systems and construction and certain other items required to remove and install air handlers, associated mechanical and electrical systems, install and remove temporary Sterile Processing Services (SPS) trailer, temporary mobile water storage trailer, VA supplied sterilizer equipment, temporary office trailer, temporary SPS storage trailer, associated corridor and utilities, removal and installation of new in duct humidification for Reusable Medical Equipment (RME) Storage Rooms. Installation of new dunnage for new rooftop AHU, ceiling replacements in building 1, 2, 38 and 42. Contractor to procure the services of the equipment manufacturer or equipment manufacturer designated representative to disconnect, relocate, reinstall, test, commission and service the equipment for duration of project. Relocation of equipment to include both from the bldg. 38 SPS area to the Mobile Sterilizer Trailer and back to Bldg 38 SPS area. Contact information for Equipment Manufacturer representatives is located below:
ELECTRICAL WORK: Work includes all labor, material, equipment and supervision to perform the required electrical construction work on this project including the Modification of the existing electrical system to power new HVAC and plumbing equipment including, Exhaust Fans, Chilled Water Pumps, Roof mounted Air Handling Unit and associated electrical components. Upgrade existing lighting throughout third floor space of SPS. Remove, clean, store and reinstall existing ceiling mounted devices. Provide new Lightning Protection for new equipment on roof. Provide temporary power and systems for Mobile SPS trailer, SPS storage trailer, office trailer and temporary corridor. Power to SPS trailer and temporary corridor shall be from the generator system on the equipment (EQ) branch. Power to the office trailer shall be normal power. New lighting, security devices, telecommunication devices, fire alarm devices will be provided to the temporary corridor, SPS storage, SPS and office trailer.
MECHANICAL WORK: Work includes all labor, material, equipment and supervision to perform the required Mechanical construction work on this project including replacing the existing AHU in the Building 38 mechanical penthouse with a new unit dedicated to the SPS area on the third floor. New unit will have access platform for access. The unit shall utilize hot and chilled water to temper 100% outdoor serving the space. New exhaust fans shall replace the existing fans serving SPS also as the fans and the AHU are beyond their useful life expectancy. New exhaust fans and the AHU shall be equipped with heat recovery coils for energy conservation. All existing supply and exhaust ductwork serving the SPS area shall be removed and replaced with new. All new “wet” exhaust ductwork shall be stainless steel. A new rooftop air conditioning unit shall be installed to serve the second-floor offices and first floor chapel. The unit shall utilize the existing ductwork currently serving those spaces however new variable air volume (VAV) boxes shall replace the existing. The rooftop unit shall be a single package VAV air conditioning unit with electric resistance heat. Satellite sterile storage rooms located in Buildings 1, 2, 38 and 42 are in need of humidification and pressurization. New VAV boxes with duct-mounted humidifiers are proposed for these spaces. Existing room-type humidifiers, where existing, will be replaced/converted for steam distribution within the duct work (providing the humidifier has adequate capacity). New humidifiers will be provided where none exist. All existing automatic temperature controls (ATC) shall be replaced with new direct digital controls (DDC) which shall be compatible with the existing Building Automation System (BAS). New HVAC system will be provided to the SPS storage trailer and temporary corridor.

PROJECT: 657A5-17-104, Install Ventilation Corrections for Sterile Processing LOCATION: Marion VA Medical Center, Illinois
1. PREPARATION AND SUBMITTAL OF PROPOSALS
a. GENERAL INFORMATION.
Selection of an offeror for contract award will be made on the basis of an assessment of each offeror’s response to the Request for Proposal (RFP). All proposals shall be subject to evaluation by a team of government personnel. The government reserves the right to award without discussions based upon the initial evaluation of the proposals. The proposals will be evaluated in accordance with the content provided in the solicitation. Using the Tradeoff process under the Best Value, in accordance with Federal Acquisition Regulation (FAR) Part 15.101-1, it may be in the best interest of the Government to consider award to other than the lowest priced offeror or other than the highest technically rated offeror. All evaluation factors other than price, when combined are approximately equal to price. Evaluations will be based on the following evaluation factors:

NOTE: Failure to comply with the RFP requirements will be grounds to eliminate the proposal from further consideration for contract award.
b. THE OFFER.
The submission of the documentation specified below will constitute the Offeror’s acceptance of the terms and conditions of the RFP, including the Plans & Specifications for the construction of this project. These instructions prescribe the format for the proposal, and describe the approach for the development and presentation of proposal data. These instructions are designed to ensure the submission of necessary information to provide for the understanding and comprehensive evaluation of proposals.
c. AWARD BASED ON INITIAL OFFERS.
Pursuant to clause 52.215-1 (included by reference), the Government intends to evaluate proposals and award a contract without discussions with offerors (except clarifications as described in FAR 15.306(a)). Therefore, the offeror’s initial proposal should contain the offeror’s best terms from a cost or price, and technical qualifications standpoint. The VA reserves the right to conduct discussions if the Contracting Officer later determines such discussions to be necessary.
d. NUMBER OF COPIES TO SUBMIT. Offerors shall submit a single package to the address shown in Block 8 of the Standard Form 1442. The package shall include both the original signed paper hard copies and a separate compact disc (CD) containing copies of the originally signed paper hard copies. The package shall include the following:

2. DOCUMENTS TO SUBMIT
Documents to be included in the proposal identified above shall consist of:
| a. | STANDARD FORM 1442. Submit the SF 1442 issued under this solicitation, with Blocks 10 (DUNS Number) and Blocks 14 through 20 properly filled-out by the Offeror. Include acknowledgment of any and all Amendments that may have been issued, either by: (1) listing them in Block 19 of the SF 1442, or (2) including copies of the Amendment document(s) (Standard Form 30) with Blocks 8 and 15 filled in and signed, or (3) including signed acknowledgement in the form of a separate letter that includes a reference to the solicitation and amendment numbers. NOTE: Failure to acknowledge any and all Amendments issued pursuant to this solicitation may be cause for rejection of your offer. |
| b. | OFFER GUARANTEE (BID BOND). In accordance with solicitation provision 52.228-1, Bid Guarantee, failure to furnish a bid guarantee, in the proper form and amount, by the deadline established for submitting offers, may be cause for rejection of the offer. | c. | DOCUMENTATION OF TECHNICAL ACCEPTABILITY. Proposals received in response to this solicitation will be evaluated in accordance with procedures outlined in Federal Acquisition Regulations (FAR) Part 15.101-1 for the Best Value – Tradeoff source selection process. |
The following NON-Price Evaluation Factors will be used as the basis for determining Technical Acceptability: Prime Contractor Construction Experience, Technical Construction Experience of Mechanical Subcontractor, Project Execution, Key Personnel, Past Performance and Prime Contractor’s Safety Plan.
NOTE: There is a realistic possibility that some offerors may choose to submit the same construction project as a qualifying example for both the past performance and the construction experience evaluation factors. This is not prohibited, but the supporting documentation must demonstrate that the submitted projects absolutely do comply with the specific minimal requirements, identified below, for each separate evaluation factor.

To be Technically Acceptable, Offerors should submit a minimum of three (3) construction projects for the Offeror that best demonstrates your experience on relevant projects that are similar in size, scope, and complexity to the RFP. The projects must demonstrate an Offeror’s construction experience as a prime construction contractor directly responsible to the owner and managing multiple subcontractors. For the purposes of this evaluation, a relevant project is further defined as “replacement of boilers, completed within a functioning hospital or VA hospital setting.
Project(s) should have a minimum value of $2,000,000.00 and be 100% complete. Projects submitted for the Offeror shall be completed within the past five (5) years of the date of issuance of this RFP. If the contract/work is incomplete or was completed more than five years prior to the date of submitting this proposal, it will not be deemed relevant and will not be considered.
A project is defined as a construction project performed under a single task order or contract. For multiple award and indefinite delivery/indefinite quantity type contracts, the contract as a whole shall not be submitted as a project; rather Offerors shall submit the work performed under a task order as a project.
Offeror’s submission should include at a minimum:
· Provide the Project Title and Description, Project Location (Physical Address); Contract Type (Example: Design Build, Design Bid Build).
· Provide the project owner name and telephone number of the owner’s contact person.
· Provide a description of the scope of work, to include the work performed by the prime contractor.
· Provide project statistics including start and completion dates (original vs actual) and project cost (original vs actual. If original vs actual completion dates and project cost differ, please explanation as to why they differ.
If the Offeror is a Joint Venture (JV), relevant project experience should be submitted for projects completed by the Joint Venture entity. If the Joint Venture does not have shared experience, projects shall be submitted for each Joint Venture partner. Offerors who fail to submit experience for all Joint Venture partners may be rated lower.
(Note: If submitting as a Prime/Sub teaming arrangement under FAR 9.601(2), the designated prime must meet the specific requirements of Factor 1 “Prime Contractor Construction Experience” in order for the teaming arrangement to be deemed acceptable. Subcontractor experience will not be considered.)
FACTOR 2: TECHNICAL CONSTRUCTION EXPERIENCE OF MECHANICAL SUBCONTRACTOR
To be technically Acceptable, offerors must provide evidence of technical experience of plumbing/HVAC work is self-performed or provide subcontractor technical qualifications and experience needed to meet the technical performance requirements of this project. To be evaluated as Technical Experience, the information submitted by offerors must involve the following:
· Work under the NAICS code 238220, Plumbing, Heating, and Air-Conditioning Contractor.
· Ability to meet the technical requirements of specification Divisions 22 and 23 requirements. Residential Experience does not qualify.
· Products or services of proposed manufacturer, suppliers and installers of Division 22 and 23 specifications as follows:
1. Subcontractor is currently and regularly engaged in fabrication, and installation of plumbing/HVAC systems for hospitals. Residential plumbing does not qualify. Provide documentation for fabrication and installation of plumbing for hospitals.
2. Subcontractor has technical qualifications of at least five years of successful experience. Provide documentation and a list of facilities with knowledgeable and qualified points of contact who can verify these qualifications.
3. Submit a list of two or more prior, related installations where this subcontractor’s work has performed satisfactorily together under conditions of normal use. The list shall include projects that have been in operation for a period of not less than two years preceding the date of this solicitation. Include the names and addresses of contact where installations took place and who are familiar with the contractor’s performance.
FACTOR 3: PROJECT EXECUTION
To be Technically Acceptable, offerors must:
Provide a Draft Project Schedule:
Prepare and submit a practicable construction schedule showing all necessary work elements to complete the project identified under this solicitation. The schedule must be in the form of a progress chart of suitable scale to indicate appropriately the percentage of work scheduled for completion by any given date during the performance period. The submitted schedule must be developed using project scheduling software such as MS Project, Primavera, or any other comparable form.
Each Offeror's construction schedule must address the following:
· Order of work elements to include project phasing; Submittals, Mobilization, Demolition, Construction, Equipment Deliveries and Lead Time, Installation of new Equipment, Punch List, De-Mobilization.
· Temporary Trailer Rental
· Number of days for each work element
· Identification of long lead time materials
· Identification of separate work elements
· The VA’s review and approval or RFI’s, Submittals and other pertinent documents.
· Interruption of VA Facilities utilities, delivery of Government furnished equipment, rough-in drawings, project phasing and any other specification requirements.
The proposed schedule must include the activities which are consistent with those described within the project specifications and drawings and must not exceed the Government's maximum allowable performance period, as noted in Block 11 of the SF 1442. The project will start at the issuance of the Notice to Proceed. For scheduling purposes, assume the Notice to Proceed will be issued thirty (30) calendar days after the award date. (Note that there is no guarantee the Notice to Proceed will be issued within this timeframe.)
*The schedule submitted with the offer should not be construed as the agreed upon schedule as per FAR 52.236-15, the contractor shall, within five (5) days after receiving the Notice to Proceed, submit a revised schedule which will supersede the proposed schedule. The revised schedule will be subject to VA approval and must show the project being accomplished within the time frame specified on the SF 1442.
Provide Narrative for Project Challenges:
· Describe in a written narrative, the challenges identified for this project and a plan for addressing these challenges. This plan shall include how to minimize the disruption of patient care to the greatest extend possible.
FACTOR 4. KEY PERSONNEL EXPERIENCE
To be Technically Acceptable, the Offeror shall provide a resume for each of the following key personnel members, to include the Project Manager, On-Site Superintendent, Quality Control Manager, Safety Officer (designated Competent Person as defined by OSHA) and all of the identified or known subcontractors. (It is recognized that not all subcontractors may be identified by the time of proposal submission.) For each resume, include name of company, name of individual, relevant listing of experience, qualifications for each person such as specialized training, education, experience, etc. For the subcontractors identified, provide a resume of that company, identify any of the key personnel that will be working this project and the relevant experience of both the company and any key personnel that were identified. Please delineate the approximate % of work the prime contractor will perform on this job and the approximate % of work the subcontractors (collectively) will perform on this job.
FACTOR 5: PAST PERFORMANCE
To be Technically Acceptable, each proposal shall provide current and relevant information regarding an Offeror’s actions under previously awarded contracts referenced under Factor 1, Construction Experience. If a completed past performance evaluation is available in PPIRS, it shall be submitted with the proposal for each project referenced in Factor 1, Construction Experience. If there is not a completed past performance evaluation available in PPIRS, then the Offeror shall submit Past Performance Questionnaires (PPQ) (reference ATTACHMENT 5) for each project referenced in Factor 1, Construction Experience. The Offeror shall notify their client that they PPQ shall be submitted via email to the Government’s point of contact maria.hoover@va.gov. If the Offeror is unable to obtain a completed PPQ from a client for a project(s) before proposal closing date, the Offeror shall complete and submit with the proposal the first page of the PPQ, which will provide contract and client information for the respective project(s). The Government may make reasonable attempts to contact the client noted for that project(s) to obtain the PPQ information. However, Offerors should follow-up with clients/references to help ensure timely submittal of questionnaires.
The Government reserves the right to contact references for verification or additional information.
FACTOR 6: PRIME CONTRACTOR’S SAFETY PLAN
To be technically acceptable, Offerors must provide a construction safety plan that is deemed acceptable and meets the following requirements:
a. The contractor's Safety Plan shall be evaluated for their compliance with local/State/Federal rules and regulations and the company's consideration of safety of its employees and the general public. The contractor's Safety Plan at the minimum shall address their safety policy, commitment to safety, detailed disciplinary action to be taken with respect to employees violating safety requirements, personnel safety responsibilities, personnel safety training, personal protective equipment, accident / incident reporting procedure and investigations, emergency procedures guidelines.
b. The contractor’s Safety Plan shall address their plan for completing all contract work on and around an active hospital without impacting patient care and completing all work in accordance with all construction documents and all local/State/Federal rules and regulations.
d. PRICE PROPOSAL.
The Government will evaluate offers in accordance with the process identified in the Price Schedule. The total evaluated price will be determined by the Offeror’s price for Bid Item 1. Offerors must provide a price for each bid item. In addition, offerors shall include a breakdown of material and labor costs, by specification division for each bid item. Overhead, profit and bond costs shall be added after a subtotal of materials and labor costs has been calculated.
Note: It is intended that award will be made on Bid Item #1 but in the event the bid exceeds the funds available, a single award will be made on Bid Item #2.
The VA reserves the right to award to a higher priced offeror in accordance with the stated evaluation criteria. The VA also reserves the right to award to a lower priced, lower rated offeror if it’s in the interest of the VA.
3. BASIS OF AWARD.
VA will make the award using best value under the tradeoff process of proposals meeting or exceeding the acceptability standards for non-cost factors.
Note: Offers that are not technically acceptable cannot be selected, regardless of price.
4. SPECIAL CONTRACT REQUIREMENTS.
SUBSTITUTIONS OF KEY PERSONNEL OR SUBCONTRACTORS
When an offeror submits its proposal in response to this Request for Proposals, and key personnel or subcontractors who are proposed to work on the project are required to be submitted, those personnel for one of those whose qualifications were the basis for evaluation of the offer and award of the contract, the contractor shall submit to the Contracting Officer the same information that was required in the initial proposal regarding the proposed substitute employee. The Contracting Officer shall have the right to review the qualifications of the proposed substitute employee’s qualifications and to approve or disapprove his or her qualifications. If the proposed substitute employee’s qualifications are disapproved by the Contracting Officer, the contractor will propose another employee who does possess equivalent qualifications.
5. SAFETY OR ENVIRONMENTAL VIOLATIONS AND EXPERIENCE MODIFCATION RATE
All Bidders/Offerors shall submit the following information pertaining to their past Safety and Environmental record see Appendix 2. The information shall contain, at a minimum, a certification that the bidder/offeror has no more than three (3) serious, or one (1) repeat or one (1) willful OSHA or any EPA violation(s) in the past three years.
All bidders/Offerors shall submit information regarding their current Experience Modification Rate (EMR) equal to or less than 1.0. This information shall be obtained from the bidder’s/offeror’s insurance company and be furnished on the insurance carrier’s letterhead.
Self-insured contractors or other contractors that cannot provide their EMR rating on insurance letterhead must obtain a rating from the National Council on Compensation Insurance Inc. (NCCI) by completing/submitting the form ERM-6 and providing the rating on letterhead from NCCI. Note: self-insured contractors or other contractors that cannot provide EMR rating on insurance letterhead from the states or territories of CA, DE, MI, NJ, ND, OH, PA, WA, WY, AND PR shall obtain their EMR rating from their state-run worker’s compensation insurance rating bureau.
A Determination of Responsibility will be accomplished for the apparent awardee prior to processing the award. The above information, along with other information obtained from Government systems, such as the OSHA and EPA online inspection history databases will be used to make the Determination of Responsibility. Failure to affirm being within the guidelines above or submit this information will result in a determination of “Non-Responsibility” for the bidder/offeror. NOTE: Any information received by the Government that would cause for a negative Determination of Responsibility will make the bidder/offeror ineligible for award. This requirement is applicable to all subcontracting tiers, and prospective prime contractors are responsible for determining the responsibility of their prospective subcontractors.

2.3 52.222-23 NOTICE OF REQUIREMENT FOR AFFIRMATIVE ACTION TO ENSURE EQUAL EMPLOYMENT OPPORTUNITY FOR CONSTRUCTION (FEB 1999)
(a) The offeror's attention is called to the Equal Opportunity clause and the Affirmative Action Compliance Requirements for Construction clause of this solicitation.

2.4 52.223-20 AEROSOLS (JUN 2016)
(a) Definitions. As used in this clause— Global warming potential means how much a given mass of a chemical contributes to global warming over a given time period compared to the same mass of carbon dioxide. Carbon dioxide's global warming potential is defined as 1.0.
High global warming potential hydrofluorocarbons means any hydrofluorocarbons in a particular end use for which EPA's Significant New Alternatives Policy (SNAP) program has identified other acceptable alternatives that have lower global warming potential. The SNAP list of alternatives is found at 40 CFR part 82, subpart G, with supplemental tables of alternatives available at (http://www.epa.gov/snap/).
Hydrofluorocarbons means compounds that contain only hydrogen, fluorine, and carbon.
(b) Unless otherwise specified in the contract, the Contractor shall reduce its use, release, or emissions of high global warming potential hydrofluorocarbons, when feasible, from aerosol propellants or solvents under this contract. When determining feasibility of using a particular alternative, the Contractor shall consider environmental, technical, and economic factors such as—
(1) In-use emission rates, energy efficiency;
(2) Safety, such as flammability or toxicity;
(3) Ability to meet technical performance requirements; and
(4) Commercial availability at a reasonable cost.
(c) The Contractor shall refer to EPA's SNAP program to identify alternatives. The SNAP list of alternatives is found at 40 CFR part 82, subpart G, with supplemental tables available at http://www.epa.gov/snap/.

2.5 52.225-10 NOTICE OF BUY AMERICAN REQUIREMENT—CONSTRUCTION MATERIALS (MAY 2014)
(a) Definitions. "Commercially available off-the-shelf (COTS) item," "construction material," "domestic construction material," and "foreign construction material," as used in this provision, are defined in the clause of this solicitation entitled "Buy American—Construction Materials" (Federal Acquisition Regulation (FAR) clause 52.225-9).
(b) Requests for determinations of inapplicability. An offeror requesting a determination regarding the inapplicability of the Buy American statute should submit the request to the Contracting Officer in time to allow a determination before submission of offers. The offeror shall include the information and applicable supporting data required by paragraphs (c) and (d) of the clause at FAR 52.225-9 in the request. If an offeror has not requested a determination regarding the inapplicability of the Buy American statute before submitting its offer, or has not received a response to a previous request, the offeror shall include the information and supporting data in the offer.
(c) Evaluation of offers.
(1) The Government will evaluate an offer requesting exception to the requirements of the Buy American statute, based on claimed unreasonable cost of domestic construction material, by adding to the offered price the appropriate percentage of the cost of such foreign construction material, as specified in paragraph (b)(3)(i) of the clause at FAR 52.225-9.
(2) If evaluation results in a tie between an offeror that requested the substitution of foreign construction material based on unreasonable cost and an offeror that did not request an exception, the Contracting Officer will award to the offeror that did not request an exception based on unreasonable cost.
(d) Alternate offers.
(1) When an offer includes foreign solicitation in paragraph (b)(2) of the clause at FAR 52.225-9, the offeror also may submit an alternate offer based on use of equivalent domestic construction material.
(2) If an alternate offer is submitted, the offeror shall submit a separate Standard Form 1442 for the alternate offer, and a separate price comparison table prepared in accordance with paragraphs (c) and (d) of the clause at FAR 52.225-9 for the offer that is based on the use of any foreign construction material for which the Government has not yet determined an exception applies.
(3) If the Government determines that a particular exception requested in accordance with paragraph (c) of the clause at FAR 52.225-9 does not apply, the Government will evaluate only those offers based on use of the equivalent domestic construction material, and the offeror shall be required to furnish such domestic construction material. An offer based on use of the foreign construction material for which an exception was requested—
(i) Will be rejected as nonresponsive if this acquisition is conducted by sealed bidding; or
(ii) May be accepted if revised during negotiations.
