B.3 PERFORMANCE WORK STATEMENT
Note 1: The use of the term “contract” within the Performance Work Statement, clauses and provisions is not used to denote a binding legal contract for the procurement but rather, a generic term for the agreement. “Contract” and “agreement” may be used interchangeably. “Contractor” refers to the awarded BPA holder(s). “Contractor personnel” or “contract provider” is used to denote the awarded BPA holder’s Radiology Technologists.
Note 2: In order to be eligible for award, the following criteria shall be met and maintained throughout the life of the BPA.
1.0 Background
The Department of Veterans Affairs (VA) provides imaging services to Veterans whom are eligible for VA health care services and have medical needs for such service. This acquisition will supplement VA in providing comprehensive imaging support to Veterans in need at both campuses of the Eastern Kansas VA Medical Centers (VAMC) Topeka and Leavenworth. It is VA’s intention to solicit quotations and award multiple blanket purchase agreements (BPA) in order to achieve a pool of providers for each technologist category identified in para 1.2.1. Services needed are both pro re (PRN) which translates to “as needed” and temporary. There are several opportunities where contracted radiology technology services may be needed.
· The pool of providers may be utilized to cover PRN lapses in the schedule due to absences, illness, change in position (VA staff gaps), etc.
· A contracted technologist may be utilized to fill temporary long term needs in the schedule due to absences due to maternity leave, military leave, unfilled vacancies in VA’s staff, etc. Long term needs may not exceed a 12-month period of performance.
1.1 Blanket Purchase Agreement (BPA)
This BPA will expire five years from the effective date of this BPA or ending date as determined by the exercise of the option to extend the term of the BPA, whichever occurs earlier. The maximum term of this BPA shall be five (5) years from the effective date of this BPA. The VA will review the estimated purchases and the corresponding discounts for this BPA annually. The annual review shall take place before the next option is exercised.
1.1. Economic Price Adjustment (EPA)
Prices shall remain unchanged unless an adjustment (increase or decrease) is made in accordance with the Economic Price Adjustment (EPA) clause. It is incumbent upon the Contractor to contact the Contracting Officer to request an increase or decrease to the established BPA. Rates for established orders shall not be subject to adjustment retroactively.
1.2 Estimated Full Time Equivalents (FTE)
1.2.1 The Contractor shall provide non-personal healthcare services for up to five (5) full time equivalent (FTE) Registered Radiology Technologist/Computed Tomography RT(R)(CT); two (2) FTE Ultrasound (US) Technologist; and two (2) FTE Magnetic Resonance Imaging (MRI) Technologists to perform the requirements of this contract. A full time equivalent employee is defined as a Contractor’s employee working eight hours in a day. A Contractor’s employee must be present at the VA Medical center facility and must actually be performing the required services for the period specified in the contract or the contract costs will be decreased accordingly during each billing cycle. The payment for any leave, including sick leave, vacation time, and authorized Federal holidays is the responsibility of the Contractor.
1.2.2 Hours of service must be documented on time and attendance records and attached to the invoice for review and certification by the Contracting Officers Representative (COR) in order for the Contractor to be compensated. The Contractor employee shall not receive compensation from the VA of any hours such as sick leave, holiday leave or annual leave. The Contractor employee may be required to perform work on federal holidays.
1.3 Fair Opportunity (Attachment 4)
Before placing an order, the ordering activity’s requirements will be forwarded to each BPA holder, along with the evaluation criteria, to provide the opportunity to submit candidates and a quote on the order. In order to be considered responsive to the Request for Quotation (RFQ), BPA holders shall provide all requested documentation within the predetermined time frame, i.e. quote due date. Evaluations will be based on experience, education and training of provider, timeliness/availability of proposed candidate, and price. Based on a best value determination, the order shall be placed with the BPA holder that represents the best value to the Government.

4.4.2 The technologist is required to use the VISTA computer to case edit all work, i.e., enter the name of the technologist performing the exam, and any modifiers to the examination. All examinations must be case edited within fifteen minutes of the exam’s completion. To be considered fully successful in this element, he/she cannot fail to complete as identified more than 15 times annually.
4.4.3 To be considered fully successful, a technologist must be in compliance with all departmental and medical center safety policies. Copies of the medical center radiation safety policies are maintained in Radiology Department and may be viewed, by appointment, by contacting the Supervisory Technologist or Administrative Officer. If a technologist violates these policies more than twice annually, he/she is unsuccessful.
4.5 Setting up Radiographic Rooms and Exams
4.5.1 If any piece of Radiology equipment stops functioning properly, it is the technologist’s responsibility to inform the Radiology Supervisor &/or the COR.
4.5.2 It is the responsibility of the technologist assigned a room to set it up for procedures and to keep it clean. Rooms are subject to random inspections and are expected to be maintained to a level of cleanliness that complies with medical center infection control policies. This includes ensuring the equipment is wiped down with Cavi wipes between each patient and at the end of the day. All supplies are to be stocked or restocked, in an orderly manner, daily or when supplies are low. There will be an adequate supply of linens available in the individual exam rooms, and all expended supplies/linens from the previous exams should be properly disposed of in the room as appropriate for either the trash can or the dirty linen bag. When the dirty linen bag is full, the technologist shall take it to the EMS linen shoot and replace with a new empty bag. Environmental Management Service will be responsible for maintaining the floors and emptying the trash. The cleanliness of the equipment is the sole responsibility of the technologist. If the technologist fails to comply more than three times annually, he/she is unsuccessful in this element.
4.5.3 Exposure Control Plan – The technologist is responsible for observing the departmental and hospital policies for the Exposure Control Plan for infection control or safety policies. Copies of the medical center exposure control plan are maintained in the Radiology Department and my viewed, by appointment, by contacting the Supervisory Technologist or Administrative Officer. To be considered fully successful, the technologist cannot violate these policies more than three times annually.
4.6 Performance Standards
4.6.1 Ninety (90) percent of all routine radiographs taken by the technologist must be of diagnostic quality. Diagnostic quality is defined as “films that demonstrate the body part requested to the satisfaction of the radiologist that reads the film.” The Supervisory Technologist and/or the Quality Control Technologist may review the films for that quality prior to the films being sent to the radiologist.
4.6.2 The technologist is limited to one poor image for every 10 he/she takes. A poor image is a film that does not demonstrate the requested body part to the satisfaction of the radiologist. The Supervisory Technologist and/or Quality Control Technologist will use their judgment as to whether a film is of an acceptable quality.
4.6.3 The technologist must complete his/her work in a timely manner. Each type of exam has a generally acceptable range of time that it should be completed in. This range of time depends on several different variables, including condition of the patient, equipment, etc. Every exam has a certain number of finite steps that must be completed to produce a clinically acceptable exam. Through experience, one learns how long it will take, on average, to complete all of the necessary steps. However, consideration will always be given to certain fluctuating factors that may affect the length of time it takes to complete an exam. For example, a routine Chest PA and Lateral exam performed on an automated unit generally takes five to seven minutes to complete. This may be influenced by the physical condition of the patient, the characteristics of their anatomy and the experience of the technologist. All of these factors are taken into consideration by the Supervisory Technologist when determining “timeliness” of the exam. The Supervisory Technologist will take these variables into account when deciding if the technologist is taking too much time to complete an exam. There should be no more than five of these incidents annually.
4.6.4 The technologist may commit up to 15 “minor” errors annually. The Supervisory Technologist and the Quality Control Technologist will determine if errors are “minor”. Examples of minor errors are leaving right and left markers off the film, not identifying the film with the patient’s name, social security number, date, case number and type of exam, or leaving artifacts on the film (i.e., pen in shirt pocket, necklace, coins, lighters, etc.)
4.6.5 If more than eight sets of radiographs taken annually are returned by the radiologist for repeat, the technologist’s work shall be considered unsatisfactory. A “set” is the complete collection of films, showing different views of the anatomy that comprise one exam. A chest PA and Lateral is one exam that has two films in the set, one front-to-back and one side-to-side. A Lumbar Spine exam has five films. If one of the five films were too dark, all five films would be returned as a set and be counted as one error.
4.6.6 The technologists shall be courteous to patients, visitors, and fellow employees. Courtesy is defined as respect and consideration for others. This includes maintaining a professional and polite demeanor at all times, which contributes positively to the operation of the department. To be considered fully successful, the technologist cannot have more than one valid complaint concerning lack of courtesy toward a patient or visitor, or three valid complaints concerning lack of courtesy toward medical staff for an annual period. The Supervisory Technologist determines the validity of a complaint of discourtesy.
4.7 Scheduling
4.7.1 Monthly Scheduling:
4.7.1.1 The VA scheduler will email the monthly open schedule to Contractor(s). The open schedule identifies unfilled shifts. The Government’s intent is to provide the open schedule two weeks prior to the beginning of each month identifying the available shifts for contracted technologists.
4.7.1.2 Contractor(s) shall have 48 hours to coordinate availability with their technologists and submit names, by shift, and return to VA’s scheduler.

4.7.1.4 If shifts are not filled, the scheduler shall resubmit a second request for those open shifts.
4.7.1.5 The scheduler shall notify each Contractor of the key personnel selected and shift scheduled.
4.7.1.6 The Contractor is responsible for notifying their personnel of selected shifts.
4.7.2 Immediate Scheduling:
4.7.2.1 Should contracted coverage be required with no advanced notice, the scheduler will distribute an email to all Contractor(s) asking for immediate coverage and identify a report for duty time.
4.7.2.2 The Contractor who responds with confirmed coverage will be given first opportunity to fill the schedule. The scheduler shall respond with confirmation of the selected technologist’s schedule and report time.
4.7.3 Temporary Long-Term Scheduling:
4.7.3.1 When a need is identified for temporary long-term performance, not to exceed 12 months, a designated technologist shall be selected, using Fair Opportunity practices identified at para 1.3. The selected technologist shall have a set work schedule.
4.7.4 Schedules will be made available to the Contractor no later than one week prior to the requested tours of duty.
4.7.5 Shift requirements are subject to change. The Contractor will be expected to fill all additional unscheduled shifts with a 72-hour notice up to the approved FTE of the contract as stated in the solicitation.
4.7.6 The Contractor cannot make any change to the required shifts unless the change is requested and approved by the VAMC.
4.7.7 Contractor employees must contact the agency, the VA shift supervisor, and COR regarding cancellations, changes in scheduling, etc. The Contractor will in turn contact the VA Department Supervisor and/or his designee and advise the name of the replacement technologist identified within the key personnel roster. Replacement technologists not identified on the key personnel roster are not eligible to work under this contract.
4.7.8 The actual number of hours and contractor employee(s) scheduled will be determined by vacancies in the Radiology Department. The COR will notify the Contracting Officer in writing of all scheduled shifts missed by the Contractor within 24 hours.
4.7.9 The Contractor employee(s) shall not miss more than three (3) shifts per year, or shall not be tardy more than three (3) shifts per quarter. The COR will contact the Contractor directly with the first occurrence of a missed shift or tardiness and any repeated occurrences shall be documented with a Contract Discrepancy Report (CDR).
4.7.10 Radiology Service schedules tours of duty on standard 8-hour shifts.
4.7.11 The Contractor shall have sufficient qualified employees so that services are provided in the event a contractor employee scheduled to work becomes ill, resigns, is terminated, or is otherwise unavailable to work. Contract requirements are not altered or mitigated by inclement weather.
4.7.12 Contracted personnel must complete, or must be expected to complete specific orientation/training requirements, prior to scheduling eligibility.
4.8 Surveillance, Performance Standards, Quality Assurance, and Quality Improvement
4.8.1 Surveillance
4.8.2 The Contracting Officer’s Representative (COR) may gather records (e.g. Clinic profiles) and Clinic activity sheets that list the time clinics’ start and stop (kept by the VAMC). The COR shall also receive a time and attendance report that lists each day of the month, the time contract technologist spends at the VA facility and a brief description of activities.
4.8.3 In order to provide a systematic method of evaluating Contractor performance a Quality Assurance Surveillance Plan (QASP) shall be utilized. The Government shall evaluate the contract provider’s performance in accordance with the Quality Assurance Surveillance Plan. This plan is primarily focused on what the Government must do to ensure the Contractor has performed in accordance with the performance standards. The plan defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable levels.
4.8.4 The COR may perform surveillance of services by:
4.8.4.1 Observing actual performance;
4.8.4.2 Checking time and attendance logs;
4.8.4.3 Reviewing minutes of meetings;

4.8.4.5 Review of any other appropriate electronic records.
4.8.5 In all cases, surveillance shall not be so intrusive as to impact the Contractor’s successful accomplishment of the mission.
4.8.5.1 When unacceptable performance occurs, the COR shall inform the Contractor. This will normally be in writing unless circumstances necessitate verbal communication. In any case the COR shall document the discussion and place it in the COR file. When the COR determines formal written communication is required, the COR shall prepare a Contract Discrepancy Report (CDR), (Attachment 5) and present it to the Contractor's program manager. The Contractor shall acknowledge receipt of the CDR in writing. The CDR will specify if the Contractor is required to prepare a corrective action plan to document how the Contractor shall correct the unacceptable performance and avoid a recurrence. The CDR will also state how long after receipt the Contractor has to present this corrective action plan to the COR. The Government shall review the Contractor's corrective action plan to determine acceptability. Any CDRs may become a part of the supporting documentation for any contractual action deemed necessary by the Contracting Officer.
4.8.6 Quality assurance monitoring documentation shall become an official Government record of the Contractor’s performance.
