Provide labor, materials, tools and equipment necessary to provide full service maintenance and emergency repairs of the GE imaging equipment located throughout VISN 12. The equipment shall be serviced for one year from 10/1/18 – 9/30/19. Service will require remote access through GE’s proprietary software. A listing of the equipment (Attachment A) is included in the procurement package.
(4) IDENTIFY THE AUTHORITY AND SUPPORTING RATIONALE (see 8.405-6(a)(1)(i)(A), (B), and (C) or 8.405-6(b)), AND IF APPLICABLE, A DEMONSTRATION OF THE PROPOSED CONTRACTOR’S UNIQUE QUALIFICATIONS TO PROVIDE THE REQUIRED SUPPLY OR SERVICE.
|X| Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; The equipment is specialized High Tech Medical Equipment (HTME). Remote access is required with site to site VPN utilizing the vendor’s proprietary software to maintain 95% uptime availability. GE is the only vendor that can perform software diagnostics to ensure operation is in accordance with the manufacturer’s specifications.
(5) DESCRIBE WHY YOU BELIEVE THE ORDER REPRESENTS THE BEST VALUE CONSISTENT WITH FAR 8.404(d) TO AID THE CONTRACTING OFFICER IN MAKING THIS BEST VALUE DETERMINATION: The task order will be placed against a National Acquisition Center (NAC) contract, VA797H-17-D-0024, which has been determined to be fair and reasonable per FAR Part 8.404 (d). The Contracting Officer will request additional discounts from the vendor. Pricing was also compared to the IGCE ($2,053,701.00) and current task order VA69D-17-J-6287 due to expire on 9/30/18. Total amount is $1,118,551.56 for 44 pieces of equipment which included four major systems that were prorated due to warranty time. Task order VA69D-16-J-5503 (10/1/16 – 9/30/17) serviced 46 major systems for $1,527,089.42. Currently, 61 major systems shall be serviced for a total contract value of $2,054,149.47.
(6) DESCRIBE THE MARKET RESEARCH CONDUCTED AMONG SCHEDULE HOLDERS AND THE RESULTS OR A STATEMENT OF THE REASON MARKET RESEARCH WAS NOT CONDUCTED: Market research was not conducted amongst the schedule holders. General Electric utilizes proprietary software to conduct remote patches, upgrades and diagnostics needed for the equipment. No other vendor has the capability to access GE’s software. An intent to sole source notice (36C25218Q9775) was posted on FBO from 8/7/18 – 8/16/18, no responses were received. A review of historical documents, task order VA69D-17-J-6287 was awarded to GE as a sole source due to proprietary software and remote access for software diagnostics and repair.
(7) ANY OTHER FACTS SUPPORTING THE JUSTIFICATION: GE already possesses the security documentation required to allow remote access immediately after award.
(8) A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS THAT LED TO THE RESTRICTED CONSIDERATION BEFORE ANY SUBSEQUENT ACQUISITION FOR THE SUPPLIES OR SERVICES IS MADE: This requirement consists of high tech medical equipment and will remain restricted due to proprietary software. The basic service requires remote access to the equipment and GE does not allow other manufacturers remote access.
(9) REQUIREMENTS CERTIFICATION: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge.
