FEDERAL BUREAU OF INVESTIGATION

LIMITED SOURCES JUSTIFICATION (FAR PART 8)

LIMITED-SOURCES JUSTIFICATION FOR FEDERAL SUPPLY SCHEDULE PROGRAM

FAR 8.405-6(b) Requisition Number: DJF-21-2200-PR-0002316

Date: 2/24/2021 Estimated Contract Dollar Value: $162,591.00

The following justification and approval for the use of sources limited to fewer than those required in FAR 8.405-1 is prepared in accordance with Federal Acquisition Regulation (FAR) 8.405-3. This acquisition is conducted under the authority of the Multiple-Award Schedule Program (41 U.S.C. 251, et seq,and 40 U.S.C. 501).

1. Identification of the agency and the contracting activity.

The U.S. Department of Justice (DOJ), Federal Bureau of Investigation (FBI), Critical Incident Response Group (CIRG), Counter IED Section (CIEDS), Hazardous Devices School (HDS), has prepared this justification for the purchase of an upgrade with installation for an existing Remotec F6B robot.

2. Nature and/or description of the action being approved.

This is a contract to provide labor and parts to upgrade a current robot for the Federal Bureau of Investigation (FBI) Hazardous Devices School. The resultant contract is intended to be awarded as a one-time, firm-fixed price contract.

HDS requests the upgrade of one of the F6B Robots to the most current platform, the Spartan. This robot is used at the school to train Public Service and Special Agent Bomb Technicians. HDS is a world class provider of training, which includes teaching students how to use the most current industry standard equipment. In order to do this, HDS must either upgrade an existing robot, or purchase a brand new robot. Upgrading to the newest platform is far less expensive.

This requirement includes all parts and labor and should be completed within 8 months from the award of the contract.

3. A complete description of the supplies and/or services required to meet the agency’s needs.

The upgrade will consist of Remotec ordering the required components to conduct the upgrade of the robot. The HDS personnel will then transport the robot to be upgraded in Remotec’s facility in Clinton, Tennessee. During the upgrade of the robot, Remotec will charge the government labor cost of $110/per hour. Once the upgrade is completed, HDS personnel will return the robot to the school.

4. The authority and supporting rationale (see 8.405-6(a)(1)(i) and (b)(1)) and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.

· FAR 8.405-6(b) – An item peculiar to one manufacturer is required.

The Remotec’s robot parts are serviced and supported solely by the manufacturer. It was determined that the Remotec’s robot parts will provide the required security, technical, functional, and operational requirements that are compatible and exceed any competitors.

5. A determination by the ordering activity Contracting Officer that the order represents the best value consistent with FAR 8.404(d).

Upgrading existing equipment is more cost-effective than purchasing entirely new equipment. The HDS budgetary restrictions do not support replacing robots. Additionally, upgrading a robot is part of the life cycle replacement program. The robots are used on a weekly basis at HDS during training exercises.

6. A description of the market research conducted among schedule holders, and the results of the research. A statement must be made that the supplies and services are available from the FSS.

Significant market research efforts were conducted by the FBI previously by querying the internet, requesting information from industry sources, attending industry trade shows, and years of ongoing testing and training. This equipment is extremely reliable, trustworthy and currently being utilized by other agencies units in the field. In conclusion, the Northrup Grumman/Remotec, Inc. is the sole source manufacturer and distributor of the equipment.

7. Any other facts supporting the limited source justification.

Upgrading existing equipment is more cost-effective than purchasing entirely new equipment. The Remotec robots are industry standard equipment. HDS trains the bomb technicians across the country, so training bomb technicians with the most commonly used robots is logical. The HDS budgetary restrictions do not support replacing robots, which cost in excess of $300,000/each. Additionally, upgrading a robot is part of the life cycle replacement program. The robots are used on a weekly basis at HDS during training exercises.

8. A statement of the actions, if any, the agency will take to remove or overcome any barriers that led to restricted consideration before any subsequent acquisition for supplies and services is made.

The actions of the CIRG to identify potential sources possessing the ability to satisfy this and similar requirement are ongoing. Over time, additional sources may become available and identifiable through market surveys, trade shows, magazine articles, collaboration with other Federal agencies, or other means. The ability to predict this possibility is difficult. Therefore, the barriers to competition they impose are impossible to avoid.
