SECTION 00112
DEFINITIONS
Except where specific definitions are used within a specific MANUAL section, the following terms, phrases, words and their derivation shall have the meaning given herein when consistent with the context in which they are used. Words used in the present tense include the future tense, words in the plural number include the singular number and words in the singular number include the plural number. The word "shall" is mandatory, and the word "may" is permissive.
AMERICAN ASSOCIATION OF STATE HIGHWAY AND TRANSPORTATION
OFFICIALS (AASHTO): Any reference to AASHTO standards shall mean latest edition.
AMERICAN NATIONAL STANDARDS INSTITUTE (ANSI): Any reference to ANSI standards shall mean latest edition.
ARCHITECT: Architect registered with the State of Florida Department of Business and Professional Regulation to provide professional architectural services.
AMERICAN SOCIETY FOR TESTING MATERIALS (ASTM): Any reference to ASTM standards shall mean latest edition.
AS-BUILT SURVEY: Field measurements of vertical and horizontal dimensions of constructed improvements certified by a Surveyor so that the constructed facilities can be delineated in such a way that the location of the construction may be compared with the construction PLANS.
AMERICAN WATER WORKS ASSOCIATION (AWWA): Any reference to AWWA Standards shall mean latest edition.
BOUNDARY AND TOPOGRAPHIC SURVEY: Boundary and topographic survey, map and report certified by a Surveyor that meets the requirements of F.A.C. Chapter 5J-17.
CAPITAL IMPROVEMENT PROGRAM (CIP): City documents that identify planned improvements that will be funded and constructed as identified within the current 5-year C.I.P.
Plan for the City’s infrastructure.
CITY: The City of Sarasota City Commission, Florida and its employees.
CITY COMMISSION: The City of Sarasota City Commission, Florida.
CITY MANAGER: the person who is responsible for the day-to-day administration and management of the City of Sarasota, Florida or designee.
CITY OF SARASOTA UTILITIES DEPARTMENT (COSU): The City of Sarasota entity which has the responsibility of administering, operating, and maintaining the potable water, wastewater, and reclaimed water facilities and infrastructure owned and/or operated by the City.
CITY OF SARASOTA UTILITIES REGULATIONS (SUR): The City of Sarasota, Florida’s

Chapter 37 of the CITY CODE, latest edition.
CITY SURVEYOR: The City staff member or hired consultant, licensed by the State of Florida as a professional surveyor and mapper pursuant to Chapter 472, F.S., who is responsible for reviewing surveying related information and documents within the City.
CONTRACTOR: Person, firm, or corporation with whom the contract for work has been made with the CITY or the DEVELOPER.
COUNTY: The Sarasota County (Florida) Board of County Commissioners and its employees.
CROSS CONNECTION CONTROL ASSEMBLY: An assembly that has been manufactured in full conformance with AWWA Standards, latest editions, and meets the laboratory and field performance specifications of the FCCCHR, latest editions. Cross Connection Control Assemblies shall also comply with the requirements of Rule 62-555 F.A.C.
DEVELOPER: Person, firm, or corporation engaged in developing or improving real estate for use or occupancy. Also refer to OWNER.
DEVELOPMENT: Any improvement of real estate for use or occupancy.
DEVELOPMENT REVIEW COMMITTEE (DRC): The entity within the City of Sarasota’s Neighborhood Development Services Department that reviews all proposed non-residential and residential development plans, etc. in accordance with the ZONING CODE.
DIGITAL UTILITY PLAN: For approvable construction projects, a digital utility plan of the affected construction area shall be submitted in encompassing digital file(s) that is suitable for importing into COSU’s GIS. The digital files include existing, new or altered structures in the work area, geodetic control and survey data, and all x-reference files.
DRAWINGS: Also known as Plans.
ENGINEERING DESIGN CRITERIA MANUAL (EDCM): The City of Sarasota, Florida’s Engineering Design Criteria Manual as specified in Chapter 29.5 of the CITY CODE, latest edition.
ELEVATIONS: Vertical elevations based on the North American Vertical Datum 1988 (NAVD 88).
ENGINEER: An individual currently licensed to practice engineering in the State of Florida.
EQUIVALENT RESIDENTIAL CONNECTION (ERC): The water demand and sewage generation value (gpd) for a standard detached single family dwelling.
FLORIDA ADMINISTRATIVE CODE (FAC): The State of Florida’s Administrative Code, latest edition.
FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION (FDEP): The State of Florida’s Department of Environmental Protection.
FLORIDA DEPARTMENT OF HEALTH (FDOH): The State of Florida’s Department of Health.

FLORIDA DEPARTMENT OF TRANSPORTATION (FDOT): The State of Florida’s Department of Transportation.
FIRE DEPARTMENT: The Sarasota County Public Safety Department.
FIRE FLOW: The amount of water measured in gallons per minute at a minimum residual pressure of 20 p.s.i that is required to provide adequate fire suppression in accordance with standards established by the FIRE DEPARTMENT.
FLORIDA STATUTES (FS): The State of Florida’s Statutes, latest edition.
INSPECTOR: A City employee or consultant that is qualified and authorized to perform inspections on behalf of COSU.
MAINTENANCE OF TRAFFIC (MOT) PLAN:
MANUAL (UM): The City of Sarasota Utilities Manual, latest edition.
MANUAL OF UNIFORM TRAFFIC CONTROL DEVICES (MUTCD): The Federal Highway Administration’s “Manual of Uniform Traffic Control Devices”, latest edition.
MASTER METER ASSEMBLY: An above ground installation containing a dual body meter assembly, a certified cross connection control assembly, concrete pad, SCADA, piping, valves, and related components.
MASTER PLAN: For projects to be constructed in multiple phases, a master plan for water, wastewater and/or reclaimed water is required. The master plan consists of a utility system layout superimposed on a topographic map, calculations for potable water demand, reclaimed water demand and wastewater flow, as well as a pipe network analysis for flow and pressure distribution.
NATIONAL ELECTRICAL MANUFACTURERS ASSOCIATION (NEMA): Any reference to NEMA Standards shall be the latest edition.
NORMAL WORKING DAY: Monday through Friday, excluding CITY holidays.
NORMAL WORKING HOURS: Hours are between the hours of 7:00 a.m. to 6:00 p.m. of a
NORMAL WORKING DAY.
NSF INTERNATIONAL (NSF): An independent and accredited organization that develops standards, tests, and certifies products and systems. Any reference to NSF Standards shall be the latest edition.
OWNER: Person, firm, corporation, or governmental unit holding right of possession of the real estate upon which construction is to take place.
PLANS: Drawings prepared by an Engineer or Architect to show the proposed and, when the City approved review process is completed, the CITY approved improvements that are to be constructed.
POTABLE WATER SYSTEM: Potable water distribution and transmission mains, pump stations, fittings, valves, fire hydrants, services, meters, and miscellaneous related appurtenances.
PRIVATE SYSTEMS: Utility systems that are not to be owned, operated, or maintained by

COSU.
PUBLIC WORKS DEPARTMENT: The Public Works Department of the City of Sarasota, Florida.
PUBLIC WORKS DIRECTOR: The person who is responsible for the day-to-day administration and management of the Public Works Department of the City of Sarasota, Florida.
RECLAIMED WATER REGULATIONS: The City of Sarasota, Florida's “Reclaimed Water Policy”.
RECLAIMED WATER SYSTEM: Reclaimed water distribution and transmission mains, pump stations, augmentation wells, fittings, valves, services, meters, and miscellaneous related appurtenances.
RECORD DRAWINGS: Plans certificated by the Engineer that accurately depict the horizontal and vertical locations of all installed utility system components involved in the completed WORK that will include information provided by the Contractor.
REGISTERED HOLDERS: Users of the MANUAL that have provided current email information to the UTILITIES MANUAL REVIEW COMMITTEE, so they may be notified of pending revisions to the MANUAL.
RIGHT-OF-WAY PERMIT: Regulations, as established by the City of Sarasota’s City Commission, for the governance of the installation of infrastructure within the City’s public rights-of-way and easements.
SAMPLES: Physical examples of materials, equipment, or workmanship that are representative of some portion of the WORK and which establish the standards by which such portion of the WORK will be judged.
SHOP DRAWINGS: All drawings, diagrams, illustrations, schedules, and other data or information, which are specifically prepared or assembled by or for Contractor and submitted by Contractor to illustrate some portion of the WORK.
SPECIFIC PURPOSE SURVEY: Survey, map, and report certified by a Surveyor that is performed for any other purpose than is described in F.A.C. Chapter 5J-17 050 of the “Standards of Practice”.
STANDARD DRAWINGS: Detailed drawings contained in this MANUAL related to water, wastewater and reclaimed water system materials and installation.
STANDARD FDOT SPECIFICATIONS: Florida Department of Transportation’s “Standard Specification for Road and Bridge Construction”.
SUBCONTRACTOR: An individual or entity having a direct contract with Contractor or with any other subcontractor for the performance of a part of the WORK.
SURVEY COORDINATE VALUES: The survey coordinate values are based on State Plane Coordinates, Florida West Zone in U.S. survey feet, North American Datum of 1983 and the North American Vertical Datum (N.A.V.D.) of 1988. Vertical control shall be established project in the form of Permanent Benchmarks. These benchmarks shall be suitable for use during construction.

SURVEYOR: A Professional Surveyor and Mapper licensed to practice in the State of Florida.
TRAFFIC CONTROL AND SAFE PRACTICES MANUAL: Florida Department of Transportation’s “Manual on Traffic Control and Safe Practices for Street and Highway Construction, Maintenance, and Utility Operation”, latest edition.
UTILITIES DEPARTMENT: The Utilities Department of the City of Sarasota, Florida.
UTILITIES DIRECTOR: The person who is responsible for the day-to-day administration and management of the City of Sarasota Utilities.
UTILITIES MANUAL REVIEW COMMITTEE (COMMITTEE): shall be comprised of the Utilities Engineering Manager, Utilities Treatment Manager, Utilities Pipeline Reliability Manager, and representatives from the Public Works Engineering, City Engineering, and the City Purchasing Divisions, or designees. The Committee shall perform all duties described in Section 37-1 (g) of the SUR. The Utilities Director shall be ineligible to serve as voting members on the Utilities Manual Review Committee.
UTILITY CONSTRUCTION PERMIT: Regulations, as established by the City of Sarasota City Commission, for the governance of the installation of potable water, wastewater, and reclaimed water infrastructure that will be dedicated to the City and located within public rights-of-way and easements.
UTILITY ACCOMMODATION GUIDE: State of Florida Department of Transportation Utility Accommodation Guide, latest edition.
UTILITY ASSET: Any component of a potable water, reclaimed water, or wastewater system, including, but not limited to, permits, easements, and fee simple properties.
WASTEWATER SYSTEM: Wastewater collection and transmission mains including gravity and force mains, wastewater lift stations, fittings, valves, service laterals, and miscellaneous related appurtenances.
WORK: Labor, materials, equipment, supplies, services and other items necessary for the execution, completion and fulfillment of the approved PLANS.
ZONING CODE: The City of Sarasota, Florida’s Zoning Code as specified in Chapter 38 of the CITY CODE, latest edition.

SECTION 00800
GENERAL PROVISIONS
PART 1- GENERAL
1.01 GENERAL
A. Work in this Section includes all labor, material, equipment, testing, tax, overhead, and profit necessary to install, construct, and place into service the items described in this Section to provide a complete and functional system ready for use by the City.
B. The Work shall be constructed in accordance with the Contract Documents (plans and specifications). In the event additional information or detail is necessary for a portion of the Work, the City of Sarasota Engineering Design Criteria Manual (EDCM) shall apply.
C. When reference is made to a Division, Section, or Article, it shall mean a Division, Section, or Article of said Specification.
D. When reference is made to a five (5) digit specification number, it shall apply to a section of the City of Sarasota Standard Technical Specifications or a non-standard specification included in the Contract Documents.
E. These General Provisions may be amended, clarified, and altered as necessary for the
Work in Section 00805 – Special Provisions.
F. No additional payment shall be made for compliance with these General Provisions. Any costs or expenses incurred by the Contractor shall be considered subsidiary and incidental to the payment items defined in the Bid Form.
G. Nothing in this Section shall relieve the Contractor of the responsibility for the means, methods, techniques, sequencing (except as required herein) or procedures of construction, or of any other responsibility under the Contract Documents.
H. The Contract Documents contain data relative to existing public utility installations and structures above and below the ground surface. These data are not guaranteed as to their completeness or accuracy and it is the responsibility of the Contractor to make his own investigations to inform himself fully of the character, condition and extent of all such installations and structures as may be encountered and as may affect the construction operations.
I. References to time shall be in calendar days, etc. unless otherwise stated.

1.02 COOPERATION WITH OTHERS
A. The Contractor shall cooperate with the Owners of any underground or overhead utilities in their removal and rearrangement operations, in order that these may progress in a reasonable manner and that the service rendered by these parties will not be interrupted.
The Contractor shall, prior to interrupting a utility service (water, sewer, etc.) for the purpose of making cut-ins to the existing lines or for any other purposes, contact the owner and make arrangements for the interruption which will be satisfactory to the respective utility or City.
B. During progress of work under this Contract, it may be necessary for other contractors and persons employed by the City to work in or about the Work.
C. The City reserves the right to put such other contractors to work and to afford such access to the Site of the Work to be performed hereunder at such times as the City deems proper.
D. The Contractor shall not impede or interfere with the work of such other contractors engaged in or about the work and shall so arrange and conduct his work that such other contractors may complete their work at the earliest date possible.
1.03 SURVEYING
A. Grade:
1. All work under this Contract shall be constructed in accordance with the lines and grades shown on the Drawings, or as given by the Engineer. The full responsibility for keeping alignment and grade shall rest upon the Contractor.
2. The Engineer will provide bench mark information and base line controlling points.
Reference marks for lines and grades as the work progresses will be located by the Contractor to cause as little inconvenience to the prosecution of the work as possible. The Contractor shall so place excavation and other materials as to cause no inconvenience in the use of the reference remarks provided. The Contractor shall remove any obstructions placed by him contrary to this provision.
B. Surveys:
1. The Contractor shall furnish and maintain, at his own expense, stakes and other such materials.
2. The Contractor shall retain the services of a surveyor to identify existing control points and provide line and grade surveys necessary to properly construct the work.
3. The Contractor shall check such reference marks by such means as the Contractor
00800-3 may deem necessary and, before using them, shall call the City and Engineer's attention to any inaccuracies.
4. The Contractor shall, at his own expense, establish all working or construction lines and grades as required from the reference marks set by the Engineer, and shall be solely responsible for the accuracy thereof.
5. The Contractor shall keep the City and Engineer informed a minimum of (48) hours, less City holidays and weekends, in advance as to the need for line and grade reference marks, in order that they may be furnished and all necessary measurements made for record and payment with the minimum of inconvenience to the City or of delay to the Contractor.
6. It is the intention not to delay the work for the establishment of reference marks but, when necessary, working operations shall be suspended for such reasonable time as the City may require for this purpose.
C. Safeguarding Marks:
1. The Contractor shall so place excavation and other materials as to cause no inconvenience in the use of the reference marks provided. Any obstructions placed by the Contractor contrary to this provision shall be removed.
2. The Contractor shall safeguard all points, stakes, grade marks, monuments, property corners, and bench marks made or established on the work, bear the cost of re-establishing them if disturbed, and bear the entire expense of rectifying work improperly installed due to not maintaining or protecting or to removing without authorization such established points, stakes and remarks.
3. The Contractor shall safeguard all existing and known property corners, monuments and marks adjacent to but not related to the work and, shall bear the cost of re-establishing them if disturbed or destroyed.
4. The Contractor shall notify the Engineer immediately upon disturbing or destroying any reference marks.
1.04 REPLACEMENT OF TRAFFIC, STREET SIGNS, AND SIGNAL LOOPS
A. The Contractor shall re-erect all existing traffic and street signs within the Work site that must be moved or relocated to permit construction operations.
B. The Contractor shall notify the City at least five (5) business days prior to disturbing any traffic signal loops and shall replace or repair any traffic signal loops disturbed to the satisfaction of the City.

1.05 GEOTECHNICAL INVESTIGATIONS
A. It shall be the Contractor’s responsibility to have determined to his satisfaction, prior to the submission of his bid, the nature and conformation of the ground, the character and quality of the substrata, the types and quantities of materials to be encountered, the nature of the groundwater conditions, the character of equipment and facilities needed preliminary to and during the execution of the work, the general and local conditions and all other matters which can in any way effect the work so that the prices established and bid for the work reflect all costs pertaining thereto.
1.06 PROSECUTION OF WORK
A. No work shall be performed between 6:00 PM and 7:00 AM on weekdays or between
6:00 PM and 9:00 AM on weekends or City holidays without the written permission or other permit approved by the City. However, emergency work may be done at any time without permission. The City shall be notified no later than a half hour after such emergency work has commenced, and shall have the option to determine if the work is in fact an emergency.
B. Contractor’s schedule shall be reviewed and approved by the City prior to beginning construction.
C. The Contractor shall provide a full time experienced project superintendent that has at least five (5) calendar years of equivalent underground water and wastewater installation experience. The project superintendent shall not be assigned to or regularly operate equipment on site.
1.07 WORK SITE
A. The Contractor shall furnish all labor, superintendence, materials, plant, power, light, heat, fuel, water, tools, appliances, equipment, supplies, and means of construction necessary for proper performance and completion of the work.
B. The Contractor shall perform and complete the work, in the manner best calculated to promote rapid construction consistent with safety of life and property and to the satisfaction of the Engineer, and in strict accordance with the Contract Documents.
C. The Contractor shall clean up the work and maintain it during and after construction, until accepted, and shall do all work and pay all costs incidental thereto.
D. The Contractor shall repair or restore all structures and property that may be damaged or disturbed during performance of the work.

E. The Contractor shall be solely responsible for the adequacy of his workmanship, materials, and equipment, prior approval of the City and Engineer notwithstanding.
F. Contractor shall furnish competent personnel and equipment which will be efficient, appropriate, and large enough to secure a satisfactory quality of work and a rate of progress which will insure the completion of the work within the time stipulated in these Contract Documents.
G. The Contractor shall do all cutting, fitting, or patching of his portion of the work that may be required to make the several parts thereof join and coordinate in a manner satisfactory to the City and Engineer and in accordance with the Contract Documents.
1.08 PRIVATE LAND
A. The Contractor shall not enter or occupy private land outside the site, except by written agreement with the appropriate legal owners. It shall be the responsibility of the Contactor to determine the legal owners of all private property used. Contractor shall provide the City with a copy of such written agreement.
1.09 WORK LOCATIONS
A. Work shall be located as indicated on the Drawings, but the Engineer reserves the right to make such modifications in locations as may be found desirable to avoid interference with existing structures or for other reasons.
B. The Contractor shall be responsible for the relocation of structures, including but not limited to light poles, signs, sign poles, fences, piping, conduits and drains that interfere with the positioning of the work as set out in the Drawings. The cost of all such relocations shall be included in the bid. Contractor shall install any test pits required to identify potential points of interference.
C. It is intended that wherever existing utilities such as water mains, wastewater mains, stormwater mains, or service lines must be crossed, deflection of the pipe within recommended limits and cover shall be used to satisfactorily clear the obstruction unless otherwise indicated on the Drawings. However, when in the opinion of the City or Engineer this procedure is not feasible, they may direct the use of fittings for a utility crossing as detailed on the Drawings.
1.10 CARE AND PROTECTION
A. The Contractor shall be responsible for the preservation of all public and private property, and shall use every precaution necessary to prevent damage thereto. If any direct or indirect damage is done to public or private property by, or on account of, any act, omission, neglect, or misconduct in the execution of the work on the part of the

Contractor, such property shall be restored by the Contractor, at his expense, to a condition similar or equal to that existing before the damage was done, or the Contractor shall make good the damage in other manner acceptable to the Engineer and City.
B. Protection of Wetland Areas:
1. The Contractor shall properly dispose of all surplus material, including soil, in accordance with local, state and federal regulations.
2. Under no circumstances shall surplus material be disposed of in wetland areas as defined by the Florida Department of Environmental Regulation or the Southwest Florida Water Management District.
C. All newly constructed work shall be carefully protected from damage in any way. Any portions of the Work damaged shall be reconstructed by the Contractor at his own expense.
D. If, in the final inspection of the work by the City and Engineer, any defects, faults or omissions are found, the Contractor shall repair, remove and/or replace with proper materials and workmanship any defects, faults or omissions without extra compensation for the materials and labor required. Further, the Contractor shall be fully responsible for the satisfactory maintenance and repair of the construction and other work undertaken herein, for at least the guarantee period described in the contract.
E. Public Utility Installations and Structures:
1. Public utility installations and structures shall be understood to include all poles, tracks, pipes, wires, conduits, vaults, manholes and all other appurtenances and facilities pertaining thereto whether owned or controlled by the City, other governmental bodies or privately owned by individuals, firms or corporations, used to serve the public with transportation, traffic control, gas, electricity, telephone, wastewater, drainage, water or other public or private property which may be affected by the work shall be deemed included hereunder.
2. The Contractor shall protect all public utility installations and structures from damage during the work. Access across any buried public utility installation or structure shall be made to avoid any damage to these facilities. All required protective devices, support services, and construction shall be provided by the Contractor at his expense. All existing public utilities damaged by the Contractor which are shown on the Drawings or have been located in the field by the utility shall be repaired by the Contractor, at his expense. No separate payment shall be made for such protection or repairs to public utility installations or structures.
3. Public utility installations or structures owned or controlled by the City or other
00800-7 governmental body which are shown or described in the Contract Documents to be removed, relocated, replaced, or rebuilt by the Contractor shall be considered as a part of the general cost of doing the Work and shall be included in the prices bid for the various contract items. No separate payment shall be made thereof.
4. Where public utility installations of structures owned or controlled by the City or other utility body are encountered during the course of the work, and are not indicated on the Drawings or in the Specifications, and when, in the opinion of the City and Engineer, removal, relocation, replacement or rebuilding is necessary to complete the work under this Contract, such work shall be accomplished by the utility having jurisdiction, or such work may be ordered, in writing by the City and Engineer, for the Contractor to accomplish. If such work is accomplished by the utility having jurisdiction it will be carried out expeditiously and the Contractor shall give full cooperation to permit the utility to complete the removal, relocation, replacement or rebuilding as required. If such work is accomplished by the Contractor, it will be paid for as extra work as provided in the Agreement.
5. The Contractor shall, at all times in performance of the work, employ acceptable methods and exercise reasonable care and skill so as to avoid unnecessary delay, injury, damage or destruction of public utility installations and structures; and shall, at all times; in the performance of the work, avoid unnecessary interference with, or interruption of, public utility services, and shall cooperate fully with the owners thereof to that end.
6. The Contractor shall give written notice to City and other governmental utility departments and other owners of public utilities of the location of his proposed construction operations, at least two (2) business days in advance of breaking ground in any area or on any unit of the Work.
7. The maintenance, repair, removal, relocation or rebuilding of public utility installations and structures, when accomplished by the Contractor as herein provided, shall be done by methods approved by the owners of such utilities.
8. All material delivered to the job site shall be properly protected from dirt, dust, dampness, water and any other condition detrimental to the life of the material from the date of delivery to the time that the material is installed and the City assumes beneficial occupancy.
F. Temporary Structures:
1. Temporary Fences: If, during the course of the work, it is necessary to remove or disturb any fence or part thereof, the Contractor shall provide a suitable temporary fence at his own expense.

2. Responsibility for Temporary Structures: In accepting the Contract, the Contractor assumes full responsibility for the sufficiency and safety of all temporary structures or work and for any damage which may result from their failure or their improper construction, maintenance or operation and will indemnify and save harmless the City from all claims, suits or actions and damages or costs of every description arising by reason of failure to comply with the above provisions.
G. The Contractor shall also be entirely responsible and liable for all damage or injury as a result of his operations to all other adjacent public and private property, structures of any kind and appurtenances thereto met with during the progress of the work.
H. The cost of protection, replacement in their original locations and conditions or payment of damages for injuries to such adjacent public and private property and structures affected by the Work, whether or not shown or described in the Contract Documents, and the removal, relocation and reconstruction of such items called for on the Plans or specified shall be included in the various Contract items and no separate payments will be made therefor.
1. Contractor is expressly advised that the protection of buildings, structures, tunnels, tanks, pipes, etc. and related work adjacent and in the vicinity of his operations, wherever they may be, is solely the Contractor’s responsibility.
2. Conditional inspection of buildings or structures in the immediate vicinity of the
Work which may reasonably be expected to be affected by the Work shall be performed by and be the responsibility of the Contractor.
3. Contractor shall, before starting operations, make an examination of the interior and exterior of the adjacent structures, buildings, facilities, etc., and record by notes, measurements, photographs, and video, conditions which might be aggravated by open excavation and construction. Repairs or replacement of all conditions disturbed by the Contractor’s operations shall be made to the satisfaction of the City. This does not preclude conforming to the requirements of the insurance underwriters. Digital copies of surveys, photographs, videos, and reports shall be given to the City.
4. Prior to the beginning of any excavations the Contractor shall advise the Engineer of all buildings or structures on which he intends to perform work or which performance of the Work will affect.
I. Protection of Trees: Unless noted on the Drawings, all trees and shrubs shall be adequately protected by the Contractor in accordance with the City’s Tree Protection Ordinance governing the protection of trees. No excavated materials shall be placed so as to injure such trees or shrubs. Trees or shrubs destroyed by the Contractor or his employees shall be replaced by the Contractor with new stock of equivalent size as
00800-9 measured at Mean Breast Height, at its proper transplanting season, and at the sole expense of the Contractor.
J. Lawn Areas: Unless noted on the Drawings, lawn areas shall be left in as good condition as before the starting of the work. Where sod is to be removed, it shall be carefully removed, and later replaced, or the area where sod has been removed shall be restored with new sod matching that which was removed or disturbed.
K. Restoration of Fences:
1. Any fence, or part thereof, that is damaged or removed during the course of the work shall be replaced or repaired by the Contractor and shall be left in as good a condition as before the starting of the work.
2. The manner in which the fence is repaired or replaced and the materials used in such work shall be subject to the approval of the City.
3. The cost of all labor, materials, equipment, and work for the replacement or repair of any fence shall be deemed included in the appropriate Contract item or items, or if no specific item is provided therefore, as part of the overhead cost of the work, and no additional payment will be made therefore.
1.11 CONTRACT DOCUMENTS
A. Drawings: When obtaining data and information from the Drawings, figures shall be used in preference to scaled dimensions, and large scale drawings in preference to small scale drawings.
B. Copies Furnished to Contractor:
1. After the Contract has been executed, the Contractor will be furnished one (1) complete set of reproducible drawings (24 inches by 36 inches) in pdf format and one (1) copy of the conformed construction documents (Contract Requirements, Specifications, and all addenda) in pdf format.
2. The Contractor shall furnish each of the subcontractors, manufacturers, and material suppliers such copies of the Contract Documents as may be required for their work. All copies of the Contract Documents shall be printed from the reproducible sets furnished to the Contractor. All costs of reproduction and printing shall be borne by the Contractor.
C. Supplementary Drawings:
1. When, in the opinion of the Engineer, it becomes necessary to explain more fully
00800-10 the work to be done or to illustrate the work further or to show any changes which may be required, drawings known as Supplementary Drawings, with specifications pertaining thereto, will be prepared by the Engineer; the Contractor will be furnished one (l) set of reproducible drawings (24 inches by 36 inches) in pdf format and one (l) reproducible copy of any additional specifications in pdf format.
2. The Supplementary Drawings shall be binding upon the Contractor with the same force as the Contract Drawings. Where such Supplementary Drawings require either less or more than the estimated quantities of work, credit to the City or compensation to the Contractor shall be subject to the terms of the Agreement.
D. Contractor to Check Drawings and Data:
1. The Contractor shall verify all dimensions, quantities, and details shown on the
Drawings, Supplementary Drawings, schedules, Specifications, or other project data, and shall notify Engineer of all errors, omissions, conflicts, and discrepancies found therein. Failure to discover or correct errors, conflicts, or discrepancies shall neither relieve the Contractor of full responsibility for unsatisfactory work, faulty construction or improper operation resulting therefrom nor from rectifying such conditions at his own expense. Contractor shall not be allowed to take advantage of any errors or omissions, as full instructions will be furnished by the Engineer, should such errors or omissions be discovered.
2. From investigations, including surveys made at the site, it is assumed that physical conditions are approximately as indicated on the Drawings, but the nature of the materials below the surface, the depth to satisfactory foundations, or the stability of beds or banks, are not guaranteed.
3. Certain information regarding the reputed presence, size, character and location of existing underground structures, pipes and conduits has been shown on the Contract Drawings. There is no certainty of the accuracy of this information, and the location of underground structures shown may be inaccurate and other obstructions than those shown may be encountered. The Contractor hereby distinctly agrees that the City and Engineer are not responsible for the correctness or sufficiency of the information given; that in no event is this information to be considered as part of the Contract; and that consideration for equitable compensation will be made for conditions materially different from those shown on the Drawings, as determined by the City and Engineer.
E. Intent:
1. All work called for in the Specifications applicable to this Contract, but not shown on the Drawings in their present form, or vice-versa, shall be of like effect as if shown or mentioned in both. Work not specified in either the Drawings or in the

Specifications, but required to carry out their intent or in the complete and proper execution of the work, is required, and shall be performed by the Contractor as though it were specifically delineated or described.
2. The apparent silence of the Specifications as to any detail, or the apparent omission from them of a detailed description concerning any work to be done and materials to be furnished, shall be regarded as meaning that only the best general practice is to prevail, and that only material and workmanship of the best quality is to be used.
The interpretation of these Specifications shall be made upon that basis.
3. The Specifications, the Special Provisions, the Plans, General Provisions, and all supplementary documents are essential parts of the Contract Documents, and a requirement occurring in one is as binding as though occurring in all. They are intended to be complimentary and to describe and provide for a complete Work. In case of a discrepancy, calculated dimensions will govern over scaled dimensions;
plans will govern over standard Specifications; Special Provisions will govern over General Provisions, Specifications, and Plans.
4. The Contractor shall take no advantage of any apparent error or omission in the plans or specifications. If the Contractor discovers such an error or omission, he shall immediately notify the City. The City will then make such corrections and interpretations as may be deemed necessary for fulfilling the intent of the plans and specifications.
1.12 MATERIALS AND EQUIPMENT
A. Manufacturer:
1. The COSU maintains an Approved Materials Checklist (the Checklist) for its utilities infrastructure which shall be the basis of selection and supply of all materials and supplies for the Work. For items not included in the Checklist nor defined elsewhere in the Plans and Specifications, the Contractor shall submit requests developed in accordance with Section 1.13 of this Section to the Engineer for approval at least 14 business days in advance of submittal of associated Shop Drawings to afford time for proper investigation and discussion with City. Such pre-approval must be obtained before Shop Drawings for these items may be submitted. No manufacturer shall be approved for any materials to be furnished under this Contract unless it is of good reputation and has a plant of ample capacity.
Contactor shall, upon the request of the Engineer, be required to submit evidence that the proposed vendor has manufactured a product similar to the one specified, and that it has been previously used for a like purpose, for a minimum of five (5) calendar years to demonstrate its satisfactory performance.
2. All transactions with the manufacturers or subcontractors shall be through the
Contractor, unless the Contractor shall request and at the Engineer's option, that the
00800-12 manufacturer or subcontractor deal directly with the Engineer. Any such transactions shall not in any way release the Contractor from his full responsibility under this Contract.
3. Any two or more pieces of material or equipment of the same kind, type or classification, and being used for identical types of service, shall be made by the same manufacturer.
B. Delivery:
1. The Contractor shall deliver materials in ample quantities to insure the most speedy and uninterrupted progress of the work so as to complete the work within the allotted time.
2. The Contractor shall also coordinate deliveries in order to avoid delay in, or impediment of, the progress of the work of any related Contractor.
1.13 SUBSTITUTIONS FOR SPECIFIED MATERIALS OR EQUIPMENT AS AN
APPROVED ALTERNATE
A. Whenever materials or equipment are specified or described in the Contract Documents by using the name of a proprietary item or the name of a particular supplier, the naming of the item is intended to establish the type, function, and quality required. Unless the name is followed by words indicating that no substitution is permitted, materials or equipment or other supplier may be accepted by the City if sufficient information is submitted by the Contractor to allow the City to determine that the material or equipment proposed is an approved alternate to that named. Requests for review of approved alternate items of materials and equipment will not be accepted by the City from anyone other than the Contractor.
