8.0 Basis for Award:

The Government will make a single award to the responsible contractor on the basis of lowest price technically acceptable (LPTA). The Government will evaluate the lowest priced quote and, if acceptable, evaluations will cease, and award will be made. The Government reserves the right not to make award.

To be considered for award, each prospective contractor must submit their quote based on the requirements in Attachment 2- SOW and the CLIN structure provided in Attachment 3- CLIN Pricing Structure. Each contractor must show in their quote how they meet each requirement in Attachment 2- SOW. Each contractor is required to enter the total price quoted for 199 parking spaces per month and extend the monthly price to show the annual quoted amount for all 199 parking spaces. Example: The monthly price for one space is $125.00 per month times 199 parking spaces equals $24,875.00 per month. The per month price ($24,875.00) for 199 parking spaces is then extended to show the annual price ($24,875.00 x 12 months equals $298,500.00 annually). These calculations should be completed for the base period plus the two (2) option periods. Subsequently, all annual prices for the base and two (2) option periods are totaled to show the total amount quoted.

The Government will evaluate proposals for award purposes by adding the total price for all options to the total price for the basic requirement. To account for the option periods possible under FAR 52.217-8 (maximum of six months), Options to Extend Services, the Government will evaluate the option to extend services by adding six months of the Quoter’s final option period price to the Quoter’s total price. This amount will be the total evaluated price. The

RFQ 70CMSD24Q00000005 4

Government may choose to exercise the Option to Extend Services at the end of any performance period (base or option periods). Prices for the base and option periods, including the 6-month option available under FAR 52.217-8, will be evaluated to ensure that they are fair and reasonable for performance of the requirements established in the solicitation and as proposed in the technical submission. The price for the effort associated with FAR 52.217-8 will not be included in the total awarded value at contract award. If, at the end of the order’s period of performance (the end of the base period or any option period) and within the time period established in the clause, the Government chooses to exercise this option, the pricing will be pursuant to the rates specified in the contract for the preceding performance period.

The Government may determine that a quote is unacceptable if the option prices are significantly unbalanced. Evaluation of option periods shall not obligate the Government to exercise the option(s). A written notice of award or acceptance of an offer mailed or otherwise furnished to the successful quoter within the time for acceptance specified in the quote, shall result in a binding contract without further action by either party.

9.0 Quote Submission:

Contractors shall submit quotes in accordance with FAR 52.212-1, Instructions to Offerors/Quoters- Commercial Items as well as in accordance with this RFQ and its attachments.

Quoters shall also submit their parking/tenant agreements, if applicable.

All quotes shall be sent via e-mail to the Contracting Officer, Michelle Levine, at Michelle.Levine@ice.dhs.gov. Submissions shall be received no later than 12:00pm ET on Tuesday, March 5, 2024. Quotes received after the closing date and time will not be accepted.

DHS/ICE is a federal agency and is tax exempt.

Include the UEI number on the quote. To be eligible for award, contractors must be registered and have an active System for Award Registration (SAM) account.

The Government intends to award a purchase order as a result of this combined synopsis/solicitation that will include the terms and conditions set forth herein.

Any questions or concerns regarding this solicitation shall be submitted via e-mail to the Contracting Officer, Michelle Levine, at Michelle.Levine@ice.dhs.gov
