B.2 STATEMENT OF WORK

Annual Document Shredding Contract

(1) General. Special Requirement -- The Contractor will provide all transportation, material hardware and parts, tools, specialized equipment, labor, supervision and technical expertise to provide Document Shredding Service at VAMC Asheville, Franklin CBOC, Rutherfordton CBOC, Hickory CBOC, and Franklin HBPC Clinic. The period of performance is 1 April 2019 thru 31 March 2024. Vendor will provide all shred containers and shall be in place at designated shred locations on 1 April 2019, followed by the first scheduled pick-up during the week of 1 April 2019.

(2) Coordination. Facility Management Service will serve as the focal point and Contracting Office Representative (COR) for this contract.

(2.1) The COR will be immediately notified whenever the document shredding, or related activities interfere with normal VAMC operation.

· Specific Requirements. The Contractors work shall include, but not be limited to:

· The contractor shall provide specified shred containers, on-site shredding, pick up and emptying of shred containers for Asheville VAMC, CBOC’s and Franklin HBPC, complying with all directives.

· Contractor shall develop a Document Shredding Plan for approval. The plan will require approval by the Chief of Environmental Management Services prior to implementation and is subject to the contracting officer’s approval.

· The contractors Document Shredding Plan shall establish the strategy and methods for conducting a safe, effective, and environmentally sound Shredding program in accordance with all HIPPA privacy rules, Federal, State and Local regulations.

· Contractor shall provide Certificate of Destruction upon completion of on-site shredding. Contractor shall also provide COR with monthly report of shred services for locations contracted for service.

· Contractor personnel are required to interrupt their work at any time so as not to interfere with the normal functioning of the facility, including utility services, fire protection systems, and passage of facility patients, personnel, equipment and carts. Contractor will perform services weekly for the Asheville VAMC.

· Contractors are not required to be NAID certified for onsite shredding however must comply with VA Directive 6371 Destruction of Temporary Paper Records.

· In the event of inclement weather, the entire work shall be rescheduled to a date and time satisfactory to the contractor and the Chief, Environmental Management Services. Postponement will not reflect any penalties assessed to the contractor, nor shall there be any additional cost to the Government.

· NOTE: Work is being completed in a hospital environment. The Contractor must take all precautions to ensure all tools and materials are under continuous observation and accountability. At no time will tools be left unattended or unsecured.

· When complete, notify the COR to inspect and accept all accomplished work.

· Ensure all invoicing documents are submitted in-accordance with the instructions provided in the formal contract.

(3) Scope of Work

· Provide bulk purging on site shredding

· Final Destruction to be: The process through which temporary paper records are pulped, macerated or shredded by pierce and tear method to a degree that definitively ensures that they are not readable or unable to reconstruct to any degree.

· Drivers never to touch paper and other materials such as tapes, plastic or CD’s

· Provide appropriate locked bins (96 gal) and executive console (40’H x 19 ½ W x 19” D)

· Provide labor to pick up containers throughout the Medical Center, CBOC’s and HBPC once a week and perform on-site shred.

· Provide a certificate of destruction upon completion of on-site shredding

· Turn around for emergency calls will be as soon as reasonably possible

· All materials to be recycled

(4) Other Station Rules and Guidelines. The Contractor will adhere to the following station rules.

4.1. All work will be accomplished to industry standards and compliant with all current CODE requirements (Life Safety, NFPA, Electrical and Building). All Dept. of Veteran Affairs, Federal regulations and codes will be complied with.

4.2. This is a hospital environment. The Contractor and his personnel are expected to be appropriately dressed (preferably uniformed) and to conduct themselves professionally.

4.3. This is a federal facility as well as a medical center. As such, there is NO tobacco usage allowed inside any federal building or on the grounds except in designated areas. The COR will brief the Contractor as to designated smoking areas prior to commencement of the contract. Failure to follow these regulations can result in removal of the worker or Contractor from the facility and/or a US Magistrate’s ticket and fine.

4.4. Parking will be in designated lots. Consult with the COR as to allowable parking.

4.5. Any work requiring a shutdown or utility outage will be requested in advance and scheduled by the COR prior to the work being accomplished.

4.6. The Contractor will be responsible for ensuring that all the employees and other personnel visiting the work site have and are using the appropriate Personal Protective Equipment (PPE) that addresses the particular hazards found at the site. The Contractor will be responsible for the upkeep, issue, and training for the PPE used and maintaining all required documentation

4.7. Since the incidents of September 11, 2001, the Federal Government has begun to implement new security measures to help protect federal facilities. The Contractor will provide to the COR a list of employees expected to work on this contract. This list will be on company letterhead and contain the employees’ name, driver’s license number, address and nationality. This list will be verified and signed by a corporate officer. These personnel are subject to a background check and fingerprinting to be eligible to receive a security badge.

4.8. Identification Badges will be picked up from Work Order Desk Room EB22 in Building 47 and temporary badges will be disposed of after each visit.

4.9. Compliance Awareness Training shall be completed by vendor prior to access to Charles George VAMC. Vendor has responsibility for “Duty to Report” any fraud, waste and abuse witnessed while on VA premises to the Compliance Officer.

C.2 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days.

C.3 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)

(a) The Government may extend the term of this contract by written notice to the Contractor within 30 days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed five (5) years and six (6) months .

C.4 VAAR 852.215-71 EVALUATION FACTOR COMMITMENTS (DEC 2009)

The offeror agrees, if awarded a contract, to use the service-disabled veteran-owned small businesses or veteran-owned small businesses proposed as subcontractors in accordance with 852.215-70, Service-Disabled Veteran-Owned and Veteran-Owned Small Business Evaluation Factors, or to substitute one or more service-disabled veteran-owned small businesses or veteran-owned small businesses for subcontract work of the same or similar value.

(End of Clause) C.5 VAAR 852.219-10 VA NOTICE OF TOTAL SERVICE-DISABLED VETERAN-OWNED SMALL BUSINESS SET-ASIDE (JUL 2016)(DEVIATION)

(a) Definition. For the Department of Veterans Affairs, “Service-disabled veteran-owned small business concern or SDVSOB”:

(1) Means a small business concern:

(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans or eligible surviving spouses (see VAAR 802.201 Surviving Spouse definition);

(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans (or eligible surviving spouses) or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran;

(iii) The business meets Federal small business size standards for the applicable North American Industry Classification System (NAICS) code identified in the solicitation document;

(iv) The business has been verified for ownership and control pursuant to 38 CFR 74 and is so listed in the Vendor Information Pages database, (https://www.vip.vetbiz.gov); and

(v) The business will comply with subcontracting limitations in 13 CFR 125.6, as applicable

(2) “Service-disabled veteran” means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).

(b) General.

(1) Offers are solicited only from verified service-disabled veteran-owned small business concerns. Offers received from concerns that are not verified service-disabled veteran-owned small business concerns shall not be considered.

(2) Any award resulting from this solicitation shall be made to a verified service-disabled veteran-owned small business concern.

(c) Agreement. A service-disabled veteran-owned small business concern agrees that in the performance of the contract, the concern will comply with the limitation on subcontracting requirements in 13 CFR §125.6.

(d) A joint venture may be considered a service-disabled veteran owned small business concern if the joint venture complies with the requirements in 13 CFR 125.15, provided that any reference therein to SDVO SBC is to be construed to apply to a VA verified SDVOSB as appropriate.

(e) Any service-disabled veteran-owned small business concern (non-manufacturer) must meet the requirements in FAR 19.102(f) of the Federal Acquisition Regulation to receive a benefit under this program.

(End of Clause) C.6 VAAR 852.219-75 SUBCONTRACTING COMMITMENTS MONITORING AND COMPLIANCE (JUL 2018)

(a) This solicitation includes the clause: 852.215-70 Service-disabled veteran-owned and veteran-owned small business evaluation factors. Accordingly, any contract resulting from this solicitation will include the clause 852.215-71 Evaluation factor commitments.

(b) The Contractor is advised that in performing contract administration functions, the Contracting Officer may use the services of a support contractor(s) to assist in assessing Contractor compliance with the subcontracting commitments incorporated into the contract. To that end, the support contractor(s) may require access to the Contractor's business records or other proprietary data to review such business records regarding contract compliance with this requirement.

(c) All support contractors conducting this review on behalf of VA will be required to sign an “Information Protection and Non-Disclosure and Disclosure of Conflicts of Interest Agreement” to ensure the Contractor's business records or other proprietary data reviewed or obtained in the course of assisting the Contracting Officer in assessing the Contractor for compliance are protected to ensure information or data is not improperly disclosed or other impropriety occurs.

(d) Furthermore, if VA determines any services the support contractor(s) will perform in assessing compliance are advisory and assistance services as defined in FAR 2.101, Definitions, the support contractor(s) must also enter into an agreement with the Contractor to protect proprietary information as required by FAR 9.505-4, Obtaining access to proprietary information, paragraph (b). The Contractor is required to cooperate fully and make available any records as may be required to enable the Contracting Officer to assess the Contractor compliance with the subcontracting commitments.

C.7 VAAR 852.237-70 CONTRACTOR RESPONSIBILITIES (APR 1984)

The contractor shall obtain all necessary licenses and/or permits required to perform this work. He/she shall take all reasonable precautions necessary to protect persons and property from injury or damage during the performance of this contract. (d) Comptroller General Examination of Record. SECTION E - SOLICITATION PROVISIONS

E.1 INSTRUCTION TO OFFEROR

Offers should submit all technical questions regarding the solicitation electronically to warren.pennil@va.gov by March 5, 2019 @ 12:00 PM EST. No questions will be answered after this date. All responses to questions, which may affect offers, will be incorporated via a solicitation amendment.

A complete offer shall include:

Pricing: Offers shall be submitted as requested in the Price Schedule comprised within the solicitation document.

Evaluation Method: Your quotation must demonstrate a clear understanding of the standards and requirements outlined in the solicitation. The feasibility of approach must meet contract requirements, which will be evaluated in respect to providing the VA with a high level of confidence in successful performance.

All factors will be evaluated based solely on the quote provided and to the extent in which the quote demonstrates a clear understanding of the requirements in meeting or exceeding the standards for the various tasks. Extent to which uncertainties are identified and resolutions proposed.

Contractor’s offer shall address their ability to meet contract requirements with respect to providing the VA with a high level of confidence in successful performance. 2. AWARD BASIS

The Government will award a firm fixed priced contract on the basis of the “best value” to the Government. Non-price factors will be rated on an “Acceptable/Unacceptable” basis. Failure to meet any of the requirements will result in an “Unacceptable” rating and eliminate the offeror from further consideration for contract award. The following factors shall be used to evaluate offers:

Factor I – Socioeconomic Category To be considered as eligible for SDVOSB set aside, all offerors shall be certified Service Disable Veteran Owned Small Business (SDVOSB) in the Office of Small and Disadvantaged Business Utilization’s (OSDBU), Vendor Information Pages (VIP) website; (www.vip.vetbiz.gov). Vendors not certified in www.vip.vetbiz.gov will not be considered.

Factor II – Technical Capability

1) EXPERIENCE: Offeror shall provide documentation supporting the offeror’s history and background in Document Shredding services that includes documentation demonstrating that the offeror has at least three (3) years of experience in the field of document shredding services. If the offeror intends to utilize a subcontractor to perform any of the shredding services, the technical quote must include documentation demonstrating that the subcontractor meets the requirements of having at least three (3) years of experience in the field of document shredding. FAILUE to provide documentation will result in an unacceptable rating.

2) The Technical Rating shall be rated in based on “Acceptable” or “Unacceptable” as follows:

o Acceptable: The quote clearly meets the minimum requirements of the solicitation.

o Unacceptable: The quote does not clearly meet the minimum requirements of the solicitation.

Factor III – Past Performance List 3 references and identify all federal, state, and local government contracts as well as any private/commercial contracts of similar scope, size, complexity that are ongoing or have been completed within the last three years. • Contract type (e.g. fixed-price, cost reimbursable) and total contract value Past performance information will be utilized to determine the quality of the contractor’s past performance as it relates to the probability of success of the required effort. The Government will evaluate customer satisfaction, responsiveness to customer needs, and past demonstration of meeting delivery schedules and the delivery of quality services. Emphasis will be on recent, relevant past performance in the previous 3 years. Recent is defined as work performed within the last three years. Relevant is defined as work similar in size and scope of the work described in the Statement of work (SOW).

Past performance information is one indicator of an offeror’s ability to perform the contract successfully. Current and relevant information, source of information, context of data, and general trends in Contractor’s performance shall be considered as it pertains to the performance of work described in this solicitation. Offerors may provide information on problems encountered on identified contracts and the offeror’s corrective action. The Government shall consider this information as well as information obtained from any other sources when evaluating the offeror’s past performance.

Since the Government may not necessarily interview all of the sources provided by the offerors, it is incumbent upon the offeror to explain the relevance of the data provided. Offerors are reminded that the Government may elect to consider data obtained from other sources.

Factor IV- Price Total price will be evaluated by the Government. In evaluating the offeror’s quoted price for this requirement, the government concern includes determining whether:

a. Quoted price reflects a clear understanding of the requirements, and is consistent with the various elements of the offeror’s quote.

b. Quoted price is reasonable in comparison with proposed prices received in response to the solicitation.

c. Quoted price is reasonable in comparison with prices with the independent Government cost estimate.

Failure to submit a complete quote may result in the quote being deemed technically unacceptable.

ADDENDUM to FAR 52.212-1 INSTRUCTIONS TO OFFERORS—COMMERCIAL ITEMS Provisions that are incorporated by reference (by Citation Number, Title, and Date), have the same force and effect as if they were given in full text. Upon request, the Contracting Officer will make their full text available.

The following provisions are incorporated into 52.212-1 as an addendum to this solicitation:

E.2 VAAR 852.215-70 SERVICE-DISABLED VETERAN-OWNED AND VETERAN-OWNED SMALL BUSINESS EVALUATION FACTORS (JUL 2016)(DEVIATION)

(a) In an effort to achieve socioeconomic small business goals, depending on the evaluation factors included in the solicitation, VA shall evaluate offerors based on their service-disabled veteran-owned or veteran-owned small business status and their proposed use of eligible service-disabled veteran-owned small businesses and veteran-owned small businesses as subcontractors.

(b) Eligible service-disabled veteran-owned offerors will receive full credit, and offerors qualifying as veteran-owned small businesses will receive partial credit for the Service-Disabled Veteran-Owned and Veteran-owned Small Business Status evaluation factor. To receive credit, an offeror must be registered and verified in Vendor Information Pages (VIP) database (https://www.vip.vetbiz.gov).

(c) Non-veteran offerors proposing to use service-disabled veteran-owned small businesses or veteran-owned small businesses as subcontractors will receive some consideration under this evaluation factor. Offerors must state in their proposals the names of the SDVOSBs and VOSBs with whom they intend to subcontract and provide a brief description of the proposed subcontracts and the approximate dollar values of the proposed subcontracts. In addition, the proposed subcontractors must be registered and verified in the VetBiz.gov VIP database (https://www.vip.vetbiz.gov).
