3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:

The Clement J. Zablocki VA Medical Center (VAMC) located in Milwaukee, WI and the Green Bay Health Care Center located in Green Bay, WI has the requirement for GI Lab Image and Data Mining Software. This software supports the endoscopy and reprocessing equipment found in the GI Lab, where patients receive care for various gastrointestinal issues and ailments. It has the capability to archive, organize, and data mine endoscopy images take in the GI Lab. The software is also capable of interfacing with the reprocessing equipment to track and data mine statistical metrics related to the quality and efficacy of the VA's reprocessing services, which are directly relate to patient care and outcomes.

4. Description of market research conducted and results or statement why it was not conducted:

Market Research for Purchase Requests 695-18-2-969-0060 and 695-18-2-969-0061 showed Olympus Americas, Inc. software/equipment to be available from a Service-Disabled Veteran-Owned Small Business (SDVOSB). As such, a justification was prepared pursuant to 38 U.S.C. 8127(b) and in accordance with VAAR 813.106-70, which states, “a contracting officer may award a contract to a verified SDVOSB concern using procedures other than competitive procedures” provided that certain criteria are met, which this procurement does.

An Intent to Sole Source notification was posted IAW FAR 5.201, Synopses of Proposed Contract Actions, which stated that other offers will be considered by the Government if received within three days of the posting. A response was received from an Other Than Small Business offering an alternative product. Accordingly, the CO corresponded with the POC from the Other Than Small Business to determine if its products could meet the need of the facility, which it is determined that it may. The CO then inquired if it uses any VOSB or SDVOSB to distribute its products. The POC indicated that it uses at least one VOSB and one SDVOSB, both on the open market.

A Request for Quote was then issued to the Governmentwide Point of Entry, FBO.gov, with a 100% SDVOSB set-aside. The SDVOSB distributor for Olympus Americas, Inc. responded to the solicitation stating that the software in the requisition was not able to be provided by the SDVOSB, contrary to previous correspondence. The CO received a quote from a Vendor for a total of , which is above the IGCE. No other responses were received.

Due to the above response, lack of any other response to the RFQ, and market research, the CO elects to award a single source purchase order to Olympus Americas, Inc. for the requisite software.

5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
