About this file

This is a Justification and Approval (J&A) document for a sole source acquisition by the Department of Veterans Affairs, VISN 1, Providence VA Medical Center.

The contracting activity seeks to renew a one-year lease for modular trailer 35 VRC currently on site at the Providence VA Medical Center located at 830 Chalkstone Avenue, Providence, Rhode Island. The acquisition plan action ID is 36C241-27-AP-0173, with funding reference 2237: 650-27-1-4856-0002. The justification invokes the statutory authority under 41 USC §3304(a)(1) permitting sole source procurement when only one responsible source exists and no other supplies or services will satisfy agency requirements. Williams Scotsman is identified as the sole source contractor, being both the manufacturer of the trailer and the only known vendor capable of maintaining the trailer and providing required repair and preventive maintenance parts. The contractor has maintained a yearly service contract for at least 15 years. Market research was conducted through FPDS, SBS, and industry contacts, confirming that quoted rental amounts are below comparable competitive ranges for similar products. The anticipated cost is determined to be fair and reasonable based on current market prices. The agency determined that removing and rebidding the trailer would be prohibitively expensive and operationally infeasible, as the Providence VAMC lacks capacity to temporarily relocate personnel if the trailer were replaced. The requirement was certified by Michael LeBeau, Chief Engineer, on September 8, 2026, and approved by Gail Grundy, Contracting Officer, on September 10, 2026.

DEPARTMENT OF VETERANS AFFAIRS

Justification and Approval (J&A) For

Acquisition Plan Action ID: 36C241-27-AP-0173

1. Contracting Activity: Department of Veterans Affairs, VISN 1, Providence VA Medical Center, 830

Chalkstone Avenue Providence, RI 02908-4734.

2237: 650-27-1-4856-0002

2. Nature and/or Description of the Action Being Approved: The Providence VAMC needs a one-year lease for the on-site lease for the modular trailer 35 VRC at the Providence VA Medical Center.

3. Description of Supplies/Services Required to Meet the Agency’s Needs: The Providence VAMC needs a one year lease for the on-site modular trailer 35 VRC at the Providence VA Medical Center.

4. Statutory Authority Permitting Other than Full and Open Competition:

( x ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per 41 USC §3304(a)(1) as implemented by RFO 6.103-1;

( ) (2) Unusual and Compelling Urgency per 41 USC §3304(a)(2) as implemented by RFO 6.103-2;

( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert

Services per 41 USC §3304(a)(3) as implemented by RFO 6.103-3;

( ) (4) International Agreement per 41 USC §3304(a)(4) as implemented by RFO 6.103-4 ( ) (5) Authorized or Required by Statute per 41 USC §3304(a)(5) as implemented by RFO 6.103-5;

( ) (6) National Security per 41 USC §3304(a)(6) as implemented by RFO 6.103-6;

( ) (7) Public Interest per 41 USC §3304(a)(7) as implemented by RFO 6.103-7;

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Williams Scotsman is the manufacturer of this trailer and the only known vendor for maintaining the trailer and parts required to perform repair and preventive maintenance on the trailer. They have had a yearly contract for these services for at least 15 years. The cost to remove the trailer and rebid is not reasonable, compared to the current cost. For this reason, it is better to continue with Williams Scotsman.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as possible (including whether a notice was or will be publicized as required by RFO Part 5 and, if not, which exception under RFO Part 5 applies): Due to limited time, a sources sought notice couldn’t be considered. Contract Specialist plans to issue a sources sought notice next year.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and

Reasonable: The anticipated price is considered fair and reasonable based on the current market prices.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: The Providence VAMC needs a one-year lease for the on-site modular trailer 35 VRC at the Providence VA Medical Center for at least 15 years. Current market research queries through FPDS, SBS, and knowledgeable individuals within the industry have verified that the quoted rental amounts per unit/amount are less than the comparable competitive range of similar products. Since this unit is already on site and being utilized, the cost to remove the trailer and rebid is not reasonable, compared to the current cost. The cost associated with removing these units would be . Furthermore, the Chief of Engineering, , mentioned Providence VAMC does not have the capacity at the station to temporarily place people in offices if the trailer were to be swapped out. Since the trailer is still in good condition it is in the best interest of the facility to continue/renew the lease. Once the trailer is unserviceable then it would make sense to decommission it and solicit it for another lease.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition: The trailer is already on site; it would be prohibitive to remove and replace them. Therefore, as sole source to the incumbent LB Williams Scotsman is warranted.

10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: N/A

11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: Since the trailer is still in good condition it is in the best interest of the facility to continue/renew the lease. Once the trailer is unserviceable then it would make sense to decommission it and solicit it for another lease.

12. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.

Date

13. Approvals in accordance with the VHAPM Part 806.3 OFOC SOP:
