About this file

This document is a sole source justification for a federal contract award. The Defense Logistics Agency Aviation approved a sole source award to AVOX Systems Inc. (CAGE code 53655) for 264 oxygen mask regulator/miscellaneous items (NSN 7RH 1680-01-610-6290) for the P-8A aircraft. The justification cites that AVOX Systems is the original equipment manufacturer and only source with the technical data and certification required to manufacture and supply this commercial spare part. The Navy is obligated to procure from AVOX per a 2016 letter from PMA-290. The contracting officer determined the estimated $262,400 value to be fair and reasonable. Contract SPRPA1-20-CV-020 was awarded to an unknown vendor on June 15, 2020 for an unknown amount.

List of Items/Item Description

P-8A Oxygen Mask

This justification is based upon the statutory authority of 41 U.S.C. 1901, as implemented by Federal Acquisition Regulation Subpart 13.5

A/RMC 3

Acquire, for the second or subsequent time, directly from the actual manufacturer.

A/RMSC Z

This part is a commercial/nondevelopmental/off-the-shelf item. Commercial item descriptions, commercial vendor catalog or price lists or commercial manuals assigned a technical manual number apply. If one source is available, A/RMCs 3, 4, or 5 are valid. If at least two sources are available, A/RMCs 1 or 2 are valid.

This acquisition will be negotiated with

This Acquisition will be solicited to the OEM, AVOX SYSTEMS INC . (53655) This item does not have a criticality determination as the part is a commercial FAA governed item and AVOX SYSTEMS INC is the only source with access to the technical data required to manufacture, test and certify that it is airworthy prior to delivery to the Navy. In the absence of a Government assigned criticality code, it is imperative that the Government deal strictly with the OEM/ Prime Vendor for procurement of this item. The Government does not physically have in its possession any engineering or technical data to contract for spares with other than the OEM/ Prime at this time. The Government does not have the empirical engineering data available that would allow for realistic competitive sustainment efforts at this time. Furthermore, NAVSUP WSS is obligated to follow the supply support strategy as outlined in the NAVAIR program office, PMA- 290 letter, 5000 Ser PMA-290/128 dated Aug 23 2016, hence no full screen review necessary by source development as we are sole sourced to the OEM/ Prime and no other potential sources may be approved or developed.

The proposed contract action was synopsized in the government-wide point of entry on

The following sources have expressed an interest, in writing, in this acquisition

No other sources have expressed an interest in this acquisition.

Market research was conducted in accordance with far part 10. The results of the market research conducted (or the reason(s) market research was not conducted) are as follows

Due to the sourcing restrictions imposed by NAVAIR PMA-290 letter, 5000 Ser PMA-290/128 dated Aug 23 2016. Market Research is limited to identifying the OEM and or the designated distr butor of the OEM for procuring P-8 spares and or repair services. No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any other source to provide the required supplies and services. NAVSUP WSS must procure these items from AVOX SYSTEMS INC . (53655). The available technical data is insufficient for the development of new sources. Source Development Department files indicate no Source Approval Request (SAR) has been received from any party interested in becoming an approved source. AVOX SYSTEMS INC (53655) is the only approved source at this time.

The contracting officer determines that the anticipated cost to the Government of the supplies covered by this J&A will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition

History

For reasons set forth in Paragraph (5) and (6), NAVSUP WSS has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NAVSUP WSS will assess whether competition for future requirements is feas ble.
