JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity.

Naval Surface Warfare Center, Port Hueneme Division

2. Description of the Action Being Approved.

NSWC PHD intends to award a Purchase Order on a sole source basis for installation of a complete classified material destruction system with Security Engineered Machinery (SEM).

3. Description of Supplies/Services.

Items required to be procured from SEM for a complete classified material destruction system include the following.

Disintegrator 3000 Dual Stage (Quantity 1). NSA listed Dual Stage Conveyor fed Disintegrator

Systems will have a minimum of 1,200 lb. per hour capacity using a 3/32 DOD security screen for paper destruction. Speed: 585 rpm and 5850 cuts per minute. The Disintegrator will be equipped with a Solid Steel welded rotor with three turning knives and two stationary bed knives for maximum cutting inertia and durability. No open or “hollow space” rotor designs will be accepted. The Disintegrator will have a minimum 40HP motor with 24” x 12” Cutting chamber and will be equipped with a manual hydraulic system for ease of access for service and operation.

Feed Conveyor 3000 Package (Quantity 1) System will be supplied with minimum 22” adjustable speed Steel Feed Conveyor. Feed Conveyor will have a rubberized conveyor belt with a minimum of 2” cleats. The conveyor will be equipped with a safety load control meter interlocked with disintegrator and MCP to prevent overfeeding or jamming. The conveyor will automatically stop when the destruction system is under extreme workloads.

Air Evacuation system (Quantity 1), Air Filtration system (Quantity 1), and Duct Kits KB Galvanized (Quantity 1). Pneumatic waste cyclone with airlock and self-contained dust collection system. The system will be provided with a minimum 7.5HP external fan cyclone system and rotary air lock adequate for pneumatic conveyance of disintegrated paper into compactor. The fan system will be suspended above the compactor by a metal frame free standing support stand with safety catwalk utilizing an airlock for pressure less waste distribution. The dust filter system will have fully sealed enclosed panels with remote auto shaker integrated within the MCP. Dust filtration system will be mounted above compactor on frame for cleaner disposal of dust and eliminate manually emptying filter bin. Dust filters include cotton socks for maximum dust control and automatic filter shakers. All duct to be of galvanized steel with viewing spools. A Spare Filter Kit will be supplied for all filters.

Electrical M/C Panel 460V (Quantity 1). Destruction system shall have an interlocked Master Control Panel to maintain sequential individual system component functionality and include all safety interlocks to ensure proper operation and allow for auto start up and shutdown of all system components in proper timed sequence. The MCP will further integrate a safety interlock and feed rate control with the conveyor to prevent overfeeding of the system. MCP will contain a visual feed rate meter to prevent overfeeding, an hour meter, and key locked auto start/stop button which includes the timed shutdown feature to ensure cutting chamber is empty of material upon shutdown and prevent system jamming upon restart. MCP will include individual component starters for disintegrator and waste evacuation system and contain all Safety magnetic motor starters and thermal overload protection. The filter shakers will be controlled through the MCP. The MCP is built to comply with the following standards, NFPA 70 National Electric Code, NFPA 79 Industrial Control and UL508A Industrial Control Panels. MCP will comply with UL 508A and will be labeled as such.

Engineering & Site Review (Quantity 1). Engineering layouts, Schematics, and Manuals, Site evaluation prior install.

Period of Performance: 01 OCT 2024 through 30 SEP 2025

The Government’s minimum needs have been verified by the certifying technical and requirements personnel.

4. Statutory Authority Permitting Other Than Full and Open Competition

10 U.S.C. 2304(c)(1). as implemented by the Federal Acquisition Regulation (FAR) 6.302-1, Only One Responsible Original Equipment Manufacturer (OEM) manufactures the parts and No Other Supplies or Services Will Satisfy Agency Requirements.

5. Rationale Justifying Use of Cited Statutory Authority.

The objective of this contract is to procure and install equipment to satisfy the requirement for a replacement heavy-duty, commercial destruction system located on-site that is capable of destroying large volumes of paper and optical media. To meet current and future NSWC PHD destruction demands, the new destruction system must have a throughput greater than 1000 lbs./hr. Current demand requires the average daily destruction of the contents of fourteen (14)

96-gal shred bins, each weighing approximately 350 lbs. for approximately 5-hours of personnel-supported, daily shred processing.

Security Engineered Machinery (SEM) is the only company that is listed on the NSA Evaluated Products List (EPL) as an approved vendor for classified material destruction machines, as well as the only manufacturer of NSA approved dual-stage disintegrators, that is capable of replacing the existing non-functional destruction system. Only NSA approved equipment can be used for the destruction of classified and controlled unclassified information. All other equipment listed on the EPL other than the SEM machinery does not meet the volume requirements required by NSWC PHD. SEM has confirmed that they do not have any authorized third-party distributors capable of manufacturing a customized system to meet the requirement. If NSWC PHD does not gain the capability to destroy the volume of material required, there is the risk of grave damage to national security due to enhanced likelihood of unauthorized disclosure associated with transporting classified material to another site.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

After exhausting all Navy Supply resources, a Quote was obtained from SEM in the United States. Quotes were not solicited from any other companies, as no other company approved by NSA manufactures a machine capable of the throughput NSWC PHD requires.

No other company is capable of providing a NSA-approved dual stage disintegrator. As verified by SEM on 26 January 2024, SEM is the only manufacturer of this equipment, and must customize the system to meet the requirement. Authorized distributors are not capable of customization.

7. Determination of Fair and Reasonable Cost. The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition.

NSWC PHD will continue to conduct market research as warranted to provide a broader vendor base as applicable for the types of supplies/services covered by this document. If another potential source emerges, NSWC PHD will assess whether competition for future requirements is feasible.
