The Contractor shall furnish all materials, supplies, equipment, personnel and supervision to accomplish project number 526-21-111 to Replace Main Kitchen Freezers. Completion Time: 330 Calendar Days from the Notice to Proceed

This is a 100% Service-Disabled Veteran Owned Small Business set aside procurement.

All prospective bidders must be registered in SAM (www.sam.gov), and are verified/visible/certified in VIP VetBiz (https://www.vetbiz.va.gov) at the time of offer submission and before award of this procurement. Offerors must submit their annual Vets 4212 Report. Magnitude of Construction is between $2,000,000 - $5,000,000. The North American Industry Classification System Code (NAICS) is 238220- Business Size is $19.5 Million.

Contractor will be responsible to coordinate and schedule work and shall be expected to plan work typically during duty hours of 8 AM to 4:30 PM eastern time except as noted in the general conditions and as approved by the CO. Work shall comply with VA Specifications and regulations, all applicable Federal, State and Local codes, including specific regulations related to working at the Bronx VA Campus.

A pre-bid site visit is scheduled for 12/20/2023 at 10:00 AM EST. Prospective bidders will meet at the JJP Bronx VAMC Campus, Building 100- Engineering Reception area NOTE: NO OTHER SITE VISITS WILL BE ALLOWED. INTERESTED BIDDERS ARE STRONGLY ENCOURAGED TO ATTEND.

A. SCOPE OF WORK

This project is to “Replace Main Kitchen Freezers” at the ground level of building 100 at the JJP VAMC in Bronx, NY. The installation of the new refrigerators and freezers will require the phasing of the demolition and new construction as specified in the drawings and specifications. The kitchen will remain operational for the duration of the contract so the contractor will work hours specified and assure kitchen operations are not affected, and the contractor will provide temporary refrigerators and freezers in accordance with the drawings and specifications.

Work shall be included but not limited to following items:

· Contractor shall perform field verifications prior to submitting any submittals and any purchasing.

· Contractor shall provide submittals for review and approval on all items as specified in the specifications prior to mobilization.

· Contractor shall provide CPM-project schedule within one week of notice to proceed, updated schedule and progress report with each invoice submission for the payment approval.

· Kitchen will remain occupied throughout the duration of the project. All work inside the kitchen shall be conducted between the hours of 6:00pm and 6:00am.

· Areas outside of main kitchen can be worked between the regular work hours of 8:00am and 4:00pm.

· All domestic water, electrical, steam, chilled, and heating hot water shutdowns shall be requested two weeks in advance.

· Contractor shall provide a site-specific work plan for approval.

· Contractor shall provide daily logs during the duration of the project.

· Contractor shall provide daily cleanup of work site and remove of all excess materials at the end of each workday.

· Contractor shall dispose existing materials as per VA GEMS recommendations and submit monthly waste generating reports with invoices.

· Contractor shall test the whole system when installation is complete to verify proper operation and will be responsible for troubleshooting the system until fully functioning. This will include acquiring the expertise of the current Bronx VA fire alarm vendor, control vendor, etc to provide a fully successful installation.

· Contractor to provide training on all new Freezer equipment as necessary.

· Contractor is responsible for electrical wiring of ALL new devices required for the complete installation of the Main Kitchen Freezers including any/all wiring for devices required to operate, control and monitor the freezer units.

· Contractor shall provide all equipment testing reports and operations manual to the James J Peters VA Medical Center Facility Management Division.

B. SAFETY REQUIREMENTS

Contractor shall comply with VA and OSHA safety standards.

C. PERIOD OF PERFORMANE

All work must be completed within 330 calendar days of notice to proceed. This period of performance includes reasonable durations for all submittals to be approved prior to beginning construction. Contractor is required to notify the COR/CO prior to any approved work to be performed at the JJP VAMC.

D. WARRANTY

The contractor shall guarantee that all work performed will be free from all defects in workmanship and materials and that all installation will provide the capacities and characteristics specified. The contractor further guarantees that if, during a period of one year from the date of the certificate of completion and acceptance of the work, any such defects will be repaired by the contractor at their own cost.

E. INSPECTION

A final inspection for quality assurance shall take place by VA personnel prior to acceptance of the work.

Bids providing less that 120 Calendar Days of Government Acceptance after the date bids are due will not be considered and will be rejected.

The bidder agrees to perform the work required at the prices specified below in strict accordance with the terms of the solicitation if this bid is accepted by the Government in writing within 120 calendar days after the date bidders are due.

Base Bid (Item #1) General Construction - Contractor shall furnish materials, equipment, personnel and supervision to accomplish the work as described in the contract drawings, specifications specified herein and comply with VA specifications and VA regulations, procedures and conditions for work at the Bronx VAMC center and any applicable codes as per requirements of all governing agencies for Project 526-21-111 to “Replace Main Kitchen Freezers” at the James J. Peters DVA Medical Center, Bronx Campus.

Work shall comply with VA Specifications and regulations, all applicable Federal, State and Local codes including specific regulations related to working at the James J. Peters DVA Bronx Campus.

Contractor shall be responsible to complete the work within the contractual period of performance, and within the work hours as defined in the contract. Contractor shall be responsible to plan and develop activities, phasing and project scheduling. Contractor shall be responsible to coordinate and schedule work to minimize any utility /service shutdowns for the Replace Main Kitchen Freezers project.

The Bidding Contractors shall inspect the areas of work prior to bidding.

ITEM 1 – Base Bid (Entire Scope of Work).

Contractor will furnish all materials, equipment, labor, and personnel necessary to accomplish the project Scope of Work below. All work will be completed as per contract drawings and specifications and must comply with all applicable OSHA, NFPA, VA Regulations and New York State Codes.

INFORMATION REGARDING BIDDING MATERIAL, BID GUARANTEE AND BONDS

(a) Bidding materials consisting of Invitation for Bids, drawings, specifications and contract forms will be available on https://sam.gov/ in electronic format only by searching for solicitation number 36C24223B0046. All interested parties (subs & primes) should register at https://sam.gov/ as an “Interested Vendor” so that others will know of our interest in participating in this procurement. A Bidder’s mailing list WILL NOT BE prepared by the Contract Specialist. SOLICITATION AMENDMENTS: Amendments to the solicitation will be posted at https://sam.gov/ Paper copies of the amendments will NOT be individually mailed. By registering to “Receive Notification”, you will be notified by e-mail of any new amendments that have been issued and posted. No other notification of amendments will be provided. Bidders are reminded that they are responsible for obtaining and acknowledging all amendments to this solicitation prior to the time for receipt of bids.

(b) If bid exceeds $150,000 a bid bond must be submitted. A bid guarantee is required in an amount not less than 20 percent of the bid price but shall not exceed $3,000,000. Failure to furnish the required bid guarantee in the proper form and amount, by the time set for opening of bids, will require rejection of the bid in all cases except those listed in FAR 28.101-4, and may be cause for rejection even then.

(c) If the contract will exceed $150,000 (see FAR 28.102-1 for lesser amount), the bidder to whom award is made will be required to furnish two bonds, a Payment Bond, SF 25A, and a Performance Bond, SF 25, each in the penal sum as noted in the General Conditions of the Specification. Copies of SFs 25 and 25A may be obtained upon application to the issuing office.

(d) If the bid is between $30,000 - $150,000. The bidder to whom award is made will be required to furnish a Payment Bond, Standard Form 25A or alternative payment protection which conforms to the requirements set forth in FAR Clause 52.228-13, Alternative Payment Protections, as noted in the General Conditions of this Specification. Copies of the Standard Form of Payment Bond may be obtained upon application to the Issuing Office.

Peters DVA Medical Center, Bronx, NY.

The Government contemplates award of a Firm-Fixed-Price contract resulting from this solicitation.

2.2 52.222-5 CONSTRUCTION WAGE RATE REQUIREMENTS—SECONDARY SITE OF THE WORK (MAY 2014) (a)(1) The offeror shall notify the Government if the offeror intends to perform work at any secondary site of the work, as defined in paragraph (a)(1)(ii) of the FAR clause at 52.222-6, Construction Wage Rate Requirements, of this solicitation.

(2) If the offeror is unsure if a planned work site satisfies the criteria for a secondary site of the work, the offeror shall request a determination from the Contracting Officer.

(b)(1) If the wage determination provided by the Government for work at the primary site of the work is not applicable to the secondary site of the work, the offeror shall request a wage determination from the Contracting Officer.

(2) The due date for receipt of offers will not be extended as a result of an offeror's request for a wage determination for a secondary site of the work.

These goals are applicable to all the Contractor's construction work performed in the covered area. If the Contractor performs construction work in a geographical area located outside of the covered area, the Contractor shall apply the goals established for the geographical area where the work is actually performed. Goals are published periodically in the Federal Register in notice form, and these notices may be obtained from any Office of Federal Contract Compliance Programs office.

(c) The Contractor's compliance with Executive Order 11246, as amended, and the regulations in 41 CFR 60-4 shall be based on (1) its implementation of the Equal Opportunity clause, (2) specific affirmative action obligations required by the clause entitled "Affirmative Action Compliance Requirements for Construction," and (3) its efforts to meet the goals. The hours of minority and female employment and training must be substantially uniform throughout the length of the contract, and in each trade. The Contractor shall make a good faith effort to employ minorities and women evenly on each of its projects. The transfer of minority or female employees or trainees from Contractor to Contractor, or from project to project, for the sole purpose of meeting the Contractor's goals shall be a violation of the contract, Executive Order 11246, as amended, and the regulations in 41 CFR 60-4. Compliance with the goals will be measured against the total work hours performed.

(d) The Contractor shall provide written notification to the Deputy Assistant Secretary for Federal Contract Compliance, U.S. Department of Labor, within 10 working days following award of any construction subcontract in excess of $10,000 at any tier for construction work under the contract resulting from this solicitation. The notification shall list the—

(1) Name, address, and telephone number of the subcontractor;

(2) Employer's identification number of the subcontractor;

(3) Estimated dollar amount of the subcontract;

(4) Estimated starting and completion dates of the subcontract; and

(5) Geographical area in which the subcontract is to be performed.

2.4 52.225-12 NOTICE OF BUY AMERICAN REQUIREMENT—CONSTRUCTION MATERIALS UNDER TRADE AGREEMENTS (MAY 2014) ALTERNATE I (MAY 2014) AND ALTERNATE II (JUN 2009)

(a) Definitions. "Bahrainian, Mexican, or Omani construction material," "commercially available off-the-shelf (COTS) item," "construction material," "designated country construction material," "domestic construction material," and "foreign construction material," as used in this provision, are defined in the clause of this solicitation entitled "Buy American—Construction Materials Under Trade Agreements" (Federal Acquisition Regulation (FAR) clause 52.225-11).

(b) Requests for determination of inapplicability. An offeror requesting a determination regarding the inapplicability of the Buy American statute shall submit the request with its offer, including the information and applicable supporting data required by paragraphs (c) and (d) of FAR clause 52.225-11.

(c) Evaluation of offers.

(1) The Government will evaluate an offer requesting exception to the requirements of the Buy American statute, based on claimed unreasonable cost of domestic construction materials, by adding to the offered price the appropriate percentage of the cost of such foreign construction material, as specified in paragraph (b)(4)(i) of FAR clause 52.225-11.

(2) If evaluation results in a tie between an offeror that requested the substitution of foreign construction material based on unreasonable cost and an offeror that did not request an exception, the Contracting Officer will award to the offeror that did not request an exception based on unreasonable cost.

(d) Alternate offers.

(1) When an offer includes foreign construction material, except foreign construction material from a designated country other than Bahrain, Mexico, or Oman that is not listed by the Government in this solicitation in paragraph (b)(3) of FAR clause 52.225-11, the offeror also may submit an alternate offer based on use of equivalent domestic or designated country construction material other than Bahrainian, Mexican, or Omani construction material.

(2) If an alternate offer is submitted, the offeror shall submit a separate Standard Form 1442 for the alternate offer, and a separate price comparison table prepared in accordance with paragraphs (c) and (d) of FAR clause 52.225-11 for the offer that is based on the use of any foreign construction material for which the Government has not yet determined an exception applies.

(3) If the Government determines that a particular exception requested in accordance with paragraph (c) of FAR clause 52.225-11 does not apply, the Government will evaluate only those offers based on use of the equivalent domestic or designated country construction material other than Bahrainian, Mexican, or Omani construction material. An offer based on use of the foreign construction material for which an exception was requested—

(i) Will be rejected as nonresponsive if this acquisition is conducted by sealed bidding; or

(a) Definitions. 2.10 VAAR 852.219-75 SUBCONTRACTING COMMITMENTS MONITORING AND COMPLIANCE (JUL 2018)

(a) This solicitation includes the clause: 852.215-70 Service-disabled veteran-owned and veteran-owned small business evaluation factors. Accordingly, any contract resulting from this solicitation will include the clause 852.215-71 Evaluation factor commitments.

(b) The Contractor is advised that in performing contract administration functions, the Contracting Officer may use the services of a support contractor(s) to assist in assessing Contractor compliance with the subcontracting commitments incorporated into the contract. To that end, the support contractor(s) may require access to the Contractor's business records or other proprietary data to review such business records regarding contract compliance with this requirement.

(a) Any protest filed by an interested party shall—

(2) Identify the solicitation and/or contract number;

3.2 52.209-7 INFORMATION REGARDING RESPONSIBILITY MATTERS (OCT 2018)

(a) Definitions. As used in this provision— "Administrative proceeding" means a non-judicial process that is adjudicatory in nature in order to make a determination of fault or liability (e.g., Securities and Exchange Commission Administrative Proceedings, Civilian Board of Contract Appeals Proceedings, and Armed Services Board of Contract Appeals Proceedings). This includes administrative proceedings at the Federal and State level but only in connection with performance of a Federal contract or grant. It does not include agency actions such as contract audits, site visits, corrective plans, or inspection of deliverables.
