Ms. Katie McFarland Category Specialist, Commodities Central Procurement Services - Enterprise Sourcing State of Michigan

Subject: Cost Proposal Submission for Contracts #240000001044 and #240000001045 – Water Service Line Replacements and Restoration

Dear Ms. McFarland, On behalf of LGC Global Inc, we are pleased to submit our cost proposal in response to the Request for Quotes (RFQ #240000001044 & #240000001045) for the continuation of service line replacements and restoration services within the City of Flint, Michigan.

Our proposal has been developed with thorough review and consideration of the Phase 4 (Final Phase). Scope includes 879+ remaining properties (Residential and Commercial) requiring investigation, Service lines replacements, cut and caps and restoration, in addition to 662 outstanding restoration location from Phase-3.

We understand that this phase represents the final and most logistically complex stage of the program and requires precise coordination, accelerated production rates to achieve successful completion. The unit price cost estimate provided herein is based on the most current information available and reflects the operational realities necessary to execute this contract effectively.

State has advised that this contract will be subject to an incentive plan, contingent upon completion of the work in accordance with the contractual timeline.

Key Facts Considered in the Proposal:

1. Sites are dispersed across the city and the direction to complete them will be provided by Rowe and the State.

| 2

2. Restoration efforts will require various trades, including concrete, asphalt, and lawn restoration, resulting in multiple mobilizations and demobilizations.

3. Accelerated Schedule-To complete the project within a (4) month timeframe, the work must proceed on an expedited schedule. Our pricing reflects extended daily work hours, weekend work operations, additional labor resources, dedicated crews, and increased equipment utilization necessary to meet the required timeline.

LGC proposes the following unit prices for the line items requested by the State of Michigan.

FLINT LSL REPLACEMENT PROCESS – PHASE 4 (FINAL PHASE)

Excavation, replacement, and restoration work for the remaining properties in Flint that have either known lead, galvanized, or unknown service line materials will be directed by Rowe and follow the process outlined in this document. This document should be considered fluid and subject to change as field conditions necessitate a need to alter the process.

Timeline for Completion:

• The timeline for the work outlined in the tables above to be completed is July 31, 2026. To complete all the work that has been identified, all activities of the project must be performed simultaneously. This will require dedicated crews for the identifications, replacements, cut and caps, and restoration.

• Based on a tentative start date of Monday, March 23, 2026, there will be 19 weeks to complete the entire project.

• The first priority will be the 183 identifications to be completed by April 30, 2026.

Progress Tracking:

• To ensure the deadline of July 31, 2026, is met, a weekly quota for each activity has been calculated with the expectation it will be achieved, or adjustments will be made to make up for the lack of any progress during the following week.

• Using the inventory tables above, and the estimated hit rate of 68% identified as lead or galvanized, the following numbers will be used as a weekly guideline to track the progress of the project. (These numbers were averaged using a 6-day work week and rounding to the nearest whole number.) Once the construction season has begun, these numbers will be updated and shared with the group during our weekly progress meetings.

1. Identifications- (183/5) =~37/week over 5 weeks

a. 2 crews @ 3-4 per day

b. Estimated 59 (32% of 183) of the identifications will be full copper service lines

2. Replacements- (500 +64 (68% of 94) = 564 = ~30/week over 19 weeks

a. 5 crews @ 1 per day, could be less crews if 2 replacements are achieved

3. Cut and Caps- (130 + 60 (68% of 89) = 190 = ~10/week over 19 weeks

a. 1 crew @ 3 per day

4. Restorations (665 outstanding) = ~35 properties/week over 19 weeks

a. 1 soft crew and 1-2 hard crews @ 6 per day

5. Restorations (813) = ~43/week over 19 weeks

a. 1 soft crew and 2-3 hard crews @ 8 per day

• Any property that Rowe directs LGC crews to mobilize to and is not able to perform any of the work anticipated because of extenuating circumstances outside of the contractor’s control, and if Rowe does not have another property for the contractor to move on to immediately, then LGC can consider that instance as an unsuccessful attempt and submit for reimbursement per the rate schedule.

Data Management:

• Rowe and the city will use the same geographically based map made up of 11 Zones that was designed for Phase 3, to assign work for LGC’s crews to move proactively through the city. A list of properties will be provided to LGC on a weekly rolling basis, such that they can be responsible for calling in the tickets to Miss Dig, organizing the plans for traffic control, and communicating with their crews as necessary to keep work progressing.

• All information and data pertaining to this project will be stored in the city’s database known as Cityworks. Rowe will be responsible for maintaining all the data throughout the duration of the project. The city will be responsible for copying all data in Cityworks and uploading it to their BS&A UB system.

Investigations:

• Traditional excavation will be the preferred method for identifying unknown service lines for Phase 4 due to the timeline for completion. All sites will be verified by inspectors prior to being assigned to crews.

• An investigation of any property that is identified with full, non-lead/galvanized service line materials will be immediately restored to grade. Any further restoration needs will be scheduled and completed as soon as possible.

o The Rowe and/or City inspector will knock on the door and notify the resident of the service line materials found and request access to verify the material of the service line where it enters the structure.

o If there is no answer, the Rowe and/or City inspector will leave a notice informing the resident of their service line materials on the door.

• Investigations at inactive accounts where the service line material is found to be lead or galvanized, a cut and cap will be performed immediately. The “investigation” is then considered a cut and cap versus a traditional excavation investigation for the purposes of billing.

• Investigations at active accounts where all, or only the private side is identified with lead or galvanized materials, the line will be inventoried for replacement, and the following actions will be initiated:

o The Rowe and/or City inspector will knock on the door and notify the resident of the composition and try to obtain consent for replacement.

o If there is no answer, there are 3 things that must be left on the door:

1. A service line notification letter informing the resident of their service line material, and

2. A shut off notice informing the resident they have 7 days to contact the number to schedule a replacement.

3. A copy of the consent form.

o After 7 days, the service can be shut off and scheduled for a cut and cap as soon as possible.

• When an investigation at an active account identifies lead or galvanized on the public side and non-lead/galvanized on the private side, the public side can be scheduled for replacement as soon as practical. Since this service line does not have lead on the private side, a consent form for replacement is not necessary as only the public portion will be replaced. The city will be responsible for notifying the resident of the change in service line material status (from unknown to known) and attempting to access the interior 18” of the service line to identify the material for their records.

o Rowe and/or the city inspector will knock on the door and notify the resident of the composition and explain next steps.

o If there is no answer, there are 2 things that must be left on the door:

1. A service line notification letter informing the resident of their service line material

2. A letter stating they will be notified when crews are going to be there to replace the city’s side of the service line and what to expect.

Completion of the above investigation activities will produce:

• A list of locations that do not currently have a structure present.

• A list of locations that are confirmed to not have a lead or galvanized service lines.

• A list of locations that have confirmed lead or galvanized service lines in need of replacement, or to be cut and capped.

Resolution of confirmed lead or galvanized service lines at active accounts:

• Rowe, with assistance from City inspectors, will schedule the replacements and send LGC the necessary information electronically to submit Miss Dig tickets and traffic control plans as needed.

• The City inspector will leave a door hanger on the property for the resident to inform them their water service could be terminated in 7 days if they do not consent to a replacement.

Once water service is shut-off, it will remain shut-off until permission is granted.

o Shut-offs will be performed systematically over a region such that the contractor is coordinated and working in a defined area as much as possible.

o If permission is still not granted before the contractors are leaving an area, or by a predetermined date, then a cut and cap will be performed.

Standards for Cut and Cap:

• All lead and galvanized service lines inventoried to be cut and capped will be cut and capped on the private side of the curb stop, and minimally one dry bag of ready-mix cement

(at least 60lb) will be poured over the curb stop prior to restoring the area to grade. The purpose of the cement is to reduce the likelihood of the curb-stop being accessible/operable.

• If there is not a way to cut and cap the line on the private side, lead or galvanized service lines will be abandoned on the public side by removing them from the corporation fitting at the water main. It is expected that the corporation valve would be left in place with a cap on the exit side of the valve.

Standards for Restoration:

• All disturbed areas should be left in the same condition or better than the same condition prior to any disturbance due to service line activities. This includes installing fresh topsoil to make up any removed soil, grading all materials, replacing hardscapes, and seeding all softscapes.

Standards for Conduct and Performance:

• All contractors will conduct themselves in a professional and respectful manner at all times while working under this contract. Anyone who engages in crude or unruly behavior will be removed from the project indefinitely.

• All field staff will be expected to report to the specified jobsite daily, on time, and ready to start work at 8am. If inclement weather is forecasted, it will be a joint decision by Rowe/City if work will proceed as planned, be delayed as necessary, or called off completely, i.e. some rainfall with no thunderstorms expected would continue the schedule for that day.

• Each contractor/crew/inspector will show up daily with enough equipment, tools, materials, fuel, etc. to perform their workload for the day.

• Regardless of if the reason is related to the weather, the site conditions, a resident response, etc.; no one will be forced to work in an unsafe environment. Any situation that results in the decision of any individual to remove themselves from working on the project should be immediately communicated to their supervisor.

Project Completion:

• Once all lead and galvanized lines have been identified, and are either replaced or removed from the distribution system by means of cutting and capping so they are no longer attached and able to deliver water, then the service line replacement/removal program can be considered complete. The expected date for completion is July 31, 2026.

• Once all properties are restored with hard and softscape materials, the restoration portion of the project can be deemed complete. The expected date for completion is August 31, 2026.

• Once all service line information collected during the duration of this project is provided to the city of Flint to use as their official record, then the data management portion of the project can be deemed complete. The Expected date for completion is September 15, 2026.

• Once all invoices have been compiled, submitted for reimbursement, and approved, the entire project can be deemed complete. The expected date for completion is September 30, 2026.

Contract Incentive Terms:

This special provision describes the requirements for earning an incentive for the completion of the contract items described herein, on or prior to the dates specified for this project. There are three (3) milestones that can be obtained, to which the contractor is eligible to receive any combination of, or all, if all the terms of each individual milestone are met.

Milestone 1: $250K

All addresses/parcels with unknown service line materials must be identified by April 30, 2026, AND a minimum of 50% of the total service lines requiring replacement or cut and cap are completed by end of day May 30, 2026. The contract items for completing this requirement include water service line inspection and identification, water service line replacement, and cutting and capping of service lines.

Milestone 2: $500K

100% of the total service lines requiring replacement or cut and cap are completed by end of day July 31, 2026. The contract items for completing this requirement include water service line inspection and identification, water service line replacement, and cutting and capping of service lines.

Milestone 3: $250K

100% of all hardscape and softscape restoration is complete from all phases of the service line replacement project by August 31, 2026. This includes all hardscape and softscape areas associated with any contract items for water service line inspection and identification, water service line replacement, or cutting and capping of service lines.

Contract Service Level Credits:

This provision describes the credits that are to be paid by the contractor for non-conformance or uncompleted field work by the end dates established for this contract as defined in the contract and below. Both Credit 1 and Credit 2 may run concurrently if delays occur in both categories.

Credit 1:

A ten thousand dollar ($10,000) per day credit will be accrued by the contractor for every day after July 31, 2026, that service line inspection and identification, water service line replacement, and cutting and capping work is left to complete.

Credit 2:

A ten thousand dollar ($10,000) per day credit will be accrued by the contractor for every day after August 31, 2026, where hardscape or softscape restoration is not complete at areas associated with any contract items for water service line inspection and identification, water service line replacement, or cutting and capping of inactive service lines.

Subject: Fast Start VII -Restoration and Water Service Line Replacements

Proposal for Escalation in Contract Unit Price Rates

Dear Ms. Erin Russell, LGC appreciates the opportunity to continue our partnership with Flint Fast Start- Restoration and Service line replacement project. After assessing the 2022 & 2023 construction phases, the crew productivity was impacted by scattered locations and complexity of the work, and the limited scope of work at sites, all of which affected both efficiency and cost-effectiveness. In addition, there has been a rise in the prices for water service materials.

In light of these changes, LGC proposes adjusting the unit prices for the specific line items listed below from the original bid, while keeping the remaining line items at the same 2022 bid prices.

Estimated total cost for service line replacement and restoration at 89 addresses is approximately $900,000.00.
