The library will remain closed to the public and unoccupied during the five-month construction period. A non-mandatory pre-bid meeting is scheduled for September 4, 2026 at 10:30 AM via Microsoft Teams. Questions and substitution requests must be submitted by September 8, 2026 at 2:00 PM, with responses published by September 14, 2026. Sealed bids are due September 21, 2026 at 2:00 PM, followed by a public bid opening at 3:00 PM the same day. The contract term is five months from the date of Notice to Proceed, with contractor work hours permitted Monday through Sunday between 7:00 AM and 6:00 PM in compliance with City of Kent construction rules.
The owner's estimated base bid range is $3.25 million to $3.9 million. A 5 percent bid bond is required when the sum of the base bid plus additive alternates exceeds $35,000. Retainage of 5 percent will be withheld from all payments in accordance with Chapter 60.28 RCW. The contract requires prevailing wage compliance under RCW 39.04.010, with workers subject to prevailing rates as defined by chapter 39.12 RCW, and a minimum of 15 percent of total labor hours must be performed by registered apprentices unless a waiver is granted. Bidders must satisfy mandatory responsibility criteria including Washington contractor registration under chapter 18.27 RCW, current unified business identifier number, industrial insurance coverage, employment security registration, apprenticeship compliance, prevailing wage training certification, and no disqualifying wage violations. Supplemental responsibility criteria require bidders to have completed at least three comparable public construction projects within five years with contract values of not less than $2.5 million, demonstrate on-time completion history with no more than one instance of liquidated damages or late completion, maintain an Experience Modification Rate (EMR) not exceeding 1.0, and disclose any termination for default, claims, or willful OSHA violations within specified periods. The Library encourages proposals from minority- and women-owned businesses and reserves the right to reject any or all bids. X. STATEMENT OF BIDDER’S QUALIFICATIONS: Bidders must submit bid qualification criteria (Attachment E – Bidder Responsibility Questionnaire) under RCW 39.04.350 and must meet the responsibility criteria to be considered.
1. General
This Section is issued in accordance with RCW 39.04.350. Before the contract is awarded, the Library will determine whether the apparent low bidder is a "responsible bidder" within the meaning of RCW 39.04.350. A bidder that fails to meet any mandatory or supplemental responsibility criterion set forth in this Section will be found not responsible and its bid will not be considered for award, regardless of bid price.
Nothing in this Section limits the Library's right to request clarifying information, to verify any information submitted, or to make an independent determination of responsibility based on all information available to the Library, whether or not submitted by the bidder.
2. Mandatory Responsibility Criteria (RCW 39.04.350(1))
To be considered a responsible bidder and eligible for award of this contract, each bidder must satisfy each of the following mandatory criteria at the time(s) indicated. Bidders are advised that these criteria are established by state law and cannot be waived by the Library.
(a) Contractor registration/licensing. At the time of bid submittal, the bidder must hold a certificate of registration in compliance with chapter 18.27 RCW, and, if applicable to the scope of work bid, a plumbing contractor license in compliance with chapter 18.106 RCW, an elevator contractor license in compliance with chapter 70.87 RCW, or an electrical contractor license in compliance with chapter 19.28 RCW.
(b) Unified business identifier (UBI). The bidder must have a current State of Washington unified business identifier number.
(c) Industrial insurance, employment security, and excise tax registration. If applicable, the bidder must have: (i) industrial insurance coverage for the bidder's employees working in Washington as required under Title 51 RCW; (ii) an employment security department number as required under Title 50 RCW; and (iii) a state excise tax registration number as required under Title 82 RCW.
(d) No disqualification from public works bidding. The bidder must not be disqualified from bidding on any public works contract under RCW 39.06.010 or RCW 39.12.065(3).
(e) Apprenticeship compliance. If this project is subject to the apprenticeship utilization requirements of RCW 39.04.320, the bidder must not have been found out of compliance by the Washington State Apprenticeship and Training Council for working apprentices out of ratio, without appropriate supervision, or outside their approved work processes under their standards of apprenticeship (chapter 49.04 RCW) during the one-year period immediately preceding the bid solicitation date.
(f) Prevailing wage training. The bidder must have received training on public works and prevailing wage requirements under chapters 39.04 and 39.12 RCW, through training provided by the Washington State Department of Labor & Industries ("L&I") or an L&I-approved training provider, and must have designated the person(s) trained, unless the bidder is exempt because it has completed three or more public works projects and has held a valid Washington business license for three or more years.
(g) No willful wage violations. Within the three-year period immediately preceding the bid solicitation date, the bidder must not have been determined, by a final and binding citation and notice of assessment issued by L&I or by a civil judgment entered by a court of limited or general jurisdiction, to have willfully violated (as defined in RCW 49.48.082) any provision of chapter 49.46, 49.48, or 49.52 RCW.
(h) Sworn statement. Before award, the apparent successful bidder must submit to the Library a signed statement, in accordance with chapter 5.50 RCW, verifying under penalty of perjury that the bidder is in compliance with the criterion in subsection 2(g) above. The Library may award the contract in reasonable reliance on that sworn statement.
(i) Apprentice utilization plan. If this project is subject to apprentice utilization requirements under RCW 39.04.320, the apparent successful bidder must submit an apprentice utilization plan to the Library before receiving the notice to proceed, using the L&I template (or an L&I-approved the Library template), unless the Library exempts the bidder because it met or exceeded apprentice utilization requirements on the last public works project it completed.
3. Supplemental Responsibility Criteria (RCW 39.04.350(4))
In addition to the mandatory criteria in Section 2 above, and as authorized by RCW 39.04.350(4), the Library has adopted the following supplemental criteria applicable to this project because the scope, complexity, and value of the project require bidders to demonstrate a proven, directly comparable track record. The basis for evaluation of each criterion, and the process for a bidder to request modification of these criteria before the bid submittal deadline, are set forth below.
(a) Relevant project experience. Within the five (5) years immediately preceding the bid submittal deadline, the bidder must have successfully completed, as prime contractor, at least three (3) public construction projects that are reasonably comparable to this project in size, scope, and complexity, meaning projects involving: (i) interior renovation, tenant improvement, or comparable alteration work within commercial or public-facing facilities; and (ii) a total construction contract value of not less than $2,500,000.
(b) Evidence of experience. For each reference project submitted under subsection 3(a), the bidder must provide: the project name, location, and owner; a description of the scope of work; the original and final contract value; the original and actual completion dates; and the name and current telephone number of an owner's representative familiar with the bidder's performance whom the Library may contact for verification.
(c) On-time completion history. Within the five (5) years immediately preceding the bid submittal deadline, the bidder must not have been assessed liquidated damages, or otherwise found responsible for an uncured, unexcused delay resulting in late substantial completion, on more than one (1) of its public works or comparable private construction projects. For each project on which liquidated damages were assessed or a late completion occurred, the bidder must disclose the project, the length and cause of the delay, whether any time extension was granted, and the resolution.
(d) Termination and default history. The bidder must disclose whether, within the five
(5) years immediately preceding the bid submittal deadline, it has been terminated for default, termination for convenience following a dispute, or removed from a public works or comparable private construction project by an owner. A bidder that has been terminated for default on one (1) or more such projects within that period may be found not responsible, unless the bidder demonstrates, to the Library's reasonable satisfaction, that the circumstances of the termination do not reflect on the bidder's present responsibility to perform this contract.
(e) Claims and litigation history. The bidder must disclose all claims, demands, arbitrations, mediations, administrative proceedings, and lawsuits filed by or against the bidder within the five (5) years immediately preceding the bid submittal deadline arising out of a construction contract, including: the parties, forum, nature of the dispute, amount in controversy, and current status or outcome (including any adverse judgment, arbitration award, or settlement). The Library will evaluate the frequency, nature, and outcome of disclosed claims and litigation, including whether a pattern of disputes reflects on the bidder's responsibility, its history of contract performance, or its financial stability to complete this contract.
(f) Safety record. Within the three (3) years immediately preceding the bid submittal deadline, the bidder's Experience Modification Rate (“EMR”), as reported to the bidder's workers' compensation or industrial insurance carrier, must not have exceeded 1.0 for the current policy year or either of the two preceding policy years. In addition, the bidder must not have received a willful violation citation from the federal Occupational Safety and Health Administration or the Washington State Department of Labor & Industries' Division of Occupational Safety and Health within the three (3) years immediately preceding the bid submittal deadline. The bidder must provide its EMR for the current and prior two policy years and disclose any such willful OSHA/WISHA citation, including the citation number, the violation cited, and its current status (including any abatement, appeal, or resolution). The Library will evaluate whether a disclosed EMR above the stated threshold or a disclosed willful citation reflects on the bidder's ability to safely perform this contract.
(g) Right to request modification. A potential bidder may, in a timely manner before the bid submittal deadline, request that the Library modify the supplemental criteria in this Section 3, in accordance with RCW 39.04.350(4)(b). Requests must be submitted in writing to the Library procurement contact at Purchasing@kcls.org by Wednesday, September 16, 2026 by 9:00 AM. The Library will evaluate the request and respond before the bid submittal deadline. If the Library's evaluation results in a change to the supplemental criteria, the Library will issue an addendum to the bidding documents identifying the revised criteria.
4. Submission of Responsibility Information
Each bidder must submit the information required to demonstrate compliance with the mandatory and supplemental responsibility criteria in this Section, in the form and within the time specified in the bid documents (see Bidder Responsibility Questionnaire, Attachment E). If a bidder fails to supply requested responsibility information within the time and manner specified, the Library may base its responsibility determination on any available information related to the supplemental criteria, or may find the bidder not responsible, in accordance with RCW 39.04.350(4)(c).
5. Determination and Appeal
If the Library determines that a bidder is not responsible, the Library will provide the bidder with the reasons for that determination in writing. A bidder may appeal a not-responsible determination within two (2) business days of receipt of the Library's written determination by submitting additional information to the Library procurement contact at Purchasing@kcls.org, in accordance with RCW 39.04.350(4)(d). The Library will consider any additional information submitted before issuing its final determination. If the Library's final determination affirms that the bidder is not responsible, the Library will not execute a contract with any other bidder until two business days after the bidder determined not responsible has received the Library's final determination.
Y. REFERENCES: List the names and addresses of three (3) customers, for whom the bidder has provided similar services. Include dates, contact persons, and telephone numbers. Should any reference submitted by the bidder be found unsatisfactory, the Library, as its sole option, may reject that bidder’s offer. The Library shall be the sole judge in determining a satisfactory or unsatisfactory reference response. References must be submitted with the bid response on Attachment D.

This order of precedence does not limit the Library’s right to issue clarifications or corrections through the RFI, SI, FA, or CO process.
B. SPECIFICATIONS AND DRAWINGS ARE THE BASIS OF THE WORK: The intent of the Specifications and Drawings is to describe a complete Project to be constructed in accordance with the Contract Documents. Contractor shall furnish all labor, materials, equipment, tools, transportation, permits, and supplies, and perform the Work required in accordance with the Drawings, Specifications, and other provisions of the Contract Documents.
