The Department of Veterans Affairs (VA), Office of Information and Technology (Ol&T), has a requirement for NetApp storage augmentation which shall include hardware, software, installation and remote technical support and maintenance. Specifically, VA currently utilizes NetApp FAS2520 storage appliances to store backup and/or archive data at approximately 260 facilities across Ol&T Service Delivery and Engineering, Field Operations (FO) Regions 1 through 6. VA requires the augmentation of twenty-nine (29) of these appliances to add between 10 and 280 terabytes of additional usable capacity per site. This will be accomplished by adding disk shelves, disk drives, higher capacity controllers and NetApp ONTAP unit testing software. This augmentation is required to bring VA into compliance with VA Security Directive 6500, National Institute of Standards and Technology (NIST) special publications 800-34 and 800-53, and VA Continuous Readiness in Information Security Program. Specifically, the hardware will enable the VA to implement standardized backups protected by 256-bit AES encryption using Federal Information Processing Standard 140-2 validated cryptographic libraries for the VistA electronic health record system. The Contractor shall deliver, install, cable, and configure all hardware and software components within 6 months after award and shall provide 12 months of 24/365 maintenance and technical support to include onsite support if required

JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY

1. Contracting Activity: Department of Veterans Affairs (VA) Office of Procurement, Acquisition and Logistics Technology Acquisition Center 23 Christopher Way Eatontown, NJ 07724

2. Description of Action: This proposed action is for a firm-fixed-price Delivery Order issued under the National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) V Government Wide Acquisition Contract (GWAC) for the purchase of brand name NetApp hardware and software, to include associated installation, and maintenance support.

3. Description of the Supplies or Services: The Department of Veterans Affairs (VA), Office of Information and Technology (Ol&T), has a requirement for NetApp storage augmentation which shall include hardware, software, installation and remote technical support and maintenance. The Contractor shall deliver, install, cable, and configure all hardware and software components within 6 months after award and shall provide 12 months of 24/365 maintenance and technical support to include onsite support if required.

4. Statutory Authority: The statutory authority permitting an exception to fair opportunity is Section 41 U.S.C. 4106(c)(2) as implemented by the Federal Acquisition Regulation (FAR) Subpart 16.505(b)(2)(i)(B), entitled "Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized".

5. Rationale Supporting Use of Authority Cited Above: Based on market research, as described in section eight of this justification, it was determined that limited competition is viable among authorized resellers of the required NetApp hardware, software, installation and configuration services, and associated maintenance services. NetApp brand storage hardware and software is currently utilized as the data storage architecture to backup and/or archive data at approximately 260 facilities in FO Regions 1 through 6. VA has a requirement to expand 29 of these systems to store a combined Control Number

TAC-18-52349

total of 1,400 terabytes of additional data. If different brand name hardware and software was utilized to expand these systems, it would not be able to function in the proprietary NetApp environment and the 29 systems would have to be completely replaced. No other brand name storage components can meet VA's form fit and function requirements because only brand name NetApp hardware can be used to expand an existing NetApp storage appliance. Replacement of the 29 NetApp systems to avoid procuring a brand name capacity expansion would require an equivalent system replacement and result in extensive delivery delays, as well as duplicated costs of $7,756,698.60 that would not be recovered through competition, and system downtime. This estimate is based on previous efforts to obtain these systems. In addition, an alternative storage array would also require proprietary hardware, maintenance and support which would not resolve the inability to obtain future storage capacity expansion from vendors other than through the respective storage providers. The required NetApp hardware and software will augment the performance and capacity of the current NetApp storage system by adding faster controllers and replacing older and smaller disk drives to support greater workload processing and archiving within the existing NetApp system. NetApp Data ONTAP software will also be required to permit NetApp SnapMirror data replication between new and existing NetApp storage systems. NetApp storage appliances are proprietary and only brand name NetApp hardware and software is fully interoperable and compatible with the existing storage systems.

Therefore, as this is an expansion of an existing NetApp storage system to support existing and additional new storage workload, only NetApp hardware and software can meet VA's requirement. If VA were to introduce any other brand name storage controllers, disk drives and supporting software into the existing storage appliances, it would not communicate in the current infrastructure due to the proprietary constraints, and would jeopardize performance of the current data storage hardware and software resulting in system failures and data loss. Further, only NetApp or its authorized resellers can access the proprietary storage infrastructure in order to provide the required installation, configuration and maintenance support services, therefore, no other vendor can provide these services without access to the proprietary code. Access to this code is needed to ensure all the services provided are properly configured.

6. Efforts to Obtain Competition: Market research was conducted, the details of which are in the market research section of this document. This effort did not yield any additional solutions that can meet the Government's requirements. It was determined however that limited competition is available viable among authorized resellers for the required lmageWare brand name software. In accordance with FAR 5.301 and 16.505(b)(2), this action will be synopsized at award on the Federal Business Opportunities Page (FBO) and the justification will be made publicly available. In accordance with FAR 16.505(a)(4)(iii)(A)(2) this Justification will be posted on the NASA SEWP website along with the solicitation.

7. Actions to Increase Competition: The Government will continue to conduct market research to ascertain if there are changes in the market place that would enable future augmentation a.ctions to be competed.

NetApp Storage

Augmentation Control Number:

TAC-18-52349

8. Market Research: The Government's technical experts conducted market research in July 2018 by reviewing other similar storage components available from EMC, Dell and ExaGrid. It was determined these components are not capable of augmenting the existing NetApp brand storage appliances. Based on reviews of these products, the Government's technical experts determined that none of these products can meet the Government's interoperability and compatibility requirements to operate within the existing NetApp data storage environment as described in section five. Each manufacturer has their own proprietary hardware and software in providing storage, and therefore would not integrate with the currently fielded NetApp storage appliances. Additionally, the market research confirmed that only NetApp or an authorized reseller can access the proprietary NetApp storage infrastructure which is required to provide installation, configuration and maintenance support for the new hardware and software components. Based on this, the Government's technical experts have determined that only NetApp brand name hardware, software, installation, configuration and maintenance support can meet all of VA's needs.

Additional market research was conducted in August 2018 by utilizing the NASA SEWP Provider Lookup tool to determine whether the brand name NetApp hardware, software and support is available from NASA SEWP V GWAC holders. It was determined that there are several resellers of brand name NetApp products and offerings that hold current GWACs such that limited competition is anticipated.

Commercial license agreements may be made a part of this Contract/Order but only if both parties expressly make them an addendum hereto. If the commercial license agreement is not made an addendum, it shall not apply, govern, be a part of or have any effect whatsoever on the Contract/Order; this includes, but is not limited to, any agreement embedded in the computer software (clickwrap), any agreement that is otherwise delivered with or provided to the Government with the commercial computer software or documentation (shrinkwrap), or any other license agreement otherwise referred to in any document. If a commercial license agreement is made an addendum, only those provisions addressing data rights regarding the Government’s use, duplication and disclosure of data (e.g., restricted computer software) are included and made a part of this Contract/Order, and only to the extent that those provisions are not duplicative or inconsistent with Federal law, Federal regulation, the incorporated FAR clauses and the provisions of this Contract/Order; those provisions in the commercial license agreement that do not address data rights regarding the Government’s use, duplication and disclosure of data shall not be included or made a part of the Contract/Order. Federal law and regulation including, without limitation, the Contract Disputes Act (41 U.S.C. § 7101 et seq.), the Anti-Deficiency Act (31 U.S.C. § 1341 et seq.), the Competition in Contracting Act (41 U.S.C. § 3301 et seq.), the Prompt Payment Act (31 U.S.C. §3901 et seq.), Contracts for Data Processing or Maintenance (38 U.S.C. § 5725), and FAR clauses 52.212-4, 52.227-14, 52.227-19 shall supersede, control, and render ineffective any inconsistent, conflicting, or duplicative provision in any commercial license agreement. In the event of conflict between this Clause and any provision in the Contract/Order or the commercial license agreement or elsewhere, the terms of this Clause shall prevail. Claims of patent or copyright infringement brought against the Government as a party shall be defended by the U.S. Department of Justice (DOJ). 28 U.S.C. § 516. At the discretion of DOJ, the Contractor may be allowed reasonable participation in the defense of the litigation. Any additional changes to the Contract/Order must be made by contract/order modification (Standard Form 30) and shall only be effected by a warranted Contracting Officer. Nothing in this Contract/Order or any commercial license agreement shall be construed as a waiver of sovereign immunity.

1. Disabling Software Code. The Government requires delivery of computer software that does not contain any code that will, upon the occurrence or the nonoccurrence of any event, disable the software. Such code includes but is not limited to a computer virus, restrictive key, node lock, time-out or other function, whether implemented by electronic, mechanical, or other means, which limits or hinders the use or access to any computer software based on residency on a specific hardware configuration, frequency of duration of use, or other limiting criteria. If any such disabling code is present, the contractor agrees to indemnify the Government for all damages suffered as a result of a disabling caused by such code, and the contractor agrees to remove such code upon the Government’s request at no extra cost to the Government. Inability of the contractor to remove the disabling software code will be considered an inexcusable delay and a material breach of contract, and the Government may exercise its right to terminate for cause. In addition, the Government is permitted to remove the code as it deems appropriate and charge the Contractor for consideration for the time and effort expended in removing the code.

1. Manuals and Publications. Upon Government request, the contractor shall furnish the most current version of the user manual and publications for all products/services provided under this contract or order at no cost.

Once augmented, all Tier 2 Storage Appliances shall meet or exceed each of the following requirements:

All requirements must be met simultaneously using a single production configuration per system.

1. Augmentation

0. If the capacity upgrade at one or more of the sites listed above requires modification or replacement of the storage appliance controllers, the upgraded or modified design shall adhere to the following requirements:

0. Controllers

0. The storage appliance shall provide a minimum of two controllers.

0. Controllers shall operate in an active/active fashion. A minimum of two controllers shall host volumes, Logical Unit Numbers (LUNs), and exports simultaneously for production storage access.

0. Each controller shall be capable of failing active operations over to the peer controller both manually and automatically following the detection of a failure. System shall continue to meet the performance requirements specified herein in the event of a controller failure.

0. Controllers shall be upgradable independently of one another to permit live upgrades that do not result in production downtime.

0. Connectivity

1. The Contractor shall ensure the augmented storage appliance has the same network connectivity types, speeds and quantities for both in-band and out-of-band management and production storage.

0. Licensing

2. System shall include any licensing or software necessary to utilize the Common Internet File System (CIFS) protocol.

0. System shall support Server Message Block v3.0 (SMB3) extensions. At a minimum, system shall support persistent file handles, Remote Volume Shadow Copy Service (VSS), and ODX copy offload.

0. Features

3. System shall include thin provisioning capability for all end-user volumes and LUNs.

3. System shall support volume capacity expansion and reduction in real-time without requiring data migration or downtime.

3. System shall support both single-parity, dual-parity, and triple-parity RAID for all production and system RAID groups.

3. System shall include snapshot functionality and any licensing necessary to utilize snapshots across the breadth of storage included in the bid.

3. System shall support deduplication across the full breadth of the Minimum Usable Capacity.

3. System shall be capable of expansion with solid state disks to enhance both read and write cache functionality and accelerate performance of any underlying spinning disks.

1. Capacity

1. The additional minimum usable storage capacity required varies by site and is specified in the Capacity Required (TB) column in the table above. The minimum usable capacity listed is measured in terabytes (TB). The minimum usable capacity shall be defined as storage space that is available for end user utilization when the device is configured to meet the OEM’s established best practices and all other specifications within this PD.

1. The augmentation shall include a minimum of two hot spares per disk type, speed, and size. Any dedicated hot spares or disks containing hot spare slices shall not be included in the minimum usable capacity calculation.

1. Any physical disks used for underlying storage appliance operating system or other system operations shall not be counted toward the minimum usable storage capacity. Any physical disk that contains any system operation data (e.g. root slices configured as part of NetApp Advanced Disk Partitioning or EMC Vault) shall not count toward the minimum usable storage capacity.

1. Disks used for system operations shall provide a minimum of two parity disks per RAID group (e.g. RAID 6 or RAID-DP).

1. The minimum usable capacity for RAID groups shall be calculated as follows:

4. RAID groups consisting of solid state disks or 10,000 RPM or faster spinning disks shall be calculated with a minimum of two parity disks per RAID group (e.g. RAID 6 or RAID-DP).

0. Exception: Any RAID group containing any disk with a capacity greater than 10TB shall be calculated with a minimum of three parity disks per RAID group (e.g. RAID-Z3 or RAID-TEC).

4. RAID groups consisting of spinning disks of less than 10,000 RPM shall be calculated with a minimum of three parity disks per RAID group (e.g. RAID-Z3 or RAID-TEC).

4. RAID groups with mixed disk types shall use the number of parity disks associated with the slowest disk type from the values above.

1. Performance

2. The augmented minimum usable capacity shall offer a minimum of 20 Input/Output Operations Per Second (IOPS) per terabyte. IOPS shall be calculated using the following criteria:

0. Array is configured to meet minimum parity and hot spare configuration.

0. Input/Output (IO) consists of 70% read and 30% write operations.

0. IO consists of 60% sequential and 40% random operations.

0. IO transfer request size shall be 64KB.

0. The minimum working set size shall be 5% of the minimum usable capacity.

2. The augmentation shall not prevent the existing storage capacity from meeting the performance threshold above.

1. Cabling

3. The Contractor shall ensure any internal solution cabling (e.g. SAS cabling) is sufficient in length to facilitate non-contiguous equipment placement. Individual components may be placed up to 10 meters apart at the time of installation.
