The Contractor shall furnish all materials, supplies, equipment, personnel and supervision to accomplish project number 561-19-127 Hazardous Floor Replacement in acoordance with the Statement of Work (SOW), specifications and drawings attached hereto.
Contractor will be responsible to coordinate and schedule work to minimize to short duration and shall be expected to plan work typically during duty hours of 8 AM to 4:30 PM eastern time except as noted in the general conditions and as approved by the CO. Work shall comply with VA Specifications and regulations, all applicable Federal, State and Local codes, including specific regulations related to working at the East Orange NJ VAMC
This is a Veteran Owned Small Business (VOSB) set aside procurement and will be conducted in accordance with Public Law 109-461. All prospective bidders must be registered in SAM (www.sam.gov) under NAICS code 238330, Dun & Bradstreet (www.DNB.com) and are verified/visible/certified in VIP VetBiz (www.vetbiz.gov) at the time of offer submission and before award of this procurement. Offerors must submit their annual Vets-4212 Report.
Magnitude of Construction: Between $250,000 and $500,000. The North American Industry Classification System Code (NAICS) is 238330- Business Size is $16.5 Million. Completion Time: 120 calendar days from the notice-to-proceed date.
A prebid site visit is scheduled for 12/17/2019 at 9:30AM EST. Prospective bidders shall meet at the VA East Orange campus Building 1 lobby.

STATEMENT OF WORK
Hazardous Floor Replacement
PROJECT NO. 561-19-127
As of: August 15, 2019
1. Contract Title:
Hazardous Floor Replacement.
2. Background:
Flooring material has been a concern and an area for discussion regarding infection control especially in healthcare facility and the project stemmed from the demand to replace carpet floors, vinyl tiles, vinyl sheets, the fragmented tripping hazardous floors and replace it with a more durable, hygienic friendly material.
3. Scope:
Work is located in VA New Jersey Health Care System East Orange Campus, multiple rooms and corridors in multiple floors in building (1) and building (18). The existing carpet and vinyl floors need to be replaced due to wear, hygienic concerns as well as chips and cracks in several locations. The flooring in rooms, corridors and areas to be replaced with Medical Grade seamless surface of new vinyl sheet, vinyl composition tile (VCT), luxury vinyl tiles (LVT) and rubber flooring with a continuous 6” base cove height at wall and cabinets with an approximate square footage of average 8300 SF in multiple locations as per the attached schedule.
4. Specific Tasks:
The scope of work shall include but not be limited to the following:
The rooms, corridors and areas in the attached schedule will require the complete removal of all existing flooring materials including but not limited to carpet, vinyl sheets, vinyl tiles and existing base cove in the same areas as the removed flooring. Condition of substrate is unknown until once the original floor materials are removed, cannot be established at this time. Contractor shall use care to ensure that substrate remains intact and that proper floor preparation can be completed per manufacturer’s specifications, general accepted industry practices, and all applicable VA specifications.
1. The Contractor shall be responsible for moving out of the work space all furniture with direct VA supervision, while the VA shall be responsible for removing/disconnecting IT equipment. Temporary storage nearby locations will be planned and coordinated with the VA moving committee, the service and the COR.
2. Contractor shall submit a work schedule including location and time period, and in an effort to speed up the work and cut down on the cost, the VA will accommodate the contractor based on availability, and allow work in multiple locations at once (Three or more), co-ordination for work locations will take place between contractor, COR, the service and the VA moving committee.
3. After contractor finish new flooring installation, the contractor shall move all furniture back to the work space with VA supervision, while the VA shall be responsible for re-connecting IT equipment.
4. Floor preparation shall include the following activities:
· The Contractor shall remove existing flooring down to the floor concrete slab unless noted.
· The Contractor shall be responsible for asbestos abatement and air monitoring, the Contractor will Retain and provide (VPIH/CIH) Monitoring services for all abatements that will take place during construction period services. Have subcontracted firm supply state mandated/required sample readings as well as a certified final report. The Subcontractor shall perform all requirements as specified on VA specification sections (02 82 13.19–27, 2.3.2 SCOPE OF SERVICES OF THE VPIH/CIH CONSULTANT) (02 82 11-30, 2.3.2 SCOPE OF SERVICES OF THE VPIH/CIH CONSULTANT) (02 82 13.13-27, 2.3.2 SCOPE OF SERVICES OF THE VPIH/CIH CONSULTANT)
· Walls, ceilings, ductwork and any fixtures that remain in the work areas shall be properly protected from damage and dust particles during and throughout the new flooring installation.
· The Contractor shall clean the floor surface free of all dust, dirt or built-up grime, solvents, varnish, paint, wax, oil, grease, sealers, curing compounds, residual adhesive, adhesive removers and any other foreign materials that might affect the adhesion of resilient flooring to the substrate or cause a discoloration of the flooring from below.
· The Contractor shall inspect floors for deficiencies and prepare all floors according to the new floor manufacturer recommendations and the VA specifications.
· The preparation of the floors will include but not limited to priming floors and the use of Self-Leveling Underlayment to have clean smooth, dry surface free of deficiencies and ready for the new floor installation.
· Primer shall be specifically manufactured to work with the specifically approved flooring materials approved by the VA and shall be applied over the entire substrate, shall be uniformly applied, and shall be free from pores and pinholes.
· If an alternate product is recommended by the Contractor, all comparative data shall be presented to the VA as a submission. VA may reject alternate products recommended by the Contractor if, in the opinion of the Contracting Officer and COR, said product is inferior.
· Allow the recommended drying time by manufacturer before the installation of the new floors.
· New flooring to be installed as per the manufacturer recommendations and the VA Specifications. Where pattern finish is selected, align for seaming. Only use adhesive, seam sealer, and heat weld seaming materials expressly approved by the manufacturer, as specified in the manufacturer’s technical documents.
· The contractor shall provide a per square foot price (for each finish) for any additional square footage that needs to be added to the approximate square footage that is indicated in the contract.
5. Performance Monitoring (if applicable).
The designated COR will monitor the contract performance and make sure the Contractor adheres to VA standards and designated project milestones. The contractor is required to submit daily’s progress report to the COR. Work schedule shall be coordinated with facility thru the COR on a weekend, after hours and/or week days basis.
6. Security Requirements.
General Contractor’s employees shall not enter the project site without appropriate badge. They may also be subject to inspection of their personal effects when entering or leaving the project site. For working outside the normal day working hours as defined in the Contract, The General Contractor shall give 3 days’ notice to the Contracting Officer so that security [escort] [arrangements] can be provided for contractor employees.
No photography of VA premises is allowed without written permission of the Contracting Officer.
VA reserves the right to close down or shut down the project site and order General Contractor’s employees off the premises in the event of a national emergency. The General Contractor may return to the site only with the written approval of the Contracting Officer.

C. Inspection and Acceptance Criteria.
The COR is responsible for certifying that the work done under the contract is performed to time and standard. They are also responsible to assure the inspection and acceptance of products provided incidental to services.
9. Risk Control
Contractor shall take all measures for safety & infection control and provide all material necessary for protecting existing equipment and property in affected areas of construction against dust and debris, so that equipment and affected areas to be used in the Medical Centers operations will not be hindered.
Contractor shall permit access to Department of Veterans Affairs personnel and patients through other construction areas which serve as routes of access to such affected areas and equipment. Coordinate alteration work in areas occupied by Department of Veterans Affairs so that Medical Center operations will continue during the construction period.
10. Place of Performance.
Minimize interference of construction activities with flow of Medical Center traffic, keep roads, walk ways and entrances to grounds, to parking and to occupied areas of buildings clear of construction materials, debris and standing construction equipment and vehicles.
11. Period of Performance.
Contractor to start immediately after receiving the NTP, estimate completion time is 120 calendar days.

(a) Bidding materials consisting of Invitation for Bids, drawings, specifications and contract forms will be available on http://www.fedbizopps.gov in electronic format only by searching for solicitation number 36C24219B0059_1. All interested parties (subs & primes) should register at http://www.fedbizopps.gov as an “Interested Vendor” so that others will know of our interest in participating in this procurement. A Bidder’s mailing list WILL NOT BE prepared by the Contract Specialist. SOLICITATION AMENDMENTS: Amendments to the solicitation will be posted at http://www.fedbizopps.gov. Paper copies of the amendments will NOT be individually mailed. By registering to “Receive Notification”, you will be notified by e-mail of any new amendments that have been issued and posted. No other notification of amendments will be provided. Bidders are reminded that they are responsible for obtaining and acknowledging all amendments to this solicitation prior to the time for receipt of bids.
(b) If bid exceeds $150,000 a bid bond must be submitted. A bid guarantee is required in an amount not less than 20 percent of the bid price but shall not exceed $3,000,000. Failure to furnish the required bid guarantee in the proper form and amount, by the time set for opening of bids, will require rejection of the bid in all cases except those listed in FAR 28.101-4, and may be cause for rejection even then.
(c) If the contract will exceed $150,000 (see FAR 28.102-1 for lesser amount), the bidder to whom award is made will be required to furnish two bonds, a Payment Bond, SF 25A, and a Performance Bond, SF 25, each in the penal sum as noted in the General Conditions of the Specification. Copies of SFs 25 and 25A may be obtained upon application to the issuing office.
(d) If the bid is between $30,000 - $150,000. The bidder to whom award is made will be required to furnish a Payment Bond, Standard Form 25A or alternative payment protection which conforms to the requirements set forth in FAR Clause 52.228-13, Alternative Payment Protections, as noted in the General Conditions of this Specification. Copies of the Standard Form of Payment Bond may be obtained upon application to the Issuing Office.

(2) If the offeror is unsure if a planned work site satisfies the criteria for a secondary site of the work, the offeror shall request a determination from the Contracting Officer.
(b)(1) If the wage determination provided by the Government for work at the primary site of the work is not applicable to the secondary site of the work, the offeror shall request a wage determination from the Contracting Officer.
(2) The due date for receipt of offers will not be extended as a result of an offeror's request for a wage determination for a secondary site of the work.

3.2 52.204-24 REPRESENTATION REGARDING CERTAIN TELECOMMUNICATIONS AND VIDEO SURVEILLANCE SERVICES OR EQUIPMENT (AUG 2019)
(a) Definitions. As used in this provision— Covered telecommunications equipment or services, Critical technology, and Substantial or essential component have the meanings provided in clause 52.204–25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
(b) Prohibition. Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115–232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Contractors are not prohibited from providing—
(1) A service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(2) Telecommunications equipment that cannot route or redirect user data traffic or permit visibility into any user data or packets that such equipment transmits or otherwise handles.

Determine whether the Offeror or any person owned or controlled by the Offeror may have engaged in any activity related to one or more of such foreign countries.
(2) If there may have been such activity, review all findings in the report associated with those foreign countries to determine whether or not each such foreign country was determined to be in violation of its obligations undertaken in an arms control, nonproliferation, or disarmament agreement to which the United States is a party, or to be not adhering to its arms control, nonproliferation, or disarmament commitments in which the United States is a participating state. For clarity, in the annual report an explicit certification of noncompliance is equivalent to a determination of violation. However, the following statements in the annual report are not equivalent to a determination of violation:
(i) An inability to certify compliance.
(ii) An inability to conclude compliance.
(iii) A statement about compliance concerns.
(3) If so, determine whether the Offeror or any person owned or controlled by the Offeror has engaged in any activity that contributed to or is a significant factor in the determination in the report that one or more of these foreign countries is in violation of its obligations undertaken in an arms control, nonproliferation, or disarmament agreement to which the United States is a party, or is not adhering to its arms control, nonproliferation, or disarmament commitments in which the United States is a participating state. Review the narrative for any such findings reflecting a determination of violation or non-adherence related to those foreign countries in the report, including the finding itself, and to the extent necessary, the conduct giving rise to the compliance or adherence concerns, the analysis of compliance or adherence concerns, and efforts to resolve compliance or adherence concerns.
(4) The Offeror may submit any questions with regard to this report by email to NDAA1290Cert@state.gov. To the extent feasible, the Department of State will respond to such email inquiries within 3 business days.
(d) Do not submit an offer unless—
(1) A certification is provided in paragraph (b)(1) of this provision and submitted with the offer; or
(2) In accordance with paragraph (b)(2) of this provision, the Offeror provides with its offer information that the President of the United States has—
(i) Waived application under U.S.C. 2593e(d) or (e); or
(ii) Determined under 22 U.S.C. 2593e(g)(2) that the entity has ceased all activities for which measures were imposed under 22 U.S.C.2593e(b).
(e) Remedies. The certification in paragraph (b)(1) of this provision is a material representation of fact upon which reliance was placed when making award. If it is later determined that the Offeror knowingly submitted a false certification, in addition to other remedies available to the Government, such as suspension or debarment, the Contracting Officer may terminate any contract resulting from the false certification.

GENERAL CONDITIONS
4.1 52.204-21 BASIC SAFEGUARDING OF COVERED CONTRACTOR INFORMATION SYSTEMS (JUN 2016)
(a) Definitions. As used in this clause— Covered contractor information system means an information system that is owned or operated by a contractor that processes, stores, or transmits Federal contract information.
Federal contract information means information, not intended for public release, that is provided by or generated for the Government under a contract to develop or deliver a product or service to the Government, but not including information provided by the Government to the public (such as on public Web sites) or simple transactional information, such as necessary to process payments.
Information means any communication or representation of knowledge such as facts, data, or opinions, in any medium or form, including textual, numerical, graphic, cartographic, narrative, or audiovisual (Committee on National Security Systems Instruction (CNSSI) 4009).
Information system means a discrete set of information resources organized for the collection, processing, maintenance, use, sharing, dissemination, or disposition of information (44 U.S.C. 3502).
Safeguarding means measures or controls that are prescribed to protect information systems.
(b) Safeguarding requirements and procedures. (1) The Contractor shall apply the following basic safeguarding requirements and procedures to protect covered contractor information systems. Requirements and procedures for basic safeguarding of covered contractor information systems shall include, at a minimum, the following security controls:
(i) Limit information system access to authorized users, processes acting on behalf of authorized users, or devices (including other information systems).
(ii) Limit information system access to the types of transactions and functions that authorized users are permitted to execute.
(iii) Verify and control/limit connections to and use of external information systems.
(iv) Control information posted or processed on publicly accessible information systems.
(v) Identify information system users, processes acting on behalf of users, or devices.
(vi) Authenticate (or verify) the identities of those users, processes, or devices, as a prerequisite to allowing access to organizational information systems.
(vii) Sanitize or destroy information system media containing Federal Contract Information before disposal or release for reuse.
(viii) Limit physical access to organizational information systems, equipment, and the respective operating environments to authorized individuals.
(ix) Escort visitors and monitor visitor activity; maintain audit logs of physical access; and control and manage physical access devices.
(x) Monitor, control, and protect organizational communications (i.e., information transmitted or received by organizational information systems) at the external boundaries and key internal boundaries of the information systems.
(xi) Implement subnetworks for publicly accessible system components that are physically or logically separated from internal networks.
(xii) Identify, report, and correct information and information system flaws in a timely manner.
(xiii) Provide protection from malicious code at appropriate locations within organizational information systems.
(xiv) Update malicious code protection mechanisms when new releases are available.
(xv) Perform periodic scans of the information system and real-time scans of files from external sources as files are downloaded, opened, or executed.
(2) Other requirements. This clause does not relieve the Contractor of any other specific safeguarding requirements specified by Federal agencies and departments relating to covered contractor information systems generally or other Federal safeguarding requirements for controlled unclassified information (CUI) as established by Executive Order 13556.
(c) Subcontracts. The Contractor shall include the substance of this clause, including this paragraph (c), in subcontracts under this contract (including subcontracts for the acquisition of commercial items, other than commercially available off-the-shelf items), in which the subcontractor may have Federal contract information residing in or transiting through its information system.

4.2 52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (APR 1984)
The Contractor shall be required to (a) commence work under this contract within 10 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than 120 days after receipt of notice to proceed.
