About this file

This document is a Justification for Brand Name Exception to Fair Opportunity Exceeding the Simplified Acquisition Threshold pursuant to FAR 16.505(a)(4) for IT equipment and peripherals.

The Federal Emergency Management Agency (FEMA) at the Department of Homeland Security (DHS) intends to procure brand name Dell IT equipment and peripherals, including USB hubs, keyboards, mice, headsets, docking stations, and monitors. The brand name items are unique or highly specialized and peculiar to the Original Equipment Manufacturer (OEM). The use of these specific brand name items is required to maintain the integrity of FEMA's IT infrastructure, ensure compatibility across the agency, and prevent disruptions to critical operations. FEMA conducted market research and determined that the anticipated prices will be fair and reasonable based on comparisons to GSA and strategic sourcing contract vehicles. The total estimated value of the procurement is $267,082. The contract will be awarded to an unknown vendor under solicitation number 24-334.

JEFO No.:

Date: 2 , 2024 PR Number: TN02912Y2024T

1. FEMA, Texas National Processing Center, Consolidated Resource Center and Contracting Activity. Dell IT Equipment. Anticipated Cost: $267,082.00 “Justification for an Exception to Fair Opportunity.”

AGENCY: CONTRACTING AGENCY:

Federal Emergency Management U.S. Department of Homeland Security Agency (FEMA) Federal Emergency Management Agency C/O Robert Wink Acquisition Management Division 3900 Karina Ln 500 C St SW Denton, TX 76208 Washington, DC 20472

2. Nature and/or description of the action being approved.

DHS/FEMA has identified brand-name products pursuant to FAR 16.505(a)(4), restricting consideration to an item peculiar to one manufacturer (e.g., a particular brand-name, product, or a feature of a product that is peculiar to one manufacturer) must be justified. A brand-name item, even if available on more than one contract, is an item peculiar to one manufacturer.

3. A description of the supplies or services required to meet the agency’s need are:

4. Identify the exception to fair opportunity and supporting rationale. Multiple awardee(s) are capable of providing the supplies required at the level of quality required because the supplies ordered are unique or highly specialized pursuant to FAR16.505(a)(4)(iii)(B) and is an item peculiar to one manufacturer:

FEMA intends to procure a brand name specification for (Dell Equipment) in accordance with FAR 16.505(a)(4)(i) due to:

The brand name items listed at 2. above are unique or highly specialized and is a brand name item peculiar to the Original Equipment Manufacturer (OEM). The brand name must be used because Contract Vehicles (Final Signed) annotates:

DHS Management Directive 0730.1, Strategic Sourcing Group Operations, and DHS Management Directive 731, Strategically Sourced Commodities Policy and Procedures, are superseded for contracts governed by this Directive.

DHS Components use strategic sourcing contract vehicles when purchasing supplies or services. All DHS strategic sourcing contract vehicles are mandatory for use unless the procurement meets one of the exceptions listed below or the CPO specifically designates the vehicle as non-mandatory. This eliminates redundant acquisitions and leverages buying power to achieve the lowest price possible.

IAW FAR subpart 11.105(a)(1) - The particular brand name, product, or feature is essential to the Government’s requirements, and market research indicates other companies’ similar products, or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency’s needs.

FEMA’s 1-1-1 initiative/approved products. In addition, all equipment has been proven to work with laptops currently in use in the Hermit’s Peak Calf Canyon Fire Claim’s are Dell brand, and Dell peripheral equipment will ensure compatibility. Due to the function, design, specifications, and security constraints, a deviation from FEMA’s approved Dell products could alter the operation and security of the IT infrastructure. Introducing non-FEMA IT approved equipment is not practical, is against FEMA policy, and could disrupt critical operations. It’s in FEMA’s best interest to pursue this brand name action in order to maintain the integrity of the IT system, compatibility across the agency for hoteling, and to prevent potential hardware failures.

DHS network architecture, maintenance platforms, and configuration systems require the use of this product to ensure interoperability with other DHS systems at all data centers. The Dell must be configured in accordance with DHS OCIO system architecture requirements. The use of other products could result in interoperability, compatibility, interface issues that would preclude the system’s support team from providing efficient and effective customer support. DHS FEMA, Response and Recovery, Site Support Service conducted market research on the following products:

5. Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable. This paragraph should always begin with a sentence similar to: “The contracting officer determines that the anticipated price(s) will be fair and reasonable based on….” The section should include information such as commercial pricelists or prior acquisition history that will help the contracting officer determine that the anticipated cost is fair and reasonable (see FAR Subpart 15.4 and HSAM 3015.4 for contract pricing).
