This project is for the MRI Site Prep in building 16 at the Hudson Valley Healthcare System

Castle Point VAMC, 41 Castle Point Road, Wappingers Falls, New York 12590.

The Contractor is responsible for providing all labor, materials, tools, equipment, supplies and supervision to prepare the MRI site in building 16 in accordance with the statement of work, specifications and drawings attached hereto. COMPLETION TIME: 240 Calendar Days from the Notice to Proceed date.

Contractor will be responsible to coordinate and schedule work and shall be expected to plan work typically during duty hours of 8 AM to 4:30 PM eastern time except as noted in the general conditions and as approved by the CO. Work shall comply with VA Specifications and regulations, all applicable Federal, State and Local codes, including specific regulations related to working at the VA Castle Point Campus.

This is a Service Disable Veteran Owned Small Business set aside procurement and will be conducted in accordance with

Public Law 109-461. All prospective bidders must be registered in SAM (www.sam.gov), Dun & Bradstreet (www.DNB.com) and are verified/visible/certifiedin VIP VetBiz (www.vetbiz.gov) at the time of offer submission and before award of this procurement. Offerors must submit their annual Vets4212 Report. Magnitude of Construction: Between $1,000,000 and

$2,000,000. The North American Industry Classification System Code (NAICS) is 236220 Business Size is $39.5 Million.

A prebid site visit is scheduled for 3/2/2021 at 10:00am EST. Prospective Bidders shall meet at the VA Castle Point

Campus, Building 9 Engineering Conference Room, 41 Castle Point Road, Wappingers Falls, New York 12590.

NOTE: NO OTHER SITES VISITS WILL BE ALLOWED. INTERESTED BIDDERS ARE STRONGLY ENCOURAGED TO ATTEND.

To preserve the integrity of the procurement process, all questions and request for information must be submitted in writing to Daniel Barone, Contracting Officer via email at daniel.barone@va.gov.

Questions must be received no later than 03/18/2020 at 4:00PM EST.

The bid opening will be held online via a Cisco Webex Teleconference due to COVID-19. Details will be sent via a solicitation amendment. ONLY EMAILED BIDS to DANIEL.BARONE@VA.GOV shall be accepted. The bids shall include copies of the original bid bond. The bid opening shall take place on Wednesday, April 7th at 10:00 EST.

Original Bids and bid bonds shall be sent to the contracting officer no later than two weeks after the bid opening.

Scope of Work

Construction Services for Project No. 620A4-18-217

“SITE PREPARATION AND UPGRADE MODIFICATION FOR INSTALLATION OF

SEIMANS 3.0 T MRI”

Background

The Castle Point Facility currently uses a 1.5t MRI a 3.0T unit offers better detail and diagnostics capabilities. The improvements will directly result in better care for our veterans

Objectives

Site preparation for the Replacement of 1.5t MRI with a 3.0t MRI located in the Ground floor of building

16 at the Department of Veterans Affairs Medical Center, Castle Point, New York. Contractor will work and coordinate with the MRI suppliers AE and Engineering team to ensure a successful install of new

3.0T MRI.

Period of Performance

The period of performance to complete the entire contract is 240 Calendar-days from NTP, with construction to be completed according to the phased schedule below.

- Phase I, Submissions: 15 Calendar-days duration, to be completed within 15 Calendar-days of

NTP

- Phase II, Government Review: 15 Calendar-days duration, to be completed within 30 Calendar-days of NTP

- Phase III, Construction: 210 Calendar-day duration.

Place of Performance / Place of Delivery

The place of performance for this contract is at the VA Hudson Valley Health Care System, Castle Point

Campus, Castle Point, New York.

Scope or Task (for services)

The Contractor shall furnish materials, equipment, personnel and supervision to accomplish the work as described in the contract drawings, specifications specified herein for Project 620A4-18-217 SITE

PREPARATION AND UPGRADE MODIFICATION FOR INSTALLATION OF SEIMANS 3.0 T MRI

at Castle Point Campus of the Hudson Valley Health Care System, New York.

Work shall comply with VA Specifications and regulations, all applicable Federal, State and Local codes including specific regulations related to working at the VA Medical Center.

Contractor shall be responsible to complete the work within the contractual period of performance, and within the work hours as defined in the contract. Contractor shall be responsible to plan and develop activities, phasing and project scheduling per proposed Phasing Plans.

The Bidding Contractors shall inspect the areas of work prior to bidding.

Scope of Work for the Base Bid includes the following description of work, as defined in the contract documents but not be limited to:

• Contractor shall completely prepare site for building operations, including demolition and removal of existing structures, and furnish labor and materials and perform work for Building 16

MRI Replacement as required by drawings and specifications.

• ITEM I, GENERAL CONSTRUCTION, Re-roofing, Fall Protection: Work includes general construction, staging construction area, roofing alterations, walls and other general construction activities for a complete and operable structure.

• ITEM II, Electrical Work: New Split-Systems and Lighting Fixtures: Work includes all labor, material, equipment and supervision to perform the required electrical construction work on this project including but not limited to general lighting and power, equipment power and fire alarm system alterations. Install all wire & cabling, make all connections, terminations, and patch panel connections to all it/phone and control systems to allow a complete commissioning of systems installed or interfacing with this project’s equipment and/or process. Coordinate with VA its department prior to install.

• ITEM III, Mechanical Work: New Split-Systems and New Energy Recovery Ventilator: Work includes all labor, material, equipment and supervision to perform the required mechanical construction work on this project including but not limited new split-systems, new ERV, new split-system controls, ductwork, fire sprinkler system alterations and general demolition.

The bidder agrees to perform the work required at the prices specified below in strict accordance with the terms of the solicitation, if this bid is accepted by the Government in writing within 120 calendar days after the date bidders are due.

BASE BID: The Contractor shall furnish materials, equipment, personnel and supervision in order to accomplish the work as described in the contract documents for Project 620A4-18-217 MRI Site Prep in

Building 16 at VA Hudson Valley Health Care System, Castle Point Campus, 41 Castle Point Road, Wappingers Falls, New York, 12590.

(a) Bidding materials consisting of Invitation for Bids, drawings, specifications and contract forms will be available on http://www.beta.sam.gov in electronic format only by searching for solicitation number

36C24221B0024. All interested parties (subs & primes) should register at http://www.beta.sam.gov as an

“Interested Vendor” so that others will know of our interest in participating in this procurement. A

Bidder’s mailing list WILL NOT BE prepared by the Contract Specialist. SOLICITATION

AMENDMENTS: Amendments to the solicitation will be posted at http://www.beta.sam.gov. Paper copies of the amendments will NOT be individually mailed. By registering to “Receive Notification”, you will be notified by e-mail of any new amendments that have been issued and posted. No other notification of amendments will be provided. Bidders are reminded that they are responsible for obtaining and acknowledging all amendments to this solicitation prior to the time for receipt of bids.

(b) If bid exceeds $150,000 a bid bond must be submitted. A bid guarantee is required in an amount not less than 20 percent of the bid price but shall not exceed $3,000,000. Failure to furnish the required bid guarantee in the proper form and amount, by the time set for opening of bids, will require rejection of the bid in all cases except those listed in FAR 28.101-4, and may be cause for rejection even then.

(c) If the contract will exceed $150,000 (see FAR 28.102-1 for lesser amount), the bidder to whom award is made will be required to furnish two bonds, a Payment Bond, SF 25A, and a Performance Bond, SF 25, each in the penal sum as noted in the General Conditions of the Specification. Copies of SFs 25 and 25A may be obtained upon application to the issuing office.

(d) If the bid is between $30,000 - $150,000. The bidder to whom award is made will be required to furnish a Payment Bond, Standard Form 25A or alternative payment protection which conforms to the requirements set forth in FAR Clause 52.228-13, Alternative Payment Protections, as noted in the General

Conditions of this Specification. Copies of the Standard Form of Payment Bond may be obtained upon application to the Issuing Office.

2.2 52.222-5 CONSTRUCTION WAGE RATE REQUIREMENTS—SECONDARY SITE OF

THE WORK (MAY 2014)

(a)(1) The offeror shall notify the Government if the offeror intends to perform work at any secondary site of the work, as defined in paragraph (a)(1)(ii) of the FAR clause at 52.222-6, Construction Wage Rate

Requirements, of this solicitation.

(2) If the offeror is unsure if a planned work site satisfies the criteria for a secondary site of the work, the offeror shall request a determination from the Contracting Officer.

(b)(1) If the wage determination provided by the Government for work at the primary site of the work is not applicable to the secondary site of the work, the offeror shall request a wage determination from the

Contracting Officer.

(2) The due date for receipt of offers will not be extended as a result of an offeror's request for a wage determination for a secondary site of the work.

2.3 52.225-10 NOTICE OF BUY AMERICAN REQUIREMENT—CONSTRUCTION

MATERIALS (MAY 2014)

(a) Definitions. "Commercially available off-the-shelf (COTS) item," "construction material," "domestic construction material," and "foreign construction material," as used in this provision, are defined in the clause of this solicitation entitled "Buy American—Construction Materials" (Federal Acquisition

Regulation (FAR) clause 52.225-9).

(b) Requests for determinations of inapplicability. An offeror requesting a determination regarding the inapplicability of the Buy American statute should submit the request to the Contracting Officer in time to allow a determination before submission of offers. The offeror shall include the information and applicable supporting data required by paragraphs (c) and (d) of the clause at FAR 52.225-9 in the request. If an offeror has not requested a determination regarding the inapplicability of the Buy American statute before submitting its offer, or has not received a response to a previous request, the offeror shall include the information and supporting data in the offer.

(c) Evaluation of offers.

(1) The Government will evaluate an offer requesting exception to the requirements of the Buy

American statute, based on claimed unreasonable cost of domestic construction material, by adding to the offered price the appropriate percentage of the cost of such foreign construction material, as specified in paragraph (b)(3)(i) of the clause at FAR 52.225-9.

(2) If evaluation results in a tie between an offeror that requested the substitution of foreign construction material based on unreasonable cost and an offeror that did not request an exception, the

Contracting Officer will award to the offeror that did not request an exception based on unreasonable cost.

(d) Alternate offers.

(1) When an offer includes foreign solicitation in paragraph (b)(2) of the clause at FAR 52.225-9, the offeror also may submit an alternate offer based on use of equivalent domestic construction material.

(2) If an alternate offer is submitted, the offeror shall submit a separate Standard Form 1442 for the alternate offer, and a separate price comparison table prepared in accordance with paragraphs (c) and (d) of the clause at FAR 52.225-9 for the offer that is based on the use of any foreign construction material for which the Government has not yet determined an exception applies.

(3) If the Government determines that a particular exception requested in accordance with paragraph

(c) of the clause at FAR 52.225-9 does not apply, the Government will evaluate only those offers based on use of the equivalent domestic construction material, and the offeror shall be required to furnish such domestic construction material. An offer based on use of the foreign construction material for which an exception was requested—

(i) Will be rejected as nonresponsive if this acquisition is conducted by sealed bidding; or

(ii) May be accepted if revised during negotiations.

(a) Any protest filed by an interested party shall—

(1) Include the name, address, fax number, email and telephone number of the protester;

(2) Identify the solicitation and/or contract number;

(3) Include an original signed by the protester or the protester’s representative and at least one copy;

(4) Set forth a detailed statement of the legal and factual grounds of the protest, including a description of resulting prejudice to the protester, and provide copies of relevant documents;

3.2 52.204-24 REPRESENTATION REGARDING CERTAIN TELECOMMUNICATIONS AND

VIDEO SURVEILLANCE SERVICES OR EQUIPMENT (OCT 2020)

The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it ‘‘does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument’’ in paragraph (c)(1) in the provision at 52.204–26, Covered Telecommunications

Equipment or Services—Representation, or in paragraph (v)(2)(i) of the provision at 52.212–3, Offeror

Representations and Certifications–Commercial Items. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it ‘‘does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services’’ in paragraph (c)(2) of the provision at 52.204–26, or in paragraph (v)(2)(ii) of the provision at 52.212–3.

Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204–25, Prohibition on Contracting for Certain Telecommunications and Video

(b) Prohibition. (1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for

Fiscal Year 2019 (Pub. L. 115–232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to—

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year

2019 (Pub. L. 115–232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to—

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award

Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for

“covered telecommunications equipment or services.”

3.3 52.209-7 INFORMATION REGARDING RESPONSIBILITY MATTERS (OCT 2018)

(a) Definitions. As used in this provision—

"Administrative proceeding" means a non-judicial process that is adjudicatory in nature in order to make a determination of fault or liability (e.g., Securities and Exchange Commission Administrative

Proceedings, Civilian Board of Contract Appeals Proceedings, and Armed Services Board of Contract

Appeals Proceedings). This includes administrative proceedings at the Federal and State level but only in connection with performance of a Federal contract or grant. It does not include agency actions such as contract audits, site visits, corrective plans, or inspection of deliverables.

"Federal contracts and grants with total value greater than $10,000,000" means—

(1) The total value of all current, active contracts and grants, including all priced options; and

(2) The total value of all current, active orders including all priced options under indefinite-delivery, indefinite-quantity, 8(a), or requirements contracts (including task and delivery and multiple-award
