About this file

This document is an attachment containing state insurance program requirements for a contract between Washington County, Oregon and a contractor. The attachment outlines the contractor's obligations regarding indemnification, defense, and insurance coverage in connection with contract performance. The contractor must defend, indemnify, and hold harmless the State of Oregon, its agents, officers, elected officials, and employees from all claims, demands, and judgments, including attorney fees, arising from damages to property or bodily injury caused by the contractor's negligent performance or willful misconduct, or that of its employees, agents, or subcontractors. The County agrees to promptly notify the contractor of any claims and cooperate reasonably in the defense of such claims.

The contractor is required to name the State of Oregon, its officers, employees, and agents as Additional Insureds with respect to all activities performed under the contract. The insurance coverage must be primary and non-contributory, meaning it takes precedence over any other insurance or self-insurance the State may carry. These requirements apply in addition to indemnification obligations specified elsewhere in the contract and represent standard protective measures for state entities engaging in contractual relationships.
