U.S. Customs and Border Protection Limited-Sources Justification (LSJ) - FAR 8.405-6

For orders or BPAs exceeding the Simplified Acquisition Threshold (SAT)

Version 1.0 September 2016

Date: February 19, 2019 PR Number: 20104573

This acquisition is conducted under the authority of the Multiple-Award Schedule Program, 41 U.S.C.

152(3), Competitive Procedures, and 40 U.S.C. 501, Services for Executive Agencies.

1. Agency and Contracting Activity. Identification of the agency, contracting activity, and specific identification of the document as a “Limited-Sources Justification.”

The U.S. Department of Homeland Security (DHS) Customs and Border Protection (CBP), Office of Information and Technology (OIT), Workforce Management Division (WMD) proposes to award a Task Order (TO) against the General Services Administration (GSA), Professional Services Schedule (PSS) pursuant to FAR 8.405-6(a), Limiting Sources.

2. Nature and/or description of the action being approved. Describe the action being approved, and include the name and address of the proposed contractor(s).

CBP intends to limit the number of sources solicited pursuant to FAR Part 8.405-6(a) for the procurement of services to maintain National Data Centers (NDCs) and additional OIT Facilities to Proposed Contractor: Technica LLC., 1 Cool Blow Street Suite 201, Charleston, South Carolina 23452-7373. Technica’s GSA schedule number is GS-10-F-0346U.

This Justification action is to provide continued services and maintenance for the NDCs and additional buildings and a warehouse leased by OIT. These services are currently supplied by Technica LLC under competitively awarded task order HSBP10-14-F-00001, which will expire on May 31, 2019 after all options are exercised. OIT is planning to move additional services to the cloud which will consolidate and lessen the footprint of the NDCs. Currently fourteen (14) separate buildings are covered under this procurement action and additional time will allow the transition to the GSA leased centralized campus facility in Ashburn, Virginia starting in 2020.

3. Description of Supplies/Services. Describe the supplies or services to be acquired. Provide the estimated total value (including options, if any).

The WMD provides maintenance services for all the OIT offices and NDCs. These contractor support services include operations, maintenance, logistics management, and other support services including, planning, designing, managing, operating and maintaining reliable and efficient systems, equipment, facilities and logistics infrastructures to improve equipment and logistics performance, and reduce life cycle costs.

Typical tasks include complete 24 x 7 turnkey operations, maintenance and support services, base operations support (BOS), depot maintenance, preventative maintenance planning, fleet/property management and maintenance, maintenance and repair, integrated facility management operations management support, and emergency repairs as needed to support 24 x 7 operations.

The areas supported include:

• Facilities Management

• Logistics Support

• Transportation Support

• Asset Inventory Systems

• Warehouse Operations Support

• HVAC Maintenance Requirements

• Generator/ATS/UPS Maintenance Requirements

• General Contract Requirements

The anticipated period of performance and total task order value are:

4. Authority and supporting rationale. Select one of the circumstances justifying limiting sources pursuant to FAR 8.405-6(a)(1)(i) below and demonstrate the proposed contractor’s unique qualifications to provide the required supply or service.

• FAR 8.405-6(a)(1)(i)(C) In the interest of economy and efficiency, this requirement is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order or BPA must not have been previously issued under sole-source or limited-sources procedures.

Rationale:

CBP’s intent with this logical follow-on to the existing task order is to avoid disruption of required services and maintenance operations for the NDCs and the fourteen (14) OIT buildings. This is a short term order which is not being implemented due to lack of advance planning, but instead will provide a short term vehicle to address a gap between the current task order’s expiration and the migration of services to the cloud and the consolidation of numerous building leases to the centralized campus facility by 2020.

Technica LLC, the incumbent contractor, maintains personnel with current and active CBP background clearances (BIs) and specialized knowledge and experience necessary to perform the required services without disruption. The costs associated with bringing on a new vendor would be cost prohibitive given the planned period of performance.

Award to a new vendor would create the need for a transition period that includes background investigations for a new contractor employees. The delay in schedule, risk of interrupted service, and additional cost for a short term period of performance far exceeds the cost of a follow-on task order to the current incumbent contractor.

5. Determination by the ordering activity contracting officer that the anticipated order represents the best value consistent with FAR 8.404(d).

The Contracting Officer (CO) will determine the final price to be fair and reasonable prior to award, using applicable price analysis techniques. The ordering CO will consider the current task order pricing for similar services (HSBP10-14-F-00001) and Technica’s GSA Schedule published rates versus the proposed prices for the specific services being ordered to determine the order is appropriate given the requirements and order type, consistent with FAR 8.405 ordering procedures.

6. A description of the market research conducted among schedule holders and the results, or a statement of the reason market research was not conducted.

Market Research was conducted to ensure Technica holds a valid GSA Schedule for the duration of the planned period of performance and are eligible to receive the award.

7. Any other facts supporting the limited-sources justification. Additional facts may be stated in this section. If there are no additional facts, you must state that here.

Technica has extensive familiarity with OIT WMD required services and maintenance support along with a CBP BI-cleared experienced workforce. The benefit of this follow-on solution is to continue services and maintenance without any interruption of service to CBP until consolidation of leases and the imminent Cloud solution is implemented.

8. A statement of actions, if any, the agency may take to remove or overcome any barriers that led to restricted consideration (i.e., limited-sources) before any subsequent acquisition for the supplies or services is made. Include a statement of actions taken or that will be taken to increase competition for future acquisitions of the same item/service (e.g., the government intends to revise overly restrictive technical specifications, acquire data rights, or pursue some other means to increase future competition). Posting requirements may also be addressed here or in #9 below.

CBP intends to consolidate the NDCs and to consolidate OIT building leases with GSA streamlining the future acquisition of facilities services and building maintenance requirements.

9. CBP intends to post this requirement on FedBizOpps pursuant to FAR 8.405-6(a)(2)(i).

10. Technical/Requirements Personnel Certification:

Pursuant to FAR 8.405-6(c)(2)(x), I certify that this requirement meets the Government’s minimum need and that the supporting data, which form a basis for the Limited-Sources Justification, are accurate and complete.

11. Contracting Officer Certification and/or Approval:

Pursuant to FAR 8.405-6(c)(2)(ix), I certify that the Limited-Sources Justification is accurate and to the best of my knowledge and belief.

12. Chief Counsel Review (Per HSAM 3006.304-70 – Above the SAT)

► LSJ Approvals:

13. COMPETITION ADVOCATE (Per FAR 8.405-6(d)(2) - Above $700,000)
