About this file
This document is a justification and approval for using other than full and open competition to award a firm-fixed price, indefinite delivery-indefinite quantity supply contract for various manufacturers' and sizes of rechargeable batteries. The Naval Sea Systems Command Naval Surface Warfare Center, Crane Division requires Yuasa, Enersys, and Power Sonic brand rechargeable batteries and battery cells to repair universal power supplies and battery packs for equipment aboard naval vessels. The estimated contract value is $1,000,000 annually from fiscal year 2024 through 2029. Only the specified battery manufacturers and cells will meet the equipment's operational, size, weight, and electrical requirements and have been tested and certified for use. Developing and qualifying new battery alternatives would significantly increase costs and delay deliveries needed by April 2024.

JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
Naval Sea Systems Command (NAVSEA) Naval Surface Warfare Center, Crane Division (NSWC-CR), 023 Contracts Division.
2. Description of the Action Being Approved.
The use of other than full and open competition to award a firm-fixed price, indefinite delivery-indefinite quantity supply contract for various manufacturers’ and sizes of rechargeable batteries on a brand name only and brand name or equal basis from authorized distributors.
3. Description of Supplies/Services.
The cells in this requirement consist of vendor brand name specific items used in the repair of universal power supplies and battery pack repairs. The manufacturers have been identified below, including the part numbers.
Yuasa NP7-12FR
Yuasa NP18-12BFR Enersys X-Cells 0800-0004 Enersys BC-Cells 0820-0004 Power Sonic PS6100F2 Power Sonic PHR12100 Power Sonic PS1229
The estimated dollar value of this action is $1,000,000 for FY24 through FY29, utilizing funds as identified in the table below. The Government’s minimum requirements have been verified by the certifying technical and requirements personnel.

4. Statutory Authority Permitting Other Than Full and Open Competition.
10 U.S.C. 3204(a)(1), Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority.
These cells are used to repair one or more of 18 different battery packs. NSWC Crane, Code JXM is the depot facility that is responsible for their repair. This equipment is repaired to original equipment specifications for . The cells listed were originally selected to meet operational and size requirements of various functions aboard the specific
In addition, the cells must meet the size, weight, and electrical requirements of the particular battery and be certified. To meet the specifications, the cells within any particular battery must be matched by manufacturing lot, manufacturing date and individual cells tested characteristics.
If a second source is developed, all cells must be replaced from the same source. The cells were not designed for the battery packs, rather the exisiting commercial cells were tested and approved for use in the battery pack requirements for the fleet needs.
The procurement of cells by any authorized distributor does not impact the performance of the battery pack, but the manufacturer and salient characteristics of the cells are relevant to performance. Therefore, only the approved cells can be utilized within the battery packs.
To certify other cells, the Government would have to obtain first level item testing (environmental qualification testing & performance testing), second level assembly testing (environmental qualification testing & performance testing), operation testing at sea, and approval of new equipment/vendor.
The estimated cost to develop and implement a new box/cells is significantly higher than what would be recouped through competition from a source other than authorized distributors. In addition, the length of time to perform the testing is unacceptable, as the program has a requirement of April 2024 for the first delivery of these batteries.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
Market research relating to rechargeable batteries has been ongoing and indicates that currently there are several authorized distributors that can supply the Navy needs.
Sources sought N0016423SNB17 was posted to SAM.gov on 15 November 2022. The sources sought closed on 28 November 2022 and two (2) timely and one (1) late response were received.
Wholesale Batteries provided sufficient detail to determine their capability. The other timely response from Har-Per Sales Solutions only referenced one of the required brand names and the RTA was unable to determine if the vendor could provide all requirements. The third (late) response from Pulsepacks LLC expressed their interest in providing Yuasa batteries, but did not provide supporting documentation or address any other batteries. Of the three (3) responses, only one (Wholesale Batteries) was determined capable of providing the Government’s requirements via the sources sought. However, any authorized distributors of the cells can provide a proposal
7. Determination of Fair and Reasonable Cost.
The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.
8. Actions to Remove Barriers to Future Competition.
For the reasons set forth in Paragraph 5, NSWC Crane has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NSWC Crane will assess whether competition for future requirements is feasible.
