About this file

This document contains a Request for Information and details of a related federal contract opportunity for security improvements at Department of Veterans Affairs facilities. The RFI seeks clarification on general liability insurance requirements for asbestos. It specifies that the successful bidder must provide evidence of general liability coverage without asbestos exclusions prior to award. The contracting officer confirms the requirement cannot be removed as no asbestos risk is otherwise referenced.

The solicitation will be issued on www.beta.sam.gov on or around August 17th, 2020. The NAICS code is 236210, the business size standard is $16.5 million, and the SDVOSB must perform a minimum of 25% of construction work. The project value is between $500,000 to $1,000,000 and must be completed within 180 days of the notice to proceed. Bonds, site visits, and compliance with VA security requirements are also outlined.

INFORMATION NEEDED:

Section 2.19, (d) reads as follows:

“The successful bidder must present to the Contracting Officer, prior to award, evidence of general liability insurance without any exclusionary clauses for asbestos that would void the general liability coverage.”

We have discussed with our broker and the exclusionary clause for asbestos is standard terminology in GL policies – is it possible to get this requirement removed? There is no references elsewhere to asbestos risk or exposure. Thank you

REPLY:

No, the requirement can not and will not be removed.
