About this file
This is a Request for Qualifications (RFQ) document for the Spring Independent School District in Texas, issued pursuant to Texas Government Code Chapter 2269, Subchapter F, for the selection of a Construction Manager At-Risk (CMAR) to oversee renovations at Westfield High School and Daycare. The project will be procured through a two-step RFQ process requiring submission of Statements of Qualifications (SOQ) and, for qualified offerors, Price Proposals. The document establishes the framework for evaluating potential CMARs based on their qualifications, experience, and proposed pricing for the construction and renovation work at the specified educational facilities.
The RFQ process is designed to ensure competitive selection of the most qualified CMAR capable of delivering the Westfield High School and Daycare renovation project. Offerors must demonstrate relevant experience, technical competence, and financial capability through their SOQ submissions, with qualified candidates advancing to the price proposal phase. The two-step process allows the District to evaluate qualifications separately from pricing considerations, ensuring that the selected CMAR possesses the necessary expertise and resources to successfully manage and execute the project scope while maintaining appropriate cost controls and project delivery standards.

STEP TWO
a. A short list of up to five (5) CMAR finalists will be determined by the selection committee, based on the above-detailed selection criteria and ranking evaluation. A maximum of five CMAR finalists will be notified and asked to submit responses to a Request for Proposals.
b. The proposals will be evaluated to determine the offeror that submits the proposal that offers the best value to the District, based on the following criteria:
20 Estimated CM-at-Risk Cost (proposed CM fee x estimated construction budget plus general conditions cost) and Pre-Construction Services Fee Pre-construction services maximum value 3 pts, CMAR fee maximum value 7 pts, general conditions cost maximum points 10 pts. Proposers will receive an assigned share of the total available points for each criterion. A formula will be used as follows to determine each proposer’s percentage above the low bid for each criterion. The lowest overall proposal will receive the maximum amount of points per criterion (i.e., lowest pre-construction services fee received 3 pts, lowest CMAR fee receives 7 pts, and lowest general conditions cost receives 10 pts); the other proposals receive fewer points in descending order based on the computed spread between low and high proposals for each criterion.

Proposals that have been opened may not be changed for the purpose of correcting an error in the price. Other than price, a proposer may have the right to change any other error or mistake in the proposal as may be permitted by applicable law and subject to the approval of the District, unless such change would be in contravention of statutory or common law requirements or unless such change would give an unfair advantage to the proposer making such change.
By submitting a SOQ and/or a Price Proposal, each Offeror agrees to waive any claim it has or may have against the District, the Architect/Engineer, and their respective trustees, agents and employees, and any reference sources, arising out of or in connection with the administration, evaluation, or recommendation of any submission; waiver of any requirements under the Procurement Documents; acceptance or rejection of any SOQ/Proposal; and award of a Contract. A response to this procurement solicitation is an offer to contract with the District based upon the terms, conditions, scope of work, and specifications contained in this procurement solicitation and the construction documents. The Form of Contract is subject to revision at the sole discretion of the District. In the event that a project is awarded to an Offeror and the Offeror requests changes to the District Standard Agreement forms, the District reserves the right to cancel the award and re-award the project to an alternate Offeror. If the Proposer and SISD are unable to resolve any exceptions to the mutual satisfaction of both parties, SISD reserves the right to reject the Proposer’s proposal and award the Contract to another Proposer. Each Proposer, by making its proposal, represents that the Proposer has read, understands, and agrees to SISD’s modifications to the AIA Documents. In the event that a project is awarded to a Proposer and the Proposer requests changes to the Contract Documents, the District reserves the right to cancel the award and re-award the Project to an alternate Proposer. Requests to modify the terms of the Contract Documents during the pendency of this procurement solicitation will be denied.
All savings on the project will be returned to the District at the conclusion of the project.
