DEPARTMENT OF VETERANS AFFAIRS

Justification for Single Source Awards IAW FAR 13.106-1 For Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID: 36C252-19-AP-0563

1. Contracting Activity: Department of Veterans Affairs, VISN 12, Great Lakes Acquisition Center

(GLAC), 695-19-2-133-0431.

2. Brief Description of Supplies/Services required and the intended use/Estimated Amount: The

Great Lakes Acquisition Center is in the process of establishing a fixed firm price service contract of VISN 12’s existing AGFA Healthcare Corporation (“AGFA”) radiology Picture Archiving and Communication System (PACS) solution. Estimated amount is .

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: The support covers all existing PACS hardware and software in VISN 12, including workstations, servers, archive server hardware, and disaster recovery/redundancy infrastructure. The system houses roughly 247 terabytes of archived studies dating back more than 15 years for a total unique study count that exceeds 4.2 million. The current solution cross-connects over seven VISN 12 facilities, two remote datacenters, and extends into multiple affiliate partnerships in the Madison, Milwaukee, and Chicago areas.

However, to avoid a lapse in service, a short-term (30 days) bridge contract needs to be established as a follow-on to 36C25218C0184. This contract (30 days) will be followed by a long-term contract.

Support of this system is completely proprietary in nature in that AGFA is the only vendor equipped with the training, resources, and system-level access to fully support VISN 12’s technical and functional needs. AGFA does not authorize any other company to support its radiology PACS systems. Therefore, due to the complex and proprietary nature of the equipment and the resultant lack of third party certification for services, AFGA is the only source for required support of the PACS system.

4. Description of market research conducted and results or statement why it was not conducted:

A previous procurement (36C25218C0184) with a similar requirement showed that the requested services are only available from a single source, AGFA Healthcare Corporation. To confirm, a Sources Sought Synopsis (36C25219Q0142) was issued to the Governmentwide Point of Entry, FBO.gov, on 11/16/2018 to fulfill the long-term contract. Responses were requested to be received by 11/23/2018. One response was received on 11/19/2018 from The Point of Contact (POC) from requested more information on what was requested of the Contract Specialist. The Contract Specialist responded with the required information and a statement indicating that he is attempting to determine if competition exists. As of 2/1/2019, no further information was received from the POC.

The Contract Specialist also posted an Intent to Sole Source Synopsis (36C25219Q0157) on 11/26/2018 to give firms the opportunity to respond if they can fulfill the requirement for a long-term PACS System Maintenance and Software contract. Zero responses by Industry were received.

In addition to the Sources Sought and Intent to Sole Source Synopses described above, the CS conducted a search for “AGFA” on Vendor Information Pages (VIP) to determine if any Veteran- Owned Small Businesses (VOSBs) or Service-Disabled Veteran-Owned Small Businesses (SDVOSBs) are able to fulfill the requirement. Zero results were returned. A second search was conducted with the keyword “PACS” and NAICS code 811219 (Other Electronic and Precision Equipment Repair and Maintenance). Zero results were returned.

Finally, an Intent to Sole Source Synopsis is posted with this justification.

5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.

Jim Hedman Date Contracting Officer
