Summary of CSP 26-147 Panther Island Canals C & D Contract Documents
This is a Competitive Sealed Proposal (CSP) package issued by the Tarrant Regional Water District for the construction of Panther Island Canals C & D in Fort Worth, Texas. The project encompasses mass grading and excavation of canals and an outfall swale, installation of drill shafts and bridge retaining walls, construction of a concrete-lined canal with adjacent paseo and park facilities, storm sewer improvements at the canal outfall, and utility improvements and relocations including lift station construction. The work is divided into six units: Base Bid Items (Canal and Swale, Paseo and Park), City of Fort Worth IPRC Items (Sewer, Drainage, and Paving), and Make Up Water Line Items. Key line items include 48,985 cubic yards of unclassified excavation, 690 square yards of concrete pavement, retaining walls, storm and sewer piping (ranging from 12 inches to 48 inches in diameter), box culverts (7x4 to 8x8 configurations), and landscape and irrigation work across multiple blocks. The non-mandatory pre-proposal conference and site visit are scheduled for August 19, 2026, at 9:00 AM at the Coyote Theatre in Fort Worth. Questions must be submitted via the Procurement Website by September 10, 2026, at noon. Proposals are due by September 17, 2026, at 2:00 PM Central Time and will be publicly opened via Microsoft Teams teleconference. The project must achieve Substantial Completion by May 2028, with Final Completion occurring 60 days thereafter.
The Owner's budget for the project is $42,000,000. Offerors must demonstrate minimum qualifications by successfully completing five similar projects within the last ten years prior to proposal submission. Proposals will be evaluated using a best-value selection process under Texas Government Code Chapter 2269, with scoring weighted as follows: Proposed Contract Price and Contract Times (40 points), Contractor's Approach to the Project (20 points), Experience and Past Performance of Offeror (20 points), and Experience and Qualifications of Proposed Key Personnel (20 points), for a total of 100 points. Proposal Security in the amount of 5 percent of the proposed contract price must be submitted with each proposal and will be forfeited if the apparent successful offeror fails to execute the Agreement. The selected contractor must enter into the contract within 15 days of Notice of Award. The contract requires compliance with prevailing wage rates, performance and payment bonds in accordance with Texas Government Code Chapter 2253, and standard insurance requirements. All proposals must remain valid for 60 days following the opening date.

Instructions to Offerors 00 21 16 - 2
2.04 The submission of a Proposal will constitute an incontrovertible representation by the Offeror that the Offeror has complied with every requirement of this Article, that without exception the
Proposal is premised upon completion of Work required by the Contract Documents, that the
Offeror has given the OPT written notice of all conflicts, errors, ambiguities, and discrepancies that the Offeror has discovered in the Contract Documents, and that the Contract Documents adequately indicate and convey understanding of all terms and conditions required for preparation of the Proposal and completion of Work.

5.02 Review the following guidelines for asking questions on the Procurement Website before posting questions:

B. Read the previously posted questions before posting a similar question to avoid posting duplicate questions.
C. Post questions as discreet questions so an answer can be given to the specific question.
Multiple part questions cannot be answered until all responses have been prepared.

D. Do not post questions asking that the OPT confirm that the documents mean what they say.
E. Provide adequate information to allow a response to be made:
1. Reference the specific drawing or specification paragraph when asking a question using complete references e.g. section number / paragraph and drawing number / detail designations,

3. Explain why the question is being asked.
Instructions to Offerors 00 21 16 - 3

G. Ask questions early. The deadline for posting questions will not be extended unless the date for receipt of Proposals is extended. No response will be made to questions asked after the deadline. Unless there is time for the OPT to issue an Addendum and for Offerors to incorporate this information into their Proposals, no changes will be made and Offerors should prepare their Proposals on the Contract Documents as amended to that point.
H. Offerors cannot qualify their Proposals by explaining assumptions being made in posing questions or in offering a Proposal. Proposals must be in conformance with the Contract
Documents. Alternate Proposals must be submitted in accordance with Article 9 of these
Instructions to Offerors.

5.03 Abuses of the question-and-answer forum may lead to an individual or company being barred from using the Procurement Website. Inappropriate questions or questions with unacceptable language may be deleted. How questions are offered and the messages in terms of how an Offeror chooses to convey these questions may be taken into consideration when evaluating Proposals.
5.04 Responses to questions are not part of the Contract Documents and cannot modify the Contract
Documents. An Addendum may be issued to clarify, correct, or change the Contract Documents, Addenda, or the related supplemental data as deemed advisable by OPT. Modifications to the
Contract Documents can only be made by an Addendum.

Contract Documents. Describe the intent and substance of the changes in the Alternate Proposal in adequate detail so the changes are clearly understood. Acceptance of the Alternate Proposal is at the sole discretion of the OPT and will not be considered if the intent of the change is not clearly understood or is deemed to not be in the Owner’s best interest.
9.02 Alternate Proposals are to be clearly marked as Alternate Proposals and are to be submitted with the fully compliant Proposal. Do not provide a duplicate of the base Proposal. ARTICLE 12—CONFIDENTIALITY OF PROPOSAL INFORMATION
12.01 In accordance with Texas Government Code 552.110, trade secrets and confidential information in Proposals are not open for public inspection. Proposals will be opened in a manner that avoids disclosure of confidential information to competing Offerors and keeps the Proposals from the public until a contract is awarded. All Proposals are open for public inspection after the Contract is awarded, however trade secrets and confidential information in Proposals may not be open for public inspection. The Owner will protect this information to the extent allowed by law.
12.02 Clearly indicate which specific documents are considered to be trade secrets or confidential information by stamping or watermarking all such documents with the word “confidential” prominently on each page or sheet or on the cover of bound documents. Place “confidential” stamps or watermarks so that they do not obscure any of the required information on the document, either in the original or in a way that would obscure any of the required information in a printed copy or photocopy of the document. Submit all confidential information in a different binder so this confidential material is separate for the rest of the Proposal.
12.03 The Owner is a governmental body subject to the limitation of Texas Government Code
Chapter 552 and has limited obligations with regard to protecting confidential information submitted by Offerors. The Owner, upon receiving an application or other request for the disclosure of confidential information, will promptly notify Offeror of the request as required by

A. If confidential information becomes a part of the public domain through publication or otherwise through no fault of the OPT;
B. OPT can demonstrate through suitable documentation that confidential information was already in the OPT’s possession or otherwise publicly available prior to the date of disclosure hereunder;
C. The confidential information is subsequently disclosed to the Owner by a third party who has a lawful right to disclose such information; or
D. The OPT is required to disclose confidential information by court order or by applicable law.
12.06 If the OPT is requested or becomes legally compelled (by oral questions, interrogatories, requests for information or documents, subpoena, civil or criminal investigative demand, public information requests, including requests under Chapter 552 of the Texas Government Code, or
Instructions to Offerors 00 21 16 - 7 similar process) or is required by a regulatory body to make any disclosure that is prohibited or otherwise constrained by this Agreement, the OPT will provide Offeror with prompt notice of this request so that it may seek an appropriate protective order or other appropriate remedy.
12.07 Notwithstanding any other provision of the Contract Documents, it is stipulated and agreed that by accepting a Proposal, the OPT has not and does not waive its sovereign immunity from suit and/or liability.
12.08 Submit request for release of Proposals or related material to the Owner through an open records request using the online process at http://trwd.com/openrecordsrequest.

14.02 An Offeror may withdraw its Proposal within 24 hours after Proposals are opened if the Offeror files a signed written notice with the Owner and promptly thereafter demonstrates to the reasonable satisfaction of the Owner that there was a material and substantial mistake in the preparation of its Proposal. The Proposal Security will be returned if it is clearly demonstrated to the Owner that there was a material and substantial mistake in the Offeror’s Proposal. An Offeror that requests to withdraw its Proposal under these conditions may be disqualified from responding to a reissued Request for Proposals for the Work to be furnished under these Contract
Documents.
ARTICLE 15—OPENING OF PROPOSALS
15.01 Proposals will be opened at the time and place indicated in the Request for Proposals. The Owner will publicly acknowledge receipt of Proposals received in time to be considered. The Owner will publicly open and read aloud each Proposal as required by Texas Government Code 2269.154.

16.01 General Considerations:
A. The OPT will evaluate and rank each Proposal with respect to the selection criteria within
45 days after the date Offers are received using procurement procedures that conform to
Texas Government Code Chapter 2269. In evaluating Offers, OPT will consider whether or not the Offers comply with the prescribed requirements, and such alternatives, prices, and other data, as may be requested in the Offer Requirements or may be requested from
Offerors prior making a recommendation to the Owner’s Board.
Instructions to Offerors 00 21 16 - 8
B. The OPT will consider the proposed Contract Price, proposed Contract Times, qualifications of the Offerors and their Subcontractors, and other factors as described in this Article to determine which Proposal offers the best value to the Owner. The Proposals will be evaluated for each rating category with the maximum point value for each category as indicated in the following table:
Rating
Category Description
Point
Value
A Proposed Contract Price and Contract Times 40
B Contractor’s approach to the Project 20
C Experience / past performance of Offeror 20
D Experience and qualifications of proposed key personnel 20
Total 100
C. The proposed Contract Price and proposed Contract Times are to be provided in
Section 00 42 14 Proposal – Exhibit A. Points will be awarded for each rating category.
D. OPT may conduct such investigations as it deems necessary to establish the responsibility, qualifications, and financial ability of consultants, individuals, or entities proposed to furnish parts of the Work in accordance with the Contract Documents.
E. OPT, at its discretion, may also choose to conduct interviews with the top-ranking Offerors to provide the Offerors a better opportunity to demonstrate they can provide the best value to the Owner for this Project.
1. Should OPT choose to conduct interviews with the top-ranking Offerors, they will be notified of:
a. The time and place for the interview;
b. Interview format and agenda;
c. Questions to answer at the interview; and
d. Individuals that are expected to participate in the interview as a minimum.
2. Failure to participate in the interview may result in disqualification from consideration for the Project.
F. Submission of a Proposal indicates the Offeror’s acceptance of the evaluation techniques and methodologies as well as the Offeror’s recognition that some subjective judgments must be made by the OPT during the evaluation.
16.02 Evaluation for Rating Categories:
A. Rating Category A - Proposed Contract Price and Contract Times:
1. OPT will consider the Offeror’s proposed Contract Price and proposed Contract Times for completion of the project as well as any specified intermediate milestones in determining best value to the Owner.
2. The OPT will consider the Contract Price offered and demonstrated ability to complete projects for the Contract Price.
Instructions to Offerors 00 21 16 - 9
3. The Contract Price will be used in the best value determination and will be the Contract
Price awarded unless this amount is changed during negotiations between the
Contractor and Owner. Negotiations, if any, will be conducted in accordance with
Government Code 2269.155 and will only be for changes in scope and associated changes in Contract Time or Contract Price.
4. The evaluation of proposed Contract Price will consider percentages of change orders for projects as an indicator of ability to complete the Project within the Contract Price.
5. The OPT will consider the proposed Contract Times and the demonstrated ability to complete projects on time.
6. OPT will use the number of days proposed by Offeror to calculate the Substantial
Completion and Final Completion dates from the date of the Notice to Proceed. These dates will define the Contract Times. Liquidated Damages as defined in Section 00 52 13
Agreement will start to accrue after these dates.
7. OPT will consider earlier completion dates in the best value determination for the
Project. The value of this early completion will be determined using the Offerors’ proposed completion dates, approach for construction and the Owner’s cost to provide
Construction Management Services. This value for early completion will be used to adjust the Contract Price when evaluating the proposed Contract Price.
8. Consideration will also be given to the demonstrated ability of the Offeror to complete projects on time, resources available for this Project, and the Offeror's capacity.
B. Rating Category B - Project Approach:
1. OPT will consider the Offeror’s approach to constructing, completing, and commissioning projects, including, but not limited to:
a. Construction contract administration;
b. Construction site safety and risk management;
c. Quality management;
d. Management of Subcontractors and Suppliers;
e. Resolving construction issues and resolving disputes and claims.
2. OPT will consider the Offeror’s approach to constructing the project. In describing the
Offeror’s approach to constructing the project.

b. Qualifications of the management team offered;
c. Organization’s operating philosophy and approach to managing changes in project scope;
d. Financial stability and approach to financial management of projects;
e. Safety programs and past safety performance; and
Instructions to Offerors 00 21 16 - 10
f. Past experience with claims and litigation.
2. Companies that cannot meet the requirements for similar projects as defined in
Section 00 45 16 Qualifications Statement may be disqualified as non-responsive.
D. Rating Category D - Experience and Qualifications of Proposed Key Personnel:
1. OPT will consider the experience and qualification of the proposed Project Manager, Project Superintendent, Safety Manager, Surveyor, and Quality Control Manager (Key
Personnel) for this Project, including, but not limited to:
a. Education, training, and personal experience in delivering similar projects while serving in the capacity for which they are being proposed;
b. Demonstrated ability to complete quality projects on time and within budget as demonstrated by proposal information and reference checks for offered individuals;
c. Demonstrated leadership, character, and capability of proposed individuals; and
d. Availability and commitments to other projects.
ARTICLE 17—AWARD OF CONTRACT
17.01 The Offeror selected for award of the Contract will be the Offeror whose offer provides the best value to the Owner based on the selection criteria and the ranking. The Owner is not bound to accept the lowest priced Proposal if that Proposal is not in the best interest of the Owner as determined by the Owner. If the Owner determines that it is unable to reach a contract satisfactory with the Owner with the selected Offeror, then the Owner will terminate discussions with the selected Offeror and proceed to the next Offeror in order of selection ranking until an agreement is reached or the Owner has rejected all Proposals.
17.02 Owner reserves the right to reject any and all Proposals, including without limitation, non-conforming, non-responsive, or conditional Proposals.
