WAGE DETERMINATION INFORMATION

This is for informational purposes, only. This solicitation, and its resultant contract, is subject to the Service Contract Act of 1965, as amended. A contract resulting from offers to this solicitation will include a Department of Labor (DOL) Wage Determination (WD) for positions that require those determinations. Each WD that DOL issues will be county specific. Offeror must enter county(ies) and state(s) in which its facility(ies) is/are located that would be used for the fulfillment of this effort.

COUNTY / STATE __________________________________________

Offerors are cautioned that in order for a Fair Labor Standards Act (FLSA) -exempt employee to also be exempt from application of a wage determination under the Service Contract Act, that employee must be paid on a salary rather than hourly basis.

A sample WD is shown at Solicitation Section D, Attachment D.2. This sample is for the county of Kings in the state of New York, the county in which this contracting office is located. The sample WD should be consulted for position titles only; mandatory wages and fringe benefits will be different across the United States based on individual counties. Definitions of the duties/tasks that relate to the position titles shown in the WD can be found by accessing the following website: https://www.wdol.gov/

Information regarding compliance with the Service Contract Act of 1965, as amended (41 U.S.C. 351, et seq.) is available on line at https://www.wdol.gov/ . Questions regarding compliance should be directed to the Department Of Labor Wage and Hour office nearest to the offeror.
