About this file
This is a Request for Written Responses issued by Wayland Public Schools/Town of Wayland for labor, equipment, and installation services to construct an outdoor challenge/ropes course at Wayland High School. The project encompasses pole setting, ground anchors, high-element installation, coordination with the proprietary course supplier, and related closeout activities. The scope includes installing six utility poles (five 50-foot Class II and one 40-foot Class III CCA-treated poles), seventeen helical-style ground anchors, seventeen guy wires, and various challenge course elements such as a catwalk, lily pads, swing shot/flying squirrel combination, and vertical playpen. A mandatory site visit is scheduled for October 8, 2026, at 11:00 AM. Written responses are due by October 23, 2026, at 11:00 AM. The anticipated notice to proceed is October 28, 2026, with required completion by December 18, 2026. The contract award will be based on the lowest responsive price from a responsible responder.
The independent estimate for the complete labor, equipment, and installation contract is approximately $45,000, making this a Massachusetts General Law Chapter 30, Section 39M public works procurement requiring a two-week public notice period and responses from at least three qualified firms. Pricing must include all labor burdens, prevailing wages, supervision, travel, mobilization, small tools, equipment, insurance, bonds, overhead, and profit. Massachusetts prevailing wage rates apply to all covered workers as established by the Department of Labor Standards. A payment bond equal to at least 50 percent of the total contract price is required within ten days of award for contracts exceeding $25,000. The contractor must submit weekly certified payrolls and provide evidence of OSHA 10-hour construction safety training for all employees. Required insurance includes commercial general liability ($1,000,000 each occurrence/$3,000,000 aggregate), automobile liability ($1,000,000 combined single limit), and workers' compensation at statutory limits. Responses must remain firm for 30 calendar days after the deadline, and no contract exists until execution of a written agreement with all required bonds, insurance certificates, and vendor documents are accepted.

PART A - SOLICITATION AND INSTRUCTIONS
A1. Notice to Responders Wayland Public Schools, acting for the Town of Wayland (the “Awarding Authority”), invites written responses for labor, supervision, tools, construction equipment, mobilization and incidental services required to install an owner-furnished outdoor challenge/ropes course at Wayland High School. The work includes pole setting, ground anchors, high-element installation, coordination with the proprietary course supplier, and related closeout as described in Part B.
The contract will be awarded to the responsible responder offering the lowest responsive total price, subject to funding, verification of qualifications, and the Awarding Authority’s right to reject any response when permitted by law and in the public interest.
A2. Procurement Method The Awarding Authority’s independent estimate for the complete labor, equipment and installation contract is approximately $45,000. The procurement will therefore use the M.G.L. c. 30, §39M written-response process applicable to public works contracts estimated at $10,000 through $50,000: public notification for at least two weeks; solicitation of written responses from at least three persons or firms that customarily perform the work;
and award to the responsible responder offering to perform the contract at the lowest price. No bid deposit or public bid opening is required for this procurement tier.
A3. Response Submission
• Submit one complete response on the forms in Part C. Complete every blank and acknowledge all addenda.
• Responses must be received by the deadline on the cover. Late responses may not be considered.
• Pricing must include all labor burdens, prevailing wages, supervision, travel, mobilization, small tools, equipment, insurance, bonds, overhead, profit and incidentals except items expressly identified as owner-furnished. The Town is tax-exempt and will not pay Massachusetts sales tax; the responder remains responsible for all other taxes, assessments and payroll obligations applicable to its work.
• Responses must remain firm for 30 calendar days after the response deadline unless a longer period is stated by addendum.
• The responder bears responsibility for examining the site, access, soil information made available, existing utilities, school operations and the contract documents.
• Questions must be submitted in writing to the project contact by October 16, 2026. Only written addenda issued by the Awarding Authority modify the solicitation.
A4. Site Visit and Existing Conditions The proposed course area is on the Wayland High School grounds near the athletic fields. The conceptual layout is approximately 115 feet by 115 feet, with pole spacing shown at approximately 35 feet and nearby utility poles, a catwalk, Lily Pads, and other existing features depicted. Dimensions are approximate and shall not be used as final construction control.
• The contractor shall participate in a pre-installation layout meeting with the Awarding Authority and the proprietary course supplier.
• No excavation may begin until Dig Safe requirements are satisfied and the District/DPW confirms applicable site approvals.
• Rock, ledge, unsuitable soils, concealed utilities and materially different conditions shall be reported before proceeding. Unit prices in the Response Form govern only when authorized in writing.
WAYLAND HIGH SCHOOL | ROPES COURSE LABOR Page 3
A5. Award and Responsibility The apparent low responder shall provide requested evidence of experience, insurance, bonding capacity, references, safety program, equipment and ability to coordinate with the proprietary course supplier. The Awarding Authority may investigate responsibility and reject a responder that lacks the skill, ability, integrity, resources or experience necessary for faithful performance.
No contract exists until a written agreement is executed by authorized parties and all required bonds, insurance certificates, tax certifications and vendor documents are accepted.
A6. Bid Deposit No bid deposit is required for this written-response procurement because the complete contract is estimated at approximately $45,000.
A7. Payment Bond Because the anticipated contract price exceeds $25,000, the successful contractor shall, within ten days after notice of award and before commencing work, furnish a payment bond satisfactory to the Awarding Authority in an amount not less than fifty percent (50%) of the total contract price, as required by M.G.L. c. 149, §29.
A8. Permits and Fees The contractor shall obtain and close out permits required for its construction means and work. Town permit fees will be waived or paid by owner. Owner-held project approvals do not relieve the contractor from obtaining trade, excavation, lift, traffic or other permits applicable to its operations.
