Horry County Government is soliciting sealed statements of qualifications for RFQ #2023-24-051, Indefinite-Delivery, Indefinite-Quantity (IDIQ) – Unexploded Ordnance (UXO) Detection & Clearing Services. Statements of qualifications are due January 10, 2023, no later than 2:00 p.m., local time.

SECTION 00200 – INSTRUCTION TO PROPOSERS

2.1 General

This solicitation will be conducted in accordance with Horry County Procurement Code and Regulation.

This ordinance can be found in its entirety on the County’s website at https://www.horrycountysc.gov/Departments/Procurement.

Horry County hereby notifies all those responding to this RFQ that, in accordance with the provisions of the Civil Rights Act of 1964 (Chapter 21, Title 42, of the U.S. Code) and Regulations promulgated in connection therewith, that it will affirmatively ensure that any contract entered into pursuant to this RFQ, disadvantaged business enterprises will be afforded full and fair opportunity to make submittals in response to this invitation and will not be discriminated against on the grounds of race, color, or national origin in consideration for an award.

The contractor, sub recipient or subcontractor shall not discriminate on the basis of race, color, national origin, or sex in the performance of this contract. The contractor shall carry out applicable requirements of 49 CFR Part 26 in the award and administration of DOT-assisted contracts. Failure by the contractor to carry out these requirements is a material breach of this contract, which may result in the termination of this contract or such other remedy as the recipient deems appropriate.

2.2 Standards of Conduct

Potential and actual proposers are not permitted to contact Horry County employees outside of the Procurement Department during the procurement process. Potential and actual proposers are not permitted to contact any consultants contracted by the County to assist with efforts related, directly or indirectly, to the RFQ process. Failure to comply with Horry County Procurement Regulation, Chapter 4, Contractor Requirements and Standards of Conduct for Horry County and Procurement Participants may result in the rejection of the proposal and other penalties as applicable.

2.3 Funding

Goods and/or services solicited in this RFQ are anticipated to be purchased with County Funds. However, in the event that Grant and/or State or Federal Funding is available, Horry County requires compliance with all applicable federal, state, local and/or grant rules and regulations related to such funding.

2.4 Non-Appropriation of Funds

If (a) sufficient funds are not budgeted or appropriated and budgeted by Horry County Council in any fiscal period for payment of costs and fees and (b) Horry County has exhausted all funds legally available for such payment costs and fees due under this agreement or any renewal thereof, then Horry County will give awarded Proposer reasonable written notice and this Agreement will terminate as of the last day of Horry County’s fiscal period for which funds for payment are available. Such termination with notice is without any expense or penalty.

2.5 Submitting a Statement of Qualifications (SOQ)

Sealed Statement of Qualifications shall be submitted via Horry County’s electronic bid software ONLY, on or before the Closing date and time indicated in the ebidding software for this project. The only acceptable means of submitting a statement of qualifications in reference to this project is through Horry County’s

Statements of qualifications should contain all information requested and should be submitted in the format as shown within this solicitation document. By submission of this statement of qualifications, the submitter guarantees that all goods and/or services meet the requirements of this solicitation and expresses their intent to be bound by their submittal, and if awarded to abide by the Horry County Contract Terms and Conditions (Sample Professional Services Agreement within this RFQ).

Submitters should include all required forms, and all specification and descriptive documents to be considered, at the time of proposal submission.

The County, at its sole discretion, reserves the right to accept or reject any and all statements of qualifications, in whole or in part, that are deemed to be in the best interest of the County.

2.6 Examination of RFQ Document

Prior to submitting a statement of qualifications, each Submitter shall carefully examine the RFQ documents, study and thoroughly familiarize themselves with the qualification documents, Scope of Services and requirements thereof and must notify the Owner of any and all conflicts, discrepancies, or errors.

Submitters should sign their statement of qualifications in all required signature blocks. SOQs may be rejected for any omissions, alterations not allowed for, additions not called for, or any irregularities of any kind are shown.

SOQs shall remain firm for no less than one hundred twenty (120) calendar days from the Closing Date for receipt of statement of qualifications as specified in Horry County’s ebidding software for this project.

The Submitter’s name and solicitation number should be included when specifications or descriptive papers are submitted with the request for qualifications (RFQ).

By submission of a statement of qualifications, the Submitter guarantees that all goods and/or services meet the requirements of the solicitation. All goods and/or services purchased under the resulting contract(s) include the furnishing of all materials, whether particularly mentioned or not in this solicitation, that are required to fulfill the requirements specified within this RFQ. All goods and/or services are to be provided in accordance with, if applicable to the project: drawings, specifications, and any permit conditions of federal, state, local or any other agencies having jurisdiction.

This RFQ may be postponed or cancelled at any time prior to the Closing date and time. In the event that the RFQ is postponed or cancelled, a notice shall be issued via Horry County’s ebidding software communicating such action.

2.7 Questions / Addenda

All questions must be submitted via Horry County’s ebidding software prior to the Questions Acceptance Deadline as specified in the ebidding software. Each question should be submitted individually within the “Q&A” section of the electronic bid software. All questions and revisions will be provided in the electronic bid software in the form of addendum. If it becomes necessary to revise any part of this solicitation, an addendum will be published. It shall be the Submitter’s responsibility to ensure they have all addenda

RFQ 2023-24-051 - UXO Detection & Clearing Services Page 4 of 37 which have been issued. Any information obtained outside of the procurement process is non-binding and shall not be used in the response to this solicitation.

All Addenda form a part of the documents for this project and modifies / amends / clarifies / adds to the original documents as described. By submitting a response, responders acknowledge receipt and inclusion of the effects of all addenda.

2.8 Licenses

All Submitters must be properly licensed to do business in the State of South Carolina and must comply with the Code of Laws of South Carolina, including Section 40-11-200, when applicable. The Submitter’s company does not need to be based in South Carolina, but must be licensed to do business in the state of SC and specifically Horry County, if awarded a contract. The successful submitters must have all appropriate business license(s) prior to contract execution, unless otherwise stipulated by law. Failure to comply with this requirement may result in the rejection of the statement of qualifications as non-responsive.

2.9 Insurance Requirements

The successful submitter shall provide proof of all required insurance(s), including workers’ compensation, automobile liability, and general liability. Workers’ Compensation shall include a minimum limit of $100,000 per accident. Commercial General Liability coverage shall provide minimum limits of liability of $1,000,000 per occurrence. This shall include coverage for premises/operations, products/completed operations, contractual liability, and independent contractors. Commercial Auto Liability shall include a minimum limit of $1,000,000 combined single limit for bodily injury and property damage for vehicles used in premises/operations. Professional Liability insurance shall be provided with minimum liability limits of $1,000,000 per occurrence (in addition to Commercial General Liability insurance) by professional services such as accountant, attorney, architect, design, engineering and most consultants that involve errors and omissions exposure protection. Horry County shall be named as an Additional Insured on all General Liability policies and expressed on the Certificate of Liability Insurance. Certificate Holder for Certificate of Insurance must be: Horry County, Attention: Risk Management, P.O. 997 Conway, SC 29528.

Insurance shall indemnify County against any and all claims arising under or as a result of the performance of the contract resulting from this solicitation. The County must be provided written notice prior to cancellation, modification, or reduction in limits of any stipulated insurance. It is the responsibility of the vendor/contractor to ensure all subcontractors comply with all insurance requirements of this solicitation and the resulting contract.

2.10 Non-Collusion

By submitting a response, the party making the foregoing states that the statement of qualifications is genuine and not collusive or sham; that said Submitter has not colluded, conspired, connived, or agreed, directly or indirectly with any submitter or person, to put in a sham response, or that such other person shall refrain from offering and has not in any manner, directly or indirectly sought by agreement or collusion, or communication or conference, with any person to fix the submittal of affiant or any other submitter or to fix any overhead, profit or cost element of said Response or of that of any other submitter or to secure any advantage against owner any person interested in the proposed contract; and that all statements in said Response are true; and further, that such submitter has not, directly or indirectly submitted this RFQ, or the contents thereof, or divulged information or date relative thereto to any association or to any member or agent thereof.

2.11 Mistakes in Submission

Corrections and withdrawal of the submitted statement of qualifications will be permitted within the ebidding software prior to Closing date and time.

2.12 Opening / Reading of Names

Unofficial Results will be made publicly available in the County’s ebidding software within an estimated time of sixty (60) minutes after the established due date and time.

2.13 Payment Terms

Payment Terms are Net thirty (30) days upon receipt of correct invoice.

When practical, Horry County prefers to pay for purchases made under the contract awarded from this solicitation via Horry County purchasing card (similar to a MASTERCARD/VISA credit card). When preparing a price proposal, electronic payment processing fees shall be included in unit prices. No price increases shall be permitted for accepting electronic payment from Horry County.

By submitting a statement of qualifications, you agree to accept payment via Horry County purchasing card (similar to a VISA credit card) for all purchases made under the contract award from this solicitation.

2.14 Sales Tax

When applicable, Horry County currently pays eight percent (8%) sales tax. The tax rate for the City of Myrtle Beach is nine percent (9%). The County is NOT sales tax exempt. Horry County is required to pay sales/use tax.

2.15 Disaster/Emergency Clause

It is anticipated that services in the resultant contract may be necessary for emergency protective measures, disaster response, and disaster recovery. By submitting a response to this solicitation, the Proposer shall comply with all applicable federal laws, regulations, executive orders, FEMA policies, procedures, and directives, including but not limited to Appendix II to Part 200—Contract Provisions for Non-Federal Entity Contracts Under Federal Awards with the exception of Part (D) Davis Bacon Act.

Invoices for services related to emergency protective measures, disaster response, and disaster recovery shall be separate from non-emergency/disaster service invoices.

2.16 Purchase Order / Contract Award

Whether or not discussions or negotiations are held, award of purchase order/contract may be made to multiple Submitter(s) whose statement of qualifications is deemed most advantageous to the County, considering all evaluation factors set forth herein. Horry County shall be the sole judge of this determination. The County will consider/evaluate the submitter’s past and current performance of other County contracts, to include factors such as timely delivery and guaranteed delivery date. The successful Submitter will agree to the provisions contained in the attached “Purchase Order Terms and Conditions” and/or “Contract”. The resultant contract(s) from this RFQ will incorporate by reference this RFQ document and the successful submitter(s)’s response to this RFQ.

This procurement does not commit the County to award a contract, to pay any costs incurred in the preparation of the submittal, or to procure or contract for goods and/or services listed herein. Costs associated with submittal preparation, oral interviews or presentations shall be the sole responsibility of the Proposer.

Horry County reserves the right to reject any or all submissions and further reserves the right to waive technicalities and formalities in proposals as well as to accept in whole or in part such proposal(s) where it deems it advisable in protection of the best interest of the County. The County shall be the sole judge as to whether proposals submitted meet all requirements contained in this procurement.

2.17 Term of Contract

The proposed term of this contract shall be for an initial three (3) years with one (1) two-year renewal option.

2.18 Contract Changes

Contract terms and conditions shall not be changed unless by Change Order. Change must be deemed allowable, allocable, within the scope of work and grant or cooperative agreement, (when applicable) and reasonable for the completion of project scope. Changes shall be agreed upon by both parties and recorded using a dually executed change order/work authorization. The change order shall clearly identify all changes to the contract.

2.19 Contract Assignment

No contract awarded under these terms, conditions, and specifications shall be sold, transferred, or assigned without the prior written approval of the County.

2.20 Independent Contractor Status

The contractor shall not, by entering into a contract become a servant, agent, or employee of Horry County, but shall remain at all times an independent contractor to the County. The contract(s) resulting from this RFQ shall not be deemed to create any joint venture, partnership, or common enterprise between the Contractor(s) and Horry County, and the rights and obligations of the parties shall not be other than as expressly set forth.

2.21 Permits and Other Required Permits or Licenses

The successful Proposer is responsible for obtaining ALL permits or fees required of the successful Proposer by this Contract, and permits and fees customarily the responsibility of the successful Proposer.

The successful Proposer shall coordinate with the County of Horry and all other authorities having jurisdiction.

The successful Proposer shall provide or furnish, and promptly make payment for, labor, supervision, services, materials, supplies, equipment, fixtures, appliances, facilities, tools, transportation, storage, disposal, power, fuel, heat, light, cooling, and other utilities, required for construction and all necessary building permits and other permits or licenses required for the construction of the Project(s).

2.22 Grievance / Bid Protest

Any actual or prospective quoter, bidder, offeror, or awardee of a contractor agreement who aggrieved in connection with the solicitation or award of a contract may protest to the County Administrator. The protest shall be submitted in writing within fourteen (14) calendar days after such aggrieved person knows

RFQ 2023-24-051 - UXO Detection & Clearing Services Page 7 of 37 or should have known of the facts giving rise thereto provided that grievance has been made in accordance with solicitation requirements. Any grievance filed shall be made known prior to any bid opening in accordance with invitation to bids. 2.23 Freedom of Information Statement

Procurement information shall be a public record to the extent required by Chapter 4 of Title 30, (The Freedom of Information Act), South Carolina Code of Laws, 1976, with the exception that commercial or financial information obtained in response to an “Invitation for Bids” or “Request for Proposals” which is privileged and confidential if so designated by the proposer shall not be disclosed. Such information must be clearly marked as “CONFIDENTIAL” by the proposer for each section of the information so affected.

Privileged and confidential information is information in specific detail not customarily released to the general public, the release of which might cause harm to the competitive position of the party supplying the information.

OBJECTIVE & SCOPE OF SERVICES

3.1 Objective

Horry County is requesting Statements of Qualifications (SOQ) from qualified and experienced professional firms to assist the Construction and Maintenance Department with restoration activities including both conventional investigation and remediation activities, as well as the investigation and cleanup of unexploded ordnance (UXO) and other munitions-related items (generally referred to as munitions of explosive concern [MEC]), including ordnance and explosive scrap (OE scrap). The scope also includes review of regulatory and technical matters related to various hazardous, toxic, and radiological waste (HTRW) sites at these and other County sites, with a primary focus on both human health and ecological risk.

The UXO firms’ objectives are to prepare plans to provide all munitions response services necessary to support operations conducted by Horry County to excavate sediment material within the stakeholder-developed removal areas that may be collocated with munitions that may have been discarded. The UXO firm(s) may perform operations as necessary to detect and remove suspected DMM or MEC/MPPEH from multiple areas. The UXO firm may also provide standby construction support during cofferdam construction, dewatering operations, sediment removal activities IAW EP 75-1-2. The UXO firm will be prepared to mobilize additional personnel if required to dispose of MEC/MPPEH during construction support phases.

Step Two (2) of this solicitation includes a proposal submission for qualified firms to review submittals and provide limited field oversight (e.g., quality assurance-based support) related to the identification and cleanup of MEC on highway 90 at 33.820180, 78.941000. Horry County is seeking an experienced firm to perform a “Due Diligence” assessment in evaluating the property for presence of Unexploded Ordnance (UXO) / Material Potentially Presenting an Explosive Hazard (MPPEH) / Munitions and Explosives of Concern (MEC) on this site. The successful firm will need to establish a plan that at a minimum includes performing a transecting grid of the property to confidently traverse and detect hypothetical targets, based on this site being used as the former Conway Bombing and Gunnery Range.

3.2 Scope of Services

Step One (1) – The initial purpose of this Request for Qualifications (RFQ) is to solicit proposals from qualified companies to provide Statement of Qualifications (SOQs) for Geophysical Site Investigation for Unexploded Ordnance (UXO) Detection and Clearing in Horry County, SC. The successful Submitter(s) shall provide services and/or work listed below on an indefinite-delivery, indefinite-quantity (IDIQ) on-call basis upon Horry County’s request for pricing for each potential follow-on project, and in accordance with the specifications and requirements stated herein. Services and/or work include, but are not limited to, the types of services/work listed below. Only the actual services/work for each follow-on project (Task Order/Change Order) will be subject to the terms and conditions specified in the original Professional Services Agreement.

Each follow-on project shall be presented to all of the Pre-qualified Contractors awarded from this RFQ.

Each potential follow-on project may have additional requirements in addition to requirements contained within this RFQ, including but not limited: Bonds, additional insurance requirements, meetings/walk-throughs, permits, licenses, etc. There is no minimum or maximum value anticipated of any one follow-on project. Award of a Professional Services Agreement does not guarantee any follow-on awards.

The Scope of Services includes, but is not limited to the following:

A. Project Management/Project Planning – Project planning activities and meetings prior to mobilization of field personnel. Including, but not limited to: kick off meetings, pre-mobilization meetings, review of resumes and certifications and logistical coordination.

B. Work Plans / SOPs / AHAs – Prepare and submit Work Plans (WP) in a standard SOP format explaining operating procedures, safety (AHA’s), and the locations of the work sites. Plans shall be prepared as draft and final versions. Electronic submissions preferred.

C. Mobilization / Demobilization – Organize the team to come the project site(s). Prior to mobilization, firm shall be permitted to access the site(s) to evaluate conditions, including, but not limited to: evaluating safe site access, overhead vegetation coverage, walkability, etc.

D. Site Preparation – Site preparation activities, including, but not limited to: Instrument Test Strip (ITS) installation, preparation of GPS tablets and GIS forms. Field documentation training (WP/SOPs/AHAs) and organization of equipment will be conducted.

E. Detection / Intrusive Work – Perform Geophysical Site Investigations. Including, but not limited to traversing pre-planned transects and detecting sub-surface anomalies. Sub-sampling of detected anomalies may also be performed. Transects may deviate around any trees/obstructions that are directly in-line with the idealized transect design. The team may use handheld all-metals detectors to sweep 4-ft wide lanes, mark detected anomalies with non-metallic pin flags, and then dig 10% of the detected anomalies. Digs are not to exceed 50 digs per day (450 total) and will not exceed 2 ft below the ground surface (bgs.). All digging will be conducted with hand shovels, requiring no prior utility clearance. If apparent subsurface debris areas (saturated areas) are discovered, the team will estimate and determine the perimeter and test dig one or two locations in order to identify the nature of the material. All holes will be backfilled to avoid leaving any safety hazards. All debris/materials encountered will remain on-site. Site access (ground conditions) will allow for safe and unobstructed access to perform the transects. Sufficient GPS coverage is assumed to be available for positioning needs. If UXO/MEC/MPEH is located, all operations will cease and Horry County Police Department Bomb Squad will be notified for their ownership of the material.

F. Summary Reports – Provide a summary report detailing the work performed, daily activities, deviations from the WP, and any issued encountered. Electronic submission preferred.

Step Two (2) – The second purpose of this RFQ is to solicit proposals from qualified companies to provide the above referenced services of approximately seventy (70) acres located on highway 90 at 33.820180, 78.941000, see Attachment 1. The successful proposer shall perform all work in a timely manner and shall be responsible for ensuring coordination of their work with Horry County.

3.3 Evaluation Process

The evaluation of submissions will be in accordance with the Horry County Procurement Regulation and this Request for Qualifications (RFQ) and subsequent Proposal.

An evaluation team will be convened to evaluate and score submissions received.

After the initial evaluation of all submissions, the evaluation team will meet to select the firms that are most qualified based on the information submitted.

Step One (1) – Qualification Evaluation: The team shall evaluate and qualify firm(s) based on their statement of qualifications submission. All firms with a score of 70 shall be deemed qualified.

Step Two (2) – 1st Follow-On Proposal Evaluation: All firm(s) who are identified as qualified will then be evaluated on additional information identified below.

The following criteria shall be used by the team and are weighted as shown:

Award of a contract(s) from Step One (1)-Qualification, shall be made to the Submitter(s) whose SOQs are deemed to be most advantageous to the County, considering all of the evaluation factors. Award of Step Two-1st Follow-On RFP, shall be made to the Proposer whose proposal is deemed to be most advantageous to the County, considering all of the evaluation factors. This decision shall be the sole judgment of Horry County.

3.4 Fee Approach

STEP ONE (1) – Qualification – No fee is required with Step One (1) of this RFQ.

Fees will be determined through a follow-on Request for Proposal (RFP) process following selection. The qualifications of consultants will be evaluated and the best qualified consultant(s) will be selected.

STEP TWO (2) – 1st Follow-On RFP – A fee is required with Step Two (2) of this solicitation.

3.5 Submission Requirements

Submittals should be prepared in a timely and economical manner, providing a straightforward, concise description of the firms' ability to meet the requirements of the RFQ. Emphasis should be on completeness and clarity of content. The requested information shall be provided in the order listed below. The aim of the required format is to simplify the preparation and evaluation processes and to ensure that all Submissions receive the same orderly review. If the Submitter fails to provide the requested information, the Submission may be deemed non-responsive and may not be further considered.

All Submissions must include the following components:

STEP ONE (1) First Downloadable File “Envelope 1” – PACKAGE 1 – QUALIFICATIONS:

A. Cover Letter to include:

Company or corporation name, street and mailing addresses, the responsible officer(s) of the firm. Indicate the type of company (i.e. Sole Proprietor, Corporation, Limited Liability Corporation, Partnership etc.)

Names of all owners and/or corporate officers.

Identify contact person and provide telephone, fax, email address.

Date and state of incorporation (if applicable).

B. Experience – Provide a list of at least three (3) projects of comparable size and scope your firm has completed. Provide at least three (3) references that include the Agency Name, Contact Name, Title, Address, Phone Number, Email Address, and Services provided of each.

C. Project Team & Key Personnel - Provide the proposed project team, the key personnel, and the role each will fill. Include a detailed project organizational diagram which clearly shows the principal distribution of professional and supervisory personnel and resumes that will be assigned. Name the key individuals that will be assigned if awarded and describe their roles; if a change is required between submittal and award the firm must notify the County of the proposed replacement. Provide information on all applicable professional and trade licenses and registrations.

D. Current Workload - Provide a list of projects and/or contracts for which the firm is currently responsible for.

C. Fee – Provide a detailed fee proposal for the scope of services provided in your firm’s Project Approach & Schedule. Include hourly rates.

The County does not desire voluminous submissions; therefore, please limit your proposal to only essential information. By submitting a proposal, your firm agrees to the terms and conditions stated herein unless explicitly stated otherwise in your response to this RFQ.

DRUG-FREE WORKPLACE CERTIFICATION

In accordance with Section 44-107-30, South Carolina Code of Laws (1976), as amended, and as a condition precedent to the execution of this agreement, the undersigned will provide drug-free workplace by:

1. Publishing a statement notifying employees that the unlawful manufacture, distribution, dispensations, possession, or use of a controlled substance is prohibited in the workplace and specifying the actions that will be taken against employees for violations of the prohibition;

2. Establishing a drug-free awareness program to inform employees about:

a. The dangers of drug abuse in a workplace;

b. The person’s policy of maintaining a drug-free workplace;

c. Any available drug counseling, rehabilitation, and employee assistance programs; and

d. The penalties that may be imposed upon employees for drug violation;

3. Making it a requirement that each employee to be engaged in the performance of the agreement be given a copy of the statement required by item 1;
