Authority:

ORDER AGAINST FSS: Authority of the Multiple Award Schedule Program, Title III of the Federal Property and Administrative Services Act of 1949 (41 USC 251, et seq.); Title 40 USC 501, Services for Executive Agencies; and Section 803 of the National Defense Authorization Act of 2002 (PL 107-107) and implemented by FAR 8.405-6. Mark the applicable exception:

|X| An urgent and compelling need exists, and following the procedures would result in unacceptable delays(FAR 8.405-6(a)(1)(i)(A);

|X| Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; (FAR 8.405-6(a)(1)(i)(B)) or

|_| In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order and the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order was not previously issued under sole-source or limited-sources procedures. (FAR 8.405-6(a)(1)(i)(C)

4. Rational/explanation to support cited authority:

The Olympus EndoEye 5 & 10mm 0 & 30 degree scopes are compatible with current Olympus Evis Exera II system in use at WJB Dorn VA Medical Center and is the preferred system of use by the Surgeons. The EVIS EXERA II system works seamlessly with a wide range of endoscopes across specialties to provide easier data management and cost efficiencies. WJB Dorn VA Medical Center currently uses this system for bronchoscopy, gastroenterology, laparoscopic and arthroscopic surgery, urology, anesthesiology and ENT. The flexibility of this widespread platform reduces the need for multiple video systems. Additional features include:

· Autoclavability: State of the art reprocessing compatibility: completely autoclavable

· Chip-on-the-tip: The advanced chip-on-the-tip enables the ENDOEYE to provide bright, clear images. Much fewer elements, moving parts and interfaces along the imaging chain are a garant for no picture deterioration from tolerances, misfits or free surfaces.

· Efficiency: Unrivalled ENDOEYE efficiency for superior handling and maximum surgeon comfort from all-in-one product concept.

· NBI (Narrow Band Imaging): NBI is an optical image enhancement technology that improves the visualization of vessels and other tissues on the mucosal surface. Only Olympus products feature NBI, which is 20% brighter compared to previous models.

· All-in-one design: Integrates the light cable and camera system into the laparoscope for improved ergonomics and easier set up.

The number needed of each EndoEye was determined by the surgical service team and the general surgeons who most frequently use these scopes. To support the volume of cases completed every week by our three general surgeons it has been concluded that we need six 0 degree and five 30 degree scopes. In conclusion, replacing the non-repairable EndoEyes and increasing the quantity will achieve the best possible patient outcomes and improve overall hospital efficiency and safety.

Olympus is the only source for this specific camera and the camera is proprietary. Olympus EndoEyes can be purchased through a partner vendor such as Alliant that is disabled veteran owned business and has been verified by Olympus with a Letter of Authority for record.

5. BRAND NAME ONLY: This buy is estimated to exceed $25,000 and this documentation will be posted along with the RFQ on e-Buy, as required by FAR 8.405-6(b)(3).
