About this file

This document is a Single Source Justification for Simplified Acquisition Procedures (SAP) under the Simplified Acquisition Threshold (SAT) for the Department of Veterans Affairs (VA). The VA is seeking to renew annual software licenses for radiation oncology treatment planning and evaluation software from the sole-source provider, Radformation, Inc. (a small business). The required software includes ChartCheck, ClearCheck, and ClearCalc, with a total estimated cost of $28,000. The VA conducted market research and determined Radformation is the only provider of these proprietary products, which are integrated with the VA's Aria Oncology Information System. The Contracting Officer has certified the purchase as fair and reasonable under FAR 13.106-1(b). The VA awarded a contract to Radformation, Inc. on 2024-05-08 for the $28,000 software subscription renewal.

Acquisition Plan Action ID: 36C250-24-AP-3198

1. Contracting Activity: Department of Veterans Affairs, Network Contracting Office 10 located at 260 E University Avenue, Cincinnati, OH 45219-2356, in support of VISN 10, Richard L. Roudebush VA Medical Center (RLR VAMC), 1481 West 10th Street, Indianapolis, IN 46202-2803. 2237 #: 583-24-3-020-0030.

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: This new request by the RLR VAMC Radiation Oncology Service is for renewal of brand name software licenses to support the treatment of Veteran patients with cancer diagnoses. These products will aid in reducing the time it takes to complete a treatment plan while also easing the resource strain associated with treatment planning.

In addition to enabling clinicians to create more treatment plans in less time, the software increases the plan quality, safety, and efficiency by streamlining the workflow between contouring, planning, checking, and implementing treatment plans. The contractor shall provide the following services and supplies:

· ChartCheck Radiotherapy Treatment Evaluation Software Annual Subscription: 06/01/2024 – 05/31/2025 (Quantity of 2 LINACS Each)

· ClearCheck Radiotherapy Treatment Plan Evaluation Software Annual Subscription: 06/01/2024 – 05/31/2025 (Quantity of 2 LINACS Each)

· ClearCalc: Secondary Calculation Software Annual Subscription: 06/01/2024 – 05/31/2025 (Quantity of 2 LINACS Each)

The estimated cost of these subscriptions is $28,000.00.

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: The OEM of this brand name software is Radformation, Inc. (SB). It has an approved VA FITARA (See ARM # 177347). Radformation, Inc. confirmed via email dated 09/20/2023 that there are no resellers available for this product.

The OEM retains proprietary licenses for the following technology:

· ChartCheck actively monitors patient data in real-time to ensure safety for ongoing treatment. With automatic notifications for failing checks, plan errors can be resolved immediately, resulting in higher quality patient care and significant time savings.

· Clear Check is an automated plan check and documentation software that ensures the highest quality treatment plans and helps clinics save time with in-depth plan checks, quick plans, comparison, and instant documentation. This standardizes and simplifies the plan evaluation process.

· ClearCalc is an independent calculation software platform for all second check needs. ClearCalc supports a full complement of clinical techniques, treatment planning systems, and offers a variety of algorithms to efficiently validate plan accuracy.

These products are operating on servers inside the RLR VAMC’s HTM VLAN. They are used in conjunction with ARIA OIS. These three software applications are all used in addition to the Aria OIS, not instead of. This is mature technology which will help manage and improve VA Operations to deliver seamless and integrated support, and result in improving productivity. This technological platform integrates with other TRM software to provide enhanced functionality.

Radformation, Inc. offers a solution to support treatment planning and clinical workflow that is efficient, straightforward, and user-friendly. Other competitors are not able to provide products with the same services or purpose.

4. Description of market research conducted and results or statement why it was not conducted: Market research queries were conducted using VetCert, FPDS-NG, GSA eLibrary, VA NAC, VA SAC, and other resources. The results found that the OEM is a small business and the sole distributor for these products. There is not a reasonable expectation of obtaining offers from two or more responsible small business concerns. The VA and SBA Rules of Two cannot be met.

Based upon market research and comparison to the Government IGCE, there is a reasonable expectation that award can be made at a fair and reasonable price offering best value from Radformation, Inc.

5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
