Everett Housing Authority is soliciting bids from qualified contractors to complete exterior building envelope repairs at Broadway Plaza Apartments. The work is based on the Building Envelope Assessment Report prepared for Broadway Plaza East and Broadway Plaza West.

EHA Invitation to Bid | Page 5

The project includes repair, cleaning, sealing, recoating, and weatherproofing of exterior façade systems and related components at the East Building, West Building, breezeway, garage/foundation areas, elevator penthouse, sunroom glazing assembly, and parking structure.

The Base Bid shall include all work described in this Scope of Work unless specifically removed by an accepted deductive alternate.

The intent of the project is to address observed façade and building envelope deficiencies, reduce water intrusion risk, restore weather-resistive performance, repair localized deterioration, extend the useful life of exterior systems, and protect the building from continued moisture-related damage.

The Contractor shall provide all labor, supervision, materials, equipment, lifts, scaffolding, access systems, protection, permits, safety controls, disposal, testing, submittals, coordination, and incidentals necessary to complete the work.

The Contractor shall field verify existing conditions, quantities, dimensions, access requirements, and repair locations before beginning work.

3.3 Scope of Work

The contractor shall provide all labor, supervision, materials, equipment, tools, transportation, permits, disposal, testing, documentation, and incidentals necessary to complete the work described in this ITB and “Attachment A – Scope of Work”.

3.4 Technical Specifications

Attachment K - Engineer’s Assessment Report

3.5 Site Conditions and Coordination

The contractor shall coordinate work with EHA and minimize disruption to residents, staff, visitors, and neighboring properties. Work areas must be secured and maintained in a safe condition at all times.

3.6 Schedule and Completion

Work is anticipated to begin in mid-August, with the final schedule to be negotiated and established following contract award.

3.7 Deliverables and Closeout

Deliverables may include schedules, submittals, permits, warranties, training materials, as-built documents, lien releases, prevailing wage affidavits, and other closeout documents required by EHA.

3.8 Alternates, Unit Prices, and Allowances

For the deductive alternates, bidders must complete all applicable lines on the Bid Form. EHA may award the base bid, any combination of alternates, or no award, in accordance with the ITB and available funding.

SECTION 4 — BID REQUIREMENTS

4.1 Bid Package Organization

Bids must be organized in the order listed below. Each section must be clearly labeled.

EHA Invitation to Bid | Page 6

4.2 Required Bid Contents

The bid package must include the completed Bid Form, acknowledgment of addenda, bid security, bidder information form, non-collusion certification, responsible bidder certification, subcontractor list if required, applicable HUD forms, W-9, and any project-specific forms identified in Section 9.

4.3 Bid Form

Bidders must use Attachment B - Bid Form. Prices must be complete, clearly stated, and inclusive of all costs necessary to perform the work. Bidders must not alter the bid form except to fill in required information.

4.4 Bid Bond Requirements

A bid bond in the amount of five percent (5%) of the total bid price is required. Bid security must be submitted as a bid bond, cashier’s check, or other form acceptable to EHA.

4.5 Subcontractor Listing

Bidders must identify subcontractors for specified categories of work on the bid form. Failure to provide required subcontractor information may result in the bid being deemed non-responsive.

4.6 Addenda Acknowledgment

Bidders must acknowledge receipt of all addenda. A bid that fails to acknowledge a material addendum may be deemed non-responsive.

4.7 Bidder Responsibility

Before award, EHA will determine whether the apparent low bidder is responsible. Bidders must meet mandatory responsibility criteria under Washington law and any supplemental responsibility criteria identified in this ITB.

4.8 Supplemental Responsibility Criteria

In addition to the mandatory bidder responsibility criteria required by law, EHA may consider the following supplemental responsibility criteria to determine whether the apparent low bidder is responsible for this project.

Because this project involves exterior building envelope repairs at an occupied multifamily housing property, the apparent low bidder must demonstrate that it has the experience, capacity, and qualifications necessary to perform the work safely, properly, and in compliance with the contract documents.

The apparent low bidder shall submit documentation demonstrating the following, if requested by EHA:

Relevant Project Experience The bidder shall have successfully completed at least three projects of similar size, scope, and complexity within the past five years. Similar projects may include exterior building envelope repairs, façade restoration, masonry repair, EIFS repair, sealant replacement, waterproofing, concrete repair, traffic coating, occupied multifamily housing work, or similar public works projects.

Occupied Building Experience The bidder shall demonstrate experience performing construction or repair work at occupied residential, senior housing, multifamily, public housing, or similarly sensitive occupied facilities while maintaining resident access, safety, communication, and site protection.

Specialized Envelope Repair Experience The bidder or its proposed subcontractors shall demonstrate experience with the major work elements included in this project, including exterior sealant replacement, masonry repair, EIFS repair or coating, waterproofing/coatings, concrete repair, glazing repair, and related façade or building envelope work.

Licensing and Registration The bidder and all required subcontractors shall be properly licensed, registered, and eligible to perform the work in Washington State, including maintaining an active Washington State contractor registration and any trade-specific licenses or certifications required for the work performed.

EHA Invitation to Bid | Page 7

Bonding Capacity The bidder shall demonstrate the ability to provide required bid, performance, and payment bonds in the amounts required by the solicitation.

Safety Record The bidder shall have a satisfactory safety record and shall provide safety-related information if requested, which may include EMR, OSHA/WISHA citations, L&I history, or a written safety program. EHA may consider whether the bidder’s safety history indicates an unreasonable risk to residents, staff, the public, or the successful completion of the project.

Project Management Capacity The bidder shall demonstrate that it has adequate supervision, staffing, equipment, access systems, and project management capacity to complete the work within the required schedule while maintaining safe occupied-building operations.

Prevailing Wage and Public Works Compliance The bidder shall demonstrate a record of compliance with Washington State prevailing wage, public works, apprenticeship, retainage, and contractor responsibility requirements. EHA may consider prior violations, debarment, or failure to comply with public works requirements.

References The bidder shall provide references for similar projects if requested by EHA. References should be able to confirm project scope, quality of work, schedule performance, change order management, safety, communication, and overall performance.

If the apparent low bidder does not meet the supplemental responsibility criteria, EHA may determine the bidder to be not responsible, provided EHA follows the applicable notice and response process required by law.

4.9 No Substitution Unless Approved

Bids shall be based on the products, materials, and methods specified in the solicitation documents, or on equivalent products, materials, and methods approved by EHA. Any proposed equivalent must be submitted to EHA for review by the questions deadline, unless another deadline is stated in the solicitation. Substitutions or equivalents shall not be used unless approved by EHA in writing, either by addendum before bid opening or as otherwise expressly permitted by the contract documents.

4.10 Responsiveness

A responsive bid is one that conforms in all material respects to the ITB. EHA may reject bids that are incomplete, conditional, materially unbalanced, unsigned, late, or otherwise non-responsive.

SECTION 5 — BID EVALUATION AND AWARD

5.1 Basis of Award

EHA intends to award the contract to the lowest responsive and responsible bidder whose bid conforms to the ITB and is in the best interest of EHA. Award is subject to EHA approval, funding availability, HUD or other funding requirements, and successful execution of contract documents.

5.2 Evaluation of Bid Price

Bid price will be evaluated based on the method stated in Attachment B. Unless otherwise stated, evaluation will be based on the total base bid plus any alternates selected by EHA for award.

5.3 Responsiveness Review

EHA will review bids for completeness, signatures, addenda acknowledgment, required forms, bid security, subcontractor listings, and compliance with material requirements.

EHA Invitation to Bid | Page 8

5.4 Responsibility Review

EHA may review licensing, bonding capacity, insurance, references, past performance, SAM.gov status, Washington Labor & Industries status, Washington Department of Revenue status, Employment Security Department status, and other criteria allowed by law.

5.5 Tie Bids

If two or more responsive and responsible bidders submit identical low bids, EHA may resolve the tie in accordance with applicable law and EHA policy.

5.6 Notice of Intent to Award

EHA may issue a notice of intent to award after completing its review. The notice does not create a contract and does not authorize work. Work may begin only after execution of the contract and issuance of a Notice to Proceed.

5.7 Bid Protest

Any protest must be submitted in writing within fourteen calendar days after the bid opening, unless a shorter period is required elsewhere in this ITB or by applicable law. A protest must state the specific facts and legal basis for the protest and must be submitted in the manner required by this ITB. EHA will not consider protests submitted after the deadline, or protests based on issues that could have been raised before bid opening but were not timely submitted.

SECTION 6 — CONTRACT REQUIREMENTS

6.1 Form of Agreement

The selected bidder will be required to enter into a written agreement with EHA. The contract will incorporate this ITB, all addenda, the successful bid, technical specifications, drawings, required HUD forms, insurance requirements, bonds, and any other contract documents identified by EHA.

6.2 Contract Documents

The contract documents may include the executed agreement, scope of work, technical specifications, drawings, bid form, insurance exhibit, EHA general or supplementary conditions, HUD-required forms and clauses, wage determinations, bonds, all addenda, and the contractor’s submitted bid as accepted by EHA.

6.3 Order of Precedence

In the event of conflict among contract documents, the order of precedence will be stated in the final agreement.

EHA may determine the controlling requirement when necessary to administer the contract.

6.4 Bonds

The contractor shall provide performance and payment bonds in the amount required by this ITB, Washington law, HUD requirements, and the final contract. Bonds must be issued by a surety acceptable to EHA and authorized to do business in Washington State.

6.5 Insurance

The contractor shall maintain insurance coverage in accordance with EHA’s Insurance Requirements Addendum E. Proof of insurance must be provided before contract execution and maintained throughout the contract term.

6.6 Permits, Licenses, and Inspections

The contractor is responsible for obtaining and maintaining all permits, licenses, certifications, approvals, inspections, and fees necessary to perform and complete the work unless the ITB states otherwise.

6.8 Retainage

Retainage will be withheld, released, or waived only as allowed by Washington law and the contract documents.

The contractor is responsible for providing all closeout documents required for release of retainage.

6.9 Changes and Change Orders

Changes to the work, contract amount, or contract time must be authorized by written change order executed by EHA. The contractor shall not perform extra work without written authorization.

6.10 Safety and Site Control

The contractor is responsible for jobsite safety, protection of persons and property, traffic control, resident protection, hazardous materials controls, and compliance with all applicable safety laws and standards.

6.11 Indemnification

The contractor shall indemnify, defend, and hold harmless EHA and its officers, employees, agents, and representatives from claims arising out of or related to the contractor’s performance, to the extent allowed by law and as stated in the final agreement.

6.12 Termination

EHA reserves the right to terminate the contract for convenience or for cause, including failure to perform, failure to comply with laws, failure to maintain insurance or bonds, or failure to meet contract requirements.

SECTION 7 — FEDERAL, HUD, AND WASHINGTON STATE COMPLIANCE REQUIREMENTS

7.1 General Compliance

The contractor shall comply with all applicable federal, state, and local laws, regulations, and requirements, including HUD requirements, 2 CFR Part 200 procurement standards, Washington public works laws, Washington prevailing wage laws, and EHA policies.

7.2 Procurement Standards

This ITB is intended to support full and open competition, documented procurement procedures, and use of the sealed bid method when appropriate. The contract file should document the procurement history, basis for award, and price reasonableness.

7.3 EHA’s General Conditions and Forms

The contract will include applicable EHA forms and clauses, found as Attachment M.

7.4 Debarment and Suspension

The bidder and its principals must not be debarred, suspended, or otherwise excluded from participation in federally funded programs. EHA may verify status in SAM.gov before award and at other times during contract performance.
