Requisition Number: DJF-22-2200-PR-0001364 Version 1.0 Page 1
FEDERAL BUREAU OF INVESTIGATION
JUSTIFICATION FOR LIMITED COMPETITION/SIMPLIFIED
ACQUISITION
JUSTIFICATION AND APPROVAL FOR
ACQUISITIONS UNDER THE SIMPLIFIED ACQUISITION THRESHOLD
Requisition Number: DJF-22-2200-PR-0001364
In accordance with Federal Acquisition Regulation 13.106-1(b)(1), I hereby determine that the Persistent Systems Wave Relay (WR)-5100 MANET radios listed on DJF-22-2200-PR-0001364 is available from only one manufacturer (brand name only), and competition is precluded as there are no substitutes available.
1. This acquisition is restricted to the following manufacturer:
Company: Persistent Systems, LLC Company Address: 303 Fifth Avenue Suite 306 Company Point of Contact and Phone Number: Nick Naioti, (603)-289-8002
2. The Persistent Systems radios and accessories for the WR-5100 MANET radios is estimated to cost $128,486.44 and is required to be delivered by 3/31/2022.
The CIEDS’ Render Safe Program Unit’s (RSPU) Stabilization Program (STAB) is responsible for providing communications equipment to fourteen Level Five (5) stabilization cities. The equipment used to provide the secure voice, video and data has to be small, lightweight, and capable of providing FBINET, and UNET connectivity for the Special Agent Bomb Technicians (SABT) to link with FBI Headquarters, FBI Field Offices, and Other Government Agencies during Render Safe missions. The STAB program procured satellite communication systems to transport secure voice, secure video teleconferencing (VTC) and secure data services back to a Land Earth Station (LES) in Quantico, VA. In urban environments, a satellite look angle is not always available from the ground so a rooftop installation is required. In these instances, employing the Persistent Systems mesh networking radios has proven to significantly decrease the amount of time needed to provide satellite communications to the Technical Operations Center (TOC). These radios will provide wireless data links to provide faster installation times and to overcome physical barriers in those circumstances where the installation of fiber optic cabling is not feasible.
The STAB uses Mobile Ad-Hoc Networking (MANET) radios to extend voice and data services. The Stabilization program is looking to acquire four MPU5 MANET radios equipped with 10 watt (10W) S-band modules in order to ensure interoperability with other Persistent Systems Units in the Federal Bureau of Investigation, Department of Defense counterparts and local law enforcement. Additionally the Stabilization program is looking to
Requisition Number: DJF-22-2200-PR-0001364 Version 1.0 Page 2 acquire dual Push-To-Talk (PTT) modules with heads sets, 10W S-band frequency modules to enhance the MPU5 MANET radios capabilities by extending the range from each radio, increasing amplification efficiency and cleaner noise filtering during Stabilization and Render Safe operations.
3. Specific characteristics of the Persistent Systems MPU 5 MANET radio that limit the availability to a sole source are: frequency spectrum diversity (2.1GHz to 6.0GHz), seamless Layer 2 connectivity for sensors and devices, Cloud Relay™ Layer 3 network interoperability, implementation of Dynamic Link Exchange Protocol (DLEP) and its Size Weight And Performance (SWAP), Wave Relay provides a unique capability that is only provided by the OEM, Persistent Systems. Only this suggested source can furnish the requirements, to the exclusion of other sources, because the proprietary Wave Relay communication devices are unique to Persistent Systems and not available for purchase through any other manufacturer/reseller. All Wave Relay communications devices include proprietary firmware developed by Persistent Systems.
4. Check and fill in all that are applicable:
X The material or service must be compatible in all aspects (form, fit, and function) with existing systems presently installed. The current equipment is the Persistent Systems WR-5100 MANET radios, and the new item/service must coordinate, connect, or interface with the existing system by being interoperable with existing WR-5100 radios on hand. Adding a new radio next to the existing WR-5100 with the use of an adapter or device will not meet mission requirements.
A patent, copyright, proprietary data or licensing agreement limits competition. The proprietary data are described as follows:
<Insert description>
These are "direct replacement" parts/components for existing equipment.
