2026-2027 Water Renewal Project - Contract Documents

This is a project manual and bid document package for construction services issued by the Benbrook Water Authority (BWA) in Fort Worth, Texas. The project encompasses the construction of 6-inch and 8-inch water main replacements and 6-inch, 8-inch, and 10-inch sanitary sewer main replacements across multiple streets in Benbrook, totaling approximately 9,450 linear feet of water mains and 2,750 linear feet of sanitary sewer mains, along with approximately 900 meter replacements. The project includes two bidding alternatives: Alternative A for open-cut construction methods and Alternative B for pipe-bursting methods. Sealed bids are due by 11:00 AM on Tuesday, September 22, 2026, at the BWA Office located at 1121 Mercedes, Benbrook, Texas 76126. A non-mandatory pre-bid conference is scheduled for 11:00 AM on Thursday, September 10, 2026, at the same location. The contract award is anticipated within 30 days of bid opening, with bids remaining open for evaluation for up to 60 days. The contractor must substantially complete the work within 180 calendar days and achieve final completion within 210 calendar days from the Notice to Proceed.

Bidders must submit a cashier's check, certified check, or bid bond equal to 5 percent of the maximum total bid price as bid security. Performance, payment, and maintenance bonds—each in the amount of 100 percent of the contract price—are required upon award. The contract structure utilizes unit pricing for individual pay items across both alternatives, with final payment based on actual quantities rather than estimated quantities. A qualified contractor statement of qualifications, including financial statements, experience records, and equipment schedules, must accompany all bids. Contractor shall perform work valued at no less than 50 percent of the total contract value with its own organization unless otherwise approved by BWA. Liquidated damages are assessed at $500 per day for delays beyond the completion deadline. The contract is subject to Texas Government Code Chapter 2252 regarding nonresident bidder bid adjustments. BWA qualifies as a tax-exempt agency under Texas statute. Project design was completed by Westwood Professional Services, with engineering inquiries directed to Dillon Burton, P.E., at 817-412-7155 or Dillon.Burton@westwoodps.com.

VENDOR COMPLIANCE TO STATE LAW

BWA Standard Specifications

Revised: October 2021

SECTION 00 43 37

VENDOR COMPLIANCE TO STATE LAW NON RESIDENT BIDDER

Texas Government Code Chapter 2252 was adopted for the award of contracts to nonresident bidders.

This law provides that, in order to be awarded a contract as low bidder, nonresident bidders (out-of-state contractors whose corporate offices or principal place of business are outside the State of Texas) bid projects for construction, improvements, supplies or services in Texas at an amount lower than the lowest

Texas resident bidder by the same amount that a Texas resident bidder would be required to underbid a nonresident bidder in order to obtain a comparable contract in the State which the nonresident’s principal place of business is located.

The appropriate blanks in Section A must be filled out by all nonresident bidders in order for your bid to meet specifications. The failure of nonresident bidders to do so will automatically disqualify that bidder.

Resident bidders must check the box in Section B.

A. Nonresident bidders in the State of Texas, our principal place of business, are required to be

_______ percent lower than resident bidders by State Law. A copy of the statue is attached.

Nonresident bidders in the State of Texas, our principal place of business, are not required to underbid resident bidders.

B. The principal place of business of our company or our parent company or majority owner is in the state of Texas.
